APPROVED MINUTES – OCTOBER 20, 2015 CALL TO ORDER Clerk Kremer called the meeting of the Tyrone Township Board to order with the Pledge of Allegiance on October 20, 2015 at 7:00 p.m. at the Tyrone Township Hall. ROLL CALL Present: Treasurer Marna Bunting-Smith, Clerk Keith Kremer, Trustees Cam Gonzalez, Soren Pedersen, Chuck Schultz and David Walker (left at 8:05 p.m.). Absent: Supervisor Mike Cunningham. Trustee Walker moved to appoint Treasurer Bunting-Smith to moderate the meeting in the absence of the Supervisor. (Trustee Schultz seconded.) The motion carried; all ayes. APPROVAL OF AGENDA – OR CHANGES Trustee Walker moved to approve the agenda as amended. (Trustee Schultz seconded.) The motion carried; all ayes. The modifications were as follows: Added New Business: Review of two purchase offers on the 20-acre parcel 4704-03-300-015. Added New Business: Request of Cider Mill Crossings for a letter of support. Added New Business: Consumers Energy natural gas line. 1. Request of David McBride to appeal a fire service charge. Mr. McBride requested the charge for fire service be waived. A passerby called 911 upon seeing an auto accident. Mrs. McBride specified they did not want EMS service, but a fire service was dispatched and they performed traffic control. Trustee Gonzalez moved to deny Mr. McBride’s

request to waive the fee. (Clerk Kremer seconded.) The motion carried; all ayes.

2. Discussion for options for broadband coverage.

Rudy Tober of Pulse Broadband was invited to the meeting to answer questions. Mr. Tober recommended the township hire a professional company to perform a survey to gauge how many residents would hook up to broadband service if the township were to offer it. Other ideas included providing information door-to-door or to circulate a petition. Also discussed was the township’s need for 42% participation to afford the bond, which would be paid over 10-12 years. It was decided to continue to research options and to obtain quotes to provide a professional survey. No motion was made.

3. Purchase offers on the 28 acre Runyan Lake Rd. parcel 4704-03-300-015.

Two purchase offers were made on parcel 4704-03-300-015. Clerk Kremer moved to authorize the Treasurer to negotiate with both interested parties and bring any offers that may result back to the board. (Trustee Schultz seconded.) The motion carried; 4 ayes, 1 nay (Gonzalez).

4. Approval of proposed holiday work schedule. Trustee Schultz moved to approve the proposed Christmas and New Years work schedule. (Trustee Pedersen seconded.) The motion carried; all ayes. 5. Approval of a preliminary 2016-2017 budget estimate for the citizen’s guide. Trustee Schultz moved to approve the preliminary 2016-2017 budget estimates, as revised, to be posted to the citizen’s guide by Dec. 1, 2015. (Trustee Pedersen seconded.) The motion carried; all ayes.

6. Award of tree removal contract.

Clerk Kremer moved to accept the lowest bid of $3,700 from Ronald’s Tree Service to perform

tree removal along the specified areas of Center Road. (Trustee Gonzalez seconded.) The motion carried; all ayes.

7. Request of the Treasurer to attend a financial seminar.

Trustee Schultz moved to approve the request for the Treasurer to attend an “Understanding

Financial Statements” seminar at a cost of $249. Trustee Schultz amended his motion to include Trustee Pedersen who said he’d also like to attend. (Clerk Kremer seconded.) The motion carried; all ayes. 8. Select collection agency. Trustee Schultz moved to use Credit Bureau of Ypsilanti on a trial basis for township collections. (Trustee Gonzalez seconded.) The motion carried; all ayes. 9. Approval to write off uncollectible accounts. Trustee Schultz moved to write off uncollectible fire service accounts in the amount of $4,515.36. (Trustee Gonzalez seconded.) The motion carried; all ayes.

10. Request to print and mail voter information brochure for 2016 election cycle. Trustee Gonzalez moved to authorize up to $2,000 to provide voter information brochures to be mailed with the tax bills. (Trustee Schultz seconded.) The motion carried; all ayes.

11. November 3 board meeting schedule conflict with election.

Due to the election, Treasurer Bunting-Smith moved to cancel the November 3 board meeting. (Trustee Schultz seconded.) The motion carried; all ayes. If needed, a special meeting could be scheduled for November 5.

12. Cider Mill Crossings request for support to obtain state variance.

Cider Mill Crossings was requesting a variance from the State of Michigan to renew their Permit to Construct. Cider Mill Crossings’ engineering firmasked the township if they’d be willing to

provide the state with a letter of support. Trustee Pedersen moved to authorize the Clerk to provide a letter in support of Cider Mill Crossings’ permit renewal. (Trustee Schultz seconded.)

The motion carried; all ayes.

13. Energy proposed line on Center Road.

The Clerk announced that Consumers Energy will be providing a natural gas line in the township hall’s area and asked if the board would be willing to hook up. Trustee Schultz moved to allow

the township to connect to the natural gas line if financially advantageous. (Trustee Pedersen seconded.) The motion carried; all ayes.

Commissioners Talk About Roads with Legislators

The Livingston County Board of Commissioners 

passed a resolu on at it’s August 17th mee ng 

expressing  the  immediate  need  to  fund  the 

repair of Michigan’s  roads  for  resident  safety 

and  the  fiscal  health  of  our  State  and  local 

communi es.  The  Legisla ve  Commi ee 

invited State Representa ves Lana Theis and Hank Vaupel along with 

Senator  Joe  Hune  to  speak  about  road  funding  and  were  very 

apprecia ve  that  both  State  Representa ves  were  able  to  a end. 

Legisla on  that  would  raise  taxes  to  support  fixing  roads  was 

discussed, along with the history of road condi ons and infrastructure 

needed  to  complete  repairs.  The  Legisla ve  Commi ee  emphasized 

that  they don’t  support  forcing  local units of  government  to pay  for 

road maintenance and improvements. 

The County Adopts a New Social Media Policy

With the use of social media becoming more and

Livingston County Update September 2015 www.livgov.com

The Board of Commissioners authorized the payment of $1.0 million as an additional contribution to MERS as a continuing effort to address long term liabilities. In 2013 the Board authorized an additional payment of $1.0 million and in 2014 an additional payment of $2.0 million was made.

A professional contract for education services in the Livingston County Jail was approved. The contract will allow the Jail to provide a variety of education services such as high school completion, GED, creative writing, life-skills, and other specialized programs.

The Board of Commissioners authorized a contract extension for Law Enforcement Services with the Township of Tyrone effective August 5, 2015 to March 31, 2019.

The 44th Circuit Court is adjusting its programming to provide a Multi-Systemic Therapy Program (MST) for youth and families involved with the Juvenile Court.

The Board of Commissioners authorized a revised Strategic Business Partnership Agreement with Cleary University.

A three year contract for snow removal at the airport with Fonson Company, Inc. was approved by the Board on August 18th.

A joint agreement between Livingston County, Green Oak Township, Hamburg Township, and The Huron Clinton Metroparks Authority was authorized to provide for the continued funding of the Gaging Station at Milford.

The Board of Commissioners authorized the issue of Sewage Disposal Bonds for the Construction Portion of the Lake Tyrone Sanitary Sewer System Improvements.

The Livingston County Sheriffs’ Department will continue the Secondary Road Patrol and Traffic Accident Prevention Program for the fiscal year of 2016 through a contract with the State of Michigan.

The budget plan for the Partnership, Accountability, Training, and Hope (PATH) Plan has been approved. The PATH Program was established to assist welfare applicants/recipients and low-wage workers in addressing employment barriers. PATH connects Michigan’s families with the kind of employability services that will help them achieve self-sufficiency and meet the workforce needs of Michigan’s businesses.

OLD BUSINESS: None. NEW BUSINESS #1: Section 21.32 Wireless Communications Facilities Section 21.32 was reviewed and discussed for future changes. Due to recent state and federal regulation changes, the ordinance must be reviewed to ensure compliance. Section 21.32.B was also reviewed and discussed to include co locations and modifications. Structures located outside or inside public rights of way must be distinguished between one another. Language for Section 21.32 will be further reviewed in the future to ensure compliance with state and federal standards. NEW BUSINESS #2: Section 21.31 Temporary Structures and Uses As a result of a recent application, Section 21.31 was reviewed and discussed to clarify regulations. Chairman Meisel discussed the perceived issues with the current ordinance. The language in the current ordinance is not clear on specifications of

temporary uses and structures. The definitions of temporary uses, structures, and buildings were reviewed and discussed for the possibility of future amendments. Section 21.31.A.2 was also reviewed and discussed. Wardin expressed concern about what type of temporary structure would be permitted by Livingston County as “habitable.” The language in Section 21.31 is designed to limit the use of temporary structures other than a mobile home for a temporary dwelling during a residential construction. The Planning Commissioners discussed a list of amendments to be made to the ordinance to clarify specific criteria for the use of a temporary structure during a single family residence construction. This list may include:

- Demonstrating the existence of electricity, water, and septic to be considered as habitable.

- The possibly of the addition of a minimum lot size requirement to permit a temporary structure during construction.

- Access to the site for all vehicles and materials needed for the construction of a new single family home.

- The temporary structure must be visually unobtrusive. - Written agreements must be presented to meet the standards for water and

sanitation. These must be approved and inspected by Livingston County. - Neighbors within a certain distance of the temporary structure may be notified of

the application and provided the opportunity to comment.

Planner Hodges suggested the review of ordinances pertaining to temporary structures and uses for other townships for comparison of regulations.

The applicant requesting a temporary structure may be subject to the following criteria:

- A plot plan in compliance with Section 21.25.E - The plot plan must show the location of the well and septic field - A written agreement from the applicant ensuring the removal of the structure - The structure may only be erected for a 10 month period of time during

construction with the possibility of only one 3 month extension - The applicant must be bound by a financial guarantee with Tyrone Township to

ensure the removal of the structure after the allowed time period - A statement of intent must be presented by the applicant.

Discussion concluded with the need for future action regarding the language of Section 21.31 to include clarification of the process and approval of an application for a use of a temporary structure as a dwelling unit during the construction of a single family home. NEW BUSINESS #3: Section 21.52.D.10 Supplementary Shoreland Regulations Chairman Meisel discussed the need for clarification of Section 21.52.D.10. The boat docking regulations in Tyrone Township are not clear. Meisel stated that residents have approached him on numerous occasions requesting an explanation of regulations regarding private lot boat docking.

The current Shoreland Regulations include private boat dock regulations as part of the common use lot regulations, making those regulations difficult for many to interpret. Discussion on the intent and purpose of “boat docking regulations should be clarified in the future. It was suggested property owners should be able to determine their boat dock regulations in Section 21.52 rather than have to locate and interpret the various footnotes or interpret the regulations that apply to them within the common use lot regulations. Discussion will continue during a future meeting. NEW BUSINESS #4: Article 27 Signs Planner Hodges discussed the new US Supreme Court Decision on content neutral signage. Article 27 of our Zoning Ordinance must comply with the new decision. Planner Hodges discussed the new decision in detail providing examples of the idea of content neutrality and how Article 27 must be altered. Planner Hodges also discussed the need for clarification of on premises and off premises signs. Commissioners examined the current Article for future changes that will be needed to comply with the Supreme Court decision. The new changes will result in fewer categories of signs throughout the township. Planner Hodges will provide amendment recommendations for discussion during a future meeting. NEW BUSINESS #1: LaGuire Temporary Structure Application The Planning Commissioners reviewed the application for a temporary structure to be placed on a vacant property during a new single family home construction and identified potential issues and revisions. Tyrone Township planner Sally Hodges also reviewed ordinance Section 21.31.A.3 which discusses the necessary components that should be included on a plot plan for temporary dwelling approval. The applicant presented an older engineering survey of the property and Chairman Meisel discussed the details needed to be added to the drawing. The drawing is required to show features superimposed to scale as closely as possible. This includes the existing structures, setback requirements, building envelope, location of natural features, and wetlands (if applicable). Commissioners expressed concern regarding if permitting the temporary structure during construction for a 10 month period of time will have an outcome of 2 primary dwellings located on the same parcel, which is not permitted.

The applicant is required to obtain an engineered septic system due to the parcel’s Perk test

results. Commissioners urged Mr. LaGuire to update the survey showing location of the proposed engineered septic field, well, and home. The applicant is required to submit the following criteria before the Planning Commission can consider further action:

- Updated plot plan showing the location of the proposed engineered septic field - Updated plot plan showing the location of the proposed well - Updated plot plan showing the location of the proposed single family dwelling - Plot plan showing the location of the mobile home temporary dwelling - Proof and documentation of electric, septic, and gas utilities locations.

A motion to table the application to a future meeting was made by Gonzalez (Wardin seconded). The motion was carried by a unanimous voice vote.

OLD BUSINESS #1: Section 21.52 Shoreland Regulations The discussion of Shoreland Regulations continued from the October 13, 2015 meeting. Chairman Meisel presented a few proposed changes to the current ordinance with suggestions on language and editing for better compliance with the state of Michigan’s Riparian Laws.

Commissioner Wardin suggested more accurate and clear definition of “wetlands” and size

limitation of specific bodies of water to be included with the proposed changes. Chairman Meisel expressed the inclusion of language to apply to all shorelands within Tyrone Township in the same section and not exclude any specific bodies of water or areas. The discussion of Shoreland Regulations concluded by acknowledging the need for future discussion to further develop amendments to this section. NEW BUSINESS #2: Rezone Request of Section 20 Tyrone Township Planner Sally Hodges presented a list of parcels that could potentially be included with the rezone request along Old US 23 as well as two maps showing details of the future and current zoning districts. All parcels under consideration are master planned PCI. A table was created to show suggested parcels for rezoning and if the current uses for these parcels would be permitted under the new zoning district. The new zoning would eliminate the uses for light manufacturing and community business districts. This zoning district is in compliance with the Master Plan and would permit a variety of permitted and special land uses consistent with the current and planned future uses. Commissioners expressed the necessity for all parcel owners affected to be notified and invited to an informal meeting to discuss the proposed rezoning and how it might affect the current land use. Consideration was offered to exclude two parcels due to the their current uses. A invitation letter will be drafted and sent to the affected property owners requesting their attendance during the Planning Commission’s December meeting. October 30, 2015 Hon. Cam Gonzalez, Trustee Tyrone Township 10408 Center Road Fenton, MI 48430 Subject: Potential Township-Initiated PCI Rezonings for Master Plan Compliance along Old US 23

Dear Trustee Gonzalez: As you know, you and the other members of the Planning Commission have been working for some time on the goal of making the zoning districts along Old US 23 match both the Township’s Master Plan and the existing uses in that area. The recent Master Plan update and new PCI Planned Commercial Industrial District both support the types of commercial and light industrial uses already present between Center Road and Faussett Road. When the parcels are rezoned to PCI to comply with the Master Plan, this land will be easier to improve, develop and redevelop. Attached are two maps and a table that identify the existing conditions and potential zoning changes, as reviewed and supported by the Planning Commission. Most of the parcels selected are developed sites; however a few vacant and/or single family parcels are included. The attached “Analysis of Potential Zoning Changes” table lists these parcels with their existing land use, existing zoning, Master Plan classification and proposed zoning district. The “Future Land Use” map outlines the parcels with their Master Plan category. The “Proposed Township Initiated Rezonings” map locates the parcels on the Township’s current zoning map. If the Township Board is in agreement, we propose the following steps:

1. The Planning Commission will invite the parcel owners potentially affected to attend a Planning Commission meeting (tentatively December) to learn more about the impacts/benefits of the PCI rezoning for them. The Commission would conduct the meeting in an open and informal manner to answer the questions the land owners will undoubtedly have. This way if property owners elect to opt out of rezoning, they will be making an informed choice.

2. Absent any major objections, the Township Board would then initiate rezoning of the

identified parcels by considering the matter at an upcoming Board meeting, make a motion directing the Planning Commission to proceed, and direct staff to prepare a rezoning application on its behalf.

3. The Planning Commission will then give notice of and hold a public hearing on rezoning the parcels to PCI and make a recommendation to the Township Board.

RESOLUTION #15xxxx TYRONE TOWNSHIP, LIVINGSTON COUNTY

DISPOSAL OF SURPLUS PROPERTY POLICY

WHEREAS, the Township Board has the responsibility to set the policy of operations within the Township and; WHEREAS, there is a need to promote uniformity in the policy and procedure for the disposal of surplus property owned by the township; NOW THEREFORE, BE IT RESOLVED by the Township Board that the policy and procedure listed below is adopted:

1. Trash. Personal property which a reasonable person would feel no longer has any value, may be discarded as trash by any Township official or employee. If anyone is interested in acquiring the property or retrieving it from the trash, then it cannot be assumed that it has no value.

2. Declaration. Each department director i.e. Supervisor Clerk Treasurer shall be

responsible for identifying property within his or her department that is obsolete, surplus or salvage property. The department director shall estimate the fair market value of such property in “as is, where is” condition.

3. Disposition. For all such property, the department director will notify the other

department directors, who will first attempt to find a use for the property in another department. Personal property which a reasonable person would feel is at the end of its useful life, but that the cost of sale or disposal exceeds any sales value, shall be considered of “nominal value” and may be sold, discarded at the discretion of the

department director. 4. Personal property which a reasonable person would feel has remaining value in

excess of the nominal value defined above shall be subject to disposition in any manner deemed by the department director to be in the Township’s best interest,

including: a. Trade-in for other equipment b. Auction or sale on a first come-first served basis (public or online) c. Solicitation of written bids d. Negotiated sale to one or more designated buyers e. Sale as scrap f. Recycling, salvaging or junking

5. Substantial Value. Disposition of any one item of personal property with an estimated value of $1,000 or more must first be approved by the Board of Trustees.

6. Conflict of Interest. Township elected officials and staff are prohibited from

acquiring any personal property of the Township, if they participated in the disposition process described above. The Township Supervisor may grant a written exemption to this prohibition, if they can verify the propriety of, and are not a party to, the disposition.
