Special Rule: [20 U.S.C. Section 4110]

Title IV, Part A program funds may be used only to supplement, and not supplant, non-federal funds that would otherwise be available for activities authorized under the program.

This means that program funds may not be used for the cost of activities in the three content areas (well-rounded education, safe and healthy students, and technology) if the cost of those activities would have otherwise been paid with State or local funds in the absence of the Title IV, Part A funds.

Basic Requirements of All LEAs

Prioritization of the Distribution of Funds Are among the schools with the greatest needs; Have the highest percentages or numbers of children counted under

section 1124 (children counted for purposes of basic grants under Title I, Part A);

Are identified for comprehensive support and improvement under section 1111 (c)(4)(D)(i) (low-performing schools);

Are implementing targeted support and improvement plans as described in section 1111(d)(2) underperforming student subgroup; and

Are identified as persistently dangerous public elementary school or secondary school under section 8532 (unsafe school).
