The transition to the new compa- ny should be seamless since many of the same people will be working for the new landscape company. Pursuant to NRS 116.31034, the Board of Directors at their meeting held April 27, 2017 de-termined that if the number of candidates for Board positions are equal to or less than the num-ber of open positions, after the 30-day period for self-nominations, the candidates would be deemed to be elected at the annual meeting scheduled for July 20, 2017. Margaret Powell - I have lived in The Vistas for almost 18 years and am retired from the City of Sparks. I previously served on the Board from 2009 to 2013 and volunteer at sev-eral non-profit organizations. I have no specific agenda as being part of the Board of Directors.

Spring has finally arrived and the trees and bulbs are blooming and the grass is turning green. Unfortunately, so are the weeds! The abundant rainfall has been wonderful, but the community is already seeing a large number of weeds sprouting in those beautiful yards. It looks like we are headed into a busy season for the Association of-fice and compliance staff. I thought it might be useful to provide some tips on navigating the Vistas Homeowners Association compliance process.

• Letters are the way we communicate to the homeowner about possible violations of the CC&R’s. The letters provide infor-mation and documentation to the homeowner and the property file. The Courtesy Letter is the first letter in a series of letters you may receive if your property is not in compliance. This is the time to get the problem resolved. If you disagree with what the letter alleges, contact us. If you know you will have diffi-culty getting the problem solved quickly let us know. You should get between 10 to 14 days to bring the issue into compli-ance. If we don’t hear from you and the issue has not been re-solved you will receive a second letter.

• Respond by filling out the Compliance/Correction Response form that is included with the letter or fill it out electronically on the website. Send us an email or call the office. This way we know you are aware of the issue and what your plan is to re-solve it.

• The second letter a homeowner will receive when the property is not brought into compliance is a Second Request for Compli-ance and a Notice of Hearing. This letter will schedule you for a hearing with the Board of Directors at an Executive Session. You will have at least 14 additional days before the hearing to rectify the problem. Here again, communication is key. Let us know if you have resolved that matter so the Compliance Of-ficer can verify it before the hearing date.

• Appear on your own behalf and present your situation to the Board of Directors. It is important to work with the Association to resolve issues that may arise.

• Communicate with the Association office staff and the Board of Directors. There is nothing better than communication when it comes to problem solving, so please feel free to reach out to us.

• Prevention is best. Educate yourself and your tenants on the

rules and regulations to prevent violations from

occurring in the first place.

Defensible Space Cleanup

The Association landscape company has begun clear-ing an area of approximately 10-feet, where possible, be-hind homes that abut common area. The work was started behind homes on Santa Rosa and Santa Barbara and will continue up the hill. Homeowners will be responsible for cleanup of any garbage, vegetation, or other debris dumped behind their home in the common area. The Board is considering an application of post emer-gent in these areas to try to help reduce weeds and other vegetation from growing during the summer months.

On January 1, 2015, a quiet title action was commenced by Reno Project Management, LLC (“RPM”) in the Second Judicial District Court as Case No. CV15-00167 (“Action”). The Action seeks to quiet title of the real property located at 4276 Talladega Drive, following the Association’s Assess-ment Lien Foreclosure sale on September 25, 2013. The As-sociation was subsequently joined in the action by Deutsche Bank National Trust Company to challenge the Legal effect of the Foreclosure. The claims against the Association, which include quiet title, wrongful foreclosure, negligence, breach of contract, unjust enrichment, and breach of cove-nant of good faith and fair dealing, were tendered to insur-ance, and the law firm of Boyack & Taylor has been repre-senting the Association.

The Court previously denied the Bank’s Motion for Summary Judgment, and a trial date has been set for Octo-ber 09, 2017 with a pre-trial conference scheduled for Au-gust 31, 2017.

On February 16, 2016, an Alternative Dispute Resolu-tion was entered by the Nevada Real Estate Division (“NRED”) as NRED 16-432 (“Action”). This Action has been commenced by Deutsche against The Vistas Homeowners Association (“Association”), Kern & Associates, Ltd., and Reno Project Management, LLC concerning the real proper-ty located at 4276 Talladega Drive. This Action was ten-dered to the Association’s insurance carrier, and Boyack & Taylor has also been retained to represent the Association in conjunction with this Action.

Mediation was scheduled with the Chapman Law Firm, and on December 27, 2016, Mr. Chapman referred the mat-ter back to NRED due to a conflict. To date, the parties have not received any update on the appointment of a new medi-ator and/or a mediation date.

On May 1, 2014, an interpleader action was com-menced by The Vistas Homeowners Association (the “Association”) against Michael E. Yoelin; U.S. Bank National Association, as Trustee for the Benefit of Har-borview 2005-08 (“US Bank”); Mortgage Electronic Registration Systems Inc. (“MERS”), Solely as Nominee for Lender Being Countrywide Home Loans Inc., a New York Corporation; Washoe County Collections; American Express Centurion Bank; Does I-V, inclusive; and Roe Corporations VI-X, inclusive, in the Second Judicial District Court as Case No. CV14-00952 (“Action”). This Action was commenced by the Associ-ation to disburse the surplus funds from the foreclosure sale of the real property located at 4687 Sirach Court, Sparks, Nevada 89436, pursuant to statute. On August 28, 2014, counsel for US Bank, MERS and BANA filed a Motion to Join Third Party Purchaser SFR Investments Pool 1, LLC (“SFR”) as a Necessary Party. An Order Granting Motion to Join Third Party was entered on October 23, 2014. On November 17, 2014, counsel for BANA filed an Answer and Cross/Counterclaims against the Association and SFR for quiet title, declara-tory relief and wrongful foreclosure.

The claims against the Association were tendered to insurance, and defense counsel Christopher Phipps, Esq. has been representing the Association.

A Motion for Summary Judgment (“Motion”) was filed on behalf of the Association. On November 21, 2016, the Court issued an Order granting the Associa-tion’s Motion with respect to the quiet title claim be-cause the Association claims no ownership interest in the Property. On April 5, 2017, the Court heard oral argument on the Association’s Motion on the remain-ing claims for declaratory relief and wrongful foreclo-sure. Third party Purchaser SFR Investments Pool 1 (“SFR’s”) Motion for Summary Judgment was also ar-gued at the same time.

At conclusion of the hearing, the Court took the matter under submission, and the parties are awaiting decision on both the Association’s and SFR’s Motions for Summary Judgment.

Pursuant to NRS 116.31083(6)(f), the cur-rent status of this litigation will be re-viewed by the Board at least once every 100 days at a Board meeting.

Under NRS 116.41095, you are required to inform potential buyers or lenders of any litigation pending. A copy of all pleadings and correspondence (if there is any) is on file at the office.
