THE COmmERCIAL EGG mARKETING PLAN REGULATIONS — SALE OF PRODUCTION LImITS

ORDER 45/09. The Saskatchewan Egg Producers, pursuant to provisions of The Agri-Food Act, 2004 and The Commercial Egg Marketing Plan Regulations hereby determines and orders that:

1 The Board shall offer the egg production limits described in Appendix A and Appendix B to this Order, for sale in accordance with The Commercial Egg Marketing Plan Regulations and in substantial compliance with the procedures, rules, and stipulations set forth here.

2 Notices of the sale will be published on the website of the Saskatchewan Egg Producers and in such other ways as considered necessary by the Board, with sufficient notice to allow for responses.

3 If all of the egg production limits described here are not acquired, the Board may retain the limits in abeyance until such time as it is deemed appropriate to offer them for sale again.

4 The Board may establish such further rules or procedures relating to the conduct of the sale as the Board may consider advisable.

Order No. 45/09 is made pursuant to clauses 4(a) and 26(w) of The Commercial Egg Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Saskatchewan Egg Producers:

APPENDIX A — SALE NOTICEThe Saskatchewan Egg Producers (SEP) will receive offers to purchase egg production limits as outlined in

this Notice. The production limits being offered for purchase entitle a licensed producer to produce a specified number of dozens of eggs per year by a specified number of laying hens. Production limits remain the property of the SEP.

Production lots available

1. The following egg production limit lots (production lots) will be available for purchase by existing Saskatchewan production limit owners:

448,196 dozens of eggs per year (equivalent to a base production limit of 17,935 hens), to a maximum of two percent (2%) of the production limit currently owned by that existing production limit owner.

2. The following egg production limit will be available for purchase by new applicants. Existing licensed producers or production limit owners are not eligible to submit an offer and purchase this production lot.

3. Offers to purchase a Production Lot will be received up to 5:00 p.m. on monday, August 17, 2009 at the Saskatchewan Egg Producers’ office, 496 Hoffer Drive, Regina, SK S4P 3B8, physical address 496 Hoffer Drive, Regina, SK S4N 6E2.

4. Offers must be submitted using the prescribed Offer to Purchase Form and must be submitted in a sealed envelope that is clearly marked with “Offer to Purchase Production Lot”. Offer to Purchase forms may be obtained by contacting the SEP office or through SEP’s website.

5. Offers must remain open for acceptance by SEP until September 17, 2009.

6. Only one offer may be submitted by a production limit owner or a person seeking to become a production limit owner.

Eligibility Requirements

7. In the case of an existing production limit owner, the owner must be in good standing pursuant to section 11 of the Industry management Order, and must meet the requirements and be in compliance with The Agri-Food Act 2004, The Commercial Egg Marketing Plan Regulations, and all Orders of the SEP.

8. In the case of an existing production limit owner, the owner must also be in compliance with Board Orders No. 42-08 Start Clean-Stay Clean™ and No. 43-08 Animal Care before production limits will be issued to that owner.

9. In the case of a new applicant, applications for a license to produce and market eggs must be submitted before August 17, 2009, or submitted with the Offer to Purchase Form.

10. In the case of a new applicant, the applicant’s submission must include a Business Plan that describes:

(a) where the applicant intends to set up production;(b) the facilities and equipment the applicant will be using for production;(c) the applicant’s experience and/or knowledge of egg production and hen;(d) the timeframe in which the applicant will begin production; and(e) the applicant’s experience and/or knowledge of animal care, food safety, and biosecurity practices.

11. In the case of a new applicant, the applicant’s submission must meet the requirements and be in compliance with The Agri-Food Act 2004, The Commercial Egg Marketing Plan Regulations, and Orders of the SEP.

Opening of Offers

12. Offers will be opened privately after the closing date for receipt of offers by an independent party appointed by SEP in the presence of a scrutineer appointed by the SEP who is not an employee, officer, or director of the SEP, nor a production limit owner.

Award of Production Lots

13. In the case of existing production limit owners, Production Lots will be awarded in accordance with the bids to a maximum of two percent (2%) of the production limit owners currently owned production limit. The successful bid price for each 24.99 dozen eggs (equivalent of one hen) will be twenty-five dollars ($25).

14. In the case of new applicants, the Production Lot will be awarded in accordance with the applicant meeting all application criteria to become a licensed producer. The successful bid price maximum for 24.99 dozen eggs (equivalent of one hen) will be twenty-five dollars ($25).

15. In the case of receiving two or more offers from new applicants, the successful applicant shall be the applicant who demonstrates, through their Business Plan described in section 9 above, that they are most able and prepared to become a licensed producer. This determination will be made by the SEP directors and officers.

Terms of Purchase

16. Acceptance by the SEP of an offer to purchase a Production Lot will create a binding contract between the SEP and the purchaser for the purchase and sale of the Production Lot.

17. A non-refundable deposit equal to 50% of the purchase price offered must be delivered to the SEP within fourteen (14) days of a purchaser receiving written notice of acceptance of the purchaser’s offer. The full purchase price offered must be delivered to SEP at the time the Production Lot being purchased is put into production. Both payments must be in the form of a certified cheque, bank draft, or money order payable to the Commercial Egg Producers’ Trust Fund.

18. A Production Lot purchased by an existing production limit owner under this Order must be put into production within 1 year of the purchaser receiving written notice of acceptance of the purchaser’s offer, or in such longer period of time as the SEP, in its sole discretion, may allow. A Production Lot may be put into production either directly in the facilities owned and operated by the purchaser on land owned by the purchaser, or by a lease arrangement in accordance with the Regulations, duly approved by the SEP.

19. A Production Lot purchased under this Order and put into production by a lease arrangement approved by the SEP must be put into production directly by the purchaser in facilities owned and operated by the purchaser on land owned by the purchaser within two years of the purchaser receiving written notice of acceptance of the purchaser’s offer, or in such longer period of time as SEP, in its sole discretion, may allow.

20. A Production Lot purchased by a new applicant must be put into production within 1 year of the purchaser receiving written notice of acceptance of the purchaser’s offer on land owned by the new applicant, and such land may not serve as a production location for any other licensed producer. No other licensed producer or any individual who has a direct or indirect beneficial interest in another licensed producer, may have any direct or indirect beneficial interest in a new applicant or in the production location where a new applicant puts the Production Lot in to direct production.

21. A Production Lot purchased under this Order shall be forfeited and cancelled if:

(a) The Production Lot has not been put into production in accordance with this Order; or(b) It is subsequently determined by the Board that the purchaser does not satisfy the eligibility or other

requirements referred to in this Order.22. A Production Lot purchased under this Order may not be transferred by the production limit owner in

accordance with the provisions of the Regulations prior to the fifth anniversary of the Production Lot being awarded.

23. Production Lots purchased under this Order are also subject to all applicable provisions and restrictions set out in the Regulations or SEP Orders.

Withdrawal of Production Lots

24. SEP reserves the right to withdraw any or all Production Lots offered for sale under the Order at any time before or after the closing time for receipt of offers. Unless and until the SEP has accepted in writing an offer from a purchaser, a contractual relationship (either express or implied) is not created with any person submitting an offer in response to this Order.

THE CATTLE DEVELOPmENT PLAN REGULATIONS —REGISTRATION OF CATTLE PRODUCERS

ORDER NO. 01/09. The Saskatchewan Cattlemen’s Association, pursuant to the provisions of The Cattle Development Plan Regulations, and The Agri-Food Act, 2004 hereby orders and determines as follows:

1 A list containing the name and address of every cattle producer that paid a levy on Saskatchewan cattle sold in the last two years and a list containing the name and address of every cattle producer who received a refund of said levy in the last two years, pursuant to sections 3 and 12 of The Cattle Marketing Deductions Act, 1998, shall be provided to the Saskatchewan Cattlemen’s Association by the minister of Agriculture upon signing of a Confidentiality Agreement.

2 The two lists provided shall be used by the Saskatchewan Cattlemen’s Association to develop a register of every registered cattle producer pursuant to clause 2(q) and section 22 of The Cattle Development Plan Regulations.

NOTICE TO ADvERTISERS

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is noon on the Thursday previous to the week of publication. If a holiday occurs within the week of publication, the deadline is set back to noon of the previous Wednesday. Please allow yourself at least one full week to ensure mail delivery of Gazette submissions. Publication of any material received late will be delayed until the following week’s issue.

All material for publication in The Saskatchewan Gazette must be submitted electronically (WordPerfect or Word) accompanied by a signed hard copy to the Office of the Queen’sPrinter, Saskatchewan justice, B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-2367, or by E-mail: [email protected].

Each document or disk must be complete in the form required for publication and must be separate from the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.

Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. Cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.

Pour les envois de soumissions à la Gazette par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera remise au numéro de la semaine suivante.
