CRTC Enforcement: National Do Not Call List

The Canadian Radio-television and Telecommunications Commission (CRTC) contin-

ues to actively monitor and enforce the National Do Not Call List (DNCL). The DNCL is a list of telephone num-bers of consumers who have chosen to reduce the number of marketing calls they receive. Subject to limited excep-tions, marketers are prohibited from contacting numbers on this National Do Not Call List.

CREA has been informed by the CRTC that it is increasing enforce-ment oversight of the National DNCL as it relates to the real estate sector. Members should be aware that non-compliance can result in significant financial penalties, so it is impor-tant to be sure you understand your responsibilities.

As a reminder:

• If your Brokerage conducts telemarket- ing, the Brokerage must register at https://www.lnnte-dncl.gc.ca/ind/ins- org-regorg-eng. Telemarketing is mak- ing calls or sending faxes to consumers for the purpose of solicitation.

• A Brokerage that conducts telemarket- ing must (subject to limited exemp- tions) purchase a subscription for the area codes it intends to call (fees will be based on the subscription model you select). It is the responsibility of the Brokerage to ensure its office has access to the most up-to-date version of the National DNCL and that those num- bers are removed from their calling list.

• The Brokerage must also maintain an internal do not call list. If a consumer asks not to be contacted, the Brokerage must add their name and number to its own internal do not call list.

We urge Brokerages to exercise caution when hiring a third-party service pro-vider to assist the Brokerage in manag-ing their telemarketing operations. The CRTC issued an administrative monetary penalty of $260,000 to one such provider, Telelisting, in January 2015. Telelisting obtained and disclosed contents of the National DNCL to their clients, a violation of CRTC’s Telecommunications Rules. An investigation by the CRTC could also result in monetary penalties to Brokerages who were clients of Telelisting. It is im-portant to remember that Brokerages who conduct marketing and hire third-party service providers still need to register with the DNCL Operator and subscribe to the National DNCL.

Professionalism in Real Estate

In this new, regular column for Across The Board, we will feature tips focus-ing on REALTOR® professionalism. This month’s edition continues the series of the Three Cs – Common Sense, Courtesy and Communication.

Courtesy (Part 1 of 2)• If a Seller has made a final decision to list with someone else, respect and reinforce that decision. A professional attitude will create more business than making negative comments about the competition.

• Speak respectfully about your compe- tition. It will enhance your reputation as a professional.

• Arrive on time, don't waste anyone's time. If you are running late or have to cancel an appointment, advise the other party in a polite manner.

• Be timely when picking up or drop- ping off courtesy keys.

• Return any key you have to the listing/ courtesy office promptly after a showing.

• Face a problem situation promptly and squarely. Consult management immediately when a problem develops.

• Leave the house as you found it (e.g., lights on or off, pets in or out, all doors locked, etc.) Don't turn switches on or off if you don't know what they control – it could be the furnace or the air conditioner.

Members who serve on the Arbitration Roster are responsible

for arbitrating and mediating dis-

putes between Brokerages concerning the distribution of commission. Those who serve on the Professional Standards Rosters (Complaint Review, Hearing, and Appeals) are responsible for reviewing and render-ing dispositions on complaints that allege a breach of MLS® Rules and Policies, TREB By-Law, and/or sections of the CREA Code of Ethics and Standards of Business Practice.
