GENERAL

De Stadhouders project

De Stadhouders project is designed by ELV architecten. The construction plan provides for 268 apartments in three building blocks which will be completed in stages; blocks 1 (Frederik Hendrik) and 2 (Maurits) will be completed successively, followed by block 3 (Casimir). The complex will be situated between President Kennedylaan, 2e Sweelinckstraat, Stadhoudersplantsoen, Lübeckstraat and Verhulstplein. This is the technical description for 28 owner-occupied apartments, types A1, A2, A3, A4, A5, A6 and A7 in block 1 (Frederik Hendrik). The main entrance to the building is situated between block 1 and 2, along the access that will run from Stadhoudersplantsoen/2e Sweelinckstraat to Verhulstplein. Jan des Bouvrie designed the central hallway, where he has made the most of the available light and space.

Artist’s impression

De Stadhouders project is an ongoing construction process, with continuous adjustments being made to, for instance, the location of the structures, green zones, trees, adjacent structures, dimensions, foot and cycle paths, parking, driving lanes, and the layout of adjacent parks. Please remember that drawings and descriptions have no legal effect if they are not part of a zoning or implementation plan. No rights may be derived from these drawings, artist’s impressions, photos, lists, etcetera; they are shown for illustration purposes only.

People and planet

The apartment design, choice of materials and work during the construction all take into account people and planet. Construction waste is minimised through the use of prefab components and any remaining waste is separated before being disposed of. Other measures include:

Insulation of ground floor, facades and roofs;

Water-saving flush facilities toilet(s) (stop valve);

FSC quality mark on all timber used;

Use of recycable and prefab materials where possible;

Use of sustainable materials in the facade

Buildings Decree and standards

This General Project Information & Technical Description complies with the Buildings Decree current at the time of the application for the integrated environmental permit (2012). For ease of reading, some of the terms used in this Description and these drawings differ from the terminology used in the Buildings Decree. For instance:

Instead of habitable space, the Technical Description refers to living room, kitchen and bedroom;

To entrance / hallway instead of circulation area;

To storeroom (exterior) and storeroom (interior / terrace) instead of unnamed space;

To meter cupboard instead of meter area. Where Jan des Bouvrie’s designs do not comply with the Buildings Decree, changes may need to be made, unless an exception is granted pursuant to the Buildings Decree.

Energy label

From 1 January 2008, homes are provided with an energy performance certificate, as an indication of their level of energy efficiency. The national certificate currently ranges from A++++ (most efficient) to G (least energy efficient). Homes with a green A-certificate are the most energy efficient, homes with a red G-certificate the least. Basically, homes are rated based on the Energy Performance Coefficient (EPC) used for the design of the apartment.

Energy performance certificates are issued per apartment and are valid for ten years. With an EPC of less than 0.4, De Stadhouders apartments qualify for an A+++, or the green A-label. In other words – these are very energy-efficient homes!

Some of the measures taken to ensure this are:

facade with low transmission losses; high-heat resistance values of the ground floor, exterior facades and roof; frames with high-performance insulating glass.

Connection to mains

All apartments will be connected to the mains, including water, electricity and gas, and the central antenna and telephone network; the costs for putting these facilities in place are included in the purchase sum. Not included are connection and subscription costs for the use of the central antenna and telephone. All installations comply with statutory standards.

Buyers’ options

All apartments offer options to tailor your apartment to your wishes. You will receive a copy of the so-called ‘tailor-made list’ of standard options, and prices, if applicable. If you opt for a particular finish (excluding certain sanitary facilities or tiling, for instance), and the apartment does not meet applicable standards upon completion, the Woningborg’s limited Guarantee and Warranty Scheme (Garantie- en Waarborgregeling) applies. You will be informed prior to this.

Closing dates

You may suggest alternatives or choose from the list of options until a date to be decided in advance by the contractor, depending on the construction, preparation and material supply times. If you inform the contractor of any changes after this date, implementation will be subject to the contractor’s approval.

Woningborg guarantee and warranty

The apartments are built and sold subject to the Woningborg N.V. guarantee and warranty, and a guarantee certificate will be issued by Stichting Woningborg (housebuilders' certification institute). The contractor is affiliated with Woningborg.

Installations

All installations and their respective functions are indicated on the apartment drawings. Locations, dimensions and heights may vary in places if so required or necessary for their installation.

Transfer and cleaning

The apartment will be transferred “swept clean”. The bathroom facilities, tiles and windows will be cleaned wet, and transferred clean.

Public spaces

All civil engineering works outside the allocated site will be executed in collaboration with the Municipality (including the construction of parking in the public space, the inner yard etcetera). Transferral of the apartment will not be dependent on completion of these works.

Communal areas

Buyers of an apartment in De Stadhouders have access to a number of communal areas. These spaces will be managed by the project’s Homeowner’s Association (Vereniging van Eigenaars, VvE). As a buyer, you automatically become a member of the association. The entrance to the building is a communal area. The letter boxes situated at the entrance are accessible for mail delivery from the outside and can be emptied from the inside. The entrance hall will be finished with charcoal grey floor tiles, and wood panelling and white paint on the walls for a pleasant acoustic climate. The floor-to-ceiling concrete wall will be painted white and covered with artificial plants and lighting to form a green wall.

The inner yard

Verhulstplein will be landscaped, as indicated on the ground plan. The Municipality of The Hague, owner of Verhulstplein, plans to transform the current site into a green city square. The plans are based on drafts supplied by the Municipality of The Hague, and are subject to change.

Dimensions

All dimensions shown on the drawings are used for indicative purposes only. Unless stipulated differently, the dimensions on the drawings are given in millimetres. The dimensions of ducts are indicative and executed in conformance with contractor calculations and plans.

Height

The standard level is set at the top of the finished ground floor. Heights are calculated and set based on this Standard (P=0). The Standard will be established by the municipal services

STRUCTURAL WORK

Groundwork

Groundworks are performed to lay foundations, drains, cables and pipes, paving, etcetera.

Foundations

The building is built on steel foundations.

Walls

Constructive walls consist of concrete poured in situ. The interior cavity sheets are built as timber frame structures. The interior climate is guaranteed to meet applicable noise and temperature regulations. Party walls are concrete or metal stud walls. Metal stud walls are built with solid and shock-resistant sheets. Where prescribed under the Buildings Decree, use is made of insulating or soundproofing materials. The apartments’ interior walls consist of metal stud and/or gypsum blocks, except for shaft walls, which are executed in lime-sand stone. Shrinkage cracks may occur as materials continue to work after completion.

Floors

Ground and upper floors are constructed from prefab concrete elements, filled with concrete and insulated where necessary.

FINAL STRUCTURAL WORK

Site paving / layout

The project grounds will be paved with quality stone, with matching plant containers. The paving will match the Verhulstplein landscaping.

Storerooms

Each apartment has a storeroom, situated either in the basement, or on the ground or upper floors. Storerooms on the upper floors will have anhydrite floors, and in the basement monolithic concrete floors. Storeroom walls are lime-sand stone or facing concrete if bearing walls. The ceilings of the storerooms are facing concrete. Ceilings situated directly below an apartment are finished with white insulating wood wool cement board.

Parking

Each apartment has the option to buy a designated parking space in the basement. There are a limited number of parking spaces available and they will be sold based on the “first come, first served” principle. The parking garage is fitted with a monolithic concrete floor.

Roofs

The roof will be built as an insulated concrete floor, finished with bituminous roof cover. The roof on the fifth floor is structured with a wooden beam construction. Besides a window washer unit, the roof will house PV panels.

Facades

Facades are yellow-grey facing brickwork, grey grouting, with brick on edge courses and window ledges/coping ledges. The facade of floors 13, 14 and 15 have charcoal grey panels. The masonry contains settlement joints to allow for shrinkage and expansion in the material caused by changes in temperature. The cavity wall is ventilated. The facades are waterproofed using plastic, lead or foil.

Façade frames, windows and doors

Exterior window and door frames in the facades are made from low-maintenance materials. Windows turn inwards. All accessible exterior apartment frames, doors and windows are fitted with quality locks carrying the SKG logo, which meets the Politiekeurmerk Veilig Wonen Nieuwbouw® security standards.

Exterior glazing

Glass openings in the exterior frames, windows and doors to the apartment are fitted with transparent high-performance insulating glazing (HR++ or HR+++). Sliding doors are fitted with high-performance insulating double glazing (HR++).

Balconies

Balconies are mounted as prefab concrete elements. Balustrades around the balconies are fitted with baluster posts and reinforced glass, mounted on the balconies.

FINAL FITTING

Interior frames and doors

Door frames accessing the apartment are wood, painted white. Doors accessing the apartment are also wood, painted slate grey (RAL 7015). The apartment’s hardwood interior frames are factory-painted and fitted with flush doors painted white in the factory. Frames are not fitted with a top window. Doors to the toilet area(s) and bathroom are fitted with a vacant - engaged lock, the meter cupboard with a cupboard lock and the other interior doors with a mortice latch. The interior frames of the bathroom and toilet area(s) are fitted with an artificial stone threshold, the remaining interior frames will not be fitted with a threshold.

Wall and ceiling finish

All apartment walls are finished for papering, except for the meter cupboard, the technical area and any tiled or spray-plastered walls. The sanitary area walls are spray-plastered white from the tiles up to the ceiling. The concrete ceiling is spray-plastered. The meter cupboard’s ceiling is not finished. The V-grooves between the concrete ceiling sheets in the apartment remain visible.

Floor finish

With the exception of the bathroom floor and toilet floor, all floors in the apartment are fitted with a suspended cover floor (anhydrite). The cover floor in the sanitary spaces is a suspended cement cover floor, with tiles. In the shower corner, the floor is fitted with tiles in mortar.

Tiling

Floors and walls of the bathroom and toilet area are tiled. Wall tiles are 147x197x6.3 mm, floor tiles 196x196x10 mm. There is a sunken shower area. Toilet walls are tiled up to around 1500 mm from the floor. The wall is spray plastered from the tiles up to the ceiling. Bathroom walls are tiled to around 1200 mm from the floor and up to the ceiling in the shower area. The walls above the tiles are spray plastered. The wall and floor tiles are not lined up. Corners are sealed. You may customise your apartment by selecting tiles from a designated tile showroom. The tile showroom will make you a quote for the selected tiles, and any price difference will be settled with you. Sanitary ware

Toilet areas(s) and bathrooms are fitted with white Villeroy & Boch Architectura ceramic sanitary ware. Toilet space(s):

Painting

Wooden frames, doors, and wood finishes are painted in the colours listed on the colour and materials list. Interior doors and frames are factory-painted white.

INSTALLATIONS

Installation and connection costs

The purchase sum includes costs for the installation of, and connection to, electricity, heat, water and sewer. For telephone and central antenna contracts, you must contact a supplier of your choice. For the completion of the building, the contractor will take out a contract with a supplier for electricity, water and heat. You may change this supplier after completion and acceptance of your apartment.

Exterior waste pipes

The apartment is fitted with a separate drain system, discarding waste water to the municipal drains, and any rainwater to open waters or clean water drain. Drain pipes are made from plastic and are fully equipped.

Interior waste pipes

Interior waste pipes are plastic and connect to the waste water drain. Waste discarders are fitted with all regulatory traps, vents, aeration and unblocking options.

Water installation

The apartment is connected to the local fresh water drinking water network, through plastic water pipes that comply with all applicable regulations. A cold-water pipe is connected from the water meter to:

the kitchen sink (sealed pipe)

the toilet in the toilet area(s) and/or bathroom(s)

the cold-water tap of the toilet area(s) sink

Electrotechnical installations

The electrical installation complies with applicable regulations (NEN1010) and is connected to the electricity grid. It connects from the meter cupboard to power points across the apartment. In principle, horizontally fitted power outlets will be located throughout the property 30 cm from the floor; switches 105 cm from the floor. The white plastic sockets will be fitted with a white plastic, preferably single, cover. In principle, all pipes and wiring will be mounted in walls.

Washing machine and dryer

Every apartment has a single wall socket on a separate group for the washing machine, and one for a dryer.

Smoke alarms

The apartment is fitted with statutory 230V smoke alarm(s) connected to the grid.

Telephone/CAI/Data

Connections for data cabling (UTP cat. 6-connection) and wired cai (central antenna) are provided in the living room and master bedroom. The other bedrooms are fitted with two empty ducts. The meter cupboard is fitted with an elevated double wall socket.

Intercom

There are doorbells to the apartments in the main entrance, and individual doorbells outside the apartments’ front doors. The video intercom for opening the doors is indicated on the floorplan.

Sunblind

Sunblinds may be fitted on the inside of the facade.

Ventilation unit

The apartment is ventilated with fresh air supplied via ventilation grilles in the facade. The ventilation grills are located above the frame and are self-regulating. The mechanical extraction is CO2-driven. The ventilation is operated automatically but may also be set manually via the main controls in the living room (absent/present/maximum). The panel lists the CO2- concentration, with stale air discarded via air duct valves in the toilet area, bathroom, kitchen and washing machine area to a vent in the façade or roof. The ventilator is located in the technical area.

Gas installation

A gas pipe with gas tap is laid from the meter cupboard to the kitchen and the heating unit.

Central heating installation

The apartment is heated by means of floor heating. An electrical radiator will also be placed in the bathroom. The apartment is fitted with a central heating boiler for hot water and heating. This boiler is controlled by means of a room thermostat for the living room. The distributors for the floor heating are situated in a box, in sight or out of sight, in the technical area or washing area. It is possible to regulate the temperature per room at the distributor. The heating installation should be able to generate the following ambient temperatures if all heating elements operate at the same time, and the door and windows are closed: (Entrance) hallway / landing / unnamed space: 18 °C Living room, kitchen and bedrooms: 20 °C Bathroom: 22 °C Toilet area(s), technical area, and (outdoor) storage: not heated

Kitchen

In principle, the apartment will be fitted with a kitchen. You will be given the option to tailor the kitchen to your wishes at the kitchen showroom. To prevent damage to the kitchen, it will be installed after the final delivery. As the apartment will be prepared ready for wallpapering, the wall behind the kitchen must be finished before installation of the kitchen. If no use is made of the kitchen offer, and the closing date for making changes has passed, installations are fitted as indicated on the kitchen installation drawing. Pipes for gas and for hot and cold water in the kitchen will be closed off upon delivery. The kitchen will be fitted with the following basic connections: Gas:

PURCHASE AND BUILDING CONTRACT

Introduction

By signing the Purchase Contract (PC) and the Building Contract (BC), the acquirer / buyer agrees to pay the purchase sum, while the contractor / vendor agrees to build the apartment. You will receive a copy of the signed Purchase Contract and Building Contract. The original copy will be sent to a civil-law notary, who will draw up a notarial deed to transfer the title to you.

Split Purchase Contract and Building Contract

The project land will be transferred to the buyers via a Purchase Contract, subject to transfer tax. VORM Ontwikkeling will agree a so-called ruling with the Dutch Tax Authorities for calculation of the project land value. The land will be transferred to the buyers before demolition of the current buildings and/or any local soil clean-up. The Building Contract between the buyer and the contractor stipulates the conditions for the building to be built on the land, subject to VAT.

What should you pay when

If you buy an apartment before commencement of its construction, the purchase sum is paid when the apartment right (the title to the apartment) is transferred by means of a notarial deed. The contract sum is charged in instalments as construction progresses and as specified in the Building Contract. Following the notarial transfer, you will receive a progress bill each time a construction phase is completed. These bills must be paid within fourteen days. If you wish, you may pay these bills from any private funds. If you wish to pay the bills from your mortgage loan, you must sign the original bill and promptly forward them to your lender. Your lender will then pay the bill. You incur mortgage interest from the date of transfer until completion of the construction. This usually comprises the interest you pay on the full mortgage sum, minus any interest you receive on the sum the lender holds in deposit. Any additional work commissioned by you will be subject to the payment scheme pursuant to the Woningborg or SWK terms, as stipulated in the Purchase Contract and Building Contract. If you do not have any private funds, and the mortgage deed has not been executed, the notarial transport is postponed, as is the payment, as stipulated in the Purchase Contract and Building Contract. Upon signing the notarial deed of transfer, you pay all bills due, plus the interest for deferred payment. If you buy an apartment after construction has commenced, you will receive a bill for the instalments due, plus interest, as soon as you sign the Purchase Contract and the Building Contract. These instalments and the interest charged for deferral must have been paid on the date of the notarial transport.

Transfer of title

The title will be transferred to you by means of a so-called “deed of transfer” which you sign before a civil-law notary. The Purchase Contract stipulates the date by which the transfer must take place. Prior to the date of the transfer, the civil-law notary will send you a completion statement that lists the total sum due on that date. This includes any additional costs not included in the Purchase Contract, such as:

Interest charged for deferral (interest incurred during construction) of payment of any instalments due until the date of transfer;

Costs charged by the civil-law notary for drawing up the mortgage deed;

Costs for arranging the mortgage;

Specific mortgage costs (depending on the type of mortgage and lender, such as risk insurance premiums, or life insurance premiums).

Insurance

During construction, and until the date of completion and acceptance, the vendor will take out buildings insurance covering fire, storm, or any other damage. From the date of completion and acceptance, this will be arranged through the Homeowners’ Association (VVE). De Stadhouders will have a Homeowners’ Association, with separate divisions for each block, as stipulated in the deed of division. Content insurance must be arranged by the buyers themselves.

Price changes

The total purchase sum or contract price agreed with you in the Purchase Contract and the Building Contract is fixed, expect for changes to the VAT rate. Any changes to wages or materials during construction will not be charged on to you.

Purchasing costs payable by the vendor (v.o.n.)

The costs associated with purchasing the apartment will be payable by the vendor. This means the vendor will pay for:

Land costs;

Building costs;

Fees of parties involved in the construction, such as the agents, installation consultant, architect and constructor;

Fees charged by the civil-law notary for the deed of transfer;

Charges for building permits;

Costs for Woningborg;

Costs charged by utilities for connections to electricity, telephone, CAI, water and sewer. Any statutory subscription fees and connection fees to obtain a connection are not included in the Purchase Contract and Building Contract;

Taxes (VAT and/or transfer tax)

Cadastral surveys The purchase sum does not include costs of financing your property, or local taxes and subscriptions.

Small print explained

The developer and building contractor reserve the right to change materials and finishes, and to adjust the surrounding area, without affecting the quality. Adjustments made shall not entitle the buyer to any set-off.

The sale documents have been carefully drafted based on details and plans furnished by the architect, municipality, authorities and consultants. Nevertheless, we reserve the right to make changes, for instance if they result from government requirements or as stipulated by utility companies. The information in the sales documents is furnished for information purposes only.

Any furniture or appliances that feature in drawings is included merely to give an impression of the available space; they are not included in the purchase sum.

The dimensions in the drawing are given for indicative purposes only and may show minor differences.

Unless expressly indicated differently, all dimensions are given as millimetres. Dimensions between walls do not allow for any wall finishing. Please do not scale from these drawings.

The installations and their locations on the drawings are indicative only.

Most land plans in the sales documents are snapshots and changes may be made to many things, including the green zones, adjacent structures, dimensions, foot and cycle paths, parking facilities, or driving lanes.

Please remember that drawings or descriptions that do not form part of a zoning or implementation plan have no legal effect, and that no rights may be derived from them.

No rights may be derived from drawings, artist’s impressions, coloured maps, photos, statements, advertisements, folders, advertising material, etcetera, nor from the positions of any drawn (kitchen) appliances, washing machines, dryers, etc. They are provided for illustration purposes only.

Completion and acceptance

Upon completion and acceptance, you will receive the guarantee certificates or manuals to the technical installation, as well as the paint specifications / maintenance advice and a colour and material sample with colour numbers. You will also receive the final, standard, drawings of the technical installation, indicating the location of electricity, gas, water, sanitary ware, radiators and MV unit (i.e. these do not include any changes made by the buyer). Up to three months after receiving the keys to your apartment, you may inform the contractor in writing if any defects found previously have been solved and/or new defects have occurred that are not the result of misuse of materials, or the materials continuing to “work”. Please remember that the apartment is built from “living” materials that may show signs of work. For instance, plaster may show hairline fractures in corners, and doors may jam as the wood adjusts to new temperatures and moisture levels. This cannot be avoided. Once all reported irregularities have been solved, the contractor has met its obligations.

GENERAL TERMS AND STIPULATIONS

Woningborg guarantee and warranty

Buying a property is not something you do every day. Even if you have bought a property before, there are some aspects to bear in mind.

Guarantee and warranty scheme

The apartments in this construction plan are subject to the Woningborg guarantee and warranty and warranty scheme. What this means for buyers is set out below. If the contractor experiences financial problems during construction of the project, and is unable to complete it, Woningborg N.V. will arrange for the completion of the apartments by a third party, in collaboration with the insurance company involved, without any additional costs for the buyer. This is the so-called insolvency guarantee. The contractor guarantees a particular level of structural quality of the apartment and building from three months after the apartment’s completion and acceptance. If there are any structural defects during the guarantee term, the contractor is obliged to repair them. In principle, this guarantee applies for a period of six years. In very serious cases, the guarantee may even be extended to a period of ten years. This is the so-called Woningborg guarantee and warranty. A guarantee period of less than six years applies in some cases. For instance, paintwork guaranteed for a period of one year. Obviously, damage resulting from poor maintenance is not covered under the guarantee. Some items (such as wallpaper) are not covered by any guarantee. If the contractor fails to meet his its obligations pursuant to this structural guarantee, the buyer may invoke the so-called maintenance enforcement provisions with Woningborg if: 1. the contractor goes bankrupt after commencement of the guarantee term; 2. the contractor fails to observe (in time) an arbitration award ordering it to repair a defect under the guarantee. Together with the insurance company involved, Woningborg will ensure that the defect will be repaired free of charge, subject to a maximum cover per apartment. In the event of a dispute, Woningborg can mediate between the buyer and the contractor. The Guarantee and Warranty scheme also offers an easily accessible dispute settlement procedure. Waal B.V. is registered with Woningborg N.V..

Construction time

At the time of purchase, you will be given an indication of when your apartment will be ready for moving in, calculated from the start of construction. Unforeseen circumstances such as fire, storm, water damage and/or unworkable weather may cause a delay in the construction time. Public and other holidays, weekends and ATV days (reduction of working hours days) are not considered workable days.

Your current home

We recommend that you allow for a flexible date if you plan to sell your current home, or if you give notice on your rental home, and wait for our completion and acceptance letter before finalising the sale or cancellation of your rent. It goes without saying that we will make every effort to give a more or less accurate completion and acceptance date. However, there are many reasons, some of which we have already mentioned, that could cause a delay, particularly if you buy an apartment before construction has commenced. Legally speaking, the building contract offers no more than a guide to the time of completion and acceptance. In general, the completion and acceptance term allows for plenty of time.

Completion and acceptance and key transfer

At least two weeks prior to the completion and acceptance date, you will receive a written invitation to inspect your apartment, together with the site manager or supervisor. Any defects found during the inspection will be taken down in writing. While the defects are being fixed by the contractor, you will receive the final bill. Once you have met all of your financial obligations, you will receive the keys to your apartment. This will constitute the legal completion and acceptance of your apartment.

Woningborg stipulations take precedence

The regulations, rules and standard clauses set out in the Guarantee and Warranty scheme shall apply in full, without prejudice to the stipulations in the brochure and this Technical Description. In the event these regulations, rules and standard clauses conflict with a clause in the brochure or harm the buyer, the Woningborg stipulations shall take precedence.
