1 Ms AAI Cargo Logistics and AtliedSJrVitesCompany Limited (AAICLAS) is a 100 subsidiary company of Airports Authority of India (AAI) providing Cargo Handling Services at various AAI operated Airports including Sri Guru Ram Dass Jee International Airport Amritsar Airport Authority of India (AAI) demerged its Cargo operation from 11th August 2016 into a subsidiary company ie AAI Cargo Logistics and Allied Services Company Limited (AAICIf~) which is setup exclusively to focus on the growth in Aviation Cargo bq~in~~~ in 111d~~

2 Ms AAICLAS vide letter~~~ed i~Ql29~Q~ubllli~ed their Multi Year Tariff Proposal (MYTP) and Annual Tari~icrr~o~gll~-A~yen) t~~~rds determination of tariffs from FY 2017-18 to FY 2023-=tflfbrlr9~Bil1gC~rgo[Iandling Services at Sri Guru Ram Dass Jee International Airport Amritsar In their MYTPATP proposal AAICLAS also submitted the details of actual and projected Revenue Operating expenditure Capital expenditure etc from FY 2017-18 to FY 2023-24 AAICLAS have sought an increase of 1687 for FY 2020-21 and thereafter 10 year on year (y-o-y) from FY 2021-22 to FY 2023-24 In the same proposal AAICLAS requested that the Control Period may be considered as 7 years including the previously elapsed 2 years ie FY 2017-18 and FY 2018-19

threshold limit of 25 for the Cargo Handling Service hence the regulated service is deemed as Not Material Since the service is Not Material the Assessment of Competition and reasonableness of the User Agreements have no relevance for the assessment of regulatory approach As per Clausegz (i) of the guidelines 2011 wherever the regulated service provided is Not Material the Authority shall determine tariff (s) for service provider (s) based on a Light Touch Approach for the duration of the Control Period

4 The Authority observed that MsAAlGLAS had not conducted the Stakeholders Consultation meeting on the proposed-tariffproposal at the time of submission of its MYTP ATP Therefore AERAinitsSopsultation Paper directed that AAlCLAS to conduct a Stakeholder Consultation meeting and submit details to the Authority along with Stakeholders comments befq~EfdS~KJEfi9ftltlriffOrder on the above proposal

5 Ms AAlCLAS submitted the copyOpound G()ncession Agreement between AAlCLAS and Airport operator ie AAl As per-Concession Agreement the AAlCLAS is paying 30 of the actual Gross Revenue as Concession fee toAAl The concession agreement is valid for 30 years from the date of execution ofConcession Agreement ie 018t April 2017

6 AAlCLAS has requested to consider-theControlperiod as 7 years including the previously elapsed 2 years ie FY 2017-18 amp FY 2018-19 the Authority is of the view that as per AERA (CGF) guidelines 2011 Control period means a period of 5 years during which the Multi Year Tariff Order and Tariff (s) determined by the Authority pursuant to such order shall subsist Therefore Control Period cannot be considered for more than 5 years The FY 2017-18 and FY 2018-19 has lapse and AAlCLAS has not submitted any proposal it is inappropriate to recover any shortfall for the past year from the present user Hence the Authority considers themiddot FirsfCoijtrolEeriod frorriFY 20J920 to FY 2023-24

7 Ms AAlCLAS submitted the actual financial data for FY 2017-18 and FY 2018-19 and projections from FY 2019-2()to FY~q7~~740nth~ basis of actual and projected data of Revenue Operating expengiTI~re~(S~pit~l~~~pe~~iture etc submitted by the AAlCLAS the Authority observed t~ftth~ ~eturn~nAve~~geyenB was -1123022 in FY 2017-18 and 1231152 in FY 2018-19 (actual) and as pet projections for FY 2019-20FY 2020-21

FY 2021-22 FY 2022-23 and FY 2023-24 Returns on Average RAB will be -21136 -2920 -1611 -1350 and -880 respectively mainly due to projected Capital Expenditure Further the Authority observed that the Operating profitturnover ratio was -8766 in FY 2017-18 and 1070 in FY 2018-19 (actual) and as per projections for FY2019-20FY 2020-21 FY 2021-22 FY 2022-23 and FY 2023-24 Operating profitturnover will be -10421 -5632 -3924 -24-47 and -1169 respectively AAlCLAS have projected Capital Expenditure of Rs 91638lakhs during the First Control Period for improving and expanding the available infrastructure at Amritsar Airport in which the major portion of Rs 38255 lakhs will be incurred on new Cargo Terminal Building and Rs 25229 lakhs on ElecH1~_~ion and maintenance

8 The Authority considered the submissions made by AAICLAS and issueda Consultation Paper No 232020-21 dated 23062020 wherein the Authority observed that AAICLAS would require higher rate of increase in tariff rates at Amritsar Airport to achieve the

sufficient Return on Average RAB amp Operating Profit Margin and due to low volume of Cargo at the Airport Considering the substantial change in the prevailing business scenario and higher tariff rate required to AAICLAS the Authority proposed ill the CP to allow Ms AAICLAS to charge an increase of 1687 from existing tariff for FY 2020-21 and thereafter 1000 increase Y-O-Y from FY 2021-22 to FY 2023-24 as sought by AAICLAS

9 The Authority sought written evidence basedfeedback comments and suggestions from Stakeholders on the above prop()sall~test~Y14072020 The Authority vide e-mail dated 24062020 informed the same tBgt1Ui~Bl1~e~ged stakeholders on their registered e-mail IDs Since no comments have beeli~ecei~ed from any stakeholders on Consultation Paper no 232020-21 dated 23062020t4et~lJthoritypresumed that the stakeholders have no objection to the proposal

10 Ms AAICLAS has conducted stakeholder Consultation meeting on 17072020 and submitted the minutes of the meetitigtothe Authority As per the Minutes of the meeting submitted by AAICLAS they have mCjlde some amendments in the tariff rates and notes of the tariff card on the request of the Stakeholders AAICLAS has proposed to keep the existing tariff rates for Regulated Agent Facilitation (for Export amp Domestic Outbound) and some others line items like Terminal Operator PackingRepacking charges Merchant over Time XBIS usage charges of Import Cargo etc The Authority has decided to allow Ms AAICLAS to increase 1687 from existing tariff for FY 2020-21 and thereafter 1000 increase Y-O-Y fromfY 2021-22 toFY2023-24 except the amended charges proposed by AAIQLtS ontherequestbftheSt(yeneho~d~rs Further the Authority has decided to implement tpetarifffromOllO2020aspJpppsectedby the AAICLAS

Upon careful consideratiBOampm~ierial a~ailable~tit~ecord as well as submissions made by the service provider tlie AuthpJity inltexercis~of powers conferred upon it by Section 13(1) (a) of the AERAAct 2008 hereby orders that

(i) The Cargo services provided by Ms AAI Cargo Logistics and Company Limited (AAICLAS) at Sri Guru Ram Dass Jee International Airport Amritsar are Non Material Hence the Authority decides to adopt Light Touch Approach for determination of tariff from 1st tariff year to 5th tariff year of the 1st Control Period FY 2019-20 to FY 2023-24

(ii) Ms AAICLAS is allowed to charge an increase of 1687 from the existing tariff for FY2020-21 and thereafter 1000 increase Y-O-Y from FY 2021-22 to FY2023-24 as per the tariff card attached as Annexure-I The Financial performance and the investment made by AAICLAS 9u v~ilt7GQntrol Period shall be reviewed while determining the tariff for the n ]I middotrrtro $i

i) Terminal Operator shall levy packingrepacking charges 2 of packages per shipping bill with a minimum of INR 2000 per Airway Bill Packing Repacking charges will be at INR 1216per packet(There will not be year on year increase till next revision takes place)

j) XBIS usage charges INR 100 per kg subject to minimum of INR 15000 per shipment The same is applicab subject to minimum of INR 10000 per ODC shipment where physical check with the help of ETDs are facilitated However in random check cases in ETDs by Airlines after scannin rges to be levied for usage of ETDs (There will not be year on year increase till next revision takes place)

1) As an incentive to trade to utilize the lean hours 20 discount in the Terminal Storage and Processing charges will be granted to Export cargo admitted between 1000 hrs to 1500 hrs subject to levy of minimum rate per consignment as given in Scale of Charges

5 Ms AAlCLAS submitted the copyOpound G()ncession Agreement between AAlCLAS and Airport operator ie AAl As per-Concession Agreement the AAlCLAS is paying 30 of the actual Gross Revenue as Concession fee toAAl The concession agreement is valid for 30 years from the date of execution ofConcession Agreement ie 018t April 2017

6 AAlCLAS has requested to consider-theControlperiod as 7 years including the previously elapsed 2 years ie FY 2017-18 amp FY 2018-19 the Authority is of the view that as per AERA (CGF) guidelines 2011 Control period means a period of 5 years during which the Multi Year Tariff Order and Tariff (s) determined by the Authority pursuant to such order shall subsist Therefore Control Period cannot be considered for more than 5 years The FY 2017-18 and FY 2018-19 has lapse and AAlCLAS has not submitted any proposal it is inappropriate to recover any shortfall for the past year from the present user Hence the Authority considers themiddot FirsfCoijtrolEeriod frorriFY 20J920 to FY 2023-24

7 Ms AAlCLAS submitted the actual financial data for FY 2017-18 and FY 2018-19 and projections from FY 2019-2()to FY~q7~~740nth~ basis of actual and projected data of Revenue Operating expengiTI~re~(S~pit~l~~~pe~~iture etc submitted by the AAlCLAS the Authority observed t~ftth~ ~eturn~nAve~~geyenB was -1123022 in FY 2017-18 and 1231152 in FY 2018-19 (actual) and as pet projections for FY 2019-20FY 2020-21

FY 2021-22 FY 2022-23 and FY 2023-24 Returns on Average RAB will be -21136 -2920 -1611 -1350 and -880 respectively mainly due to projected Capital Expenditure Further the Authority observed that the Operating profitturnover ratio was -8766 in FY 2017-18 and 1070 in FY 2018-19 (actual) and as per projections for FY2019-20FY 2020-21 FY 2021-22 FY 2022-23 and FY 2023-24 Operating profitturnover will be -10421 -5632 -3924 -24-47 and -1169 respectively AAlCLAS have projected Capital Expenditure of Rs 91638lakhs during the First Control Period for improving and expanding the available infrastructure at Amritsar Airport in which the major portion of Rs 38255 lakhs will be incurred on new Cargo Terminal Building and Rs 25229 lakhs on ElecH1~_~ion and maintenance
