When the meeting came to order, Engr. Reyes ex­plained briefly to the body the history of the issue of the Prego Building. The representative of the Prego Building applied for a building permit for a 3-storey bldg. which he approved on June, 1994 as Building Offi­cial. However, the construction of the said building proceeded up to the 5th storey, without a new application being filed to his office before the vertical extension to the 4th & 5th floors was done. Hence, the construc­tion of the 4th & 5th floors are illegal. Engr. Larry Reyes summoned Mr. Frank Gomez; owner of the building to tell him that he was stopping the construction because the building permit he issued originally was for a 3-storey bldg., only, as he applied for, & that there was no new application filed to his office for the vertical extension of the said building up to the 6th floor. It was only last August/95 that a new application for the vertical extension of the said building. to the 6th floor was filed with the Municipal Engineer's Office. Mean­while, the construction is temporarily stopped while all the necessary requirements are not yet met, especially regarding the structural evaluation of this building. The Municipal Engineer also mentioned the parking re­quirements; that the owner should provide 2 to 3 slots storey pursuant to the National Building Code (1 parking for every floor).

Dra. Zantua explained that she is also concerned with the parking since the building is located in the main street of the municipality and will worsen the traffic congestion on this very busy street because this building has totally no provision for parking and load­ing/unloading. Also this will set a very bad precedent to other lot and building owners if a high rise building, totally without parking provision, will be allowed to be erected, especially along the busiest main street of our

town. This will make traffic congesti on in the very near future at its worst, since there wilJ be more people and more vehicles on this very busy road, if minimal parking and loading/unloading requirements for new building will not be implemented .

Dra. Zantua is also very concerned about the safety and precautionary measures during construction (i.e., providing safety conopies or nets on the northern side of this building, adjacent to her residence and clinic). There had been many incidents of construction materials and debris falling on their premises; hitting structures and persons, especially during the last typhoon. It is still fortunate that there's still no major or serios injuries to persons living on their premises as of now.

Atty . Perlas, counsel for the building owner, ex­plained that this question of safety measures, to prevent construction materials and debri s from falling to the premises of Dra . Zantua, will be given utmost important and that he will personally see to it that Mr. F. Gomez but these proper safety measures in place and that they will be properly and regularly maintained.

Ora. Zantua questioned the building's structural stability . She asked if the original structural plan submitted and made for the 1st 3 floors is very strong and very stable for the building to be extended up to the 6th floor. Engr. Larry Reyes is requiring the private structural engineer of the Prego Bldg . to submit to his office a certification that the structural foundation and the built of the lst-3 fllors are structurally safe and stable for this bldg. to be extended up to the 6th floor. Ora. Zantua also requested Engr. Larry Reyes to do an independent evaluation himself of the said structural plan to confirm its stability. At this point Councilor Tapangco assured that the matter will be given much attention by the Engineering Office for the welfare of everybody.

Mr. Frank Gomez promised that he will provide a parking space required of his bldg. on the residential lot of Mrs. Lucia Arambulo, 1 block away along Zavalla street, so as not to violate the traffic rules and regu­lation and the National Building Code requirement for parking . But Engineer Larry Reyes pointed out that the National Building Code still requires a minimum of 1 parking requirement) even if the Prego Building (or 20% of the total parking requirement) even if the Prego Bldg. will provide a parking space on the lot of Mrs. Lucia Arambulo, 1 block away. Vice-Mayor catindig questioned the use of the building and Mr . Gomez explained that the first three floors will be for commercial purposes while the - remaining 4th and 5th floor and 6th floor will be their residential, for the family to use. Vice-Mayor catindig pointed out that the water tank should be placed at the roof top or the 7th floor.

Engr. Larry Reyes offered this compromise to Mr~; Frank Gomez to complete the building up to 5th floor (if

it's really proven to be structurally stable up to the 5th floor), just to complete whatever has been started. This would also decrease the parking requirement for the building and will shorten the construction period needed. Mr. Frank Gomez insisted that the building be approved up to the 6th floor .

At this juncture, Ora . Zantua requested that a 60 day construction period should be made mandatory to finish the exterior construction of the roof top and the whole of the fire wall on the northern side, which is adjacent to Dra. Zantua's residence and clinic, so as to completely remove within the shortest time all the safety canopies, safety nets, and other construction materials over hanging the premises of Dra. Zantua, which always pose as a danger to the safety of structures and person in her residence and clinic. This 60- day construction period should be counted from the day the offical build­ing permit for the vertical extension to the 4th-6th floors is approved by the Municipal Engineer's Office . The request was accepted by the owner and agreed upon by all present.

Engr . Reyes advised Mr. Gomez and his party to submit the required documents before · resumption of the project including the clearance from the Fire Department, after Mr. Pambid, the Zoning Administrator had issued the Zoning clearances. Dra. Zantua stressed the most import­ant requirement {before the approval of the vertical extension of the said building to the 6th floor can be given) is the submission of the official certification of the private structural engr. of the Prego Bldg. that the building's foundation and the built of the lst-3 floors afre really structurally stable for 6 floors. And that Engr . Larry Reyes himself should do an independent evala­tion of its structural s ·tability .

Furthermore. Ora. Zantua stressed that in case of future violations to the National Building Code or to laws, rules, or regulation related to the construction of this building, permanent cancel lation of the building pwermit of this structure will be imposed. She likewise, requested that since application and permit is for a 6 storey building, then the water tank should be placed at the floor of the 6th level and not at the roof level of the 6th floor.

Dra. Zantua noted that it was unfair that Mr . Frank Gomez brought a legal counsel with him but she has none. Had she known that a legal counsel will help defend Mr. Frank Gomez'case she should have brought a lawyer also. Dra. Zantua thought all along that the committee hearing will be attended only by the government officials con­cerned, Mr. Frank Gomez and herself (Ora. Zantua) without legal counsels around. Ora . Zantua also pointed out the penal provisions of the National Building Code for cases of illegal building construction which are:

1. fine of P20,000.00 or 2. imprisonment (or both fine and imprisonment)
