INTRODUCTION

In the following pages you will find detailed information on properties for rent through local landlords and Real Estate agents in The Hague. This list is based on the recommendation of the ICTY staff members. Please, share with us your experiences with the landlords and/or real-state agencies. Depending on your evaluations the real-state agencies will be kept or removed from this list. Thanks in advance for your feedback. It is policy of the Staff Welfare Office not to advertise properties above €1600 per month; however the Staff Welfare Office has a list of more expensive properties that are not advertised here. Staff members looking for big family houses or for more expensive apartments can contact the Staff Welfare Office directly. If you know of available and affordable properties (apartments, houses or rooms), or you need further assistance with accommodation, please ring the Staff Welfare Assistant to arrange an appointment.

IMPORTANT ADVICE

� Do not pay/sign anything before you have seen any property (except registration form); � Do not sign the contract before you check with the Staff Welfare Office whether your chosen real-

estate agency is recommended by the ICTY colleagues or contrary, the agency is it on the “Black List”

� Be sure you know what kind of contract will be used before committing yourself to a property; otherwise you risk an unpleasant discussion about the terms and conditions;

� It is not common to pay for a ‘tour’ to view houses. � Never commit yourself verbally, but make a written proposal to the landlord or through your

agent. Therefore, no misunderstanding can occur. If the landlord agrees verbally, then this is considered to be an official agreement.

� Be sure that a report is made as to the conditions of the property as this will be very useful when you decide to leave and may resolve any discussions with regards to the deposit.

� The landlord is obliged to return your deposit within 2 months after you have left the property: you can make a different arrangement but the landlord is not obliged to go along with that.

� The landlord can only terminate the contract when he has a diplomatic clause as well, with a term of notice of minimum 3 calendar months.

� Further the reasons to terminate a contract are: 1. tenant has not paid for longer than 3 months; 2. tenant has misbehaved and "ruined" the property; 3. landlord needs the property urgently himself; 4. the property will be demolished; 5. the destination or goal of the property will change (e.g. apartment will become a shop);

� Normally the term of notice is one/two calendar months (starting from the 1st of the month e.g.: if you give notice on the 12th of April you can leave the flat on the 1st of June) unless otherwise agreed. This always applies after the minimum stay period.

� The rent can only be adjusted after 1 year of tenancy; the tenant has to be notified 2 months in advance; the adjustment can only be done on the net rent.

� Once the tenant has given notice, he has to cooperate in allowing other possible tenants to view the property. The tenant should be notified in advance.

Signing the contract is only the finalisation of the deal. A contract is entered into when both parties agree upon the object, price and terms. This is a verbal agreement. It is not advisable to agree on a property and send a deposit to an agency before you have arrived and seen the property. Written contracts: Do not sign any contract until you are definitely interested in the apartment and until all your conditions are agreed upon (make sure that both parties are present at the moment of signing the contract). TENANT AGREEMENT Things to expect from an agreement are:

� Monthly rent, paid in advance � One month deposit as guarantee for the landlord in case the tenant: leaves the house behind

dirty (cleaning costs); breaks things during the rental period (repair costs); has made changes like removing a wall or repainting in bright colours, etc (only allowed in consultation with the landlord).

� Responsibility for maintenance � User’s costs if it is exclusive (utilities etc.) � Termination of the Contract (one to two full calendar months notice and/or with a diplomatic

clause). Rental price too high? If you think the rent you are paying per month is too high, you can contact within the first 6 months from the signing of the contract, the Institute Sociaal Raadslieden, Slachthuisplein 25, and The Hague. How can you ensure getting your deposit back?

� Make sure you check the accommodation beforehand with the estate agent or landlord.

� Make a list in duplicate of all the defects you find, also the defects you discover in the first two weeks which must be submitted in writing.

� Don’t make major changes if you are not planning to live there for long. � No changes without the written approval of the landlord (make sure the landlord has signed). � When you leave the accommodation, inspect it together with the estate agent or landlord. � Leave the accommodation clean on departure. If you don’t leave the place clean, the landlord will

bring in a professional cleaning agency. The costs will be approximately €150. NOTE: Be aware when you take over the accommodation from a friend or colleague that you take over all his/her responsibilities as well (arrange this well beforehand with the leaving tenant and the estate agent or landlord). DIPLOMATIC CLAUSE A diplomatic clause means that if, on account of his/her work, the tenant will be transferred to a place 75 km or more removed from the premises or if they have to leave the premises for reasons beyond their control, the tenant is entitled to terminate this agreement prematurely. This is on condition that he/she informs the owner by registered letter, whereby two full calendar months' notice shall be observed. You can ask this to be included in the tenancy agreement. The Landlord is entitled to request a letter from your employer stating that you have been transferred or you are no longer an employee as proof of your transfer.
