Background

During the last decade, particularly in the years leading up to and including 2007-2009, intense extremist activities and unrest in many parts of Khyber Pakhtunkhwa (KP) province adversely a�ected local governance institutions and security in the region. There were several challenges causing varying levels of fragility in the border province. Malakand Division as well as southern KP districts were particularly e�ected by insecurity and the weakening of state authority. The violence in Malakand division has left the local state institutions weakened and arguably, the formal justice sector was virtually nonfunctional. Lawyers were threatened not to take cases, justice actors received warnings, while the population was constrained from approaching the formal judicial system as militants tried to usurp the role of the state. On the front lines, the police were targeted and large numbers were assassinated.

Symbols of state power, such as government buildings, were attacked and damaged as a further means to undermine state authority. Insecurity was not limited to the Malakand Division; Issues of militancy, under-development and low institutional capacity also marked southern KP. The geographical and demographic characteristics of these districts have been heavily in�uenced by unrest in the Federally Administered Tribal Areas (FATA).

Following the undertaking of security operations in 2009, the KP Government took immediate measures to restore the writ of the state and the rule of law. Since this time, judicial and security institutions in KP have been greatly strengthened, but challenges remain including: limited capacity of the formal court system, including judiciary and prosecution; undertrained and under-resourced police, with a recognized need for more interaction with the community; undertrained

and under resourced prisons with limited rehabilitation initiatives for detainees to address recidivism and little support for women and children in con�ict with the law; absence of e�ective, sustainable and institutionalized legal aid mechanisms within a context of low public legal literacy; and limited access to justice for women and limited female representation within the rule of law sector.

Given the strong correlation between the breakdown of state institutions and the rise of militant groups initiatives to restore and establish public con�dence in justice and security institutions remains a critical and challenging need. The necessity to extend support to strengthen and consolidate such e�orts, from both ‘supply’ and ‘demand’ sides, is recognized by national partners.

The coming few years represent a key window to consolidate past e�orts and build on existing peacebuilding and con�dence-building measures in order to establish the foundations for achieving long-term stability in KP.

The KP Government has already formulated several development policy frameworks to provide a concerted policy response to security and rule of law challenges faced by KP including the Strategic Development Policy Framework 2013 (SDPF). The SDPF provides a realigned road map where the provincial government and international development partners vowed to pursue mutually complimentary strategies to fast track development and inclusive growth in KP. Included among the objectives of SPDF is a “Peacebuilding and Rule of Law” pillar focused on “reforms in security and justice systems”.

Supporting Partners to Rule of Law in KP

To support the KP Government in restoration of the rule of law supporting partners have contributed the following:

The European Union (EU)The joint EU and UNDP action for cooperation is premised on supporting public con�dence through reform and development at policy, management, outreach, and accountability level. All levels are reinforced by a need to share gender responsive policy and practice. The project is intended to support better service delivery at the local level, leveraging divisional and provincial systems as needed to a�ect durable change. The joint UNDP-EU project is also considering and is informed by management reforms anticipated under a separate expected result under the EU’s overall “Citizens’ Justice and Peace Programme in Khyber Pakhtunkhwa”.

The Embassy of the Kingdom of the Netherlands (EKON)The Netherlands supports the Judiciary and legal aid initiatives to raise public legal awareness, increase access to legal aid, improve both the quantity and quality of legal aid representation, support policy level changes as well as coordination for better legal aid provision, particularly for the most vulnerable. The intervention also endeavours to enhance knowledge and skills of judges and court sta� for better service delivery; improve the professional working environment through infrastructure and procedural support; and revive and strengthen support for ancillary/auxiliary justice delivery tools and mechanisms.

The Swiss Development Cooperation (SDC)The overarching goal of the SDC in partnership with UNDP is to support sustainable peace through improved access to justice for men and women through e�ective and accountable justice and security service delivery. The project’s key components include: (a) raising public legal awareness, increase access to legal aid, improve both the quantity and quality of legal aid representation, support policy level changes as well as coordination for better legal aid provision, particularly for the most vulnerable;

(b) addressing better and faster service delivery through increasing the capacity of court institutional actors, basic operational support, as well as facilitating additional mechanisms to meet public demand. The output’s three key interventions were: a) enhanced knowledge and skills of judges and court sta� for better service delivery; b) improved professional working environment through infrastructure and procedural support; and c) revived and strengthened support for ancillary/auxiliary justice delivery tools and mechanisms.

Department for International Development (DFID) The Department for International Development (DFID) UK has been supporting rule of law initiatives in KP under the Aitebaar program in partnership with Co�ey International. The program works in 5 districts to improve provision of security and justice services through the establishment of model police stations. It engages in research and M&E; legislation and policy for police and prosecution; and community based dispute resolution.

In partnership with Co�ey International, DFID is also supporting the new Citizen Justice and Peace Project (CJPP). The project closely coordinates with UNDP’s Strengthening Rule of Law Project (SRLP) and aims at improving visibility of justice initiatives, raising demand for justice and security services, and improved coordination between the police and the Home Department.

The US Bureau of International Narcotics and Law Enforcement A�airs’ (INL)The U.S. government, through INL provide training, equipping, and infrastructure support to KP police. This program began with the KP Police Elite Force, a mobile, SWAT-like force capable of deploying to the most volatile areas in KP. INL assistance is intended to increase the professionalism, mobility, and communication capacity of KP police so that they are better able to maintain basic law and order and interact with other Pakistani security forces to “hold” areas cleared of militants.

Inauguration of the RegionalForensic Science Laboratory, Swat

In 2014, the Rule of Law Project commenced support to the forensic facilities of the Khyber Pakhtunkhwa Police to strengthen its crime investigation capacity. The police department provided a building for the regional forensics laboratory (RFSL) while the project provided infrastructure refurbishment, equipment and training support.

The project has refurbished the entire existing building in addition to completing new construction to ensure the functionality of the laboratory, procured laboratory equipment, chemicals, consumables and laboratory support items relevant to conducting investigations involving �rearms, tools, questionable documents, vehicle examination and forensic photography, steel �xtures, furniture, general equipment, etc. have also been procured.

1. In 2014, UNDP began work on the Regional Forensic Science Laboratory at a building provided by the KP police with funding support from the Governments of Switzerland, Netherlands, and Khyber Pakhtunkhwa.

The project has provided specialized training to 14 police sta� at the Punjab Forensic Science Agency (PFSA) in Lahore. This six month course focused on three specialties: �ngerprinting, questioned documents and �rearms & tool marks. In addition to the training of the 14 police o�cials, UNDP hired three highly quali�ed experts who were deployed to the PFSA after completing the six month training course. The three experts will perform as Forensic Supervisors (Scientists) in RFSL Swat when operationalized along with the 14 trained o�cials.

On request by the Home Department and KP Police, two more police o�cials were nominated and are being sent to PFSA Lahore for a 3 month training course on forensic photography. UNDP is also planning to provide support to �rearms and tool marks, �ngerprinting, questioned documents, vehicle examination, forensic photography, narcotics, and trace chemistry and explosives if funding is available. The RFSL is expected to reduce the workload on the FSL Peshawar, improve the criminal investigation process, support in the speedy disposal of cases in the Malakand division, and improve the scienti�c forensic systems of the KP Police.

To date, the project with contributions from the Embassy of Switzerland, the Embassy of the Kingdom of the Netherlands, UNDP and the KP Government, has provided US $1.1 million of construction, refurbishment, equipment and training to the FSL in Swat. While great work has been achieved, the FSL Swat will still require an additional US $600,000 to operationalize all its units. The FSL is prepared and equipped to start operating from 1st December in the following disciplines: Fingerprints; Questioned document examination; Vehicle examination; Forensic photography. The �rearms section is one microscope short of operationalization. Explosives and chemical analysis need funding to operationalize. The delegation will meet the following at the inauguration :

1. Over 60,159 people were provided detailed orientation on laws and legal rights.

2. 1,220 legal aid clinics and community awareness sessions conducted.

3. More than 4,500 people were provided legal advice and consultation through legal aid clinics and legal aid desks.

4. Over 1,814 people were referred to 17 legal aid desks established on courts’ premises.

5. Over 1,219 poor and vulnerable people were provided legal aid in court.

6. Over 45 law students and 25 law graduates were provided scholarships & stipends to encourage them to join the legal profession.

7. With UNDP’s Rule of Law programme’s support, the number of female lawyers increased from one to 25.

QUICK FACTS: LEGAL AID AND ACCESS TO JUSTICEThe people of Khyber Pakhtunkhwa, particularly of Malakand division, face considerable challenges in accessing the formal justice system. This is in part due to a lack of knowledge or awareness on legal rights, civic duties and remedial forums, de�ciency of practicing female lawyers, expensive and prolonged litigation and inadequate legal aid services for the poor and marginalized members of the community. To address these gaps, the UNDP SRLP initiated interventions including legal awareness sessions in communities, establishment of legal aid desks and provision of legal aid services to the poor and marginalized at tehsil and district level. In order to strengthen the system on a long-term basis, UNDP initiated policy dialogues with the Law & Justice Commission and Pakistan Bar Council that resulted in proposals to amend the legal aid rules to simplify application process, introduce pro bono legal services and clinical education for students. Legal aid interventions pertaining to accessing justice have been designed to be sustainable by gradually transferring service delivery to the relevant justice sector stakeholders. For this reason, close and consistent coordination is being maintained with justice sector stakeholders, particularly the bar councils and bar associations and the judiciary at district level.

From 2012-2015 SRLP support to legal aid included: 1,220 legal aid clinics and legal awareness sessions conducted in partnership with the local bar associations, NGO partners and community paralegals. Over 60,000 community members (male 30,168 and female 29,991) bene�ted from the awareness raising sessions and clinics. Over 4,500 (male 2,478 and female 2,038) community members bene�ted from legal advice and consultation by male and female lawyers. 1,814 cases (male 949 and female 865) were referred to legal aid desks and 1,219 cases (male 629 and female 590) deserving persons were provided support in court.

Societal norms and pressures, issues of mobility and access have kept many women away from the practice of law in this region. The SRLP project endeavors to address the challenges women in the region face in accessing

justice. One such measure has been supporting female lawyers and law students through scholarships and stipends for apprenticeships. The project provided scholarships to 45 female law students, stipends to 20 female law graduates and support to 4 female lawyers in obtaining their law licenses. The project has also constructed two bar rooms for female lawyers in Malakand division which will help to create a conducive and professional environment for female lawyers in addition to providing advocacy and skills based training to 17 female lawyers. The project, in partnership with Ms. Asma Jahangir, (advocate Supreme Court, co-chair Human Rights Commission of Pakistan and human rights activist) will send 8 female lawyers from Malakand to Lahore for capacity building and mentoring.

Tour of the Regional Police Training Centre SwatThursday, 26 November 2015

The UNDP through its Strengthening Rule of Law Project in Khyber Pakhtunkhwa has been providing support to the KP Police to improve its performance through a number of interventions. One of the main focus areas has been capacity building of police sta� through training and mentoring.

A state of the art training centre has been established by the KP Police, in partnership with the SRLP, where sophisticated facilities for the training of senior police o�cers in investigation are available. Two barracks, which were in critical condition, were assessed, repaired and altered according to the needs of the training center. Now, a manager room, a crime scene lab, a library, a crime scene room, two lecture halls (capacity for 30 participants each) and three washrooms have been constructed. The project is supporting female trainees at the RTC through the construction of dorms for women police o�cers which also includes child daycare facilities.

The SRLP has delivered and supported training and development initiatives including: a training needs assessments; the production of training manuals on investigation and crime scene management; supervisory skills; and communication. The project also developed and implemented a training of trainers (ToT) course and supported the Police Training College at Hangu through forensic and gender training.

The work of the UNDP is to support the police in Malakand into becoming a professional and trusted service orientated organization. With the establishment of the RTC the police in Malakand can now fully support and develop the personnel capacity within the

Mr. Attaullah Khan comes from Oach village in Dir Lower. He obtained his LL.B. at Peshawar University and completed his LL.M. at the University of Sussex. Annex - 01: Press Release

Criminal justice in Malakand gets a boost with UNDP Pakistan-supported Forensic Science Laboratory

SWAT, 26 November 2015 – A new regional Forensic Science Laboratory (FSL) was inaugurated today by the Chief Minister of Khyber Pakhtunkhwa province, Mr. Pervez Khattak and the FSL Director, Mr. Muhammad Quresh Khan. The FSL was established with funding from the Government of Khyber Pakhtunkhwa, Switzerland and Netherlands and equipment, training and support from the United Nations Development Programme (UNDP) as part of its Strengthening Rule of Law in KP programme. The UNDP project supported the construction of a new facility and refurbishment of an existing one in order to support the KP police force to improve its criminal investigations by using modern forensic techniques. Such support will ensure that cases are processed more quickly and also decrease the burden on the FSL in Peshawar.

The inauguration was attended by the UNDP Pakistan Country Director, Mr. Marc-André Franche, the Ambassadors of Switzerland, Mr. Marc Pierre George; of the Kingdom of the Netherlands, Ms. Jeannette Georgine Seppen; of the European Union, Mr. Jean-Francois Cautain; and Senior Con�ict Advisor at the UK Department for International Development, Ms. Helen Lewis.

The event was also graced with the presence of Dr Hammad Owais Agha, Additional Chief Secretary of KP, Mr. Arbab Muhamamd Arif, Home Secretary, Home & Tribal A�airs Department, Mr. Nasir Khan Durrani PSP, Provincial Police O�cer of KP, Mr. Mian Muhammad Asif, Additional IG Police Hqrs Central Police O�ce and other senior o�cials.

“The Forensic Science Laboratory is an important milestone for UNDP Pakistan’s Rule of Law project,” said Country Director, UNDP Pakistan, Marc-André Franche. “It ensures that the police have the capacity to conduct criminal investigations quickly using scienti�c rigour; this speeds up the disposal of cases, improves service delivery and builds trust in the police and the justice system.”

UNDP Pakistan procured laboratory equipment and consumables to bring the laboratory up to international standards. It arranged for specialized training for 14 personnel and 3 M.Phil through the Punjab Forensic Science Agency based in Lahore which is the only state-of-the-art facility in Pakistan.

In addition to the FSL, the Strengthening the Rule of Law project has provided support to the judiciary, promoted alternative dispute resolution, provided capacity support to the police and prosecutors as well as supported legal aid and citizens’ access to justice. One of the project’s key initiatives is to support women in the practice of law which has led to an increased number of women who are now licensed to practice law and provide legal aid.

“The Rule of Law project has already reduced the backlog of cases, helped ensure that even the poorest have access to justice, and rebuilt some of the trust in legal institutions which was sorely lacking,” said Mr Franche. The rule of law is absolutely fundamental to a peaceful, representative society, in which all citizens, even the most marginalized, know that they have access to swift, e�ective and transparent legal services, and we are exploring avenues for further support for this important cause in KP province.”

In 2013, the Government of Khyber Pakhtunkhwa (KP) developed a Strategic Development Partnership Framework (SDPF) as a guideline for government and donor partners. The purpose is to set out shared and individual commitments of the government and donors, provide a basis for discussion of top level strategic priorities, accelerate and expand delivery of programs in the province, and to establish an agreement between the government of KP and major international partners.

The strategy categorizes the provincial government’s vision on: economic growth, peace building and rule of law, improving social service delivery, improving governance, empowering communities by involving them in decision-making processes, improving transparency and accountability by adopting international budgetary standards, expanding �scal space for economic and social development, improving gender equity through new laws and better implementation, and harmonization with the donors’ systems by adopting the Paris Declaration, the Accra Agenda for Action and the Busan Global.

Although the strategy categorizes rule of law and peace as separate objectives, they are in fact cross-cutting in that in order to achieve a secure and conducive environment for the remaining objectives rule of law and security must always be addressed1. The strategy notes that sustained and inclusive economic growth is dependent upon the level of security and justice available to the people.

Rule of law and peace building - priorities for the government:

• Restore people’ con�dence in state institutions by improving security and justice systems.

• Reform the justice system so that access to justice is a�ordable and e�cient.

• Legal empowerment of the poor by reforming formal and informal judicial systems.

• Improve coordination amongst law enforcement agencies.

• Improve e�ciency of law enforcement agencies to face challenges through capacity building and establishment of independent intelligence out�t for the province.

• Make overall security sector reforms to create a capable, well-resourced, structurally coherent and institutionally autonomous policing and law enforcement service.

Gender equality – priorities for the government:

• Addressing the gender inequality through e�ective legislation, implementation and monitoring.

• Including gender equality in sectors’ strategies.

• Increasing women’s representation in senior positions and girl child education to remove gender disparity in health and education services.

Improving citizens’ participation in the decision making – priorities for the government:

• Bring citizens and state closer by improving service delivery and taking operations closer to the citizens.

• Policies and plans implemented at central level face the risk of not re�ecting the actual needs of the citizens, therefore service delivery to be devolved to the lower tiers.

• Disparities among the districts will be removed through a transparent and rule-based system of allocations of resources to districts and entities at sub-district level.

• For community-driven local development, citizens at the grassroots level will be mobilized to form organizations and actively participate in needs assessments, planning, budgeting, execution and monitoring of development activities.
