Pakhtunkhwa] in the Gazette of 8[Khyber Pakhtunkhwa](Extraordinary),dated the

31st January, 2009]

ACT

to provide for the taking over of the Mineral Wing of 9[Khyber Pakhtunkhwa]

Development Authority by Government of the 10

[Khyber Pakhtunkhwa]and to

absorb the employees of the said wing in the Exploration Promotion Division of the

Directorate General of Mines and Minerals, 11

[Khyber Pakhtunkhwa].

WHEREAS it is expedient to provide for the taking-over of the Mineral

Wing of 12

[Khyber Pakhtunkhwa] Development Authority by Government of the 13

[Khyber Pakhtunkhwa] and to absorb the employees of the said wing in the

Exploration Promotion Division of the Directorate General of Mines and Minerals, 14

[Khyber Pakhtunkhwa];

It is hereby enacted as follows:

1. Short title and commencement.---(1) This Act may be called the 15

[Khyber

Pakhtunkhwa] 16

[Khyber Pakhtunkhwa] Development Authority Mineral Wing

(Taking-Over) Act, 2009.

(2) It shall come into force at once.

2. Definitions.---In this Act, unless the context otherwise requires,--

(a) “Appendix” means the Appendix to this Act;

(b) “assets” includes the vehicles, furniture, and other store

items specified in Appendix;

(c) “Department” means the Industries, Commerce, Mineral

Development, Labour and Technical Education Department of

Government;

(d) “Government” means the Government of the 17

Pakhtunkhwa];

(e) “Employees” mean the employees borne on the Mineral Wing

of SDA immediately before the commencement of this Act;

(f) “Mineral Wing” means the Mineral Wing of SDA;

(g) “Prescribed” means prescribed by rules made under this Act;

and

(h) “SDA” means 18

Authority established under section 3 of the 19

[Khyber

Pakhtunkhwa] Development Authority Act, 1972 (20

[Khyber

Pakhtunkhwa] Act No. XI of 1973).

3. Taking-over.---As from coming into force of this Act, the employees shall

stand transferred to, and vest in Government, and the Mineral Wing shall cease to

exist.

4. Transfer of assets and liabilities.---All rights, properties, assets, liabilities,

debts and obligations with regards to the employees or the Mineral Wing, and all

matters and things engaged to be done by, with or for and all suits and other

proceedings by or against, such employees or Wing shall be deemed to be rights,

properties, assets, liabilities, debts and obligations, or as the case may be, matters

and things engaged to be done, by, with or for, and suits and other proceedings by or

against Government.

5. Absorption of employees.---(1) On their transfer under section 3, the

employees shall stand absorbed in the Exploration Promotion Division of the

Directorate General of Mines and Minerals of the Department and shall, for all

intents and purposes, be deemed to be civil servants with effect from the

commencement of this Act:

Provided that their seniority vis-à-vis the employees of the Exploration

Promotion Division of the Directorate General of Mines and Minerals of the

Department shall be determined with reference to regular and continuous date of

appointment of both the employees to the respective cadre/post.

(2) The inter-se-seniority of the employees on their absorption shall

remain the same as they enjoyed during their employment under SDA.

(3) The terms and conditions of service of the employees shall be the

same as admissible to the civil servants; provided that such terms and conditions

shall not be less favorable than those admissible to them under SDA.

6. Indemnity.---No suit, prosecution or other legal proceeding shall lie against

Government or any other person for anything in good faith done or intended to be

done under this Act or any rule or order made thereunder.

7. Removal of difficulties.---For the purpose of carrying into effect the

provisions of this Act, Government shall provide for-

(a) the removal of difficulties, if any, arising out of, or in

connection with, the transfer to, and absorption of, the

employees as aforesaid; and

(b) other matters supplemental or incidental to, or consequential

upon, such transfer and absorption.

8. Provision to over-ride other laws.---The provisions of this Act and the rules

and orders made thereunder shall have effect notwithstanding anything to the

contrary contained any other law for the time being in force.

9. Power to make rules.---Government may make rules for carrying out the

purposes of this Act.

10. Repeal.---The North-West Frontier Province Sarhad Development Authority

Mineral Wing (Taking-Over) Ordinance, 2008 (N.-W.F.P. Ordinance No. XIX of

2008) is hereby repealed.
