527.01 Chairman Bartolini indicated that pursuant to Section 13 of the Open Public Meetings Act, adequate notice of the time and place of this meeting was given by filing with the Authority’s official newspapers, each Clerk of each municipality and by being posted on the Princeton Bulletin Board and on the Authority’s website.

527.02 Approval of Minutes

Chairman Bartolini asked for comments and/or questions on the minutes of the October 26, 2015 Board meeting. Mr. Kantorek indicated that there are several correction to the minutes. On page 4, paragraph 5, line 1, the sentence reads “…in terms of the low monitoring.” The sentence was amended to read “…in terms of the low level monitoring being required by EPA.” On page 5, paragraph 6, lines 1 and 2, a comma was placed after (JIF) and after 2015. On page 11, paragraph 1, line 4 reads “…at the Schwing Bioset facility in Minnesota and investment in spare parts which many spare parts can be used in the new Schwing pumps these reasons alone…” was changed to read “…at the Schwing Bioset facility in Minnesota and also investment in spare parts can be used in the Schwing Pumps. These reasons alone …”. On page 14, paragraph 7, line 3, a comma was placed after the word “letter”. On page 22, paragraph 7, line 3, groups was changed to groups’. The minutes, as amended, were approved on a motion by Dr. Downey, seconded by Mr. Morehouse and passed by a vote of 5 to 0.

527.03 Board Related Activities

Resolution 2015-70, Award of a “No Political Contributions Allowed” Contract for 2016 Labor Counsel Mr. Kantorek indicated that staff received a proposal from Schwartz Simon Edelstein Celso LLC (SSE&C) for labor counsel services for fiscal year 2016. Mr. Kantorek noted that SSE&C has been the Authority’s labor counsel since 2010. The proposed fee schedule indicates an increase in the hourly rates of $5 per hour. This is the first increase in five (5) years. The fees are as follows: Partners and Counsel at $200.00 per hour; Associates $180.00 per hour; and Paralegals and Law Clerks $105.00

Mr. Kantorek recommended approval of Resolution 2015-70, Authorizing the Award of a “No Political Contributions Allowed” Contract for 2016 Labor Counsel to SSE&C. So moved by Dr. Downey, seconded by Mr. Goldfarb.

Mr. Goldfarb expressed his concern that staff should review its firms/consultants on a regular basis. Mr. Goldfarb indicated that there are other law firms and/or consultants that provide the same services who may be just as good. A procedure should be established for a periodic review of the consultants/attorneys.

Resolution 2015-70 was then passed by a roll call vote of 5 to 0. Resolution 2015-70 follows.

Resolution Authorizing the Award of a “No Political Contributions Allowed” Contract for 2016 Labor Counsel

Resolution No. 2015-70

WHEREAS, the Stony Brook Regional Sewerage Authority has a need for a Labor Attorney for the period starting on December 1, 2015 through the end of Fiscal Year 2016 (November 30, 2016) as a contract that does not allow for political contributions to the Authority or its members (“No Political Contributions Allowed” contract) pursuant to the provisions of N.J.S.A. 19:44A-20.4 et seq.; and

WHEREAS, the purchasing agent, Stuart Neuhof has determined and certified in writing that the value of the work will exceed $17,500; and

WHEREAS, the term of this contract is 12 months; and

WHEREAS, Schwartz Simon Edelstein Celso LLC (SSEC) has submitted an Agreement indicating they will provide Labor advice from December 1, 2015 through November 30, 2016. Legal services will be billed at $200.00 per hour for Partners and Counsel; $180.00 for Associates; and $105.00 per hour for Law Clerks; and

WHEREAS, SSEC has completed and submitted a Business Entity Disclosure Certification which certifies that SSEC has not made any reportable contributions to a political or candidate committee in the Stony Brook Regional Sewerage Authority service area, Mercer County, and Middlesex County in the previous one year, and that the contract will prohibit SSEC from making any reportable contributions through the term of the contract; and

WHEREAS, the Stony Brook Regional Sewerage Authority has Funds available in its current budget.

NOW THEREFORE, BE IT RESOLVED that the Board of the Stony Brook Regional Sewerage Authority authorizes the Chairman to enter into a contract with SSEC as described herein; and

Resolution 2015-71, Award of a “No Political Contributions Allowed” Contract for 2016 NJPDES Permit Advice from Kleinfelder Mr. Kantorek indicated that Kleinfelder submitted a proposal for 2016 General Environmental Consulting Services on NJPDES permit (wastewater) and related matters. The work will be billed on time charge basis at an amount not to exceed $30,000. The fee is the same as in 2015. Mr. Kantorek recommended approval of Resolution 2015-71, authorizing the Award of a “No Political Contributions Allowed” Contract for 2016 NJPDES Permit Advice. Mr. Goldfarb questioned the number of this Resolution. The pdf version reflects the number as 2015-72. Staff will correct the pdf version. WHEREAS, the Stony Brook Regional Sewerage Authority has a need for NJPDES Permit Advice and Related Matters for the period starting on December 1, 2015 through the end of Fiscal Year 2016 (November 30, 2016) for our three wastewater treatment plants as a contract that does not allow for political contributions to the Authority or its members (“No Political Contributions Allowed” contract) pursuant to the provisions of N.J.S.A. 19:44A-20.4 et seq.; and,

WHEREAS, the qualified purchasing agent, Stuart Neuhof has determined and certified in writing that the value of the work may exceed $17,500; and,

WHEREAS, Kleinfelder has submitted a proposal indicating they will provide NJPDES Permit Advice and Related Matters during December 1, 2015 through November 30,

2016 for a time charge fee not to exceed $30,000 without written permission from Stony Brook Regional Sewerage Authority; and

WHEREAS, Kleinfelder has submitted a Business Entity Disclosure Certification which certifies that Kleinfelder its subsidiaries, assigns or principals controlling in excess of 10% of the company has neither made a contribution that is reportable pursuant to the Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-8 or 19:44A-16, in the one (1) year period preceding the award of the contract that would, pursuant to P.L. 2004, c.19, affect its eligibility to perform this contract, nor will it make a reportable contributionduring the term of the contract to a municipal political party committee of a governing bodythat appoints members to the Authority including, Princeton, South Brunswick Township,West Windsor Township, Hopewell Borough, Hopewell Township, and Pennington Borough,when the contract is awarded, or to any municipal candidate committee of any candidate foror holder of municipal elective public office of any such municipality when the contract isawarded, and

Resolution 2015-72, Authorizing the Award of a “No Political Contributions Allowed” Contract for 2016 General Counsel

Mr. Kantorek explained that Maraziti Falcon LLP submitted a proposal to provide general legal advice and assistance to the Authority. Mr. Kantorek noted that Maraziti Falcon LLP began serving the Authority as general counsel in 2008. The rate for partners is $220.00 per hour, senior associates $195.00 per hour, associates $170.00 per hour and law clerks $90.00 per hour. The fee for Ms. Alexander for preparation and attendance at the monthly Board meetings will be billed at a fixed monthly retainer of $1,500.00 per month. These rates have remained the same since 2008.

Mr. Kantorek recommended approval of Resolution 2015-72, authorizing the Award of a “No Political Contributions Allowed” Contract for 2016 General Counsel to Maraziti Falcon LLP. So moved by Dr. Downey, seconded by Mr. Goldfarb. Mr. Goldfarb noted that the copy of the Resolution in electronic form has a different resolution number. WHEREAS, the purchasing agent, Stuart Neuhof has determined and certified in writing that the value of the work will exceed $17,500; and


WHEREAS, Maraziti Falcon, LLP has submitted an Agreement indicating they will provide General Counsel advice from December 1, 2015 through November 30, 2016 for a retainer fee of $18,000 and additional legal services will be billed at $220 per hour for Partners, $195 for Senior Associates, $170 for associates and $90 per hour for Law Clerks; and

WHEREAS, Maraziti Falcon, LLP has completed and submitted a Business Entity Disclosure Certification which certifies that Maraziti Falcon, LLP. has not made any reportable contributions to a political or candidate committee in the Stony Brook Regional Sewerage Authority service area, Mercer County, and Middlesex County in the previous one year, and that the contract will prohibit Maraziti Falcon, LLP from making any reportable contributions through the term of the contract; and

Consultant List

Mr. Kantorek indicated that there are seven (7) contracts to be awarded tonight; three which have just been awarded and four (4) contracts in Construction.

527.04 Planning and Administration

Mr. Kantorek reported that the most current 12-month average daily River Road plant flow is 9,045,194 gpd with 869,141 gpd of approved but inoperative flow for a total committed flow of 9,914,335 gpd with 3,145,665 gpd or 24.09% of available capacity. The most current 12-month average daily flow at the Hopewell Plant is 221,648 gpd with 1,200 gpd of inoperative flow, for a total committed flow of 222,848 gpd with 25.72% or 77,152 gpd of available capacity. The Pennington Plant presently has 241,913 gpd as the most current 12-month average daily flow, with 18,252 gpd of approved but inoperative flow, for a total committed flow of 260,165 gpd, with 13.28% or 39,835 gpd of available capacity. Mr. Kantorek noted that the inoperative flow total for the Pennington Plant is the unused portion of Bristol-Meyers Squibb approved flow.

Mr. Kantorek noted that the available capacities are based on the extremely low flows due to the very dry weather conditions.

Monthly Flow Transmittal

The monthly flow transmittal for October was provided for information.

Mr. Kantorek noted that all the billing meters for the month were within the ±2% accuracy. However, there was an issue with the Princeton Farms data.

Review of the meter data at Princeton Farms indicated that the flow data from October 18th through October 27th seemed abnormally high (resulting in an abnormally low flow for Hopewell Borough). The pump(s) at the Princeton Farms Pump Station operate on an on/off cycle based on the wet well level. Typically during any one-hour, the minimum flow is zero when the pump is off. Review of the hourly data indicated that there was no zero minimum

flow recorded during the time period between the 18th through the 27th. This is an indication that there may be some flow leaking back from the valve and being metered twice.

Staff reviewed the Princeton Farms hourly flow data from September 2015. This data indicated hourly minimum flows of zero. Staff calculated the percent flow of Princeton Farms to the influent flow from the Hopewell STP which is 26%. The flow data from October 18th through October 27th was replaced with 26% of the Hopewell STP influent flow.

Staff contacted Mr. D. Gerrard, Hopewell Township Department of Public Works, indicating that there may be an issue with a valve at the pump station. Dr. Downey noted that she is following up with the Hopewell Township Administrator.

527.05 Approval Requests and Actions

TWA-1 Approvals

Stowe Residence, 312 North Main Street, Block 47, Lot 3, Hopewell Township

Ms. Pchola reported that this application is for the abandonment of an individual on-site septic system and connection to the Pennington sewer service area via a grinder sewage pump and approximately 700 feet of discharge piping. The property was included in the 2009 amendment to the Mercer County Water Quality Management Plan which included certain properties in Hopewell Township adjacent to Pennington Borough. The flow associated with this application is 300 gpd for the existing 5-bedroom residential dwelling.

Staff recommended approval of this application. So moved by Dr. Downey, seconded by Mr. Compton and passed by a vote of 5 to 0.

527.06 Regulatory Report

Discharge Monitoring Report (DMR)

Mr. Rahimi reported that staff is in the process of preparing the Discharge Monitoring Reports for the month of October.

Mr. Rahimi indicated that the River Road Quarterly Effluent Surface Water Discharge Waste Characterization Report was submitted for the quarter ending October 31, 2015. This report provides data for a select list of nine priority pollutants which have been historically detected in the plant’s effluent.

Residual Discharge Monitoring Report

Mr. Rahimi reported that the August Residuals Discharge Monitoring Reports were submitted to NJDEP. All River Road parameters were compliant with the Authority’s Air Permit requirements.

Mr. Rahimi noted that staff is currently preparing the September RDMR.

Air Reporting

Mr. Rahimi reported that the 3rd quarter Incinerator Sludge Report was submitted to NJDEP. No exceedances were reported for the monthly and rolling-12-month averages for metals in the sludge fed to the incinerator.

Mr. Rahimi indicated that the 3rd quarter 2015 Excess Emissions and Monitoring Performance Report was submitted to the NJDEP. Incinerator #2 operating with the Afterburner (OS3) had 1.33 hours of non-compliant oxygen levels (oxygen below 3%). A low oxygen average alone is not the basis for violation unless the carbon monoxide (CO) concentration is above 100 ppmdv at 7% oxygen during the same periods. The CO concentration was less than 100 ppmdv during the period when the oxygen fell below 3%.

Mr. Rahimi noted that a “NOTICE OF VIOLATION” was received from NJDEP (Division of Air Enforcement) regarding a missed visual emission inspection in February 2015. A copy of the violation was provided to the Board. This violation was reported in the August 2015 regulatory report. No penalty has been assessed for this violation.

Laboratory

Mr. Rahimi reported that Laboratory staff attended a demonstration of a low level Chlorine amperometric titrator by Mettler Toledo at Rockaway Valley Sewerage Authority. This instrument did not operate as required by the Standard Method. Further method validation is needed by Mettler Toledo.

527.07 Safety

Mr. Irizarry reported that there were no lost time accidents/injuries for this reporting period.

Mr. Irizarry indicated that as of November 6, 2015 Stony Brook Regional Sewerage Authority has gone 1520 consecutive days without a “Lost Time Accident”.

Mr. Irizarry reported that on July 31st and August 3rd the annual fire alarm inspection was conducted for the River Road WWTP and the Princeton Pump Station. Staff has received the report and the repairs of the two deficiencies noted on the report have been made. The deficiencies were:

1. Cake Building-horn/strobe by north landing did not activate when tested2. Sludge Receiving Station-Fire alarm control panel battery failed

Mr. Irizarry noted that staff is looking into having fire alarm monitoring added to both the Upstream Plants. Staff has prepared draft specification documents and are continuing to review them.

Mr. Irizarry reported that on November 2, 2015 the Joint Insurance Fund (JIF) conducted an inspection of the Princeton Pump Station, the spill containment chamber, the front gate and the front steps of the main entrance for River Road. Staff is waiting for the report.

Mr. Irizarry indicated that on November 6, 2015 the annual fire extinguisher inspection was conducted by Survivor Fire for the River Road, Hopewell and Pennington plants and all three Pump Stations.

Mr. Irizarry reported that training for this reporting period included:

● Fire Safety training was provided in-house on November 5, 2015 for three (3)employees.

● Fall Protection training was provided in-house on November 5, 2015 for six (6)employees.

● Storm-water Pollution Prevention (SPPP) and Spill Prevention Control andCountermeasures (SPCC) was provided in-house on November 5, 2015 for six(6) employees.

527.08 Litigation

The Litigation Report was provided for information. Ms. Alexander indicated that there were no changes this month to the Litigation Report.

527.09 Operations Report River Road Facility Mr. Kunert reported that on October 25, 2015, the emergency generators at the River Road Facility, South Brunswick Pumping Station, and the Princeton Pumping Station ran for approximately two hours due to downed power lines. Mr. Kunert indicated that the Industrial Furnace Company (IFCO) de-slagged the off line incinerator during the week of October 26, 2015. A subsequent inspection was performed by Chavond-Barry A draft report was received and there may be a possibility that Hearth #1 may need to be replaced. Mr. Kantorek indicated that this is important since the new scrubber is being installed on Incinerator #2. The Authority needs at least one incinerator to be operable. In addition, the Authority needs to be in compliance with the new EPA rules by March 2016. A brief discussion regarding the Authority’s options for the repair of the hearth, if necessary, followed. Mr. Kunert reported that SBRSA has stopped adding Potassium Permanganate to the influent flow due to the drop in hydrogen sulfide levels entering the River Road Facility. This decrease is most likely due to the cooler temperatures. The system set up will remain in place should it be needed again before winter. Mr. Kunert indicated that on Thursday, November 12, 2015, the Authority was without power for approximately four (4) hours. This shutdown was necessary as part of the new emergency generator project. The incoming wastewater was held in two empty tanks during this four (4) hour period. The tanks were dewatered back to the head of the treatment process when the shutdown was completed. This process will be repeated on November 19th. Upstream Facilities Mr. Kunert explained that the restoration of the area that was excavated for the repair of the force main at the Pennington Facility has begun. Staff took this opportunity to hire landscapers to regrade the disturbed property on the east side of the building in an effort to rectify a water drainage problem. In the past, during heavy rains, this area became flooded causing stormwater to flow into an electrical manhole which followed the electrical conduit entering the pump room on the 2nd level. The landscapers dropped the level of the storm

sewer grating and created a swale approximately 15 feet wide from the entrance of the plant leading up to the storm water catch basin. This should prevent this area from flooding as it has frequently done in the past.

Odor Report

Mr. Kunert reported that staff received three odor complaints during the month of October. One odor complaint has been received for the partial month of November.

Customer Septage and Sludge Deliveries

The quantity of liquid sludge exceeded its budgeted amount while sludge cake and gray water were below their budgeted amounts for the month of October.

527.10 Maintenance

Mr. Ireland reported that Schwing Pump #5 was taken out of service on October 21, 2015 to replace the gear box, worn tail shaft bearings, the bearing housing and two badly worn feed screws. This Schwing Pump is used to move dewatered sludge from Belt Press #1 to the Storage Bin.

Mr. Ireland indicated that on October 27, 2015 Orbal Tank #1, Drive #2 at the Hopewell Facility failed several times on motor overload. After further investigation it was discovered that the wiring connections for the motor had worn through the insulation causing the motor failure. During that down time staff took the opportunity to also replace a damaged drive bearing and worn housing. Once the repairs were completed, the drive was tested and placed back into operation.

Mr. Ireland reported that on November 4, 2015 two six-inch chain operated plug valves, which became difficult to operate over time on M.A. Scum Pumps #1 & #2 were replaced. The new valves were installed on the discharge side of both pumps and came equipped with grease fittings to help improve their service life.

Mr. Ireland indicated that on November 7, 2015 Schwing Pump #4 was removed from service because one of the two sludge feed screws in the storage bin that feeds dewatered sludge to Schwing #4 became inoperable. It was determined that the tail shaft bearing failed on the drive screw which caused the teeth on the gear to skip and cause considerable wear. Both the bearing and the gear were replaced, the screws were tested and placed back in service.

The number of open work requests stand at ten (10). The Preventive Maintenance graphs show that SBRSA is currently averaging two (2) days overdue and the number of overdue units is approximately twenty-two (22).

527.11 Construction Report

2016 General Advice Ms. Pchola reported that staff requested proposals from Kleinfelder, AECOM, CBE, and KEMS for the 2016 Annual Advice Contracts. Copies of the proposals were provided to the Board. All contracts are on a time charge basis. Each consultant has provided the required pay to play forms. A comparison chart for the consultants provided the 2015 contract amounts, what was spent through the end of October for each contract and the 2016 contract amounts.

Upstream Facilities Process Evaluation/Planning Study

Ms. Pchola indicated that the Pennington Plant draft report is still under Kleinfelder’s internal review. It is expected that both the Pennington and Hopewell draft reports will be provided to SBRSA by the end of November.

Information Technology Management Services

Ms. Pchola indicated that on November 3, 2015 staff and EMA’s IT Manager, Mr. Bob Reilly, met with Millennium Communications Group, Inc. to discuss the new/updated cabling for the IT system and provided a walk-through of the Operations Building and plant site. Millennium Communications Group, Inc. is listed on the State of New Jersey Department of Treasury State Contracts to provide cabling services. Ms. Pchola indicated that staff did receive a quote from Millennium on November 16, 2015 but has not yet reviewed it.

Ms. Pchola reported that staff met with Mr. Reilly to review the SBRSA Draft IT Charter and IT Policies. Mr. Reilly will revise the documents based on SBRSA’s review comments. The revised documents will be provided to the Board at the December Board meeting.

KEMS 2015 Annual Advice

Ms. Pchola reported that a new pre-draft permit was received from NJDEP on November 5, 2015 with comments due no later than November 20, 2015. NJDEP indicated that they would include the major modification requests for the new scrubber, actual data for the new natural gas emergency generator and the new ash handling equipment in the new pre-draft permit.

NJDEP has decided not to meet with SBRSA to discuss the health risk screen but will include language in the draft Title V permit to address the issue. As discussed with KEMS, NJDEP has indicated that the new language in the permit will indicate that the current emissions are outside the range of the acceptable cancer risk and that SBRSA will have one-year from the date the permit is issued to provide an acceptable plan to NJDEP as to how SBRSA will mitigate these risks.

A brief discussion regarding modeling and air permit parameters followed.

Schwing Pump Replacement Project

Ms. Pchola reported that GHD was on site November 16, 2015 for the kickoff meeting for this project.

Contract 10-1 Headworks Project

Ms. Pchola indicated that Kleinfelder and SBRSA are continuing to compile documents, emails, meeting minutes, memorandums, etc. requested by Authority Counsel relative to the issues raised by Tomar in their last letter.

Mr. Goldfarb asked if the Authority was going to mediation. Ms. Alexander indicated that SBRSA and Tomar are further apart on a resolve. It is important that SBRSA compiles its documentation prior to entering mediation.

Contract 14-1 SBRSA Emergency Generator Project

Ms. Pchola reported that Thomas Controls Inc. (TCI) received the building permit from Princeton on October 28, 2015. TCI mobilized and began construction activities. The first phase to be completed is the relocation of several existing conduits and wire and the relocation of the fuel day tank for the existing emergency generator. The relocation work will require two (2) planned process interruptions to allow for the temporary generator to be installed while the relocation work is being performed.

Ms. Pchola indicated that on October 27, 2015, TCI informed SBRSA that TCI would not be performing the electrical work and would be hiring an electrical sub-contractor. The bid submitted by TCI listed Thomas Controls Inc. as the named electrical sub-contractor. Since TCI had named themselves as the electrical sub-contractor, SBRSA asked TCI to provide the Authority with a letter formally indicating the change of the electrical sub-contractor and to provide the business registration certificate and public works contractor certificate for the new sub-contractor, CNN Electrical Contractors, LLC.

Ms. Pchola explained that since this project is funded by the New Jersey Environmental Infrastructure Trust “Trust”, SBRSA contacted the NJDEP to see if they would take exception to the change in a named sub-contractor. The NJDEP representative of the project stated that from his prospective, he did not see a problem with the change but asked that staff review this with our attorney and have them provide an opinion. Staff contracted Mr. Brent Carney, Esq. of Maraziti Falcon, L.L.P and after some discussion the following conclusion was reached.

Pursuant to an Appellate Division holding in O’Shea v. New Jersey Schools Construction Corporation, 388 N.J. Super. 312 (App. Div. 2006), the Local Public Contracts Law, N.J.S.A. 40A:11-16, precludes the substitution of a subcontractor not named in the bid. However since TCI named themselves as the electrical sub-contractor, the local public contract law does not prevent a sub-contractor from hiring a sub-contractor themselves. Essentially Thomas

Controls Inc., the named electrical sub-contractor is hiring a sub-contractor to perform their work. An action not disallowed under the law.

Mr. Morehouse asked if TCI has been providing SBRSA with shop drawings. Ms. Pchola indicated that they have been submitting shop drawings but have had difficulty in receiving the building permits. TCI has still not received the building permit from West Windsor Township. A brief discussion regarding TCI’s progress followed.

Contract 15-1 Scrubber Procurement

Ms. Pchola reported that EnviroCare International (ECI) has completed modifications to the PLC logic to correct minor issues, and revisions to the Operations & Maintenance manual based on as-built conditions. ECI is waiting for the performance test results from Avogadro which are expected by the end of November.

Contract 15-2, Scrubber Installation

Ms. Pchola reported that as of Pay Estimate No. 7 this project is approximately 82% complete. During the past reporting period Centerpoint Associates Inc. (CPA) began the installation of Scrubber #2. The existing scrubber was demolished and removed from the building, existing floor openings and conduits were modified for the new scrubber, and all sections of the new scrubber have been brought into the building and staged. The first scrubber section has been set into place. CPA has tentatively scheduled the performance test for Scrubber #2 for mid-January.

Contract 15-3, Ash Handling System Improvements

Ms. Pchola reported that on November 5, 2015 BR Welding, GHD, SBRSA, and representatives of the equipment supplier, Thomas and Muller, met at the site to review actual site conditions and obtain field measurements. BR Welding has begun submitting shop drawings and will provide the shop drawing submittals for the major equipment within the next few weeks.

Instrument Air Compressor Replacement

Ms. Pchola reported that the project was advertised on November 9, 2015. The pre-bid meeting was held on November 16, 2015. Bids will be received on December 9, 2015.

MA Effluent Channel Mixers

Ms. Pchola indicated that Kleinfelder has completed the mechanical design for the mixers and is currently waiting for AECOM to complete the design of the structural modifications.

Carbon Monoxide Analyzer Replacement

Ms. Pchola reported that on October 27, 2015 SBRSA submitted the performance test protocol (PST) to the NJDEP Bureau of Technical Services for review and approval. Once the protocol is approved the two new CO analyzers will be ordered.

Information Technology

Mr. Hess indicated that the Pennington and Hopewell SCADA upgrade screens are approximately 85% complete.

Mr. Hess reported that with the assistance of Operations staff, SBRSA is in the process of converting the Operations storeroom adjacent to the Assistant IT Manager’s Office into a new server room. Maintenance has repaired the roof leaks that were directly above that room.

Mr. Hess indicated that staff has begun migrating the Active Directory servers from MS Windows Server 2003 to 2012 R2. This work should be completed by November 20, 2015.

Mr. Hess reported that staff replaced the uninterruptable power supply (UPS) suppling power to most of the computer and networking equipment in the CEMS room with a new unit.

Mr. Hess noted that the staff continues to work with EMA on improving IT policies, procedures, and infrastructure

Treasurer’s Report

Mr. Neuhof reported that net income for the ten-month period ending September 30, 2015 is $807,752. This represents a decrease of $36,460 over the prior period and is due to additional repairs including the emergency repairs at the Pennington STP. The Authority has total cash and investments of $18,996,740 at an average interest rate of 0.26%. The current construction projects balance is $16,770,476. Mr. Neuhof noted there are sufficient funds for these projects. The outstanding bond principal balance remains at $23,649,523. The New Jersey Cash Management Fund yield is 0.15%.

Resolution 2015-65, Authorizing the Award of a “No Political Contributions Allowed” Contract for Non-Professional Service Vendors

Mr. Neuhof explained that Resolution 2015-65 is for vendors who are likely to exceed the $17,500 Pay to Play limit but will not exceed the bid threshold amount by the end of the fiscal year. Two vendors are listed on the Resolution: Hach Company, which supplies parts for the DO Analyzers and AW Cheston Company who supplies pump seals.

2016 Estimated Participant Charge

Mr. Neuhof provided the Board with a copy of the 2016 Estimated Participant Charge based on eleven months of flow. This was also provided to the Municipal Chief Financial Officers.

Mr. Neuhof reviewed the summary of charges and the Year End figures based on eleven months of flow.

Monthly Sludge Business Analysis

Mr. Neuhof reported that net income for the month of October is $79,434 and the cumulative net income is $1,372,162. Gas usage for the month of October was 86,169 therms. The remaining simple payback for the RTO project is 2.02 years.

RESOLUTION TO ADOPT THE 2016 RATE SCHEDULE

Resolution No. 2015-77 Dated: December 21, 2015

WHEREAS, the Stony Brook Regional Sewerage Authority (hereinafter the Authority or SBRSA) is authorized by the Sewerage Authorities Law, and particularly N.J.S.A. 40:14A-7(11), to make and enforce rules and regulations for the management and regulation of its affairs and for the use, maintenance and operation of the sewerage system of the Authority, and to amend the same from time to time; and

WHEREAS, the Authority is authorized, when necessary and desirable, pursuant to N.J.S.A. 40:14A-8, to charge and collect rents, rates, fees or other charges in the nature of use or service charges, based or computed on various factors Aor on any combination ofany such factors, and may give weight to the characteristics of the sewage and other wastes and any other special matter affecting the cost of treatment and disposal thereof, including chlorine deemed, biochemical oxygen deemed, concentration of solids and chemical composition [N.J.S.A. 40:14A-8(b)]; and

WHEREAS, the Authority desires to establish a Rate Schedule for 2016 so as to provide for the direct assessment and recovery of charges to Users discharging liquid sludge, sludge cake, septage, gray water, special wastes (Industrial Users) and high strength wastewater surcharges, as set forth in the 2016 Rate Schedule, attached hereto; and

WHEREAS, a notice of the 2016 Rate Schedule was published in accordance with the requirements of N.J.S.A. 40:14A-8, and public hearing held on December 21, 2015 at 7:30 PM, at the offices of the Authority, 290 River Road, Princeton, NJ, at which time the Authority solicited public comment on the proposed regulation.

NOW, THEREFORE, BE IT RESOLVED by the Stony Brook Regional Sewerage Authority as follows:

1. The 2016 Rate Schedule, attached as Exhibit A hereto and made a part hereof,is hereby adopted. Any and all bills issued by the Authority by reason of thisregulation shall be due and payable by the recipient within 30 days of the datethereof upon the failure of which the Authority shall be authorized to assessinterest at the rate then in effect pursuant to N.J.S.A. 40:14A-21.

2. If any provision of this resolution or the application thereof to any person orcircumstance is held invalid by a court of competent jurisdiction, such invalidityshall not affect any other provision of the resolution and to this end theprovisions of this resolution are declared to be severable.

3. This Resolution shall take effect as provided by law.

SUBJECT: Monthly Flow Transmittal for the Month of November 2015

The meter verification was conducted by Staff on November 2, 2015. All billing meters

were within ±2% accuracy and therefore no meter adjustments were required.

Princeton Pump Station: Review of the Princeton Pump Station hourly meter data

from November 25th through November 30th indicated that there were periods of time

when the meter was reading zero.

Typically the flow from North Ridge is approximately 10% of the Princeton Pump

Station flow. The North Ridge average percent flow to the Princeton Pump Station flow

from November 1st through November 24th was approximately 10.9%. Therefore the flow

for the Princeton Pump Station from November 25th through the 30th was calculated

using the average percent flow of the North Ridge Meter to the Princeton Pump Station

flow.

Continued review of the hourly flow data into December indicated that the issue with the

zero hourly flows continued. The SBRSA Instrumentation Technicians went to

troubleshoot the meter on December 7th and determined that the low range meter was

being bypassed and only the high range meter was recording data. Based on the range

and configuration of the high range meter when the flows reached a specific low level the

signal dropped to zero. The faulty instrumentation has been replaced. Based on review

of the early morning hourly flow data on December 8th it appears that the issue has been

resolved.

Meter Station No. 7: The hourly flow data starting on November 19th at 3:00 p.m. and

continuing through November 20th at 7:00 a.m. was reading a steady 0.5 mgd indicating

an issue with the meter. The data for those two days was replaced with the average of

November 18th and November 21st.

Princeton Farms: Due to the issue last month with the possibility of the check valves

remaining partially open, staff reviewed the hourly data for low to zero flows. Typically

on dry days at least once per hour the flows at the pump station are zero (the pump(s) at

the Princeton Farms PS operate on an on/off cycle based on the wet well level).

However on November 24th and 25th the minimum hourly flows rates were between

1,500 gpd to 26,000 gpd therefore indicating as issue with the valves and resulting in

artificially higher flows at the pump station.

The flow for Hopewell Borough is calculated by subtracting the Princeton Farms meter

data from the Hopewell STP influent meter data. The Princeton Farms meter data was

adjusted by first adjusting the Hopewell Borough flow. The Hopewell Borough flow

was replaced for November 24th and 25th with the average of the day before and the day

after. This data was then subtracted from the Hopewell STP flow to determine the

Princeton Farms flow for those two days.

REGULATORY REPORT December 2015

A. Discharge Monitoring Report (DMR)

The Discharge Monitoring Reports for the month of October were submitted with no violations reported.

The November DMRs are currently being prepared.

B. Residuals Discharge Monitoring Report (RDMR)

The September Residuals Discharge Monitoring Reports were submitted. All River Road parameters were compliant with the Air Permit requirements.

The October RDMRs are currently being prepared.

C. Air Reporting

The stack test for Incinerator No. 1 started on December 8 and will continue through December 22, 2015.

D. Laboratory

On Sunday November 29, 2015 the pH meter at Pennington treatment plant malfunctioned resulting in pH of the Influent and Effluent not being analyzed. SBRSA permit requires once a day pH reporting at this facility. An affirmative defense was sent to NJDEP central enforcement on December 9, 2015 (copy is attached).

E. Miscellaneous

The Quarterly Capacity Assurance Program report for the period September 1, 2015 through November 30, 2015 was submitted to NJDEP on December 11, 2015. A copy of this report is attached.

SAFETY REPORT December 2015

There were no lost time accidents/injuries for this reporting period. Attached is an up to date graph (2006-December 15, 2015) that depicts lost time accidents and the number of no loss time accidents/injuries as well. As of December 15, 2015 Stony Brook Regional Sewerage Authority has gone 1559 consecutive days without a “Lost Time Accident”. Attached is a picture of the digital lost time accident scoreboard. Staff prepared the attached summary table that details all injuries/accidents that have occurred from 2005 through October 2015. Staff has prepared the draft specifications for fire alarm monitoring at both Upstream Plants. The documents are under in-house review. On November 2, 2015 the Joint Insurance Fund (JIF) conducted an inspection for Princeton Pump Station and the spill containment chamber, front gate and front steps of the main entrance for River Road. Staff is still awaiting the report. On November 20, 2015 the annual fire inspection was conducted at the Hopewell and Pennington Plants (see attached report). Two issues were identified: 1. Fill the penetrations in the ceiling of the Chemical Room at Hopewell STP with fire rated material and 2. Add a hazard sign to the side of the tank facing the entrance to the plant site at the Pennington STP. Both issues were taken care of and the fire official is scheduled to come back out on December 18, 2015 to confirm. Staff held its quarterly Safety Meeting. Minutes are attached. Training for this reporting period included:

● Fire Safety training was provided in-house on December 2, 2015 for 8 employees.

● Fall Protection training was provided in-house on December 2, 2015 for

4 employees. ● HAZCOM (Right to Know) training was provided in-house on

LITIGATION SUMMARY

I. River Road Wastewater Concerns The final NJPDES permit received on January 26, 2006 includes a 0.1 mg/L monthly phosphorus limit, effective January 1, 2011. A “Request for Hearing” was filed with the NJDEP on February 24, 2006 to contest this limit and several other smaller items. On March 11, 2007, a letter was received from Nancy Wittenberg, Assistant Commissioner, indicating that in recognition of the fact that the TMDL based phosphorus limits will soon be available, the Department has granted a Stay of the (not yet effective) phosphorus limit until further notice. On March 28, 2007, the Bureau of Point Source Permitting sent a follow-up letter, which included all three plants and indicated that the phosphorus limits will be stayed until further notice. NJDEP has expressed its intent, to Judge Masin, to issue a draft and final permit for the River Road facility in 2012 and has requested that the pending request for an adjudicatory hearing be placed upon the inactive list for six (6) months, which was granted on June 8, 2012.

A telephone status conference before Judge Masin was held on August 26, 2013 wherein the judge again placed the matter on the inactive list for six (6) months in order that the parties could pursue rulemaking to address issues raised in the hearing request. This action was undertaken at the request of Kristen D. Heinzerling, DAG, representing the NJDEP. A meeting between representatives of the SBRSA and NJDEP was held on January 16, 2014, wherein the status of the TMDL and outstanding issues were discussed and a plan for resolution of the outstanding issues was proposed. A meeting regarding the remaining outstanding issues was held on September 17th, 2014 with representatives of the NJDEP. Agreement was reached on the issues of Phosphorus and how SBRSA would measure its influent flows. The Pretreatment related issues had been resolved through a permit modification and are no longer an issue. The contested issues relevant to SBRSA’s blending line and the Infiltration/Inflow requirements remain an issue as NJDEP is currently discussing the fate of blending lines with USEPA in the context of Combined Sewer Overflows (CSOs) and therefore this issue cannot be resolved at this time. Unless SBRSA agrees to delete references to blending line use from its permit and rely upon enforcement to grant affirmative defenses, if applicable, this issue will remain outstanding and subject to further litigation. NJDEP further advised that Nitrate effluent limitations would be established in the upcoming permit renewal. Judge Masin has retired and the matter transferred to the Honorable Lisa James-Beavers. ALJ. A telephone status conference has been scheduled for April 28, 2015. A meeting with NJDEP was held on May 5, 2015, wherein blending during periods of excessive wet

weather was discussed. The NJDEP advised regarding the position of the USEPA regarding blending, both on a permanent and temporary basis. USEPA and NJDEP approval would be needed for SBRSA to obtain a permit that contains a provision allowing the bypass of secondary treatment during excessive wet weather events. In order to obtain approval, a No Feasible Alternatives Analysis process must be followed and the NJDEP provided guidance regarding this process. On September 9, 2015, NJDEP issued a Preliminary Draft Surface Water Renewal Permit for the River Road facility. This renewal carries forward the unresolved blending line issue from the previous permit. New issues include Nitrate; Removal of the Quantification Levels and Sufficiently Sensitive Test Methods, particularly with respect to Chlorine Produced Oxidants; calculation of the Chlorine Produced Oxidant limitations; Chlorodibromomethane and Bromodichloromethane limitations, E. Coli effluent limitations, the Capacity Assurance Program provisions and provisions regarding evaluation of Local Limitations for Chlorodibromomethane and Bromodichloromethane. Comments regarding the issues raised in the Preliminary Draft will be submitted to the NJDEP on September 25, 2015. A status conference with the Honorable Lisa James-Beavers, ALJ, Kristen Heinzerling, DAG and her successor, Yin Zhou, DAG, was held on September 9, 2015, wherein the issuance of the preliminary draft permit was briefly discussed. The next telephone status conference has been scheduled for October 10, 2015. At that time, Mark Collier, DAG will represent the NJDEP.

II. Hopewell NJPDES Permit Concerns NJDEP issued a draft permit for the Hopewell plant on July 21, 2011. The terms and conditions of the draft permit were not consistent with the prior discussions between the parties, and while the Phosphorus limitation is revised to monitor and report only, the Nitrate and Copper issues are carried forward in the permit action unchanged. As such, comments contesting the inclusion of Nitrates and Copper limitations, as well as comments regarding other minor issues, were prepared and submitted to NJDEP on September 6th during the public comment period. Comments were also submitted to the NJDEP on behalf of other interested parties, including resolutions in opposition to the permit conditions adopted by several municipalities served by the SBRSA, accompanied by a request for a public hearing. Comments in support of the draft permit were submitted to NJDEP on behalf of the Stony Brook Millstone Watershed Association supporting the Draft Permit limitations and conditions, as proposed, for TDS and Copper, which limitations SRBSA and its member municipalities contested. Further, the Association expressed its concern regarding the determination made by the NJDEP not to establish an effluent limitation for Phosphorus at this time.

NJDEP granted to the interested parties (municipalities served by the SBRSA that requested a public hearing on the permit conditions) a hearing on the issues raised in the Draft Permit. This public hearing was held on November 16, 2011. Judge Masin granted the request to place the pending adjudicatory hearing request on the inactive list on June 8, 2012.

A telephone status conference before Judge Masin was held on August 26, 2013 wherein the judge again placed the matter on the inactive list for six (6) months in order that the parties could pursue rulemaking to address issues raised in the hearing request. This action was undertaken at the request of Kristen D. Heinzerling, DAG, representing the NJDEP. A meeting between representatives of the SBRSA and NJDEP was held on January 16, 2014, wherein the status of the TMDL, status of the proposed rulemaking to address nitrate limitations and the remaining contested issues were discussed. A plan for resolution of the outstanding issues was proposed to resolve the Phosphorus and Copper issues. A surrogate parameter was proposed to replace the TDS parameter contained in the current permit and a stay pending rulemaking was proposed relative to the Nitrate limitation. I have been advised by DAG Heinzerling that NJDEP intends to issue the final permit immanently to close out the old 2004 Permit and to allow any remaining contested issues to go forward under a new Permit and new docket. Upon issuance of the Final Permit, the prior permit would become moot and it would be necessary to withdraw SBRSA’s pending permit appeal relevant to the 2004 Permit and file a Request for an Adjudicatory Hearing on the new permit to preserve its right to challenge any contested permit parameters. A stakeholder meeting was held on June 17, 2014 to discuss a potential draft proposal to establish a new method of implementing the nitrate criterion based on Tiered Drinking Water Uses. NJDEP explained that it had convened a working group consisting of representatives from water and wastewater facilities, EPA, DOL and DEP to discuss alternative approaches. Based on the discussion with the workgroup, the Department arrived at an alternate approach to protect drinking water intakes. The proposal includes an alternate point of application for applying the nitrate criterion, and a new requirement for water purveyors to sample the raw water at their potable water intakes to determine actions to be required to be undertaken by upstream wastewater dischargers. On July 1, 2014, NJDEP issued a Final Surface Water Renewal Permit for the upstream Hopewell facility. The final permit and draft major modification are currently being reviewed for other miscellaneous issues that might have been included. On August 4, 2014, a Request for Hearing and Stay of the contested permit limitations was filed on behalf of the SBRSA. The issues identified included: Nitrate and Capacity Assurance Program Implementation. Copper was also contested to preserve SBRSA’s right to challenge the Copper effluent limitation in the event that the Major Modification is not adopted as proposed. On November 7, 2014, NJDEP issued the final permit action (major modification) with respect to the final Copper limitation. The Copper limitation, and the sludge quality and quantity monitoring and conditions, have been removed. Judge Masin has retired and the matter transferred to the Honorable Lisa James-Beavers. ALJ. A telephone status conference has been scheduled for April 28, 2015. As the new permit issued on July 1, 2014 has rendered the issues raised in the pending litigation moot, SBRSA will withdraw the matter currently pending before Judge James-Beavers without prejudice as to those claims plead in the Request for a Hearing filed on August 4, 2014. By letter dated September 9, 2015, SBRSA withdrew the prior litigation without prejudice as to those claims plead in the Request for a Hearing filed on August 4, 2014. A status conference with the Honorable Lisa James-Beavers, ALJ, Kristen Heinzerling, DAG and her successor, Yin Zhou, DAG, was held on September 9, 2015, wherein the issues relevant to the Final Permit, as well as, NJDEP’s proposed schedule for the adoption of rulemaking to resolve the outstanding contested issues, was discussed. The DAGs for the NJDEP advised Judge James-Beavers that NJDEP anticipates that the Tiered Use Rule will be adopted by the end of 2016. The next telephone status conference has been scheduled for October 10, 2015.

III. Pennington NJPDES Permit Concerns NJDEP issued a draft permit for the Pennington plant on July 21, 2011. The terms and conditions of the draft permit were not consistent with the prior discussions between the parties, and while the Phosphorus limitation is revised to propose monitor and report only, the other issues of concern are carried forward in the permit action unchanged. These issues are: Nitrate; Arsenic; TDS; Dichlorobromomethane and Copper limitations; as well as, other issues relevant to summer and winter ammonia limitations; TSS winter limitations and miscellaneous issues, including that the compliance schedule identified to allow SBRSA to come into compliance with all new limitations is insufficient and should be extended to 59 months, at the very least. Meetings and discussions between AEA representatives and the NJDEP have been held wherein the issue of nitrates and the other drinking water related parameters included in the SBRSA permit were discussed, particularly with regard to the impact of the

regulation of these pollutants upon the Pennington facility. All in attendance and involved believe that the concerns were received in a manner that appears will be favorable to SBRSA. Additional smaller group meetings to specifically discuss these issues are planned between AEA representatives and NJDEP, and it appears that this view of the regulation of drinking water based parameters in a manner that is favorable to a reasonable and appropriate remedy of the issue, however, at this time no formal action has been proposed by NJDEP to change the existing regulatory requirements. As the revisions requested were not made, and no regulatory action has been forthcoming, comments contesting these limitations and conditions were prepared and submitted to NJDEP on September 6th during the public comment period. Comments were also submitted to the NJDEP on behalf of other interested parties, including resolutions in opposition to the permit conditions that were adopted by several municipalities served by the SBRSA, accompanied by a request for a public hearing. Comments in support of the draft permit were submitted to NJDEP on behalf of the Stony Brook Millstone Watershed Association supporting the Draft Permit limitations and conditions, as proposed, for Arsenic Nitrogen, TSS and Copper, which limitations SBRSA and its member municipalities contested. Further, the Association expressed its concern regarding the determination made by the NJDEP not to establish an effluent limitation for Phosphorus at this time. NJDEP granted to the interested parties a hearing on the issues raised in the Draft Permit, which was held on November 16, 2011. Judge Masin granted the request to place the pending adjudicatory hearing request on the inactive list on June 8, 2012.

A telephone status conference before Judge Masin was held on August 26, 2013 wherein the judge again placed the matter on the inactive list for six (6) months in order that the parties could pursue rulemaking to address issues raised in the hearing request. This action was undertaken at the request of Kristen D. Heinzerling, DAG, representing the NJDEP. A meeting between representatives of the SBRSA and NJDEP was held on January 16, 2014, wherein the status of the TMDL, status of the proposed rulemaking to address nitrate limitations and the remaining contested issues were discussed. A plan for resolution of the outstanding issues was proposed to resolve the Phosphorus and Copper issues. A surrogate parameter was proposed to replace the TDS parameter contained in the current permit and a stay pending rulemaking was proposed relative to the Nitrate limitation. Arsenic and Dichlorobromomethane remain issues. I have been advised by DAG Heinzerling that NJDEP intends to issue the final permit immanently to close out the old 2004 Permit and to allow any remaining contested issues to go forward under a new Permit and new docket. Upon issuance of the Final Permit, the prior permit would become moot and it would be necessary to withdraw SBRSA’s pending permit appeal relevant to the 2004 Permit and file a Request for an Adjudicatory Hearing on the new permit to preserve its right to challenge any contested permit parameters.

A stakeholder meeting was held on June 17, 2014 to discuss a potential draft proposal to establish a new method of implementing the nitrate criterion based on Tiered Drinking Water Uses. NJDEP explained that it had convened a working group consisting of representatives from water and wastewater facilities, EPA, DOL and DEP to discuss alternative approaches. Based on the discussion with the workgroup, the Department arrived at an alternate approach to protect drinking water intakes. The proposal includes an alternate point of application for applying the nitrate criterion, and a new requirement for water purveyors to sample the raw water at their potable water intakes to determine actions to be required to be undertaken by upstream wastewater dischargers. On July 1, 2014, NJDEP issued a Final Surface Water Renewal Permit for the upstream Pennington facility. This renewal carries forward the issues unresolved from the draft, including Nitrate; TDS; Dichlorobromomethane and Copper limitations, as well as, ammonia limitations. A separate draft permit action (major modification) was also issued on July 1, 2014 with respect to the final Arsenic and Copper limitations. Arsenic limitations are proposed to be removed because NJDEP determined that Arsenic is not being discharged in quantifiable amounts and therefore does not cause, or have reason to cause, an excursion of the Surface Water Quality Standards. The Copper limitations are proposed to be removed consistent with the results of the Copper Water Effects Ratio and Translator Study performed by the SBRSA which lead to a re-evaluation of the Copper criteria and ultimate determination that based upon more recent data and site specific values, the discharge does not show cause, or reasonable potential to cause, an exceedance of the Surface Water Quality Standards. The draft permit action also proposes to remove the sludge quality and quantity monitoring and conditions from this permit due to the issuance of Master General Permit, Category S2G, applicable to residuals. A Request for Hearing and Stay of the contested permit limitations was filed on August 8, 2014. IV. New Source performance Standards for Sludge Incinerators Rule Proposal On October 14, 2010, USEPA published proposed Standards of Performance for New Stationary Sources and Emission Guidelines for Existing Sources for Sewage Sludge Incinerators. This rule proposal was generated in response to litigation successfully brought by the Sierra Club against USEPA alleging that the USEPA was without statutory authority to exempt sewage sludge incinerators from the definition of solid waste and calling for emission standards thereon. The proposed standards will apply to owners or operators of an incineration unit burning solid waste at wastewater treatment facilities, which includes the SBRSA. Briefly stated, the standards proposed are MACT based limitations, meaning they are derived based upon the Maximum Achievable Control Technology (MACT). For existing units, USEPA looks to the average emission limitation achieved by the best-performing 12 percent units to establish the MACT floor. USEPA has determined that each pollutant standard must be at least as stringent as the MACT floor. Separate standards have been proposed for Multiple Hearth Incinerators and Fluidized Bed Incinerators for the following pollutants: Carbon Monoxide (CO); Nitrogen Oxides (NOx); Sulfur Dioxide (S02); Particulate Matter (PM); Hydrogen Chloride (HC1); Cadmium (Cd); Mercury (Hg); Lead (Pb); Dioxins and Dibenzofurans, toxic equivalency (CDD/CDF, TEQ) and Dioxins and Dibenzofurans, total mass balance (CDD/CDF, TMB). Operator training and qualification requirements are also proposed in this rulemaking. The attached chart compares SBRSA’s existing limitations (“Operating Permit BOP080003”) with the Proposed NSPS for Existing Multiple Hearth Incinerators. The chart also includes SBRSA’s average stack test results with an indication of whether, based upon past performance, SBRSA would be able to meet the limitations proposed. Comments were prepared by Chavond-Barry, in conjunction with John Kantorek and our office, and have been submitted to USEPA on behalf of SBRSA in opposition to the standards proposed. Other trade organizations have also indicated that they will oppose these standards, including NJDEP whose comments advance the appropriateness of establishing standards, but not eliminating incineration as a method of disposal, as New Jersey has determined that it is the most appropriate method of disposing of the residual in this State.

Briefly, SBRSA’s comments focused upon the differences between the actual data available for the SBRSA facility (relative to costs and emissions) and conditions and constraints to which SBRSA was subject, and the assumptions that EPA used in proposing the standards. SBRSA sought to demonstrate that by underestimating the emission control costs and overestimating the baseline emissions from existing incinerators, EPA had grossly overstated the benefits of the proposed standards rendering the Rule Proposal far less favorable from an environmental perspective than advanced. SBRSA further pointed to the disincentives and harm that could actually result from the adoption of the Rule Proposal as presently proposed. A complete copy of the comments submitted is attached. On February 21, 2011, USEPA adopted a final rule that incorporated changes as a result of the efforts of the National Association of Clean Water Agencies (NACWA) to achieve a more appropriate regulatory approach. Specifically, the limitations for mercury were recalculated and less stringent limitations justified, as had been argued by NACWA, and advanced by SBRSA. In response to these new Sewage Sludge Incineration (SSJ) regulations, NACWA has formed a Sewage Sludge Incineration Advocacy Coalition (SSIAC) to continue a challenge the legal basis upon which sewage sludge is defined as a solid waste, as well as to initiate advocacy efforts before Congress to limit the impact of the new regulations. SBRSA has been invited to participate in these advocacy efforts and continue regulatory reform favorable to SSIs. On September 9, 2011, the National Association of Clean Water Agencies (NACWA) filed an Emergency Joint Motion for Stay of the SSI Rule, along with the Hatfield Township Municipal Authority, claiming that the Rule was an extreme example of Agency obduracy and regulatory comer-cutting that resulted in imminently harmful results for the communities that rely upon incineration. This action is requested for a number of reasons, including avoiding the immanent irreparable harm that will result as municipalities are asked to make immediate commitments to retrofit their facilities or abandon incineration in favor of landfilling. New York and Virginia are cited as examples of states pressing for such commitments. Once facilities eliminate their incinerator systems, it is unlikely that they will revert back to incineration. Additionally, NACWA is pointing to the environmentally beneficial projects that cannot go forward in the wake of these new regulations, the costs of retrofitting that will not be recovered, as well as, the effect that the new standards will have on the state of the industry and further future ratcheting down of these standards that will occur based upon new sources which are already required to comply.

NACWA challenged the rulemaking alleging that EPA regulated Sewage Sludge incinerators under the wrong section of the Clean Air Act (CAA), and that the EPA used an incomplete data set – including a failure to properly account for sewage sludge variability – when setting the SSI rule’s emission limits, and thus the rule is technically invalid. Oral Argument was held in this challenge on May 3, 2013.

On August 20th the United States Court of Appeals denied NACWA’s petition for review of EPA’s authority to regulate sewage sludge incinerators under Section 129 but agreed that EPA has not adequately established that its estimations are reasonable and remanded parts of the sewage sludge incinerator rule to EPA for further proceedings. The Appellate Court did not vacate the current standards however. A detailed analysis of the Court’s decision prepared on behalf of NACWA is available for review. By letter dated November 4, 2013, NACWA advised of its plan for continued advocacy relevant to the sewage sludge incinerator rules. This plan includes both advocacy and implementation assistance and proposes the following: submission of an administrative petition to USEPA asking the Agency to administratively stay the current March 2016 SSI Rule compliance deadline until USEPA’s remand revisions to the rule are complete; continuance of NACWA’s legal challenge to USEPA’s Non-Hazardous Secondary Materials (NHSM) Rule; engaging in discussions with USEPA during the rule remand process; and providing implementation assistance to sewage sludge incinerator advocacy coalition participants to meet existing compliance deadlines. A new funding request relevant to these efforts is included and anticipated to cost $1,000 to $2,500 per permitted sewage sludge incinerator unit operated by each utility. This amount is dependent upon the number of participants that commit to this plan.

A letter from NACWA to EPA dated December 17, 2013 requesting a meeting to discuss the next steps regarding the establishment of air emission standards for SSIs based on the U.S. Court of Appeals remanding significant portions of the Agency’s March 11, 2011 SSI emission standards. On June 3, 2015, the D.C. Circuit Court of Appeals dismissed all challenges to EPA’s Non-Hazardous Secondary Materials (NHSM) Rule. In its decision, the Court found that USEPA’s classification of sewage sludge as RCRA "solid waste" for the purpose of CAA emission standards for incinerators and other combustion units was reasonable and within EPA’s statutory jurisdiction, authority, and limitations. The Court held that neither the CAA nor the plain language of RCRA, nor court precedent, prevents EPA from defining solid waste to exclude certain non-hazardous secondary materials combusted for energy or used as an ingredient for fuel, and that the record reflects "that EPA engaged in reasoned decisionmaking to decide which characterization is appropriate" for different types of non-hazardous materials, and that distinctions drawn by the USEPA are consistent with RCRA and reasonable. The Court held that the exceptions constitute a reasonable interpretation of ambiguous language and strike an appropriate balance between RCRA’s dual goals of “recovery and conservation” and that “[b]ecause EPA “‘has considered the relevant factors and articulated a rational connection between the facts found and the choice made,’” we uphold the rule.” This decision ends NACWA’s legal challenge.

To: John Kantorek, Executive Director From: Robert Kunert, Plant Manager Subject: Operations Report Date: December 15, 2015 River Road Facility All four Chlorine Contact Tanks and all four Re-Aeration Tanks were dewatered, cleaned, and put back into service. Incinerator #2 was inspected by Chavond-Barry and a subsequent report was received. The report outlines the necessary repairs including the recommendation to replace the refractory on Hearth level #1. We do not have time to go out to bid and have the hearth replaced before the scheduled testing of this incinerator with our new scrubber system. After discussing this with Chavond-Barry we decided to have much of the other repairs completed, mainly burner repairs, and go out to bid for the hearth replacement after the scheduled Incinerator testing in January. The repair work that we need to complete fell under the bid threshold therefore we obtained quotes from two companies. Albertus Energy was the lower quote and is performing this repair work. We conducted two plant shutdowns, one on Thursday, November 19, 2015 and the other on Monday, November 30, 2015. These shutdowns were necessary as part of the emergency generator project. On Friday, November 27, 2015 the odor control system at the headworks building was found to be not functioning although all the necessary equipment was running. After investigating we found that the Odor Control Fan was not moving air because it was blowing into the underside of three bio-filters that had approximately two feet of water in them due to a clogged drain line. The main drain line from the bio-filters was jetted by an outside contractor then televised. The camera revealed a piece of wood that was lodged in a 90 degree elbow which was the cause of the clog. We needed to excavate, cut the 4” drain line, and remove this piece of wood. After obtaining two quotes this work was performed by Centerpoint Associates Inc. Upstream Facilities A filament problem is beginning to develop within the biological process at our Pennington Facility. We are addressing this problem by chlorinating the Return Sludge which has proven successful in the past. We will keep close watch via micro-exam of the settleometer test for any detrimental effect(s) that may occur which is always a risk when chlorinating to control filaments. Odors The staff received three Odor Complaints from our surrounding area during the month of November. We received no odor complaints during the partial December 2015 reporting period. The full December number will be reported in January 2016. The odor complaints appear on the graph showing the number of odor complaints received each year from January 1997 through present day December 2015.

Ireland Sr., Assistant Plant Manager DATE: December 15, 2015 SUBJECT: Maintenance Report Asco Services was on site on November 10, 2015 at the Hopewell Facility to replace the Automatic Transfer Switch power control center with a new replacement switch because of its inaccuracy and inability to make time delay adjustments. This switch is used to detect any loss of commercial power to the facility which then tells the generator to come on. The new ATS power control is now programmable and has more functions to control the Emergency Generator when power is interrupted. During the month of November, A.C. Scott was on site to replace two more transformers as recommended from the High Risk Assessment, Transformer Survey List. The transformer in the Operations first floor store room (1978) was replaced with a new 45 kva transformer that supplies the Laboratory and the Pepcon Building (1981) with a new 15 kva transformer. A portable generator was used during both events to minimize downtime to the equipment. Currently we have replaced four out of seven transformers, the remaining three will be replaced in the 2016 after the Scrubber modifications and Stack Testing are completed. Backwash Return Pump #3 was removed from service because of a leaking mechanical seal that was creating a slip hazard. The mechanical seal was removed and rebuilt, once tested the pump was placed back into service. During preparation for the Stack Test it was discovered that the Sludge Cake Delumper for Incinerator #1 was making an unusal noise and vibrating. Once removed from service it was discovered that the shaft journal on the drive side was badly worn and the bearings as well. The Delumper shaft was replaced with two new bearings and belts and has been placed into service. Attached to this report are several graphs that monitor our monthly progress. The current monthly open work requests stands at eleven. On the Preventive Maintenance graphs we currently are averaging two days overdue and the number of overdue units is twenty one approximately. CONSTRUCTION REPORT December 2015

Studies/General: 2016 EMA IT Support Contract: Staff requested that EMA provide a proposal for Information Technology Support during FY 2016. The support contract is on a time charge basis in the amount of $30,000 (see attached letter from EMA dated December 14, 2015). Staff received the required pay to play forms from EMA on December 14, 2015 and therefore the contract with EMA will not start until December 23, 2015. Staff recommends approval of Resolution 2015-81. The total spent to date for the IT support contract for FY 2015 was $4,085. Action Item:

Upstream Facilities Process Evaluation/Planning Study: Staff received the draft Pennington STP Facility Planning Study on December 10, 2015 for review. Once the report is reviewed by staff we will schedule a meeting with Kleinfelder to discuss the report. 2015 Annual Inspection: There is no change this month. Information Technology Management Services: Staff met with EMA on December 8, 2015 to discuss the status of the EMA’s progress. Staff requested that Bob Reilly provide more “hands-on” assistance to Ron Hess. Staff also requested that EMA provide a proposal for the design of the server room. Staff provided comments on the draft SBRSA IT Charter and IT Policies as prepared by Bob Reilly from EMA. Attached are the final documents. Staff met with Bob on December 10, 2015 to discuss several topics (see the attached meeting minutes). KEMS 2015 Advice: KEMS has conducted a detailed review of the draft permit and provided NJDEP with comments on December 7, 2015. The changes were incorporated by NJDEP and the draft permit is expected to be advertised for public comment on or about December 14, 2015 (see attached letter from NJDEP dated December 10, 2015). KEMS is currently coordinating/assisting staff with collecting data, monitoring and operation of Incinerator No. 1 for the stack test being conducted by Montrose (formerly Avogadro) with the new scrubber. The stack test started on December 8 and will continue through December 22, 2015.

Design: Schwing Pump Replacement Project: The project kick-off meeting was held on November 16, 2015. GHD is continuing with the preliminary design and plans to submit the preliminary design report by December 31, 2015. Contract 14-4 SBRSA Pump Station Comminutor Project: The design of the project has been completed and based on the Final 2015 Future Facilities Improvements Plan this project has been scheduled for bid in 2017. Construction: Contract 10-1 Headworks Project: Kleinfelder and SBRSA are continuing to compile documents, emails, meeting minutes, memorandums, etc. requested by Authority Counsel relative to the issues raised by Tomar in their last letter. Contract 14-1 SBRSA Emergency Generator Project. As of Pay Estimate No. 2 this project stands at 9.0% complete. Over the past reporting period Thomas Controls Inc. (TCI) completed the following at the River Road plant site: the relocation of the existing emergency generator day tank, removed or relocated existing power and control conduits, began the installation of 4-inch PVC coated conduits, demolished a section of the south wall of the Generator Room and installed a temporary wall, and completed the installation of the south wall structural support steel. TCI received and stored on-site the roof exhaust fans and curbs for the two pump stations and River Road plant. Based on communications with the construction department at West Windsor Township, which were initiated by Chairman Bartolini, the Township has been in contact with TCI and Kleinfelder (KFL). It now appears that TCI is in a position to re-submit all requested information minus the HVAC ductwork supports which are currently under review by KLF. Once the ductwork support review has been completed, TCI will submit all additional information to West Windsor. As part of the Chemical Building modifications, a section of the roof and roof support trusses are to be removed and new roof supports and roofing system installed. While completing a field evaluation for the roof modification work, the Contractor identified four (4) control conduits, and one (1) telephone/PA conduit that would need to be relocated as part of the roof modifications. In addition, two (2) other control conduits that were made obsolete under previous contracts needed to demolished and removed. The seven conduits; four running between the existing turbine generator control cabinet and the turbine generator, one telephone and PA system conduit, and two conduits to be removed were not called out for relocation/demolition by the contract documents and are considered additional work. Contract 15-1 Scrubber Procurement: On December 2, 2015, Centerpoint Associates submitted the draft performance test report for Scrubber No. 1. The report was reviewed by SBRSA, Chavond Barry Engineering, and EnviroCare International. The new scrubber system met or exceeded the emission limits of the Contract specifications. Attached is a table that includes the new scrubber performance test results compared to 40 CFR 60, Subpart MMMM limits and 75% of the Subpart MMMM limits as provided by CBE. Contract 15-2 Scrubber Installation: As of Pay Estimate No. 8 this project is approximately 90% complete. During the past reporting period Centerpoint Associates Inc. (CPA) continued with the installation of Scrubber #2. All sections of the new scrubber and quench vessels have been assembled and welded together. CPA has completed the majority of the high pressure piping, mist eliminator piping, separator tray piping, and began the installation of the low pressure piping. All field devices have been mounted and final restoration to the front of the Operations Building has been completed. The performance test for Scrubber #2 has been tentatively scheduled for mid-January 2016. During the installation of Scrubber No.1 it became apparent that in order for the contractor to install the scrubber sections in the sequence recommended by Chavond Barry Engineering, the contractor would have to modify existing floor openings to allow sections of the scrubber to be lifted into temporary positions. Likewise, the installation of Scrubber No.2 also required the contractor to modify existing floor openings to allow sections of the scrubber to be lifted into temporary positions. While the structural work to modify the floor openings was less difficult for Scrubber No. 2, the Contractor had to relocate an existing 2-inch conduit and extend the wires for the burners on Hearth Level 3. In addition to the above, the 44-inch stainless steel crossover duct that connects the quench vessel to the scrubber vessel for Scrubber No. 2 had to be modified (shortened by approximately 2-inch) to fit between the two vessels. Resolution 2015-82 is for the additional work associated with the installation of Scrubber Nos. 1 and 2 and the connection between the quench vessel and Scrubber No. 1. Staff recommends approval of this change order. While the contract documents provide for minor modifications to handrails, piping, conduit, and equipment, the level of modifications that were required to achieve the necessary clearances is considered above and beyond the normal scope of work. It should be noted that staff has received a letter from CBE indicating that including the latest invoice for work completed up to November 30, 2015, the budget for construction services is over 75% complete (see attached letter dated December 11, 2015). Based on the latest invoice the budget is approximately 87% complete. Action Item:

Contract 15-3 Ash Handling System Improvements: BR Welding continues to submit shop drawings. On December 14, 2015 a meeting was held between SBRSA, BR Welding, and the control system vendor. The layout, integration, and control for the new equipment was discussed and confirmed. Small Capital Project Status Contract 15-4 Instrument Air Compressor Replacement: Bids for this project were received and opened on December 16, 2015. Of the six (6) potential bidders, four (4) bids were received. The bids ranged in price from $109,000 to $141,000 with Derstine Company, LLC providing the lowest bid. Derstine Company provided all required documentation with their bid. Derstine Company has successfully completed work for the Authority in the past and therefore staff recommends award of Contract 15-4 Compressed Air System Replacement Project to Derstine Company in the amount of $109,000 (see attached recommendation memo dated December 17, 2015). Action Item:

MA Effluent Channel Mixers: There has been no change to this project this month. AECOM is still in the process of finalizing the structural modifications. Process Control/SCADA: Preventative maintenance was completed for all field devices and process control loops. The quarterly flow meter certification was conducted by W.G. Malden on December 1, 2015. Carbon Monoxide Analyzer Replacement: There has been no change to this project. SBRSA is awaiting approval of the performance test protocol (PST) which was submitted on October 27, 2015 to the NJDEP Bureau of Technical Services for review. Plant Influent Flow Meter: Staff continues to evaluate the flow data being obtained from the influent high range/low range meter system. Below is a summary/comparison of the River Road STP influent flow meter to the sum of the metering sites from July through November. Also included on this table is the minimum and maximum daily % difference for that month. Staff is still in the process of working with the meter manufacturer to determine the best course of action to solve the issue with the meter. Attached is a memo that summarizes what action has been performed to date.

Resolution Authorizing the Award of a “No Political Contributions Allowed” Contract for 2016 Information Technology Support to EMA, Inc.


Date: December 21, 2015 WHEREAS, the Stony Brook Regional Sewerage Authority (SBRSA) has a need for Information Technology (IT) System support for fiscal Year 2016 ending on November 30, 2016 that does not allow for political contributions to the Authority or its members (“No Political Contributions Allowed” contract) pursuant to the provisions of N.J.S.A. 19:44A-20.4 et seq.; and,

WHEREAS, the qualified purchasing agent, Stuart Neuhof has determined and certified in writing that the value of the work may exceed $17,500; and,

WHEREAS, the term of this contract will commence on December 23, 2015 and end on November 30, 2016 and,

WHEREAS, EMA, Inc. has submitted to SBRSA a proposal dated December 13, 2015 and Agreement indicating they will provide IT support through November 30, 2016 for a time charge fee not to exceed $30,000 without written permission from Stony Brook Regional Sewerage Authority; and

WHEREAS, EMA, Inc. submitted a Business Entity Disclosure Certification on December 13, 2015 which certifies that EMA, Inc. its subsidiaries, assigns or principals controlling in excess of 10% of the company has neither made a contribution that is reportable pursuant to the Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-8 or 19:44A-16, in the one (1) year period preceding the award of the contract that would, pursuant to P.L. 2004, c.19, affect its eligibility to perform this contract, nor will it make a reportable contribution during the term of the contract to a municipal political party committee of a governing body that appoints members to the Authority including, Princeton, South Brunswick Township, West Windsor Township, Hopewell Borough, Hopewell Township, and Pennington Borough, when the contract is awarded, or to any municipal candidate committee of any candidate for or holder of municipal elective public office of any such municipality when the contract is awarded, and

Dated: December 21, 2015 WHEREAS, on November 4, 2014, the Stony Brook Regional Sewerage Authority

(SBRSA) issued a Notice to Bidders seeking the receipt of sealed public bids for the “Emergency Generator Project, Contract 14-1”; and

WHEREAS, the SBRSA at its December 15, 2014 meeting awarded the Emergency

Generator Project, Contract 14-1 to Thomas Controls, Inc. (TCI) in the amount of $3,400,000; and

WHEREAS, additional unforeseen work which was not included in the original bid

specifications was required to provide labor, materials, and equipment to facilitate the demolition and relocation of conduits and wire not identified in the Contract documents; and

WHEREAS, the abovementioned changes to Contract 14-1 are incorporated within the

December 15, 2015 Contract Change Order #1 document in the amount of $20,417.69 resulting in an adjusted contract of $3,420.417.69; and

WHEREAS, the contract completion date for the project shall be extended by 7 days as a

MEMO To: John Kantorek, Executive Director From: Robert Kunert, Plant Manager Subject: Recommendation (Odor Control Bid) Date: December 15, 2015 On Wednesday, December 2, 2015 at 11:30 a.m., sealed bids for the supply of a liquid odor control product were opened. These bids were based on the results of trials that were conducted prior to bidding. During these trials, each bidder had to meet the qualifications regarding product effectiveness and determine the dosage necessary to meet these qualifications. Two companies performed trials and their bids are shown below:

After speaking with the Coyne Chemical representative and explaining the problem we both ran through the calculations using the correct data and he is in agreement with the total cost after being corrected as shown above. Our last contract was a two year contract with Evoqua Water Technologies for a total two year price of $184,748.40 at a unit price of $0.74/lb. Please note that the average total pounds used during the trials are used in the formula to calculate a total bid price. This evaluated bid price is subject to radical increases and decreases at times since it is based on the H2S concentrations in the sludge at the time of the trials which varies throughout the year. During these trials the H2S levels were high due to the low flows that we as well as all of our liquid sludge customers were experiencing. On Tuesday, December 15, 2015, I received a letter from Coyne Chemical via UPS. This letter indicated that the chemical that Evoqua used during the trial (Textone L) was not the same chemical that they bid (Textone XL) based on the label that was on the 55 gallon drum that was delivered. Therefore, they were officially protesting the award of this bid to Evoqua pending resolution of this matter. This matter was discussed with the representative from Evoqua later the same day. He explained to me that the label that Coyne Chemical was referring to was a generic label indicating the contents of the drum but had no specific percentages of the active ingredients. The active ingredient percentages was shown on a separate label which was on the drum as well. This was verified through photos and the Certificate of Analysis that was furnished to us during the trial period. This matter was discussed in a phone conversation the following day, Wednesday, December 16, 2015, with the representative from Coyne Chemical. After revealing the results of my investigation he was satisfied that Evoqua had in fact trialed and bid on the same product, that being the Textone XL. At the end of the conversation he told me that he would inform his main office and put a close to this matter. After reviewing the low bidder’s package and finding it to be in order I would recommend that a two year contract be awarded to Evoqua Water Technologies at a unit price of $0.76/lb. for the first year and a unit price of $0.76/lb. for the second year for a two year total of $242,668.61.

WHEREAS, the Authority had contacted Coyne Chemical to inform them of these errors,

and by phone, informed them of the correct values that needed to be used and the correct mathematical formula that was also needed to determine a total bid price; and

WHEREAS, the Authority, by phone, went through the correct calculations with the

representative from Coyne Chemical using the correct values and they are in agreement with the corrected 12-month total price and 24-month price shown above; and

WHEREAS, the low bidder, Evoqua Water Technologies submitted a bid of $0.76 per pound
