Produce undertrials before courts, provide medicare to inmates: HC D A RASHID Srinagar, Apr 5: The Jammu and Kashmir High court on Wednesday directed all Jail authorities of the state to pro- duce under-trial prisoners before the trial courts provide proper medical facilities to the inmates and maintain hygienic atmo- sphere in the jails. A division bench of Justice Muhammad Yaqoob Mir and Dhiraj Singh Thakur directed the jail authorities to ensure that the inmates facing trial are produced before the trial courts whenever ordered by such courts. Hearing a Public Interest Litigation by Kashmir Bar Association seeking to improve conditions in jails While the bench asked the Jail authori- ties to provide proper medi- cal facilities to the inmates as permissible, it also ordered for maintaining proper hygienic atmosphere in jails. The court, however, directed the said authorities to refrain from using CCTVs in toilets and bathrooms of the jails. “CCTV cameras, if in place in the toilets and washrooms in the jails, shall not be operated i.e. its use in toilets and washrooms shall be stopped, so as to maintain decen- cy and privacy of the inmates of the jail”. Meanwhile, the court direct- ed the district judges who have not submitted reports on condi- tion of inmates following their visits to the respective jails to submit the same by April 17. On February 28, this year, after hearing Bar president Mian Abdul Qayoom, the court had called upon the Principal District Judges to strictly comply with the directions it had passed on August 7 and October 8, 2012 besides July 9 , 2013 and visit the jails in their respective districts and to submit reports regarding jail conditions in keeping with Jammu and Kashmir Detenues (General) Order, 1968. While the court said in com- pliance to the order, District Judges Rajouri, Reasi, Gan- derbal, Samba, Baramulla and Bhaderwah have filed the report, it asked other District Judges who have not submitted the req- uisite report to submit the same by or before next date of hearing. Meanwhile the court took on record two reports prepared by separate Bar Committees after allowing an application that the lawyers’ body had moved in this regard. It asked the Addi- tional Advocate General Bashir Ahmad Dar to file the response to these reports by April 17, adding the copies of report be also sent to the concerned Dis- trict Judges who in the context of the said report after visiting the respective jails have to submit their reports. In the PIL the High court has already in its earlier directions ordered the Superintendents of the jails to ensure that inmates of the jails are treated prop- erly in accordance with the Jail Manual. It had also directed all Princi- pal District and Sessions Judges to visit all Jails of state and report on condition of inmates even Bar Association Kashmir too was asked to chart facilities which the prisoners lack. The Bar Association had decided to inform the Jammu and Kash- mir High court by an appropri- ate motion about the problems of detainees and under-trial prisoners lodged in Central Jail Kotebalwal Jammu, District Jail Kathua and District Jail Udham- pur and other jails after its two teams had prepared two separate reports on jails. Brother ‘sacks’ Ajmer deewan for beef ban support Ajmer, April 5: A long-run- ning family feud at the revered Ajmer sufi shrine culminated on Wednesday with the "sack- ing" of its spiritual head Syed Zainul Abedin, who was dubbed by his younger brother as an "apostate" for his "blas- phemous" support to the ban on slaughter of bovines and selling beef in the country. Abedin stood by his remarks opposing cow slaughter and said he was the "lifelong deewan" - the spiritual chief of the Khwaja Moinuddin Chisti mauso- leum in Ajmer -- one of the most famous Muslim shrines visited by millions of devotees from across the sub-continent every year. But his brother, Syed Alau- din Alimi, claimed he had the support of the family in "sack- ing" Abedin and anointing himself as the new "deewan". The post is hereditary and belongs to heirs of the 12th-13th century sufi priest. Deewan has no control over the management of the shrine but gets a monthly remunera- tion from the management committee, which is appoint- ed by the government. "I am the new deewan. I have the support of the entire (Chishti) clan," Alimi told IANS, alleging that Abedin was an "apostate because he had spoken in violation of the Islamic law". "I am not interested in (taking) salary. He (Abedin) can have the money. Buy I won't allow him to enter the shrine now. Whatever he has said is blasphemous. I have spoken to muftis (Islamic scholars who interpret sharia) and we will be issuing a fatwa (decree) against him. He is no longer a Muslim." Abedin has been the deewan of the shrine since after the Supreme Court 1987 order, ruling him as the most direct and eldest descendant of the sufi priest. He said his younger brother "had gone mad" and had no powers to anoint himself as the deewan. "It's a religious post. Nobody can snatch it. Nobody has enough powers to change it. Nothing has changed," Abedin told IANS, threatening "legal action" against his brother. "I stand by my statements on beef," he said. Abedin sparked a contro- versy on Monday by asking Muslims in India to stay away from slaughter of "bovine ani- mals" and to stop consuming beef for communal harmony in the country. He read his message during the 805th annual function at the shrine that was also attended by religious heads of various shrines from different parts of the country. He also announced that he and his family members "will never eat beef now". The spiritual leader got support from the head of the government-appointed com- mittee, M.A. Khan. "This is a dispute between two brothers and the deewan cannot be sacked like a coup," Khan said. One of the members of the committee, Syed Hameed Chishti, who is also a care- taker at the shrine, told IANS that the two brothers have been fighting over the post since years and Wednesday's development was a culmina- tion of the feud in the family. "It is a fight for money. They claim they are descen- dants of the Khwaja (sufi saint) but their role is lim- ited to conduct qawalis and mehfils (spiritual sittings) at the shrine," Chishti said, agreeing that Abedin can't be removed. "His (Cheetah) recovery is no less than a miracle... Despite several complica- tions in the treatment caus- ing hurdle, the team of doc- tors did their best and made him recover," Amit Gupta, AIIMS spokesperson, told IANS. The Central Reserve Police Force (CRPF) said it was due to the specialised surgical and medical inter- vention by the All India Medical Institute of Sciences (AIIMS) that helped Cheetah come back to life. Treatment of Cheetah, who was in coma for weeks after being brought to the Jai Prakash Narayan Apex Trauma Centre of the AIIMS, required the combined efforts of medical experts from six departments: Trauma Surgery and Critical Care, Intensivist, Neurosur- gery, Orthopaedic, Opthal- mology and Plastic surgery. Cheetah, 45, was injured in a gunfight between three sus- pected militants and a joint team of the CRPF, the Indian Army and the Jammu and Kashmir Police on February 14, 2017, morning in Parray- pora village, in Bandipora district's Hajin area.
