Executive VP - Retail Three of the top commercial property brokers in Salt Lake City have acquired the largest Coldwell Banker Commercial operation in the world for an undisclosed price from NRT, the New Jersey-based master franchiser, and will operate the firm as Coldwell Banker Commercial Intermountain.

The new ownership group, which includes top office broker Brandon Fugal and industry leading retail specialists Tim Simonsen and Stuart Thain, have named Lew Cramer, the founder and CEO of the World Trade Center Utah, as president and CEO of the firm.

The three principals will continue to function in their current capacities as agents in the office and retail sector for the firm, which will operate as an independently-owned affiliate member of Coldwell Banker Commercial.

This acquisition will raise the stature and visibility of the firm and help attract business from around the world to the states of Utah, Idaho and Alaska, where it has six offices.

Presently the firm has the largest book of business in the Intermountain region in both the office and retail sectors. The management team has been charged with the task of improving the industrial and investment sectors and repositioning the entire company to a global perspective.

“This new era of Coldwell Banker Commercial Intermountain will focus on strategic partnerships between the public and private sector,” said Fugal. “Lew’s leadership and knowledge of international business will be vital to help expand business development in Utah and attract growth from around the world.”

“My job has been to position Utah as a leader in the international market place,” said Cramer. “I believe that to succeed, one needs to be internationally minded. By showcasing our global competiveness, the brainpower of the Intermountain West and attracting international dignitaries to Utah, Idaho and our Anchorage locations, economic growth will come exponentially.”

As part of the new focus on growth and expansion the firm has named Kevin Long to Principal Broker/COO to run the day to day operations of the brand’s flagship franchise. The two previous principle brokers, Randy Owen and Steve Bogden, have been appointed new roles in order to capitalize on other aspects of the business.

Randy Owen will focus on the firm’s fastest growing business of Asset Services and serve as its Managing Director. Asset Services manages more than 4.2 million square feet and provides property management and advisory services for institutional owners and regional investors.

Steve Bogden will serve and the firm’s Strategic Advisor, providing a wide variety of advisory and strategic services to both local and national clients. He is one of the leading authorities in the intermountain region on retail growth and strategy.

As well, the Utah County Office will relocate and quadruple in size by the end of the year. The Salt Lake City office has been ranked as Coldwell Banker Commercial’s No. 1 office globally for 11 consecutive years and Fugal is currently recognized as the No. 1 agent in the world for Coldwell Banker Commercial, leasing over 1,000,000 square feet in the last year.

Can you tell me a brief history of Arbor Commercial and how it was started? 

Arbor Commercial was founded in 1977 with the first commercial development known as Arbor Park -- which still stands today. Since then, Arbor and our partners have developed more than 23 million square feet of

office, industrial and retail space throughout Utah. In addition, Arbor has developed over 3,000 residential lots and homes.

Arbor is probably most well-known for the retail centers it has developed, but you also have significant experience in residential and office. With this expansive view of the different disciplines, what is Arbor’s

outlook on the commercial real estate market?

We like what we see in Utah, but we are proceeding cautiously at the same time. Utah continues to have an unemployment rate lower than the national average. This, combined with the low cost of living and a highly

educated and affordable work force, make Utah an attractive place to work and live.

With your extensive background into the various sectors of real estate, what are you currently working on?

For retail, we are nearing completion on the Target-anchored shopping center known as Highbury Center in West Valley City. Also, we have commenced construction on a new Walmart Neighborhood Market anchored

center in Magna. For office, we continue to build on the success of the existing space at View 72 in Midvale. As we speak, we are under construction on a new office building, which will bring the total project GLA close

to 1 million square feet.

Are you seeing the different municipalities that you are working with be more accommodating given current market conditions and if so, how?

Before I became a developer I was the Director of Facilities and Maintenance for Salt Lake County and Director of Salt Lake City Parks and Recreation. This background has given Arbor knowledge and understanding of

the relationship between businesses and government. Today’s changing climate for new projects, as well as new tenant requirements, requires both developers and municipalities to work in tandem.

Is there one retail project that is a favorite to Arbor Commercial and why?

Hard to pick just one, but I would have to say Arbor Park, given my roots in Magna and the fact that this is where everything began.

The Marketplace Fairness Act is the primary legal focus of the International Council of Shopping Centers (ICSC), and progress is being made to advance this legislation (or a form thereof) into law. In April, Wade Williams of the Boyer Company, Chris Hatch of Mountain West, and I traveled to Washington, D.C. as representatives of the Utah Government Relations Committee for ICSC to lobby for this legislation. As the outgoing Governmental Relations Chair, Chris was kind enough to show me the ins

and outs of the maze that is the United States Capitol building. We visited the offices of each of our four Members of Congress (Bishop, Chaffetz, Matheson, and Stewart), as well as our two Senators (Hatch and Lee). While there, we had the opportunity to meet with each legislator or his legislative director.

While we discussed a variety of topics with our legislators, such as tax reform, taxation of carried interest, and storm water regulations, the main topic of our discussion was the Marketplace Fairness Act.

As most people in our industry are aware, the Marketplace Fairness Act levels the playing field by requiring online retailers to collect sales tax (which is already due -- it is not a tax increase), just as brick and mortar retailers do. Most of our Members of Congress and Senators were familiar with the legislation, and admitted that efforts to pass it have certainly gained momentum within the last year; however, there were mixed reviews on whether they would vote on the legislation. It was interesting to hear the varied opinions, which included the following points:

• The legislation hasn’t advanced through the proper committees yet, so it cannot be voted on until it is sent back to committee.

• It is absolutely the fair thing to do to level the playing field for all retailers. Special treatment shouldn’t be given to one retailer over another.

• Although this is not a tax hike, there is a concern as to how a vote for this legislation will be perceived by tax watchdogs.

• This legislation cannot be approved until certain changes are made, including the minimum exemption being increased from $1MM in total sales to $5MM or $10MM.

During one of our meetings, we were accompanied by the Vice President of Real Estate for Target, Macy’s, Saks Fifth Avenue, and Kimco, who helped plead the case for the legislation. On May 6th, the Senate voted 69-27 in favor of the ICSC-backed

Marketplace Fairness Act (S-743). The House version of the bill (H.R. 684) is still being debated, and awaits consideration by the House Judiciary Committee. All in all, it was a great experience to see the cherry blossoms in D.C., meet with the bigwigs at the Capitol, hang out with Wade and Chris, and eat way too much sushi.

Men’s apparel retailer Destination XL (DXL) opened a new store in the Boise, Idaho area on August 20, 2013 catering to men who wear extra large sizes. The 9,693 square foot store is located on the busiest intersection in Idaho, the southeast corner of Eagle Road and Fairview Ave.

Thus, McMurray Brothers Construction was founded as a partnership between Mick and his younger brother, Vic. They ended up competing with their father’s company on every highway project in Wyoming for the next 20 years. After selling the construction company, Mick wasn’t content on slowing down. He decided to try his hand in the risky oil and gas industry,

and joined McMurry Oil Company, followed by a tenure with Nerd Gas Company. Nerd Gas Company went on to become a partner in the discovery and subsequent nine-year develop-ment of both the Jonah and Pinedale Anticline Fields in Sublette County, Wyoming. Jonah Field was sold to Alberta Energy in June of 2000, and the Anticline Field was sold to Shell in Novem-ber of 2001. Nerd continues its energy resource development efforts with gas exploration proj-ects throughout Wyoming as well as other BTU-potential projects, including coal and uranium leases in the Powder River Basin and a fractured shale project.

Mick and his wife, Susie, now focus much of their efforts on philanthropic activities, including The McMurry Foundation, which was designed to create a better Wyoming through partnerships withvarious nonprofit organizations.

A fter serving in Vietnam and graduating from the University of Wyoming, Mick returned to Casper expecting to work

for his father’s construction company, Rissler and McMurry Construction. To his surprise, Mick’s father informed him that it was time to go out on his own, take his own risks and make his own mistakes.

They have also helped the quality of life in Wyoming by constructing many new developments throughout the state. One such development that Mick is working on is called Blackmore Marketplace located in Casper, WY. With help from Randy Hall of Broker One Real Estate; Tyler and Gary Howland of Eagle Pointe Financial; and Stuart Thain, Cameron Simonsen and Zach Beaudry of Coldwell Banker Commercial, Mick is developing a new shopping center that will benefit the residents of Casper and surrounding markets for years to come. Tenants that are committed or open in the vast, 55-acre development include: Kohls, Mar-shalls, Gap Outlet, Dress Barn, Shoe Carnival, Buffalo Wild Wings, Golden Corral, Olive Garden, Red Lobster and Studio City Cinemas. Many additional retailers and restaurants are currently in negotiation, and the project is shaping up to be the ultimate shopping and dining destination in Wyoming.

In 2012, Cardio Barre Quarry Bend owners, Megan Cross

and Shantel Reitz, took their passion for life and

fitness and set out on an adventure to find the best workout around. They tried everything, Pilates, yoga, even CrossFit. The workouts were good, but still did

not give the women the results they

wanted to achieve. After taking Pilates

classes at a local studio, they noticed that one of

the instructors also taught a barre class. Although they

had never heard of barre, it piqued their interest and the

impetus for bringing Cardio Barre to Utah was born.

After attending the many different types of “barre” classes offered locally, they still weren’t satisfied. They were on a quest to find the highest quality instructors with the most education who offered the most accurate technique. Additionally, they wanted a studio with available childcare. These factors drove Cross and Reitz to visualize opening their own studio, “We needed trainers who would offer a life-changing experience every time they taught a class. Luckily, after much research, and the recommendation of a friend, we were introduced to

Cardio Barre. The name itself was intriguing. Testimonials described it as nothing shy of phenomenal. We knew we were on the right path.”

After researching the Cardio Barre Franchise, Cross and Reitz discovered that studios were operating only in Southern California, but were starting to expand in surrounding states. Immediately, they booked flights to Studio City, California to experience Cardio Barre for themselves. After taking their first class, taught by the founder of Cardio Barre, Richard Giorla, they were instantly obsessed. They had finally discovered exactly what they were looking for.

Sufficiently inspired, the women franchised the first Cardio Barre studio outside of California at Quarry Bend. Cardio Barre is looking for additional locations along the Wasatch Front and elsewhere.

The approach Dr. Whitehead created stems from his background in epistemol-ogy. The learning style is not simple rote memorization or a canned methodol-ogy designed to achieve a test score or grade, rather, the Grade Power Learn-ing approach is fundamentally different in that it teaches children how to learn. The philosophy is simple; teach children the skills of learning today, so that they have the tools necessary to become life-long learners. Fundamentally, all cog-nitive learning follows the same basic pathway:

You are taught something or you discover something new.

You think about this new information. You verbalize this information in your own words. You apply this new information to the body of knowledge you al ready possess, and in the process grow intellectually.

Heather Bogden was nominated to

the 2014 Board of Directors for the

Utah Chapter of CREW (Commercial

Real Estate Women). CREW Utah’s

chapter currently has 70 members and

continues to grow. CREW is a national

organization with more than 8,000

members working in all disciplines in

the commercial real estate industry.

General Growth Properties announced

that Dillard’s will be relocating its store

at Fashion Place Mall in Murray, UT. The

new store will be constructed in the

area formerly occupied by Sears.

JC Penney has reported a monthly

sales increase for October 2013. This

marks the first sales increase since

2011, and the company is hopeful of a

turnaround.

Rouse Properties announced that they

have signed a lease with Herberger’s

to occupy 62,000 square feet at Cache

Valley Mall in Logan, UT. Herberger’s is

owned by The Bon-Ton Stores, Inc. and

operates over 272 stores in 25 states.

The Logan location will be their first

store in the Utah market.

Family Dollar has opened a new

distribution center in St. George, UT.

The building has over 800,000 square

feet of warehouse space, making it

the largest building inside the St.

George City limits. Approximately 400

employees will work at the new facility

when it reaches full capacity.

CenterCal Properties had a grand

opening event for The Village at

Meridian in Meridian, ID. The shopping

and entertainment development is

located at the intersection of Eagle

Road and Fairview Ave., which is one

of the busiest intersections in Idaho.

The project cost an estimated $300

million and is over 1 million square feet

covering 80 acres.

Pepperidge Farm invested $45 million

on a 94,000 square foot expansion of

its original 225,000 square foot facility

close to the Utah-Idaho border.

Esurance, a subsidiary of Allstate

Corp., will open a new customer service

office in Ogden, UT, which is expected

to create 700 new jobs over the next

20 years. The Illinois-based company’s

operation will be based at Business

Depot Ogden, a 1,100 acre business

park owned by The Boyer Co.
