Construction Lending News Volume 23, Second Quarter 2008 Residential Project Exception Under Arizona Lien Law By James L. Csontos 1 Granite, 10770 E. Briarwood Ave., Suite 280, Centennial, CO 80112 866.710.4087 continued on page 2 Arizona law allows for mechanics’ liens to be recorded on commercial and residential projects, but not on public works projects. However, there are limitations placed on who may record a mechanics’ lien and what conditions they must meet. ere is also a significant limitation applicable to owner-occupied residential projects, where lien rights are very restricted. A. Who May Record a Mechanics’ Lien? A lien may be recorded by “every person who labors or furnishes professional services, materials, machinery, fixtures or tools in the construction, alteration or repair of any building, or other structure or improvement.…” is protection extends to those who provide such labor, services or materials at the instance of the owner or the owner’s agent. e statutory definition of agent generally limits lien rights to those who have a direct contract with the owner, prime contractor or any of the prime contractor’s subcontractors. ese provisions are found in A.R.S. § 33-981. is definition of eligible claimants applies to all commercial and residential projects, subject to the limitations discussed below. B. Lien Law Notice Requirements. If eligible to record a lien, the claimant must satisfy the statutory requirements before being entitled to record a mechanics lien. One of the requirements is preliminary 20- day notice. Except for persons performing actual labor for wages, every party who provides labor, professional services, materials or equipment must serve the owner, the prime contractor and the construction lender, if any, with preliminary 20-day notice. e statutory form is found at A.R.S. § 33-992.01. Service may be made by mailing, with a certificate of mailing, or by registered or certified mail sent to the party’s residence or business address. A claimant need give only one preliminary notice with respect to all labor, professional services and equipment, supplied unless the actual total price exceeds by 20 percent the estimated total price, in which case an additional preliminary 20-day notice must be given. e failure to serve preliminary 20-day notice may render invalid a later-recorded mechanics’ lien claim. C. Deadlines and Definition of Completion. Under A.R.S. § 33-993, prime contractors, subcontractors, materialmen and professionals all are required to record their notice and claim for lien within the earlier of 120 days after completion or, if a notice of completion has been recorded and served, within 60 days after such recordation. For purposes of establishing a lien, completion means the earliest of: Thirty days after final inspection and written final acceptance by the governmental body issuing the building permit. Cessation of labor for a period of 60 consecutive days, except when such cessation is due to a strike, shortage of materials or act of God. If the improvement consists of the construction for residential occupancy of more than one separate building, each building is a separate work and the time within which to record a lien begins to run upon the completion of each building. A separate building means one structure and any garages or other appurtenant buildings in a multi-building residential project or subdivision. If the work performed is an improvement at the site that is not included in a contract for the construction of a building, the improvement is a separate work. e definition of a site improvement is found at A.R.S. § 33-992(E). Site work will have a separate date of commencement and completion for the purposes of calculating the deadline for recording a lien. D. Contents of Notice and Claim of Lien. As required by A.R.S. § 33-993, a Notice and Claim of Lien must be made under oath by someone with knowledge and must contain the following items of information: 1. The legal description of the land and improvements. 2. The name of the owner or reputed owner and the name of the party by whom the claimant was employed. 3. A statement of the terms of the contract if oral or a copy of the contract if written. 4. A statement of the claimant’s demand, deducting all just credits and offsets. However, if the improvement involves owner-occupiedone-family or two-family residences as defined at A.R.S. §33-1002, there is a major limitation to who may properlyrecorda lien. This is foundatA.R.S.§33-1003(B),whichprovides:

No lien provided for in this article shall be allowed orrecordedbythepersonclaimingalienagainstthedwellingof a person who became an owner-occupant prior to theconstruction, alteration, repair or improvement, except byapersonhavingexecutedinwritingacontractdirectlywiththeowner-occupant.

E. Perfection of Lien Rights.As found at A.R.S. § 33-993, a lien claimant perfects
