REQUEST FOR PROPOSALS
CITY OF ROCHESTER ONGOING HISTORIC PRESERVATION PLANNING CONSULTANT SERVICES
The City of Rochester, through its Heritage Preservation Commission, is seeking proposals from qualified consultants for preservation planning services. Proposal documents must be received at City Hall no later than 4:30 p.m. February 17, 2017. The proposal should be addressed to City of Rochester Heritage Preservation Commission, Attn: Aaron Reeves, City Hall, 201 4th St. SE, Room 266, Rochester, MN 55904. A. Professional Qualifications Only persons or firms meeting the Secretary of the Interior's Professional Qualification Standards for history, architectural history or historic architecture can be contracted for this work. The HPC prefers experience in the area of researching and writing local designation forms for commercial and residential buildings, structures, and districts as well as extensive adaptive reuse experience. B. Scope of work This project is for ongoing consultation work providing professional expertise for the following:
1. Review of buildings, structures, and districts for possible designation as Landmark or Potential Landmark Properties or Districts in the City of Rochester. The properties to be reviewed will be from a list prepared by the HPC or as nominated. It is anticipated that 10 properties per year will be reviewed. The current proposed list of properties is attached. The City Heritage Preservation Ordinance is also attached.
2. Review of development applications in relation to adaptive reuse or demolition of Landmark Properties. This includes feasibility of proposed adaptive reuse as well as review of economic hardship requests for demolition. It is unknown the number of applications that will be received per year but it is anticipated there will be 1-2 per year.
3. Revolving Fund Administration assistance. The City is creating a revolving fund to assist in the preservation of Landmark Properties. The consultant will help review and establish fund policies and procedures as well as assist in fund implementation.
4. Continued Development of Historic Contexts. The consultant with assist in keeping the City’s adopted historic contexts up to date.
5. Education and Community Engagement. The consultant will assist the HPC in engaging and educating the public on the importance of heritage preservation through events and educational sessions. The number and types of events will be determined by the HPC with direction from the consultant.
The consultant will provide all the staff, supplies, materials and equipment necessary to perform the duties above.
D. Final Products Products shall conform to all appropriate standards and guidelines including those specified in the current edition of the Guidelines for SHPO Architecture/History Projects. E. Local Resources 1. The City can provide the consultant some help with mapping through the GIS system. 2. City staff will be responsible for the administration of the designation procedures described in the ordinance. 3. City staff will assist with locations and scheduling of community engagement events. F. The Proposal Twelve copies of the complete proposal are due at City Hall by 4:30 p.m. Friday, February 17, 2017. One copy should be one-sided and not bound or stapled and an electronic copy shall also be supplied.
1. Provide a brief resume of each person or sub consultant who will participate in the work. Include documentation that the persons involved meet the Secretary of the Interior's Professional Qualification Standards for history or architectural history and historic architecture.
2. Describe the proposed approach, methods and resources to be used for each work item. 3. Provide three references, including contract work completed by the consultant under the
Secretary of the Interior's Standards. Provide names and numbers of city staff persons with whom the consultant has worked.
4. Provide an example of the consultant’s work pertinent to each work item. 5. Quote the rate structure and cost for each work item, separated out by item. Provide a per
task cost when applicable (for example, $2,000 per Phase II review or $1,000 per development application review).
The HPC and staff will review the proposals. Interviews will be required if the HPC determines that they would be helpful in making a decision. The HPC will recommend to City Council that the consulting contract be awarded to the selected person or firm, based on experience, qualifications and cost. The City reserves the right to reject any or all proposals and to waive minor irregularities that do not reflect the ability to complete the work. CHAPTER19B
HERITAGEPRESERVATION
19B.01. StatementofLegislativeIntent. Subdivision1. TheCommonCounciloftheCityofRochesterherebydeclaresasamatterofpublicpolicythatthepreservation, protection, perpetuation, promotionanduseofBuildings, Structures, Sites, andObjectshavingaspecialhistorical, community, oraestheticinterestorvalueisapublicinterestandisaworthypursuitintheinterestofourcommunity’sgeneralwelfare. Tothisend, theHeritagePreservationCommissionischargedwithresponsibilityforfacilitatingthepreservationofRochester’sheritage. Thepurposesofthischapterareto:
A. SafeguardtheheritageoftheCitybyencouragingthepreservingofpropertiesthatreflectelementsofthecity’scultural, social, economic, political, visual, orarchitecturalhistory;
B. EnhancetheCity’sappealandattractiontoresidents, visitors, andtouristswhilepromotingitseconomicviabilitythroughtheprotectionandpromotionofitsuniquecharacterasrelatedtoitshistoryandheritage;

C. Enhancethevisualandaestheticcharacter, diversity, andinterestintheCitythroughattentiontohistoricproperties;
D. Fostercivicprideinthebeautyandnotableaccomplishmentsofthepast;
E. PromotethepreservationandcontinueduseofhistoricpropertiesfortheeducationandgeneralwelfareofthepeopleoftheCity;
F. Promotetheenvironmentalbenefitsofadaptingandreusingbuildings; and
G. Provideeducationalopportunitiesforheritagepreservation, actinanadvisorycapacitytoitscitizens, andreflectthehistoryofthemanygroupsthatmakeuptheCity’srichheritage.
Subd. 2. Bytheadoptionofthischapter, theCityintendstodrawareasonablebalancebetweenprivatepropertyrightsandthepublicinterestinpreservingtheCity’scultural, social, economic, religious, political, architecturalandaesthetichistory.
19B.02. HeritagePreservationCommissionEstablished. Subdivision1. ThereisherebyestablishedaCityofRochesterHeritagePreservationCommissiontoenforceandcarryouttherights, responsibilities, andprivilegesprovidedinthischapter.
Subd. 2. TheCommissionshallconsistof11votingmemberstobenominatedbytheMayorandappointedbytheCouncil. CommissionmembersmustbepersonswithdemonstratedinterestandexpertiseinhistoricpreservationandmustresidewithintheCity. TheCommissionshallinclude, ifavailable, amemberoftheOlmstedCountyHistoricalSociety. Demonstratedinterestandexpertisemayincludeexperienceandinterestinavarietyofvocationsandfieldsthatmaybeengagedinhistoricpreservationeffortsandissues, including, withoutlimitation, architecture, construction, legal, realestate, andeconomicdevelopment.
Subd. 3. Commissionmembersshallservestaggeredthree-yearterms.
A. UponcreationoftheCommission, fourmemberswillbeappointedforatermofthreeyearseach. Fourmemberswillbeappointedforatermoftwoyearseach. Threememberswillbeappointedforatermofoneyeareach. Eachinitialtermofofficeshallexpireon

stDecember31 oftheyearthetermisscheduledtoexpire. Allsubsequentappointmentswillbemadeforthreeyearterms. Allmembersshallserveuntiltheirsuccessorshavebeenappointedandqualified.
B. Within45daysofavacancy, theMayorshallnominateasuccessorforapprovalbytheCommonCounciltofilltheunexpiredtermoftheoffice. Ifavacancyoccursinatermwithlessthan45daysremaining, theMayormayallowthetermtoexpirewithoutnominatingasuccessor.
Subd. 4. Memberswillnotreceiveasalaryfortheirservices, butmaybecompensatedforanyapprovedexpensesincurredintheperformanceoftheirdutiesinaccordancewithguidelinesestablishedbytheCouncil.
Subd. 5. TheCommissionshallmeetatleastfourtimesayear. TheCommissionshallholditsfirstmeetingwithin45daysafterthedaythischapterbecomeseffective. Atthefirstmeeting, themembersshalladoptrulesconcerningthefollowingbusiness:
A. Time, dates, andplacesoffuturemeetings;
B. ElectionofOfficers; and
C. Votingandquorumrequirements.
Subd. 6. TheCommissionshallelectfromitsmemberssuchofficersasitmaydeemnecessary. TheCommissionshallhavethepowertodesignateandappointfromitsmembersvariouscommittees. TheCommissionshallmakesuchrulesasitmaydeemadvisableandnecessaryfortheconductofitsaffairsandforthepurposeofcarryingouttheintentofthischapter.
Subd. 7. EffectiveDate. Subdivisions2and3ofthissectionbecomeeffectiveforthoseappointmentsmadeonandafterthedatethisordinancetakeseffect. Itistheintentofthissubdivision toallowmembersoftheCommissionservingtermsofofficeatthetimethisordinancetakeseffect tocompletetheirappointedtermsofoffice.
19B.03. CommissionDuties. Subdivision1. Followingitsestablishment, theCommissionshallproviderecommendationsandconsultationtotheCityforadoptionandadministrationoftheHeritagePreservationProgram.
Subd. 2. TheCommissionshallhavethefollowingadditionalduties:

A. EnsurethatthereisanupdatedlistofallBuildings, Structures, Sites, orLandmarkDistrictswhichhavebeendesignatedasDesignatedProperties; and
B. Recommendtheallocationofsuchsubsidies, taxabatement, grants, revolvingloanfunds, andotherfundsthatmaybeprovidedbytheCitypursuanttotheHeritagePreservationProgram.
19B.04. Definitions. Subdivision1. Forpurposesofthischapter, thefollowingtermsshallhavethefollowingmeanings.
Subd. 2. Theterm “Alter” or “Alteration” shallmeanachangetotheexteriorofanexistingBuilding, Structure, orfeaturethatmateriallymodifiesitsoriginalappearanceorconstruction.
Subd. 3. Theterm “AssignedStaff” shallmeanamemberoftheCity’sstaffdesignatedtoserveasthestaffcontactpersonforthischapterandfortheHeritagePreservationCommission.
Subd. 4. Theterm “Building” shallmeananyStructurehavingaroofsupportedbycolumnsorwallsintendedfortheshelterorenclosureofpersonsorproperty. Whenroofedstructuresareseparatedfromeachotherbypartywallshavingnoopeningsforpassage, eachportionsoseparatedshallbedeemedaseparateBuilding.
Subd. 5. Theterm “CertificateofEconomicHardship” shallmeananapprovalissuedpursuanttosection19B.13.
Subd. 6. Theterm “City” meanstheCityofRochester, Minnesota.
Subd. 7. Theterm “Commission” shallmeantheHeritagePreservationCommission.
Subd. 8. Theterm “ContributingResource” shallmeanaBuilding, Site, Structure, orObjectthataddstothehistoricarchitecturalqualitiesorarchaeologicalvaluesforwhichapropertyorLandmarkDistrictisconsideredsignificant.
Subd. 9. Theterm “Council” shallmeantheCityofRochesterCommonCouncil.
Subd. 10. Theterm “Demolition” shallmeananyactorprocessthatdestroysinpartorinwholeahistoricresource. Thisincludestheremovalofany

materialconstitutingpartofastructurethataffectstheexteriorappearanceofthestructure, otherthanforpurposesofordinarymaintenanceorrepair, aswellasinadequatemaintenanceoranyotheractionthatreducesthestabilityorlongevityofastructureorimpairsitshistoricorarchitecturalintegrity.
Subd. 11. Theterm “DemolitionByNeglect” meansthelong-termneglectofahistoricstructurethatcontributestoalevelofdilapidationsoseverethatrehabilitationofthestructurenolongerservesasaviableoptionandDemolitionmustbeconsideredonaccountofthepublichealth, safetyandwelfare.
Subd. 12. Theterm “DemolitionPermit” shallmeanabuildingpermitthatauthorizesthedemolitionorremovalofanexistingBuildingorStructurefromasite. ThispermitisissuedinaccordancewiththerequirementsofMinnesotaRule1300.0120.
Subd. 13. Theterm “DesignatedProperty” shallmeanapropertylistedontheInventory, andfurthercategorizedas eitheraLandmarkProperty, PotentialLandmarkProperty, orLandmarkDistrict.
Subd. 14. Theterm “HeritagePreservationProgram” shallmeanaplanestablishedbytheCitythatcontemplatesavisionfortheCity'shistoricpreservationprogram, settingnear- andlong-termprioritiesfortheprogram, andidentifiesproactiveandinnovativestrategiesforachievingtheidentifiedgoalsandobjectives.
Subd. 15. Theterm “HistoricData” shallmeanresearchpapers, surveys, andmapsthatdescribeRochester’s architecturalandculturaldevelopmentpatternsinthecontextoflocal, regional, andnationalhistory.
Subd. 16. Theterm “Integrity” shallmeantheabilityofapropertytoconveyitssignificancerelativetotheaspectsoflocation, setting, design, materials, workmanshipandassociation.
Subd. 17. Theterm “Inventory” shallmeanacomprehensivelistingofallLandmarkDistricts, LandmarkProperties, andPotentialLandmarkProperties.
Subd. 18. Theterm “LandmarkDistrict” shallmeanageographically- definablearea, possessingidentifiedhistoricallysignificantconcentration, linkage, orcontinuityofaSite, Building, Structure, orObjectunitedbypasteventsoraestheticallybyplanorphysicaldevelopment.
Subd. 19. Theterm “LandmarkProperty” shallmeanapropertydesignatedpursuanttosection19B.08.

Subd. 20. Theterm “LandmarkPropertyDemolitionPermit” or “LPDP” shallmeanapermitissuedpursuanttosection19B.12.
Subd. 21. Theterm “LandDevelopmentManual” shallmeanchapters60through65, inclusive, oftheRochesterCodeofOrdinances.
Subd. 22. Theterm “Non-ContributingResource” shallmeanaBuilding, Site, Structure, orObjectthatdoesnotcontributetothehistoricarchitecturalqualitiesorarchaeologicalvaluesforwhichaLandmarkDistrictisconsideredsignificant.
Subd. 23. Theterm “Object” shallmeanconstructionotherthanaBuildingorStructurethatareprimarilyartisticinnatureorsmallinscaleandsimplyconstructed. Itmaybebynatureordesignmovable, butitisassociatedwithaspecificsettingandenvironment.
Subd. 24. Theterm “PotentialLandmarkProperty” shallmeanapropertydesignatedpursuanttosection19B.14.
Subd. 25. Theterm “Rehabilitation” shallmeanmakingaBuildingorStructuresoundandusablewithoutattemptingtorestoreittoaparticularperiodappearancewhileretainingthecharacter-definingfeatures.
Subd. 26. Theterm “Relocation” shallmeanmovingaBuildingorStructurefromitsoriginalhistoricallysignificantorexistinglocationtoanotherlocation.
Subd. 27. Theterm “Repair” shallmeanthelimitedreplacementinkind- orwithcompatiblesubstitutematerial--ofextensivelydeterioratedormissing
partsoffeatureswhentherearesurvivingprototypes (forexample, brackets, dentils, steps, plaster, orportionsofslateortileroofing).
Subd. 28. Theterm “Restore” shallmeantheactorprocessofaccuratelydepictingtheform, features, andcharacterofapropertyasitappearedataparticularperiodoftimebymeansoftheremovaloffeaturesfromotherperiodsinitshistoryandreconstructionofmissingfeaturesfromtherestorationperiod.
Subd. 29. Theterm “Significance” shallmeanthedocumentedimportanceofapropertyforitscontributiontoorrepresentationofbroadpatternsofnationalregionalorlocalhistory, architecture, engineering, archaeologyandculture.
Subd. 30. Theterm “Site” shallmeanthelocationofasignificantevent, 6
aprehistoricorhistoricoccupationoractivityoraBuildingorStructure, whetherstanding, ruinedorvanished, wherethelocationitselfpossesseshistoric, culturalorarchaeologicalvalueregardlessofthevalueofanyexistingStructure.
Subd. 31. Theterm “Standards” shallmeantheSecretaryoftheInterior’sStandardsforTreatmentofHistoricProperties.
Subd. 32. Theterm “Structure” shallmeanacombinationofmaterialstoformconstructionforuse, occupancy, orornamentation, whetherinstalledon, above, orbelowthesurfaceoflandorwater.
19B.05. IdentificationofHistoricProperties. Subdivision1. TheCommissionshallconduct, causetobeconducted, oracceptsubmittalsofsuchpreliminarysurveys, studiesorinvestigationsasdeemednecessaryoradvisabletoadequatelyinformtheCommissionandtheCouncilofapropertyanddistrictlocatedwithintheCitywhicharesignificant. ThedocumentsgeneratedandcollectedasaresultoftheseeffortsshallberecognizedastheHistoricDataandbemadepubliclyavailable. TheCommissionshallutilizetheHistoricDatafordeterminingtheeligibilityanddesignationofadistrictandproperty.
Subd. 2. HistoricDatashallbeusedtoguidestaff, theCommission, andtheCouncilindeterminingthehistoricsignificanceofdistrictsandpropertiesintheCity. HistoricDatashallincludetheHistoricContextPaperacceptedbytheCommissionandCouncilonApril6, 2015, asthesamemaybeamendedormodifiedfromtimetotime.
Subd. 3. AlistofDesignatedPropertiesandanupdatedcatalogueofallknownpublications, articles, books, pamphlets, policies, orothermaterialshavingadirectbearingontheHeritagePreservationProgramshallbekeptandmadeavailabletothepublic.
19B.06. Miscellaneous. Subdivision1. Thelimitedandsensitiveupgradingofmechanical, electrical, andplumbingsystemsandothercode- requiredworktomakepropertiesfunctionalisappropriatewithinarestorationproject. AllsuchworkmustmeettheStandards.
Subd. 3. ThepurposeoftheAssignedStaffshallbetomeetwiththeCommissionandtoprovideinformationatpublicmeetingsregardingproposedlanduseapplications, buildingpermitsandthenatureofthepropertysubjecttothischapter.
Subd. 4. DesignatedPropertiesareeligibleforandhaveprioritytoparticipateinCityincentiveprogramsrelatedtofinancial, developmentalortechnicalassistancethatwillservetopreserve, maintainorenhancetheir

historicandarchitecturalcharacter.
19B.07. EstablishmentoftheRochesterInventoryof DesignatedProperty. Subdivision1. TheInventoryisacomprehensivelistingofallLandmarkDistricts, LandmarkProperties, andPotentialLandmarkProperties. TheInventoryisintendedtorecognizeaDistrict, Building, Structure, Land, SiteandObjectlocatedintheCitythathasspecialsignificancetotheUnitedStates, Minnesota, ortheCity’shistory, architecture, archaeology, engineeringorculture. ThelocationofapropertylistedontheInventoryshallbedesignatedonmapsonfilewiththeCityClerk.
Subd. 2. FollowingtheCouncil’sadoptionofanordinancedesignatingapropertyontheInventory, theCityClerkshallrecordwiththerealestaterecordsofOlmstedCountyacertifiedcopyoftheordinanceincludingalegaldescriptionoftheproperty.
19B.08. DesignationofLandmarkProperty orLandmarkDistrict. Subdivision1. TheCommission shalldesignateaBuilding, Site, Structure, orObject, oranycollectionthereof, asaLandmarkPropertyorLandmarkDistrictwhentheCommissiondetermines, afterreceivingandconsideringtestimonyreceivedatapublichearingandapplyingthecriteriafoundinsubdivision2, thatthepropertyissoessentialtothehistoricfabricoftheCityandhasademonstratedqualityofsignificancethatpreservationmustbemandatedregardlessofapropertyowner’s consentshallbedesignatedasaLandmarkProperty orLandmarkDistrict. TheLandmarkProperty orLandmarkDistrictdesignationshalloccurbyordinance. ALandmarkPropertyorLandmarkDistrictissubjecttothetermsofthischapter. ALandmarkPropertyorLandmarkDistrictshallbeeligibleforcertainpreservationbenefitsandmaybeawardedpreservationincentivespursuanttothe HeritagePreservationProgram. Allindividualproperties listedontheNationalRegisterofHistoricPlacesreceiveautomaticLandmarkPropertydesignation. DesignationdecisionsmadebytheCommissionmaybeappealedtotheCouncil.
Subd. 2. IndesignatingaBuilding, Land, Site, Structure, orObject, oranycollectionthereof, asaLandmarkProperty orLandmarkDistrict, theCouncilmustconsiderthefollowingcriteria:
A. Itscharacter, interest, orvalueaspartofthedevelopment, heritage, orculturalcharacteristicsoftheCity, StateorUnitedStates;
B. Itslocationasaplaceofasignificanthistoricevent;
C. Itslocationwithinandcontributionasanelementofa8
LandmarkDistrict;
D. ItsidentificationwithapersonwhosignificantlycontributedtothecultureanddevelopmentoftheCity;
E. Itsembodimentofdistinguishingcharacteristicsofanarchitecturalstyleperiod, form, ortreatment;
F. ItsidentificationastheworkofanarchitectormasterbuilderwhoseindividualeffortshaveinfluencedthedevelopmentoftheCityorhavecontributedtothedevelopmentofanationallyorinternationally-recognizedstyleormovement;
G. Itsembodimentofelementsofarchitecturaldesign, detail, material, orcraftsmanshipthatrepresentasignificantarchitecturalinnovation; and,
H. Itslocation, scale, orotherphysicalcharacteristicsrepresentinganestablishedandfamiliarvisualfeatureoraneighborhood, adistrict, thecommunity, ortheCity.
Subd. 3. ForaLandmarkDistrictdesignation, inadditiontothecriteriafoundinsubdivision2, themajorityoftheContributingResourceintheproposedLandmarkDistrictmustalsosatisfythefollowingcriteria:
A. TheLandmarkDistrictisdeemedsignificantforitsantiquity; and,
B. TheLandmarkDistrictpossessesanappropriatedegreeofintegrityoflocation, setting, design, materials, workmanship, andassociationgivenitsage. TheCouncilshalladoptandmakeavailabletothepublicscoresheetsandotherdeviceswhichshallbeusedbytheCouncilinapplyingthiscriteria.
Subd. 4. Thepropertyowner, theCommission, theCouncil, oranymemberofthegeneralpublicmayfileanapplicationforaLandmarkPropertyorLandmarkDistrictdesignation. AnapplicationfeemaybeestablishedbyresolutionadoptedbytheCouncil. Theapplicationshallincludethefollowing:
A. Theapplicableinformationrequiredbythissection;
B. LandmarkPropertyorLandmarkDistrictboundarymap;
C. Propertyordistrictdescription, includingnarrativetext, 9
photographsorothergraphicmaterialsthatdocumentitsphysicalcharacteristics;
D. Writtendescriptionofhowthepropertymeetsthecriteriafordesignation;
E. WrittendescriptionofhistoricpreservationbenefitswhichtheapplicantrequestsbeawardedatthetimeofdesignationpursuanttotheHistoricPreservationProgram; and,
F. ForaLandmarkDistrict, alistofContributingandnon- ContributingResource.
Subd. 5. AnapplicationforaLandmarkPropertyorLandmarkDistrictdesignation shallbesubmittedtotheStateHistoricPreservationOfficeoftheMinnesotaHistoricalSocietyfora60-dayreviewperiod. TheStateHistoricPreservationOffice’snon-bindingcommentsshallbesenttotheCommissionforitsreview.
Subd. 6. IftheCommissiondeniesanapplicationsubmittedbyapropertyowneroramemberofthegeneralpublic, theapplicantmayfileanappealwiththeCouncil. AfeeforanappealmaybeestablishedbyresolutionadoptedbytheCouncil.
Subd. 7. AssignedStaffisauthorizedtorejectanyincompleteapplication.
19B.09. RemovalofLandmarkProperty orLandmarkDistrictDesignation. Subdivision1. AnapplicationfortheremovalofaLandmarkPropertyorLandmarkDistrictfromtheInventoryshallfollowthesamesubmissionrequirementsandreviewproceduresasfordesignationdescribedinthischapter, exceptthattheapplicationshallincludeanexplanationdescribingwhythepropertynolongermeetsthecriteriafordesignationasaLandmarkProperty orLandmarkDistrict. Afterapublichearingonthematter, theCommissionshalldetermineifsufficientevidenceexistsshowingthepropertynolongermeetsthecriteriafordesignation. Ifso, theCommissionshallremovethepropertyfromtheInventory. RemovaldecisionsmadebytheCommissionmaybeappealedtotheCouncil.
Subd. 2. Ifarequestforrescindingdesignationisdenied, anapplicationcannotbefiledagainforaperiodoftwoyearsfromthedateofthedenialbytheCouncil. TheCouncilmaywaivethistimelimitation.
19B.10. StandardsandBenefits. TheCommissionshallfollowthe10
StandardstopreserveandmaintainthehistoricandarchitecturalcharacterofaDesignatedPropertyandLandmarkDistrict. TheStandardsapplytotheexteriorfeaturesand/ornotablestreetscapeandlandscapeelementsofthedesignatedhistoricpropertyand/ordistrict. TheStandardsareintendedtoofferassistancetopropertyownersundertakingconstruction, Rehabilitation, Alteration, changesinexteriorappearanceoranyotherdevelopmentinvolvingadesignatedLandmarkPropertyorLandmarkDistrict.
19B.11. DevelopmentInvolvingLandmarkPropertyorLandmarkDistrict. Subdivision1. Exceptasprovidedinsubdivision2, noBuildingorStructureshallbeerected, constructed, enlarged, altered, repaired, relocatedorimprovedinvolving, andnobuildingpermit issuedfor, aLandmarkPropertyorwithinaLandmarkDistrictuntilplansorsufficientinformationhavebeensubmittedtotheAssignedStaffandapprovalisgrantedbytheCouncilafterreceivingandconsideringarecommendationoftheCommission.
Subd. 2. ExemptActivities.
A. Exemptactivitiesincludeinteriorremodeling, paintcolorselection, exteriorrepaintingorreplasteringsimilartotheexistingfinishorroutinemaintenancesuchascaulking, replacementoffasteners, repairofwindowglazingorothersuchminimallyintrusivework.
B. Ifthereisanyquestionifaworkactivityqualifiesasexempt, theCommissionshallmakethedeterminationastoitsstatus.
Subd. 3. InanemergencysituationwhereimmediaterepairisneededtoprotectthesafetyofaBuildingorStructureanditsinhabitants, theCityAdministratorandCitybuildingofficialmayapprovethepermitwithoutpriorCommissionaction.
19B.12. DemolitionofLandmarkPropertyPermit. Subdivision1. Itistheintentofthischaptertopreservethehistoricandarchitecturalresourcesthathavedemonstratedsignificancetothecommunity. Consequently, anapplicationforaDemolitionPermitthatwouldallowfortheDemolitionofaLandmarkPropertymustbeaccompaniedbyaLandmarkPropertyDemolitionPermitissuedbytheCouncil.
Subd. 2. TheprocedureforconsideringanapplicationforaLPDPisasfollows:
A. AnapplicationforaLPDP willbefiledwiththeAssignedStaff. Theapplicantwillbeprovidedawrittenresponsewithinfourteendaysoftherequestdescribingthesubmittal

materialsneededforconsideration.
B. AnapplicationforaLPDPshallincludethefollowing:
1) Thegeneralapplicationinformationrequestedinsection19B.08, subd. 3 andwrittendocumentationthattheBuildingisanimminenthazard; or
2) Narrativetext, graphicillustrationsorotherexhibitsthatprovideevidencethattheBuilding, Structure, orObjectisofnohistoricorarchitecturalvalueorimportance.
C. Whencompleteapplicationmaterialsareonfileandastaffreportispreparedanalyzingtherequestbasedontherequiredcriteriainsubdivisions3and4ofthissubdivision, theCommissionshallholdapublichearingtodetermineitsrecommendationastowhethertheapplicationshouldbeapproved.
Subd. 3. TheLPDPpermitapplicationshallbeapprovedifitisdemonstratedthattheapplicationmeetsanyoneofthefollowingcriteria:
A. ThepropertyhasbeendeterminedbytheCitytobeanimminenthazardtopublicsafetyandtheowner/applicantisunabletomaketheneededrepairsinatimelymanner;
B. TheStructureisnotstructurallysound; or
C. Nodocumentationexiststosupportordemonstratethatthepropertyhashistoric, architectural, archaeological, engineeringorculturalsignificance.
Subd. 4. Inadditiontothecriteriafoundinsubdivision3, theLPDPpermitapplication shallbeapprovedifitisdemonstratedthattheapplicationmeetsallofthefollowingcriteria:
A. TheStructuredoesnotcontributetothesignificanceoftheparcelorLandmarkDistrictinwhichitislocated;
B. ThelossoftheBuilding, StructureorObjectwouldnotadverselyaffecttheIntegrityoftheLandmarkDistrictoritshistoric, architecturaloraestheticrelationshiptoadjacentdesignatedproperties; and,

C. DemolitionoftheStructurewillbeinconsequentialtothehistoricpreservationneedsofthearea.
Subd. 5. TheCommissionshallrecommendtheLPDPapplicationbeapproved, disapproved, approvedwithconditionsorcontinuedinordertoobtainadditionalinformationnecessarytoconsiderthedemolitionrequest.
Subd. 6. IftheCommissionrecommendstheapprovaloftheLPDPapplication, thenaresolutionoftheCommissionactionwillbeforwardedtotheCommonCouncilforapprovalordenial.
Subd. 7. IftheCommissionrecommendsthedenialoftheLPDP, theapplicantmayappealtherecommendationormayresubmittheapplicationafteritobtainsaCertificateofEconomicHardship.
19B.13. CertificateofEconomicHardship. Subdivision1. ItisthepolicyoftheCitytorespectprivatepropertyrights, andtocomplywithstateandfederallaw. Atthesametime, itisthepolicyoftheCitytoprotectandpreservethoseBuildings, Structures, andSiteshavingaspecialhistorical, community, oraestheticvaluetothecommunity. Inbalancingthosepublicandprivateinterests, theCityrecognizesthattheremaybesomecircumstancesinwhichtheoperationofthischaptercouldcreateanundueeconomichardship. ThisprovisioniscreatedtoprovidepropertyownerswithameansofdemonstratingthatsuchahardshipmayexistandthattheyshouldbeallowedtodemolishaDesignatedPropertybecauseofthathardship.
Subd. 2. InordertoobtainaDemolitionPermitthatwouldpermittheDemolitionofaDesignatedPropertyonthebasisofaneconomichardship, theapplicantmustobtainaCertificateofEconomicHardship. TheCommissionmayrecommendandtheCouncilmayapproveaCertificateofEconomicHardshipifoneormoreofthefollowingcriteriaaremet:
A. ABuildinghaslostitsarchitecturalandhistoricalintegrityand/oritsremovalwillnotadverselyaffectaLandmarkDistrict’shistoriccharacter. Lossofintegritymustbesubstantiatedwithphotographicdocumentationandaphysicaldescriptionofthepropertythataddressesrelevantissues; or
B. ThedenialofaDemolitionPermitwillresultinanunreasonableeconomichardshipontheapplicantasdeterminedbytheCouncil, withrecommendationfromtheCommission, usingthefollowingcriteria:

1) ThepublicsafetyandwelfarerequirestheremovalofaStructureorBuilding; and
2) Ifthestructuralinstabilityordeteriorationofapropertyisdemonstratedthroughareportbyastructuralengineerorarchitect. Suchareportmustclearlydetailtheproperty'sphysicalcondition, reasonswhyrehabilitationisnotfeasible, andcostestimatesforrehabilitationversusdemolition.
Subd. 3. InsubmittingaLPDPapplication, theburdenofproofisontheapplicant. Inreviewingtheapplication, theCommissionandCouncilmayconsidereconomichardshipbasedonthefollowinginformation:
A. Currentlevelofeconomicreturn;
B. Amountpaidfortheproperty, dateofpurchase, partyfromwhompurchased, andrelationshipbetweentheownerofrecord, theapplicant, andpersonfromwhomthepropertywaspurchased.
C. Annualgrossandnetincomefromthepropertyandthepreviousthreeyears; itemizedoperatingandmaintenanceexpensesforthepreviousthreeyears, anddepreciationdeductionandannualcashflowbefore andafterdebtservice, ifany, duringthesameperiod.
D. Remainingbalanceonthemortgageorotherfinancingsecuredbythepropertyandannualdebtservices, ifanyduringthepriorthreeyears.
E. Realestatetaxesforthepreviousfouryearsandassessedvalueofthepropertyaccordingtothetwomostrecentassessedvaluations.
F. Allappraisalsobtainedwithinthelasttwoyearsbytheownerorapplicantinconnectionwiththepurchase, financing, orownershipoftheproperty.
G. Formofownershiporoperationoftheproperty, whethersoleproprietorship, for-profitornot-for-profitcorporation, limitedpartnership, jointventure, orother.

H. Anystateorfederalincometaxreturnsrelatingtothepropertyforthelasttwoyears.
I. Anylistingofthepropertyforsaleorrent, priceasked, andoffersreceived, ifany, withintheprevioustwoyears, includingtestimonyandrelevantdocumentsregarding:
1) Anyrealestatebrokerorfirmengagedtosellorleasetheproperty;
2) Reasonablenessofpriceorrentsoughtbytheapplicant; or
3) Anyadvertisementsplacedforthesaleorrentaloftheproperty.
J. Feasibilityofalternativeusesforthepropertythatcouldearnareasonableeconomicreturn.
K. ReportfromanarchitectorstructuralengineerwhomeetsprofessionalqualificationsestablishedbytheStandaredsastothestructuralsoundnessofanyBuildingonthepropertyanditssuitabilityforRehabilitation.
L. Costestimatesfortheproposedconstruction, alteration, demolition, orremoval, andanestimateofanyadditionalcoststhatwouldbeincurredtocomplywiththerequirementsforRehabilitation.
M. Estimatedmarketvalueoftheproperty:
1) Initscurrentcondition;
2) Aftercompletionoftheproposedalterationordemolition; and
3) Afterrenovationoftheexistingpropertyforcontinueduse.
N. ExperttestimonyoropiniononthefeasibilityofRehabilitationorreuseoftheexistingStructurebyanarchitectwhomeetsprofessionalqualificationsestablishedbytheStandards.

O. Dataprovidedbythepropertyownershowingeconomichardship.
Subd. 4. ApropertyownershouldconductroutinemaintenanceandmajorrepairsonaDesignatedPropertyinordertoensuretheirpreservation. Assuch, aCertificateofHardshipcannotbeissuedtoapropertyownerwhohasengagedinDemolitionByNeglect. Additionally, nopersonshallcommitDemolitionbyNeglect.
19B.14. DesignationofPotentialLandmarkProperty. Subdivision1. TheCommissionshallcompilealistofotherpropertiesthathavenotmetthecriteriaforLandmarkPropertydesignationbuthavehistoricorpotentiallyhistoricsignificancewithintheCity andmaybeconsideredeligibleforLandmarkdesignationatafuturedate. AllsuchpropertiesshallbedesignatedasPotentialLandmarkPropertyintheInventory. ApropertyownerofaPotentialLandmarkPropertyisencouragedtomeetproactivelywiththeCommissionbeforeundertakingdevelopmentplanstoreceivepreliminaryfeedbackonappropriatedevelopmentandbenefits.
Subd. 2. TobeeligiblefordesignationontheInventoryasaPotentialLandmarkProperty, theindividualBuilding, Site, StructureorObject, oracollectionthereof, musthaveademonstratedqualityofsignificance asdeterminedbythecriteriaprovidedinsection19B.08, subd. 2. TheCommissionshalldetermineifthepropertyshouldbedesignatedasaPotentialLandmarkPropertybasedonthedesignationcriteria.
Subd. 3. Thepropertyowner, theCommission, theCouncil, oranymemberofthegeneralpublic mayfileanapplicationfordesignationofaBuilding, District, Site, StructureorObjectasaPotentialLandmarkPropertyontheInventory. TheapplicationshallbesubmittedtotheAssignedStaff forreviewandrecommendation. Theapplicationforthedesignationofapropertyorcollectionofpropertiesshallincludethefollowing:
A. Theapplicableinformationrequiredbythissection;
B. SiteorLandmarkDistrictboundarymap;
C. Propertyordistrictdescriptionincludingnarrativetextphotographsorothergraphicmaterialsthatdocumentitsphysicalcharacteristics; and,
D. Writtendescriptionofhowthepropertymeetsthecriteriafordesignation.

19B.15. 60-DayNegotiationPeriod. Subdivision1. Thepurposeofthe60-DaynegotiationperiodismeetwiththepropertyownertodiscusstheHeritagePreservationProgramandbenefitsthatthepropertymaybeeligibletoreceiveupondesignationasaDesignatedProperty. IftheownerofaPotentialLandmarkPropertysubmitsalanduseapplication, anegotiationperiodofupto60daysshallbeinitiated. The60 negotiationperiodmaybeextendedanadditional30daysuponaresolutionadoptedbytheCouncil, orlongerifmutuallyacceptabletoboththeCouncilandthepropertyowner. NothinghereinshallpreventtheCityfromreviewinganylanduseapplicationorbuildingpermitaffectingthesubjectpropertyduringthe60-daynegotiationperiod.
Subd. 2. Withinthe60-daynegotiationperiodthefollowingshalloccur:
A. TheAssignedStaffPersonorotherCitystaffshalloffertomeetwiththepropertyownertodiscusstheHeritagePreservationProgramandbenefitsthatthepropertymaybeeligibletoreceiveupondesignationasaLandmarkProperty.
B. TheAssignedStaffshallmeetwiththeCommissionregardingtheproposedapplication andthenatureoftheproperty. Thepropertyownershallbeprovidednoticeofthismeeting. TheCommissionshallreviewappropriatecontextpaperstoevaluatetheIntegrityofthepropertyunderconsiderationandshallprovideCouncilwithanassessmentoftheproperty’sconformancewiththedesignationcriteria. Whenanybenefitsarerequestedbythepropertyowner, theCommissionshallalsoevaluatehowthedesignation, andanydevelopmentthatisconcurrentlyproposed, meetsthepolicyobjectivesfortheHistoricPreservationProgram.
C. TheAssignedStaffshallconferwiththeCouncilregardingtheproposedapplicationandthenatureoftheproperty, thestaff’s andtheCommission’sassessmentofitshistoricsignificance, andtheeffectsoftheapplication. Thepropertyownershallbeprovidednoticeofthismeeting.
D. TheAssignedStaffwillnegotiatewiththepropertyownertoreachamutuallyacceptableagreementforthepreservationofthepropertyinexchangeforthebenefitsmadeavailabletothepropertyowner. TheCouncilshallconsidertheappropriatenessandavailabilityofincentives, andshallalsoseektobeequitableintheincentivesawardedthroughthenegotiationprocess. Themonetaryvalueofincentivesbeing

requestedshallbedefinedtotheextentpossible. Whenincentivesareagreeduponaspartofthenegotiation, theCouncilshallrequirethatthepropertybeaLandmarkPropertyorcarryotherrestrictionsasdeterminedbytheCouncil.
E. Ifuponthepassageof60daysoranyextensionthereof, theCityandthepropertyownerhavefailedtoreachamutuallyacceptableagreement, affectedlanduseapplicationsshallproceedtobeprocessedasapplicationswithoutfurtherdelay. TheCouncil, orthepropertyowner, maychoosetoterminatenegotiationsatanytime.
Subd. 3. ThissectionisintendedtobeconsistentwithMinn. Stat. 15.99.
19B.16. RemovalofPotentialLandmarkDesignation. TheownerofaPotentialLandmarkPropertymayapplytotheCommissionforremovalofthePotentialLandmarkPropertydesignationbyprovidingevidencethatthepropertydoesnotmeetcriteriafordesignationasaLandmarkProperty. Afterconductingapublichearing, iftheCommissiondeterminesthatthepropertyshouldberemovedfromthePotentialLandmarkPropertymap, theAssignedStaffshallissuetheowneracertificatedocumentingtheremovalofthePotentialLandmarkPropertydesignation. ThesubjectpropertyshallnotbeeligibleforhistoricdesignationintheCityforaperiodoftwoyearsfromthedateofissuanceofthiscertificate. ThecertificateshallrunwiththelandandmayberecordedinOlmstedCounty.
19B.17. NoticeandPublicHearings. Subdivision1. AnapplicationfordesignationontheInventoryshallbetransmittedtotheAssignedStafftodetermineiftheapplicationiscomplete. Foracompleteapplication, areportwillbepreparedbyAssignedStafffortransmittaltotheCommissionwiththerelevantinformationontheproposedhistoricpropertyordistrictwitharecommendationtoapproveordisapprove, andthereasonsfortherecommendation.
Subd. 2. AdateforapublichearingonacompleteapplicationwillbescheduledbeforetheCommission. Noticeofthehearingshallbeprovidednotlessthan15daysbeforethehearinginanewspaperofgeneralcirculation. ForDistricts, noticeofthehearingshallbemailedtoallownersofrecordofpropertylocatedinwholeorinpartwithin350feetoftheboundariesofthesubjectpropertynotlessthan15daysbeforethehearing.
Subd. 3. TheCommissionshallevaluatetheapplicationtodetermineif18
thepropertyordistrictmeetsthecriteriafordesignation. Atthepublichearing, thepropertyowner, partiesofinterestandcitizensshallhaveanopportunitytoprovideinformationaboutthepropertyordistrict’seligibilityfordesignation. TheCommissionmayapprove, disapprove, orcontinue theapplicationtorequestadditionalinformationnecessarytomakeadecisiontoapproveordeny.
Subd. 4. Ifanapplicationisdenied, theAssignedStaff, theCommissionortheCouncilmaynotfileareapplicationfordesignationofthesamepropertyordistrictontheInventoryfortwoyearsfromthedateoftheCouncildisapproval. Councilmaywaivethisprohibition.
19B.18. HeritagePreservationProperties – IncentivesforConservationandPreservation. Subdivision1. TheCityiscommittedtoprovidingsupporttopropertyownerstoassisttheireffortstomaintain, preserveandenhancetheirhistoricproperties. Benefitstoencouragegoodhistoricpreservationpracticesbyan ownerofaDesignatedProperty is animportantaspectofHistoricPreservationProgram.
Subd. 2. Throughgrantsorothersourcesoffunding, theCitymayprovideahistoricmarkerofastandarddesignforanyownerofaLandmarkPropertyorpropertywithinaLandmarkDistrictwhodesiresamarkertoinstallontheirBuilding. TheCitymayalsodevelopamarkerorsignageprogramtorecognizedesignatedLandmarkDistricts.
Subd. 3. TheCitymayauthorizefundingsourcestocreateafinancialincentiveprogramforpurposesofencouragingownersofaDesignatedPropertyorpropertywithinaLandmarkDistricttopreservetheirpropertyforpurposesofhistoricpreservation. TheCommissionwilladvisetheCouncilonorganizationandadministrationforanysuchlocalfinanceprogram.
Subd. 4. TheAssignedStaffwillprovideguidanceandassistanceinapplicationsforStateandNationaltaxcreditprograms.
19B.19. Appeals. AlldecisionsbytheCommissionareappealabletotheCouncil.
19B.20. Penalty. Anypersonviolatingthischapterisguiltyofamisdemeanor. Inaddition, theCouncilmayauthorizetheCityAttorneytoinitiateanyequitableproceedingagainstanypersonwhoconstructs, alters, relocates, changestheappearanceordemolishesaLandmarkPropertyorpropertywithinaLandmarkDistrictinviolationofthischapter.
