C anada’s competition commissioner says any member of the public should be able to find out a home’s sale price. Should you care whether someone knows how much you paid for your home? Some people think that information should be made public, while others believe that constitutes an invasion of privacy. Why should a stranger have access to that kind of information? This issue is a big bone of contention and now the basis of a lawsuit launched by Ottawa’s Commissioner of Competition against the Toronto Real Estate Board. The commissioner holds that anyone should be able to go onto a real estate brokerage’s website and see any price of a recently sold home in their neighbourhood. In Ontario, real estate agents can view prices through their local MLS system, but members of the public cannot. In Canada, only Nova Scotia lets everyone see this information, while in the United States, access is for the most part universal. More of my clients are asking if there is a way to keep the price they paid for their home off the title records that are accessible by anyone. It can be done if you make arrangements to pay the land transfer tax before closing. This way you keep the price you paid off the title. The competition commissioner believes that if sold prices were publicly available, buyers could figure out what to offer on a home themselves and would not need to employ a real estate agent. 10 Ways to Cut Your Moving Costs

Moving can be a very chaotic andexpensive task, one that needs tobe accomplished very carefully. A

move carried out in haste can bring aboutseveral unnecessary problems. Almosteveryone looks for cheap movers.However, there are professional movingcompanies, who offer competitive rates thatare easily affordable by everyone. There arecertain techniques or methods ofpreparation that can also help you minimizeyour expenses. Keeping a check on theoutflow of cash will make you betterprepared to understand unnecessaryexpenses. Creating a budget template inExcel or Microsoft Word—will make yourcalculations easier. If you are hiring amover, collect quotes from at least threedifferent professional moving companiesand include the highest quote in yourbudget. Check all the items that you aremoving. Luggage and carryingbags are perfect for packing sheets, towelsand clothing. Also, the bottoms of wardrobeboxes are great for bulky, lightweight items.Be wary of packing tips that might save youmoney initially but won't protect your stuff,for example, using newspaper instead ofbubble wrap.4) Drive your own moving truck. Using afull service moving company is extremelyexpensive. You can rent your own truck andhire movers to help load up and unload.5) Recruit help from friends or family. Ifyou have friends or family in the area,getting them to help you load up and/orunload is a blessing, because it saves timeand money. If you’re going to recruit help,make it's a fun event. Order some food, andmake it a moving party.6) Avoid the busy season. June, July, andAugust are the most expensive months touse a professional mover due to demand formoving services. Also, try to plan yourmove during the middle of the month—rates are higher at the beginning and the endbecause of the large number of apartmentleases with month-end dates. If you can beflexible with your move-in times, you can

also save money because the movingcompany can combine shipments.7) Get organized. Color-code boxesaccording to the room they belong in sothey all end up in the same place, savingtime for both you and your mover.8) Avoid storage costs by moving into yournew property immediately and make surethat you have payment ready for when thetruck arrives. Delays could result instorage-in-transit fees if your thingshave to be stored until they can beunloaded.9) Make sure you are insured. Your existinghomeowner’s insurance policy might coveryour move so you don't have to buyadditional moving protection.10) Your move may be taxdeductible. The seller's real estate broker or salespersonrepresents the interests of the seller in the trans-action. The decisions about how offers are pre-sented and responded to, as well as which offeris accepted, are made by the seller.

The buyer's real estate broker or salesper-son represents the interests of the buyer in thetransaction. The buyer makes the final deci-sions related to their offer, including the impor-tant decision of whether or not they want toparticipate in a competing offer situation.

In some situations, the real estate broker orsalesperson will represent the interests of bothseller and buyer or multiple buyers. Consumersshould seek guidance from their real estate bro-ker or salesperson if this situation arises.

The Listing Agreement

When you decide to sell yourhome with a REALTOR®, oneof the most important forms

you will encounter is the ListingAgreement. The Listing Agreement isthe contract between you and the realestate brokerage authorizing thebrokerage, including its brokers andsalespeople, to market your property.The Listing Agreement is such animportant part of your real estatetransaction that you'll want to be sure itis as comprehensive and accurate aspossible. Your REALTOR® will workwith you to fill in all the details andleave nothing to chance.Detailed information about your home isspelled out in the listing agreementwhich helps other REALTORS®respond to questions from potentialbuyers about your property. Also, theListing Agreement forms the basis forany offers drafted on your home as wellas any resulting negotiations involvingthe offer.There are two types of listings - an"Exclusive" listing and a "Multiple"listing. An exclusive listing gives thebrokerage the sole right to find a buyerfor your home during a specific timeperiod. You agree to pay a pre-established real estate commission to thebroker once the sale is completed. Thecommission is payable to the brokerregardless of whether someone else sellsyour home -- including yourself duringthe set period or even if your home sellsat a future date to someone the brokerintroduced to the property.A multiple listing is also an exclusivelisting between you and the broker, butincludes your authorization to allow thebroker to market your home on theMultiple Listing Service (MLS) andhave other REALTORS® help to find a

buyer. In this case, you pay the agreedupon commission and it is sharedbetween the listing broker and theREALTOR® who found the buyer.Most often, a REALTOR® willrecommend that you list your homethrough the MLS so that you receivemaximum exposure in the shortest timepossible. Many REALTORS® inOntario use a standard listing agreementform such as the one published by theOntario Real Estate Association.

Because the Listing Agreement is sovital to the whole real estate transaction,REALTORS® are well-trained tocarefully include every last requireddetail. The agreement is divided into twosections - authority and property details.The authority section establishes thelegal relationship between you and thereal estate broker, sets a time limit forthat relationship, and describes theobligations of each party. The detailsection provides information about theproperty being offered for sale and theideal terms the seller would like to see inan offer. Your property will becompletely identified by its full legaldescription, including street and house

number, as well as to lot and plannumber if the property is in a registeredplan or subdivision.Your property size and location, floorarea, room sizes, style and number ofrooms, zoning, building age and type ofconstruction will all be spelled out onthe Listing Agreement. The listing price is specified along withany other clauses regarding price orterms. There is a specific reference tothe commission that will be paid upon asuccessful sale, trade or exchange of theproperty.Other details to be filled in on theListing Agreement include mortgageinformation, how many days untilclosing after your home sells, and howyour property will be shown. YourREALTOR® will also discuss with youwhat items you are willing to sell alongwith the home. These items usually fallunder one of two categories - fixtures orchattels. Fixtures are permanentimprovements that normally stay with aproperty as part of the sale.
