Almost anyone has seen or heard the termMLS, but few people actually knowexactly what MLS is or understand how it

plays an important role in today's real estate market.No to be confused with the public MLS know as

mls.ca or realtor.ca. The MLS System is the realtorsMLS which members pay fees to have access to cur-rent inventory and up to date information you wouldnot find on the public website.

The MLS system or the Multiple Listing Serviceis an information sharing and co-operative marketingnetwork created to help buy and sell homes. Today itis online based but it began as an exchange of paperlisting information and photographs.

The MLS is paid for by the realtor members of thelocal real estate association. It symbolizes the cooper-ation among realtors to effect the purchase and sale ofreal estate. It is much more than a database of proper-ty information though. It is the local real estate associ-ation that administers and operates the local MLS sys-tem. The Canadian Real Estate Association (CREA)owns the trademark and licenses its use to boards andassociations across Canada.

MLS makes the real estate industry unique byencouraging a high degree of cooperation amongsalespeople. For example, if you are shopping for a carand you visit a local dealer, the salesperson's goal is tosell you a car from that car lot. They won't provide youwith information on cars available at other competingdealerships. In the real estate industry, the opposite istrue. MLS allows for cooperation between all realtorsno matter which company they work for.

If you are selling a property with a realtor whouses MLS it means your property will get the maxi-mum marketing exposure to all other members of thelocal association. You'll have realtors everywhere try-ing to find a buyer for your home. It is the MLS com-puter system that will provide other members of thereal estate association with detailed information aboutyour home.

If you are buying a property, MLS is a valuableresearch tool for your realtor. The realtor can input thecriteria you want and generate a list of all propertiesthat meet your requirements or needs. These homesmight be listed by other realtors or your own realtor.The goal is to help you find the property you want.

MLS supplements the realtors in-depth knowledge ofthe neighborhood and current market conditions tohelp you make a wise buying decision. The MLS sys-tem provides realtors with access to much moredetailed information than you will find on a publicwebsite. MLS information in most cases, will includeroom measurements, specifics on the property condi-tion, renovations, appliances, property zoning and taxinformation. Through the system, realtors can alsoaccess the sales history of a home in order to see howmany times it has changed hands and what the sellingprice(s) were.

People tend to think it’s harder to sell yourhome in winter than in spring or summer.While this may be generally true, there are

always people looking to buy. Whether it’smoving to a larger home after a newborn baby(or two), relocating for work, taking advantageof the slower months to view homes at a morecomfortable pace, or even downsizing ifnecessary, there is never an ‘off-season’ in realestate!Naturally, there is less competition on themarket in these winter months. While there maynot be as many buyers either, the above factorsmean that there are still people looking to buy.With less available houses on the market, youwill have more time on average to show thesepeople your home, which increases the

likelihood that they’ll become interested andmove forward with purpose.You can take advantage of the cold weather byplaying up the warm, cosy feeling people getwhen entering a welcoming home in the winter.Make sure the house is well heated. This can beeasily overlooked, especially if there is no oneliving in the home at the time. People will notwant to linger around a freezing house for long!Little things like lighting candles, having someslippers at the front door for people, or havinghot chocolate ready for people when they arrivecan really set the mood upon arrival. Makepeople feel as comfortable as possible, and goodthings will happen.

Does a minute matter in a real estate deal?

Real estate contracts often saydeals must be concluded no laterthan 6 p.m. on the day of closing.

What happens if you miss the deadline?The standard Ontario real estate contractsays deals must be concluded no laterthan 6 p.m. on the day of closing. But ifyou’re a minute late, will that kill thedeal?On Friday, Nov. 30, 2007, lawyerMichael Gatien went to the Cornwall,Ont., registry office to register a deed onbehalf of his client, who had just boughta plaza. He had wired the purchase fundsto the trust account of the seller’s lawyerjust after 4 p.m. and received the finalgo-ahead to register the deed at 4:53p.m. But when he tried to register thedeed, he missed the 5 p.m. deadline byone minute. The registration systemwould not accept anything after 5 p.m.The seller then tried to cancel the deal,claiming the deed was not registered intime. The buyer’s lawyer argued thatsince all steps had been taken to closethe deal, the deed registration could takeplace when the registry office reopenedon Monday.The sale had involved difficultnegotiations and there were some hardfeelings, which all contributed to theseller trying to cancel the deal. It went tocourt in March 2009 and a judge ruledthe seller could not refuse to close.Normally, real estate deals close whenthe money has been delivered from thebuyer’s lawyer to the seller’s lawyer andtitle has been transferred to the buyer.Funds are usually sent by wire transfer.The seller’s lawyer releases the deed fortransfer on the government computerregistry system and the buyer’s lawyerthen completes the computerregistration.Why does the standard agreement say

that deals can be completed by 6 p.m. ifthe computers close down at 5 p.m.?In order for the computer registrationprocess to operate efficiently, lawyersfor the buyer and seller sign anagreement that says all the money willbe held in escrow until the deed getsregistered. In many cases, buyers arewaiting for their own sale deal to closein order to get the money to close theirpurchase. As a result, there is often notenough time to get the money wired intothe trust account and to complete theelectronic registration before 5 p.m. Thisis especially true at the end of the month,when many deals are closing on thesame day.As a result, in many cases, the dealcloses after 5 p.m. “in escrow.” Thelawyers agree that even though the deedis not registered, the buyers can moveinto the home, the seller’s lawyer willhold the money overnight in their trustaccount and the deed will be registeredthe next morning. This escrowagreement is typically completed before6 p.m.Can a seller get out of the deal if themoney is not delivered to their lawyerbefore 5 p.m.?

While this did not occur in the abovecase, a judge will also look at the localpractice of how real estate deals areconducted.In another case, a buyer’s lawyer waslate getting the cheque to the seller’slawyer. The seller tried to cancel thedeal. The court found that the sellercontributed to the deal closing late bydelaying the final closing visit of thebuyer and not giving the buyer’s lawyerinstructions as to how to make thecheques payable until late in theafternoon.Another question that arises on closingis when does a seller have to let thebuyer into the house?This should happen as soon as titleregistration takes place and not laterthan 6 p.m. if it is an escrowarrangement. In one case, a buyer’smovers sat in the driveway from 6 p.m.on the day of closing until 9 p.m.,waiting for the sellers to leave. It costthe sellers more than $1,000 to pay forthe buyer’s additional moving costs,since they were late leaving the home.Sellers also cannot leave junk in thehouse on closing.
