TERMS & CONDITIONS
1. General: 1.1 Any offer not received as per terms & conditions of the tender enquiry is liable to be
ignored. No offer shall be considered if:
Received without earnest money 2% (19,960)of total tender estimated value
It is received after the time and date fixed for its receipt.

The offer is ambiguous
The offer is received by fax or e-mail
The offer is from a black listed firm.
Offer received with shorter validity than required.
The offer is for store not conforming to specifications indicated in the tender enquiry.

1.2 Offer rates (in Pak Rupees) will remain valid for a period of 1 Year from the date of opening the tender. No change in price will be made in case of Pak rupees variation against US$ or any other currency.
1.3 The cover envelope should indicate particulars of tender, and date of opening. The envelope must be properly sealed.
1.4 The purchaser reserves the right to issue order in full / partial quantity or as per requirement during the year as per framework rate contract basis.
1.5 The earnest money / security shall be forfeited if:
a. The acceptance of tender is not received within ten days of issuance of order b. The offer is withdrawn, amended or revised. c. The contractor fails to execute the contract strictly in accordance with terms and
conditions.
1.6 The bidder should indicate their National Income Tax No. / Sales Tax No. and circle of Income Tax Department.
1.7 The contractor will be responsible for the free replacement of stores if the same is found to be substandard and or at variance with the specifications given in the supply order within one week. Store offered of specifications superior to the one specified in the tender enquiry may be accepted subject to approval of approving authority.
1.8 Store should be brand new and in original manufacturers packing.
1.9 Offered rates will be on basis of free delivery to VTI JAMPUR and shall include all taxes.

1.10 Quantity of any item can be increased or decreased by the purchaser as per PPRA rule.
1.11 Whole tender can be cancelled by the Competent Authority of the institute without assigning any reason.
1.12 As it is framework tender so payment will be made on completion of each supply order whenever it is required during the year.
1.13 The supplier will be responsible for fitting, alteration and replacement of Uniforms accordingly. In this regard luggage charges will be the sole responsibility of supplier.
1.14 Management of VTI Jampur reserves the right to get the quality of cloth tested from a reputed Textile test laboratory at the cost of firm on each supply.
1.15 Purchase order will be issued by the Vocational Training Institute JAMPUR after signing the agreement with bidder.
2. Schedule of Requirement
The supplies shall be delivered within 10 to 15 days w.e.f. the next date after from the date of issue of
Purchase Order (without penalty), and with prescribed liquidated damage under clause 41.2, after the
grace period of 05
Days (as per following schedule of requirement):

Liquidated Damage In case of late delivery of goods beyond the periods specified in the

3. Extension of Delivery period:
In special circumstances, request for extension of delivery period may be considered by
approving authority on the written request of the firm before the target date of supply.
4. Cancellation / Penalty of Delay:
4.1 If the acceptance of the tender issued during the validity period of the tender is not
acceptable by the tenderer, the earnest money will be forfeited and the stores can be
purchased at his risk and cost.
4.2 In case the offer is withdrawn, amended or revised during the validity period of the
tender, the earnest money shall be forfeited.

4.3 In case bidder fails to execute the contract in accordance with the terms & conditions laid
down in the contract, the bank guarantee will be en-cashed and the store will be
purchased at his risk and cost.
5. Payment to the Contractors:
(1) Payment will be made through crossed cheque to the supplier against invoice after 100%
completion of delivery, commissioning & satisfactory performance against the each purchase order from Vocational Training Institute JAMPUR within 30 days after issuance
of satisfactory report by the VTI. (2) Payment against partial supply will not be made.
6. Earnest Money:
6.1 Earnest money 2% of tender amount Rs: 19,960=/ will have to be deposited along with tender. It should be in the form of Pay Order from a bank, Bank Draft / Call Deposit in the favor VTI JAMPUR.
6.2 Earnest money of successful bidder shall be refunded on successful completion of supply or submission of required bank guarantee in shape of performance bond. Whereas earnest money of unsuccessful bidders will be refunded on the approval of tender by Competent Authority.
7. Delivery / Inspection of store
The Material will be inspected by the VTI through an authorized personnel and will reject the
material, if not found according to the given specification. The delivery of the material will be
made in the premises of VTI JAMPUR.
8. Deduction of Taxes:
Any taxes (if applicable GST, Income Taxes or any other tax) will be deducted while making
payment as per Government instructions/ notifications.
9. Payment of sales & other taxes, duties, levies:
Purchase shall be made from the firms registered with income /sales tax. Sales and other such
taxes, import duty, surcharge and other will be liability of the supplier. Vender will get the
shipment cleared from customs at his risk and cost, Certificate / letter for exemption of GST and
WHT can be provided by the supplier to Vocational Training Institute (VTI) if required as per
government instructions.
10. Performance Guarantee:
Within 14 days of the receipt of Purchase Order, the successful Bidder shall furnish the
Performance Guarantee/Security in the form of Bank Guarantee/CDR or Demand Draft, issued
by schedule bank operating in Pakistan. The Performance Guarantee will be 5% of contract
amount, as specified in Special Condition of Contract.
Failure of the successful Bidder to comply with the requirement of (ITB Clause 39.1) shall

constitute sufficient grounds for the annulment of the Award, in which event the Procuring
Agency may make the Award to the next lowest evaluated Bidder or call for re-bidding.

11. Termination of Contract:
Competent Authority of concerned VTI may terminate contract for assigning any reason or
without assigning any reason and will inform the supplier about his decision in writing.
12. Arbitration and Resolution of Disputes
12.1 The Procuring Agency and the Supplier shall make every effort to resolve amicably by direct
informal negotiation any disagreement or dispute arising between them under or in connection
with the Contract.
12.2 If, after thirty (30) days from the commencement of such informal negotiations, the
Procuring Agency and the Supplier have been unable to resolve amicably a Contract dispute,
either party may require that the dispute be referred to the Arbitrator for resolution through
arbitration.
12.3 In case of any dispute concerning the interpretation and/or application of this Contract
shall be settled through arbitration. Dr.Capt. (R) Abdul Kareem Khan Executive Member, VTI
JAMPUR or his nominee shall act as sole arbitrator. The decisions taken and/or award made by
the sole arbitrator shall be final and binding on the Parties
13. Information about firms (Company Profile):
The firms shall supply information along with tender about the following:
a. List of customers b. Company profile mentioning at least one year. c. Copy of NTN and GST certificate.
14. Technical Evaluation
a. Company should be supplier of same products from the last one year. b. Annual turnover of Company for the last three years. c. Response / rectification time for complaints handling will be 36 hours. After 36 hrs, VTI
will arrange to rectify the problem at risk and cost of Bidder. 15. Evaluation Criteria d.

16. Bid / Tender opening procedure
a. The bid shall comprise a single package containing one envelope. Envelope shall contain the financial proposal along with the company profile and other required documents i.e. NTN, Sales Tax and Income tax registration certificates etc.+
b. The proposals of bid shall be opened publicly at a time, date and venue announced and communicated to the bidders in advance.
17. Breakage Warranty during Delivery of Items A warranty of Breakage will be provided free of cost which will also cover replacement of parts.
18. Warranty period etc.

19. Ensuring Storage/ Installation Arrangements
To ensure storage and installation arrangements for the intended supplies, the Supplier shall
inform end user for pre-requisites well in time for proper installation. In case the Supplier
abides by the given time frame he shall not be penalized for delay.
In case of late delivery of goods beyond the periods specified in the Schedule of
Requirements, penalty/liquidated damage Rs: 1,000 per day for late delivered supply shall be
imposed upon the Supplier? (Not exceeding 10 % of the purchase order value)
20. Inspections and Tests
The Procuring Agency or its representative shall have the right to inspect and/or to test the
goods to confirm their conformity to the Contract specifications at no extra cost to the Procuring
Agency.
For the purpose of inspections and tests of goods, The Supplier, shall Provide all reasonable
facilities and assistance, to the inspectors at no charge to the Procuring Agency. However, if the
Supplier proves an undue delay in conduct of inspection on the part of Procuring Agency, the
Supplier shall not be liable for penalty on account of that delay. The cost of such lab tests shall
be borne by the Manufacturer/ Supplier (The Procuring Agency will notify to the bidder regarding
his inspection team members).

The Procuring Agency reserves the right to inspect, test and, where necessary, reject the goods
after the goods have been installed at Procuring Agency’s destinations.
Nothing in GCC Clause 9 shall in any way release the Supplier from any warranty or other
obligations under this Contract.
21. Physical Examination/ Inspection of Goods
The goods shall be acceptable subject to physical inspection, tests and/ or in accordance with
the approved sample as decided by the Procuring Agency
22. Delivery and Documents The Supplier in accordance with the terms specified in the Schedule of Requirements shall make delivery
of the goods. The details of documents to be furnished by the Supplier are specified in SCC.
23. Insurance The goods supplied under the Contract shall be delivered duty paid (DDP) under which risk is transferred
to the buyer after having been delivered; hence insurance coverage is Suppliers responsibility.
24. Transportation
The Supplier shall arrange such transportation of the goods as is required to prevent their
damage or deterioration during transit to their final destination as indicated in the Schedule of
Requirement.
Transportation including loading/ unloading of goods shall be arranged and paid for by the
Supplier, and related cost shall be inclusive in the Contract price. The addresses of destinations/
offices shall be provided at the time of signing of the Contract.
25. Incidental Services
The Supplier shall be required to provide the incidental services as specified in SCC and the cost
of which shall be included in the total bid price.
26. Supply of Items
The successful firms will be responsible to deliver the items to the concerned institute along with
complete documents / accessories/Booklets
All packing will be opened in front Principal/AAO of the institute
Used/Second Hand items would not be acceptable at any cost.
