    (3) A major portion of the traff ic in controlled substances f lows

    through in ters ta te and foreign commerce. Incidents of the t raf f ic

    w hichare not an in teg ral p ar t of the in te rs ta te or foreign flow, such as

    manufacture , local d is t r ibut ion, and possess ion, nonetheless have a

    subs tant ia l and direct ef fect upon in ters ta te commerce because

    (A ) a f te r m anu fac tu re , ma ny con t ro l l ed subs tances a re t r an s

    por ted in in ters ta te commerce,

    (B ) control led subs tances d is t r i but ed local ly usua l ly have been

    t ranspor ted in in te r s ta te commerce immedia te ly befo re the i r d i s

    t r ibu t ion , and

    (C) control led subs tances possessed commonly f low through

    inters ta te commerce immediate ly pr ior to such possess ion.

    (4) Local d is t r ibut ion and possess ion of control led subs tances con

    t r ibute to swel l ing the in ters ta te t raf f ic in such subs tances .

    (5 ) Con t ro l l ed subs tances ma nufac tu red an d d i s t r ibu ted in t r as ta te

    cann ot be d i f ferent ia ted from con t ro l l ed subs tances ma nufac tu red and

    dis t r ibuted in ters ta te . Thus , i t i s not feas ib le to d is t inguish , in terms

    of contro ls , between control led subs tances m an ufa ctu red and dis

    t r ibu ted in te r s ta te and con t ro l l ed subs tances manufac tu red and d i s

    t r i b u t e d i n t r a s t a t e .

    (6) Fe de ral co ntrol of the in t ra s ta te incidents of the traf fic in con

    trolled substances is essential to the effective control of the interstate

    incidents of such traffic.

    any narcot ic drug so as to endanger the publ ic morals , heal th , safe ty ,

    or welfare, or who is sofar addicted to the use of narcot ic drugs as to

    have los t the power of se l f -control wi th reference to h is addict ion.

    (2 ) Th e t e rm " adm in is te r " r e fe r s to the d i r ec t app l ica t ion o f a con

    t ro l led subs tance to the body of a pat ient or research subject by

    obtained, and who possesses , a control led subs tance for h is own use or

    for the use of a member of h is household or for an animal owned by

    him or by a me mb er of h is hou sehold .

    (26) Th e t e rm "U ni te d S ta tes " , when used in a geog raph ic s ense ,

    means a l l p laces and waters , cont inental or insular , subject to the

    ju r i sd ic t ion of the U ni te d S ta tes .

    SEC.

    201 . ( a ) The At to rney Genera l sha l l app ly the p rov i s ions o f

    th i s t i t le to the control le d subs tances l i s ted in the schedules es tabl ished

    by sect ion 202 of th is t i t le and to any other drug or o ther subs tance

    added to such schedules under th is t i t le . Except as provided in sub

    sec t ions (d ) and (e ) , the At to rney Genera l may by ru le

    (1) add to such a schedule or t ransfer between such schedules

    any drug or o ther subs tance i f h e

    (A ) f inds th a t such dr ug or o the r subs tance has a pot ent ia l

    for abuse, and

    B ) mak es wi th respect to such dr ug or o the r subs tance the

    findings pre scrib ed by subsection (b) of section 202 for t he

    schedule in which such d ru g is to beplaced; o r

    (2) remove any drug or o ther subs tance f rom the schedules

    i f he f inds that the drug or o ther subs tance does not meet the

    other substance should be so control led or removed as a control led

    substance . In making such evalua t ion and recommendat ions , the Secre

    torney General as to such scient i fic and medical matters, and i f the

    S ecre tary recomm ends tha t a dr ug or o ther substance not be con

    t ro l led , the At torney Genera l sha l l no t cont ro l the drug or o ther sub

    s tance . I f the At torney Genera l de termines tha t these fac ts and a l l

    o ther re levant da ta const i tu te substan t ia l ev idence of po ten t ia l for

    abuse such as to warran t cont ro l o r substan t ia l ev idence tha t the drug

    or other substance should be removed ent i rely from the schedules,

    (c) In making any finding under subsect ion (a) of this sect ion or

    un de r subsect ion ( b) of sect ion 202, the A tto rn ey G ene ral shal l con

    s tance proposed to be cont ro l led or removed from t he schedu les :

    (1) I t s ac tua l o r re la t ive poten t ia l for abuse .

    (3) The s ta te of curren t sc ien t i f ic knowledge regard ing the

    dr ug or o the r substance .

    (4) I t s h i s tory and curren t pa t te rn of abuse .

    (5) T he scope, du ra t io n, an d significance of abuse .

    (6) W h at , i t any , r i sk there i s to the publ ic h ea l th .

    (7) I t s psychic or physio logica l dependence l iab i l i ty .

    (8) W he the r the substance i s an im me dia te precu rsor of a sub

    s tance a l ready cont ro l led under th i s t i t l e .

    (d) I f cont ro l i s requi red by U ni te d S ta tes ob l iga t ions unde r in ter

    nat ional t reat ies, conventions, or protocols in effect on the effect ive

    date of th i s par t , the At torney Genera l sha l l i ssue an order cont ro l l ing

    such drug under the schedule he deems most appropria te to carry out

    such obl ig at ion s, w itho ut reg ar d to the findings re quir ed by subsec

    t ion (a) o f th i s sec t ion or sec t ion 202(b) and wi thout regard to the

    pro ced ure s pre scrib ed by subsect ions (a ) a nd (b) of thi s sect ion.

    (e) T he A t tor ne y Gener a l m ay, w i tho ut reg ard to the f indings

    required by subsect ion (a) of this sect ion or sect ion 202(b) and with

    out regard to the procedures prescribed by subsect ions (a) and (b) of

    th i s sec t ion , p lace an immedia te precursor in the same schedule in

    which the cont ro l led substance of which i t i s an immedia te precursor

    i s p laced or in any o ther schedule wi th a h igh er num erica l des ignat ion .

    I f the At torney Genera l des ignates a substance as an immedia te pre

    cursor and places i t in a schedule, other substances shal l not be placed

    in a schedu le solely because they a re i ts pre cu rso rs.

    (f ) I f , a t the t ime a new -dru g app l icat ion i s subm it ted to the

    S ecre ta ry fo r any d rug ha v ing a s t imulan t , depres san t , o r ha l luc ino

    genic ef fect on the cent ra l nervous sys tem, i t appears that such drug

    has an abuse po ten t i a l , such in fo rmat ion sha l l be fo rwarded by the

    S ecre ta ry to the At to rney Gene ra l .

    (g) (1) The At torney General shal l by regulat ion exclude any non

    narcot ic subs tance f rom a schedule i f such subs tance may, under the

    Federal Food, Drug, and Cosmet ic Act , be lawful ly sold over the

    coun te r wi thou t a p resc r ip t ion .

    (2) Dextromethorphan shal l not be deemed to be included in any

    schedule by reason of enactment of this t i t le unless control led af ter

    the da te of such enac tm ent pur s uan t to the foregoing provis ions of th is

    section.

    SCHEDULES OF CONTROLLED SUBSTANCES

    SEC.

    202. (a) There are established f ive schedules of control led sub

    s t ances, t o be know n as s chedu les I , I I , I I I , IV , and V. S uch sched

    ules shall ini t ial ly consis t of the substances l is ted in this sect ion.

    The schedules es tabl ished by th is sect ion shal l be updated and repub

    l i shed on a s emiannua l bas i s dur ing the two-year pe r iod beg inn ing

    one year af ter the date of enactment of th is t i t le and shal l be updated

    and republ ished on an annual bas is thereaf ter .

    (b) Ex ce pt where control i s requi red by U ni te d S ta te s obl igat ion s

    under an in ternat ional t reaty , convent ion, or protocol , in ef fect on the

    effect ive date of this part , and except in the case of an immediate

    precursor , a drug or o ther subs tance may not be placed in any sched

    LABELING AND PACKAGING REQUIREMENTS

    s tance in a commercia l container unless such container , when and as

    required by regulat ions of the At torney General , bears a label (as

    defined in section 201(k ) o f the Fed era l F oo d , Dr ug , and C osmeti c

    Act) containing an ident i fy ing symbol for such subs tance in accord

    ance with such regulat ions. A different symbol shall be required for

    each schedule of control led substances.

    (b) I t shal l be unla wfu l for the m an ufa ctu rer of any co ntrol led

    substance to dis tr ibute such substance unless the labeling (as defined

    in section
