SUMMARY
On Wednesday, October 6, 2021, at 05:10 PM, I was notified by a Charter Spectrum technician about
damage at 430 Salem Grace Street, Kernersville, NC 27284. The damage happened to Charter Spectrum
buried cable while water and sewer were being installed.
I arrived on-site to investigate the damaged Charter Spectrum underground feeder cable on 10/08/2021. This
was an established residential neighborhood with new homes undertaking construction. The Charter
Spectrum underground feeder cable was running from pedestal to pedestal paralleling the front property.
Direct connected and electronically located the damaged Charter Spectrum underground feeder cable
marking with white paint at the time of the investigation. The Charter Spectrum underground feeder cable
had been pulled out of both tap pedestals and the damage location was fully exposed in the area of
excavation where a new water/sewer line had been installed. There were some faded locate markings
coming out of the Charter Spectrum aboveground pedestal on-site at the time of the investigation.
Completed a locate ticket search and found a locate request that covers the excavation work being performed
that caused the damages at this location that expired on 10/04/2021 and had a positive response of code 20
marked on 09/18/2021. Requested the pre-dig photos from expired locate request to confirm if the Charter
Spectrum underground facilities were accurately marked before the damages occurred.
The responding Charter Spectrum technician laid a temporary cable to restore services. The entire span has
been turned in for replacement to restore the original single integrity before the damages occurred.
STATEMENTS
Erik Francin-Maintenance Technician of Charter Spectrum Cable- on 10/06/2021.
Mr. Francin stated that he responded to a service outage and discovered that the Charter Spectrum
underground feeder cable had been damaged with mechanized equipment in the area where a new water and
sewer line had been installed. Mr. Francin explained that he laid a temporary cable to restore services and
has turned the entire span in for replacement to restore the original single integrity before the damages
occurred.
Bradley Sturkie- of Sutton Brothers Plumbing- on 10/08/2021 via phone.
Made contact with Mr. Sturkie regarding the damages that Charter Spectrum incurred at this location. I
explained to Mr. Sturkie that Charter Spectrum suffered damages to its underground facilities at the time the
new water and the sewer line were being installed on the front property at this location. I also explained to
Mr. Sturkie that the locate request that covers the excavation work was expired at the time the damages
occurred at this location. Mr. Sturkie was unaware that the Charter Spectrum underground line was damaged
and stated that he was going to get with his crew to find out if they hit the underground line. I explained to
Mr. Sturkie a claim was going to be sent to Sutton Brothers Plumbing due to damaging the underground
facility and a recovery agent will be in contact within 5 to 7 business days.
DETERMINATION
After investigating this damage, Sutton Brothers is liable for the damages that Charter Spectrum incurred at
this location due to non-compliance with North Carolina State dig laws provided below. The Charter
Spectrum underground feeder cable was damaged with mechanized equipment at the time the new water and
the sewer line were being installed at this location on 10/05/2021. There were some faded locate markings
coming out of the Charter Spectrum aboveground pedestal going in the direction of the damage on-site at the
time of the investigation. The locate request that was called in for the work being performed that caused the
damages at this location expired on 10/4/2021 at 11:59 pm. Sutton Brothers failed to update the locate
request and preserve the locate markings, damaging the Charter Spectrum underground facility with
mechanized equipment causing service outages to Charter Spectrum customers.
§ 87-122. Excavator responsibilities.
(c) An excavator shall comply with the following:
(3) Plan the excavation or demolition to avoid damage to or minimize interference with facilities in or near
the construction area.
(7) Beginning on the date provided in the excavator's notice to the Notification Center, the excavator shall
preserve the staking, marking, or other designation until they are no longer required. When a mark is no
longer visible or is destroyed, but the excavation or demolition continues in the vicinity of the facility, the
excavator shall request a re-mark from the Notification Center to ensure the protection of the facility.
(9) An excavator shall not perform any excavation or demolition within the tolerance zone unless the
excavator complies with all of the following conditions: a. The excavator shall not use mechanized
equipment, except noninvasive equipment specifically designed or intended to protect the integrity of NC
General Statutes - Chapter 87 Article 8A 8 the facility, within the marked tolerance zone of an existing
facility until: 1. The excavator has visually identified the precise location of the facility or has visually
confirmed that no facility is present up to the depth of excavation; 2. The excavator has taken reasonable
precautions to avoid any substantial weakening of the facility's structural or lateral support, or both, or
penetration or destruction of the facilities or their protective coatings; and 3. The excavator may use
mechanical means, as necessary, for the initial penetration and removal of pavement or other materials
requiring use of mechanical means of excavation but only to the depth of the pavement or other materials.
For parallel type excavations within the tolerance zone, the existing facility shall be visually identified at
intervals not to exceed 50 feet along the line of excavation to avoid damages. The excavator shall exercise
due care at all times to protect the facilities when exposing these facilities. b. The excavator shall maintain
clearance between a facility and the cutting edge or point of any mechanized equipment, taking into account
the known limit of control of the cutting edge or point, as may be reasonably necessary to avoid damage to
the facility. c. The excavator shall provide support for facilities in and near the excavation or demolition
area, including backfill operations, as may be reasonably required by the operator for the protection of the
facilities.
§ 87-126. Notification required when damage is done.
(a) The excavator performing an excavation or demolition that results in any damage to a facility shall
immediately upon discovery of the damage notify the Notification Center and the facility operator, if known,
of the location and nature of the damage. The excavator shall allow the operator reasonable time to
accomplish necessary repairs before completing the excavation or demolition in the immediate area of the
facility. The excavator shall delay any backfilling in the immediate area of the damaged facility until
authorized by the operator. The operator or qualified personnel authorized by the operator shall repair any
damage to the facility.
ROOT CAUSE
No notifications were made to One Call Center.
