You may at some point in your life be fortunate enough to inherit property in Jersey. Great, easy-peasy, just hand over the keys and I’ll be on my way. Actually it’s not quite that simple.

In Jersey there are two ways to inherit immovable property (land and houses): either you are left them in a will or you inherit as an heir. Either way there are some important considerations you should be aware of, particularly if the will includes life enjoyment or time-limited enjoyment granted to a third party.

The following example demonstrates some of the issues involved.

Imagine your favourite uncle has passed away, leaving you his rather smart farmhouse complete with orchard and a couple of acres. You cannot move in to the place because he has also given enjoyment of it to his mother-in-law, Delores. This sort of arrangement is often granted as life enjoyment, but in our example let’s say that she has been granted enjoyment for just 5 years. You may or may not know this woman, you may or may not like her, but both you and she have certain responsibilities whilst she lives there.

• Delores must act as a ‘prudent householder’ – she must keep the interior of the property in a good state of repair, must pay occupiers rates and buildings insurance. You as the owner must carry out structural repairs so the house doesn’t fall down around Delores’ ears.

• You can demand an annual inspection of the interior, and if she really has let the place deteriorate significantly you can even ask the Royal Court to terminate the enjoyment, but you must nominate

an agent to act on your behalf; you are not allowed to carry out the inspection yourself.

• You can sell the property, but Delores will still be entitled to her 5 years’ enjoyment, so this will probably put off prospective buyers. Delores can walk out before her 5 years are up, but only if she has left everything in a good state of repair.

• The law does allow you and Delores to come to a financial arrangement whereby you buy her out of her enjoyment of the property, typically using actuaries to calculate a fair price.

As you might imagine, this sort of arrangement has caused a lot of argument over the years, and there is plenty of case law around what you and Delores can and cannot do, particularly with regard to the land that comes with the property. She can draw benefits from the land, but not damage or change the nature of it, so in our example she can keep the apples, but cannot chop down the trees or replace the orchard with a swimming pool. If she has planted crops but has to leave before they are harvested, then legally they belong to you. Similarly, if she has been renting out the house or land, then this lease terminates when her enjoyment finishes.

It may be stating the obvious but it is strongly recommended, if you inherit property over which someone else has a right of enjoyment, you take legal advice so that you know your rights and obligations.

Bank of England base rate remains at 0.50% and there is no likelihood of this increasing in the foreseeable future, to the delight of all borrowers who have their mortgages linked to a base rate tracker product and the utter dismay of the much larger group of investors who are seeing no appreciable return on their hard earned savings.

POSITIVE COMMENT

Recently the former Conservative prime minister John Major has gone public with a well reasoned argument that the British economy is now moving into a position where growth should start to be seen by the end of 2012, and this has also been confirmed by Mervyn King, the Governor of the Bank of England who has started to become very positive about the end of the double dip recession by the last quarter of this year.

A POSSIBLE TURNAROUND

Locally, unemployment figures for August showed the biggest drop for fifteen months, although sadly, redundancies in the fulfilment industry reversed this trend in September. On a more positive note, the Island’s economy shrank by just one per cent last year, which is the smallest decline since 2007, so signalling a possible turnaround in Jersey’s economic fortunes.

A LACK OF CONFIDENCE

It is good news such as this that is badly needed by a population that has lost its confidence in the light of a barrage of negativity from the world media during the past five years. Confidence has evaporated in the housing market and this has not been helped by the global assumption that banks have stopped lending, which could not be further from the truth in the Island.

A DIFFERENT CULTURE

The Channel Islands appear to survive financial crises far better than the UK or further afield. The infrastructure and culture, especially in respect of homeownership are somewhat different to the UK and the need to acquire property for the first time or the desire to trade up to a larger property tends to be stronger, or at least it was until 2009 when everything slowed noticeably.

LOW INTEREST RATES, REDUCED PROPERTY PRICES

The old adage that you can take a horse to water but can’t make it drink really does apply to the Jersey housing market, where the lowest interest rates ever are currently available to purchase property that has fallen in value by up to 20% since the start of the crisis. A buoyant housing market needs three components: the right price, cheap mortgage funds and motivated confident sellers and buyers, and it is clear that the last of these three components is missing.

THE NEED TO MOVE

Just how much longer many of the families that need to move as they expand in size can hold out is anybody’s guess. All of this pent up energy has to create an increase in activity at some time in the future. I have always maintained however that it is the First Time Buyer market that is key to the remainder of the market functioning correctly and therefore the focus has to be on providing this sector with the incentives that it needs to help it return to the marketplace.

HELP FOR FIRST TIME BUYERS

The Housing Minister, Andrew Green, has announced plans to introduce several schemes that will help young couples to get on to the housing ladder, to include a scheme that will provide a 15% deposit, linked to a 5% personal contribution by the purchasers and an 80% bank mortgage. This type of assistance is to be commended, although the co-operation of the lenders will be essential for the proposal to work, as banks do not like secondary loans, no matter what guise they come in.

REDUCED PURCHASE PRICES

The Minister’s proposals referred to the average price of a three-bedroom house as being £487,000, which was probably correct before the recession, although an examination of the transactions passing through the Royal Court every Friday shows that any number of houses are now changing hands for figures that are more than £100,000 less than that, so making the ‘’impossible dream’’ more accessible.

Not everybody needs a house however and two-bedroom flats, with parking, in purpose-built blocks for well under £300,000 regularly come on the market.

The planning application process can be pretty daunting. There’s the plethora of planning policies, supplementary planning guidelines and various design guides and standards to be complied with, coupled with the high level of information required by the Planning Department and the fact policy can be interpreted in different ways. Follow these points to try and minimise your planning pain: 1. Agree what you want from your development that suits your needs and budget. Create an ideas board of interior and exterior styles you like and appoint a professional designer to help.

2. Ask the designer to prepare sketch schemes showing various development options. Your professional advisor should have a good knowledge of what is, and isn’t, likely to be acceptable in terms of achieving planning consent.

3. Consider obtaining pre-application advice from the Planning Department, either by visiting the Department or for more major applications, by writing to Planning. You’ll need to include a case to justify your proposals and your sketch plans. Pre-application advice can be a double-edged sword: planners tend to be cautious in their advice, particularly if your development is likely to cause objections and/or become political. So if the pre-application advice comes back heavily caveated and negative, don’t necessarily stop there. Often a well-argued case can secure required permission.

4. Next a formal planning application will need to be submitted. You have to include: a site plan; floor plans; elevations and a section, based on a topographical survey. Design Statements explaining the basis of the scheme are always encouraged. Additional information may be required including: landscape plan; waste management plan; foul drainage assessment etc. To be registered, all this information needs to be submitted together with the planning fee. If it fails to meet the requirements of the Planning Department, the application will be returned.

5. If your submission is registered, you’ll be notified and sent a site notice. This needs to be displayed in a prominent position on the site for 21 days to enable interested third parties, like neighbours, to be made aware of the proposed development and to make any representations. The Planning Department will only consider material planning issues raised – they will not consider civil or personal issues.

6. The Planning Department will also consult with statutory and other consultees regarding access and highway issues, foul and surface water drainage, listed buildings, land control issues and environmental issues, amongst others. They are obliged to have regard to the representations made but do not necessarily have to agree with them. The Department will balance all the considerations and arrive at a recommendation or decision.

7. There are many policies in the Island Plan and other guidelines, that Planning will need to consider. Quite often, whilst one policy is favourable to the application, another can be unfavourable. Once the officers have assessed all the considerations, usually following a site visit, they can either determine the application under the Director of Planning’s delegated powers or refer it to the Planning Applications Panel for a decision with a recommendation to approve, refuse or defer. Applications with an island-wide interest may, however, be called in by the Minister. These are unlikely for household applications.

8. Applications approved under the Director’s delegated powers will result in a permit (with conditions) being issued. Those referred to the Planning Applications Panel will be considered at a Panel Meeting held in public with all those who have made representations being invited to attend and address the Panel. If this is the case, it is sensible to appoint a professional to act on your behalf. It can be an intimidating forum of politicians, civil servants, civic societies, resident associations and individual objectors all scrutinising your proposals and passing comment on them.

9. If the Department, under delegated powers, refuses an application you can appeal to the Planning Applications Panel. If the Panel refuses the application, your only recourse is an appeal to the Royal Court, which is likely to be expensive, time-consuming and very difficult to win. Before going to these lengths we strongly advise engaging a planning consultant to assess whether an appeal is worthwhile.

10. If your application is approved, there’s a strong likelihood it will require Building Bye-Law Regulations consent. Your architect will be able to help you with finalising this, as well as provide support if you want your contract to be put out to tender and/or to have the project administered from start to completion.

 The Planning process is very involved and complicated. If you’re unsure, seek professional advice to give you the best chance of success and to minimise your planning pain.

THE HOT DEBATEAffordable housing and the planning system have been under close scrutiny over the last couple of years with, as yet, no conclusions reached. Looking to move the arguments forward, the Jersey Construction Council held its first ever debate as part of Construction Week 2012

Over 150 islanders attended the first debate of its kind, taking the opportunity to raise their housing and planning concerns directly with the panel which consisted of Andrew Scate, CEO of the Environment department, Peter Le Gresley, Director of the Development Control at the Environment department, Philip Syvret, Advocate and Partner at Benest & Syvret and Mike Stein, a former Planner and current Director of MS Planning. The event was kindly sponsored by Benest & Syvret.

Peter Le Gresley of the Planning department said, “This is the first time we have participated in an open forum of this kind with the JeCC and I think it is a positive step forward. It allows for more open discussion between government and industry and an opportunity to discuss important issues affecting our environment and population.”

Affordable housing was first on the agenda. The topic has been a

concern for many over the years and is never far from the headlines with a desperate need to provide much needed affordable homes on the island. Although laudable in its intentions, panelist Mike Stein criticized the H3 policy, which is concerned with ensuring a percentage of larger developments are reserved for affordable housing. Mr Stein said that “there definitely is a need for affordable housing in the island” and stated quite clearly that the H3 policy was “flawed and simply won’t work,” citing the UK government’s abandonment of their H3 policy because it stopped house building.

On the planning side, rules were relaxed last year to allow home owners to be able to carry out a greater variety of home modifications without the need for planning permission. Not only has this been helpful for home owners, it has benefitted the construction industry at large. The rules reduce the number of applications submitted to the Planning department for small alterations and allow more time to be devoted to larger applications, helping to boost the construction industry and its contribution to the economy.

The debate was hotly argued and although no firm conclusions were reached, everyone appreciated the benefits of having representatives of the Planning Department take part and able to explain policies. The JeCC is extremely grateful to all the panelists for making the debate such a success, so much so, that next year’s debate is already in development.

Industry achievers topped the bill at this year’s Jersey Construction Council Awards.

Barr Stevenson crowned a 57 year career as an engineering draughtsman by winning the JeCC Lifetime Achievement Award. Stuart Gray of Jersey Energy scooped the Ogier Industry Achiever Award at the age of just 32, Gareth Menard won the JeCC / JEP Tradesperson of the Year Award, Jonathan Frain of Jersey Electricity won the Harsco Infrastructure Apprentice / Student of the Year Award following excellent results in his studies at Highlands College, coupled with superb workplace achievements in the career that he has wanted to follow since childhood.

Barr Stevenson was recognised for his incredible career which spanned almost six decades and sees him retire at the age of 73. Described as the “only true draughtsman left in the industry” because of his refusal to switch his drawing board for a computer, Barr received his reward to rapturous applause at the Awards on Saturday night.

Whilst people topped the bill, the Island’s best construction projects were also recognised with Lakeside Care Home, constructed by AC Mauger Ltd, winning the Condor Logistics Project of the Year over £1million.

The Rowney Sharman Project of the Year under £1million Award was won by

Geomarine for the specialist work they performed on the stabilisation of the Greve de Lecq cliff face.

The awards were presented by broadcaster and sustainable design consultant, Oliver Heath who awarded the Jersey Electricity Sustainability Award to Brenwal Limited for the Millennium Town Park.

In recognition of the role that good planning advice plays in the industry, the Insurance Corporation Consultant of the Year Award was won by planning consultants, M.S. Planning Limited.

A.A. Langlois Haulage Limited won the Rossborough Sub contractor / Supplier of the Year Award and Le Masurier won the Condor Logistics Business of the Year Award for their commitment to the island and belief in its future economy.

“The Jersey Construction Council Awards have been a great success,” said Steve Jewell, Chairman of the JeCC Awards Committee. “The fact that individuals stole the show this year is testament to the construction industry’s commitment to developing talent and the wide range of careers which can be followed.

“We’ve been delighted with the way the whole evening has gone and are already looking forward to next year!”

Women have handbags, men have sheds, and all that is essential to the wellbeing of both are contained within. Men without sheds tend to have a surrogate space, or they go walking. A lot.

This may seem to be a bit of an assumption but there are, in fact, a growing number of ‘men-shed groups’ springing up in the UK, following a distinctly Australian trend. There does appear to be a deep-rooted desire for many men to be able to disappear into their own world, and to potter in their particular cave of choice.

Pottering for men is found to improve health, lower blood pressure and improve the stress levels. Most men appear to have an ‘inner shed’. It may be a rickety old one from a previous owner that has been done up and is the emporium for tools, DIY, and ‘stuff’, but in here you may find a radio, a fold out chair and a thermos.

Alternatively it could be a smart office, complete with electricity, broadband, heating and a big chunky lock to keep everyone else out. You can buy some stunning garden offices these days and to be honest they are the perfect way to work from home as it makes you leave the house and ‘go to work’. They can give your day an edge and a routine.

The greenhouse is another type of ‘cave’ for pottering in and the upside is that it you can also use it to produce vegetables, bedding plants, cuttings and seedlings to keep your garden going at a base cost. The downside is that it is see-through so if you have just put your feet up, got the paper out and poured yourself a cup of coffee, you can be spotted.

One word of warning to all those men and their sheds. “Women have become the largest part of the growth market in sheds and greenhouses.” We too have an ‘inner shed’.

As a property owner it is important that you know the limits of your property and the various boundaries towards neighbouring owners.

There are four principal ways by which boundaries of a property in Jersey are described in title contracts:-1) Party-owned;2) Owned with relief (or offset);3) Owned without relief (or offset); and4) No boundary claim.

PARTY-OWNERSHIP

Party-ownership is essentially the shared ownership of a boundary enclosure, whether it is a gable wall between two houses or walls, fences or hedges separating adjacent lands. This is the most common means of division between neighbouring properties, particular in housing developments and the built up areas of St. Helier and St Aubin.

In some instances properties are separated by party-owned boundary stones with a dividing line taken between the centres of the stones. A contract will usually provide for the respective owners to establish an enclosure on the boundary line which henceforth will be equally party-owned. Such clauses may stipulate what type of enclosures may be established and include height restrictions.

Responsibility for the maintenance of a party enclosure is shared equally between the neighbouring owners. If, however, the enclosure is damaged or destroyed as a result of any act of one of the neighbouring owners then they are solely liable for its repair or replacement.

OWNERSHIP WITH RELIEF (OR OFFSET)

This is where the side of a building or an enclosure such as a wall is owned outright by the owner of the property upon which it is constructed. The relief or offset is a strip of land running co-extensive with the building or enclosure, and is essentially a maintenance strip, so an owner can maintain and upkeep the

building or wall in question without requiring access onto the neighbouring property.

The relief generally has a width of 16½ins (there are exceptions, but these are outside the scope of this article). However, if there are windows or other openings in such a wall, then the wall (or side of the building) is required to be set back from the neighbour’s property by 2ft 9ins, effectively a double relief, unless the property’s title permits otherwise.

OWNERSHIP WITHOUT RELIEF (OR OFFSET)

In this case, the boundary of the property is the foot of the wall or side of the building. There is no relief or maintenance strip and therefore access rights onto the neighbouring property are required in order for maintenance work to be carried out. Such rights are often set out in a property’s title deeds, but if they are not, then the lawyer acting for the purchaser will seek the participation of the relevant neighbour in the contract to be party to grant such rights. In older contracts there was sometimes a tour d’echelle or ladder right. This was a right for an owner to put a ladder onto his neighbour’s land in order to maintain the side of a building.

NO BOUNDARY CLAIM

At first sight, this may seem an odd heading. Where one property, however, claims the ownership of a wall or side of a building (with or without relief), the boundary of the neighbouring property is usually ‘silent’ in that property’s title deeds, i.e. there is no description in the contract. In these circumstances, the boundary is deemed to be that described in the contract of the property claiming the ownership.

This is a brief look at the types of boundaries that may be claimed. While you will have discussed the boundaries of your property with your lawyer at the time of your purchase, it is always advisable to seek advice should you be thinking of doing any building work near to or on your boundary. This could avoid some unnecessary expenses and headaches in the future.

In the current economic climate it is difficult to know the best way of presenting your home for sale. “Should I decorate…. replace the kitchen…. pave over the garden….” These and many more are questions that people ask themselves.

However help is at hand in the form of Phil Spencer’s top tips to add value to your home or present it in the best way.

His mantra is “Square footage equals money”, which could be by way of an extension, a loft conversion or a basement conversion, or simply knocking down a wall to gain additional space and light.

Here are some of the suggestions that Phil believes add value to or improve a property, but remember that some of these may need planning consent:

1. Loft conversion – One of the simplest ways of gaining an extra bedroom and bathroom with the minimum of disruption, assuming that you have easy access;

2. Conservatory – An excellent way of extending ground floor living space and getting additional light. Make sure the style of the conservatory is in keeping with the rest of the property;

3. Basement conversion –This is an expensive option and although may add much needed space, needs careful planning as it will affect the structural load of the property and may not end up adding value in itself;

4. Upgrade the kitchen – If you plan to update one room in the house then make sure it is the kitchen, which these days is the main hub of the home;

5. Change the bathroom – This can be done simply by updating taps, fitting a chrome heated towel rail, changing the shower head or adding a mirror with a touch light;

6. Turn your garage into living space – The majority of home owners do not use their garage for cars;

7. Target your likely buyer – Present your property to the most likely purchasers in order to dress your spare room as a playroom, study or bedroom;

8. Pave the front garden – Creating additional parking could add value where parking is in short supply;

9. Paint the outside – First impressions account for a lot when trying to sell and your house should look its best;

10. Ensure windows match the age of the property – If the property is a character property then make sure the windows don’t look out of place;

11. Give the front door a makeover – Buy a new door knob, knocker of just add a new number plate or letterbox, but make sure it looks smart;

12. Put in central heating – this will not only add warmth, but value too. An electric system is easier to retro fit.

Not only will these add value to your property when you sell, but will also enhance your home for your enjoyment too.
