L In continuation of this Department letter No. PER (AP)-C-B(2)- 1/2013 dated the 8 th July, 2013, I am directed to say that the matter regarding liberalizing the policy of regularization of daily waged workers/contingent paid workers in all the Departments had been engaging the attention of the Government for sometime past. After consideration, the Government has now decided that the daily waged/contingent paid workers in all the Departments who have completed 7 (seven) years of continuous service (with a minimum of 240 days in a calendar year except where specified otherwise for the tribal areas) as on 31.3.2014 may be regularized only against vacant posts in the respective departments. No new post(s) for this purpose will be created. Completion of required years of service makes such daily wager/ contingent paid workers eligible for consideration to be regularized. Contd ... P/2-

Regularization of daily waged workers/contingent paidworkers.

In continuation of this Department letter No. PER (AP)-C-B(2)­

1/2013 dated the 8th July, 2013, I am directed to say that the matter regarding

liberalizing the policy of regularization of daily waged workers/contingent

paid workers in all the Departments had been engaging the attention of the

Government for sometime past. After consideration, the Government has now

decided that the daily waged/contingent paid workers in all the Departments

who have completed 7 (seven) years of continuous service (with a minimum

of 240 days in a calendar year except where specified otherwise for the tribal

areas) as on 31.3.2014 may be regularized only against vacant posts in the

respective departments. No new post(s) for this purpose will be created.

Completion of required years of service makes such daily wager/

contingent paid workers eligible for consideration to be regularized.

Regularization In all cases will be from prospective effect I.e.

after the date of the order of regularization IS issued after

completion of codal formalities. The regularization will be subject to the

observance of the following terms and conditions:-

Norms/principles regarding regularization of daily waged/contingentpaid workers:-

i) Daily waged/contingent paid workers who have completed 7years of continuous service (with a minimum of 240 days in acalendar year except where specified otherwise for the tribalareas) as on 31.3.2014 may be considered for regularizationonly against the available vacancies in various Departments andthe terms & conditions for such regularization shall be governedas per Annexure-' A'.

ii) No new post of any category will be created.

iii) After regularization, the original post of the concerned dailywager/contingent paid workers shall be abolished.

iv) The regularization will depend subject to availability of budgetallocated to the Department concerned for that year.

v) Since no new post is to be created, therefore, no additionalfund/budget will be demanded.

vi) 7 years of continuous service is only an eligibility criteria andregularization shall be only from prospective effect i.e. after thedate the orders of regularization is issued after completion ofcodal formalities.

vii) The daily waged/contingent paid workers being considered forsuch regularization shall possess minimum educationalqualification as prescribed in the Recruitment & PromotionRules of such post at the time of initial engagement. However,the educational qualification will be relaxed, if required.

viii) In case of a daily waged/contingent paid worker, who hasworked for less than 7 years on higher wages, on a higher payscale post, he/she will be considered for regularization bycombining the service both in the lower scale post and higherscale post but he/she will be regularized on a lower postbecause for regularization on a higher post, 7 years completedaily wage/contingent paid service on the higher pay scale postshall be essential.

ix) The daily waged/contingent paid workers may be regularizedagainst the posts/vacancies of relevant categories purely onseniority basis subject to rejection being unfit and by doing soin case any roster point for reserved/feeder category remainsunder utilized, these shall be made good in future recruitmentsby filling up the backlog first.

x) Such daily waged/contingent paid workers, who were within theage limit prescribed for direct recruitment at the time ofengagement on daily wages/contingent paid basis, may be givenrelaxation in age limit while regularizing their services, if theyhave crossed the maximum age limit as prescribcd in theRecruitment and Promotion Rules.

xi) Such daily waged /contingent paid workers, who have beenengaged without being sponsored by the EmploymentExchange, may be given relaxation while regularizing theirservIces.

xii) The Department(s) are not required to make prior consultationwith the H.P. Public Service Commission for regularization ofservices in case of those posts which fall within the purview ofthe H.P. Public Service Commission.

xiii) The seniority of the daily waged/contingent paid workers as areregularized under this policy vis-a-vis employee appointed onregular basis shall be determined on the date of issue of thesepolicy instructions. The inter-se-seniority of such daily waged/contingent paid workers shall be determined in accordance withorder of regularization of such daily wager/ contingent paidworker based on seniority as daily wager/contingent paidworker.

xiv) There shall be no resultant vacancy by way of suchregularization because such vacancies shall be abolished.

xv) If the vacant post is not available, the regularization may bedone against available analogous Class-IV posts havingidentical pay band.

ANNEXURE-"A"

TERMS AND~ONDITIONS FOR REGULA~IZATIO~L~_LJ2AILY

WAGED /CONTINGENT PAID WORKERS WHO HAVE COMPLETED 7YEARS OF CONTINUOUS SERVICE ON 31.3.2014.

I. The daily waged/contingent paid workers who have completcd 7 yearsof continuous service (with a minimum of 240 days in a calendar year)on 31.3.2014 will be eligible for consideration for regularizationagainst the available vacancies in various Departments. However,eligibility for regularization of such workers in respect of tribal areasshall be on the basis of number of minimum requisite days as under:-

(a) For Kinnaur District and Spiti 180 daysSub-Division of Lahaul and Spiti District

(b)

Bharmour area of Chamba District.

For Lahaul area of Lahaul and SpitiDistrict and Pangi Sub- DivisionofChamba District.

2. The regularization will be strictly on the basis of seniority subject tofitness and the fulfillment of minimum eligibility prescribed in theconcerned Recruitment and Promotion Rules except as prescribed in atSf. No. (vii) of the nonns/principles regarding regularization of dailywaged/contingent paid workers.

The candidate should be medically fit for the post being considered forregularization. The medical fitness certificate of the candidate shall beensured in accordance with the provisions contained in F.R. 10 andS.R. 4( I), 4(2) and 4(3).

The regularization shall be subject to verification of character andantecedents of the candidate being considered for regularization asprovided in the Himachal Pradesh Financial Rules.

5. For the determination of date of birth of the candidate concerned,criterion as laid down in Rule 7.1 of the Himachal Pradesh FinancialRules Vol. I Hand Book No.2 shall be observed.

6. A screening committee shall be constituted by the Departmentconcerned for the assessment of the suitability of the candidateconcerned for regularization.

7. The regularization shall be done at the level of authorities competentfor such appointment.

8. The daily waged workers/contingent paid workers who are to beregularized may be put in at the minimum of the time scale of paypayable to the corresponding lowest grade in the Government.

9. The daily waged workers/contingent paid workers so regularized shallbe liable to be posted anywhere within the State.
