During the course of The SecondSeminole War (1835 ' 421, Floridaeovernor Richard Keith CaIl opined thatthe only way to bring the maraudingSeminoles in the territory under controlwas to establish colonies of settlers whowould claim, populate, and hold bYforce of arms, if necessary theundeveloped lands of East Florida. Theidea was bandied about the U.S. congress

for several years, drawing support fromthose who viewed it as an alternative tothe high coets of maintaining regulararmy personnel in the area with noconcentrated enemy force to fight, andopposition from those who Eaw thereguisite land grants of such a tactic as

"ruinous".In any event, The Florida Armed

Occupation Act t5 U.S. Statutes 5027,when finally passed in August t842,provided for the granting of 160 acreE ofnew land south of the line separatingtownships 9 and 10 South (a line runningdue east/west about three miles north ofPalatka and about ten miles gouth ofNewnansville) to any head of a familyunder only three conditions.

First, the land selected could not bewithin two miles of a military post.

Second, he must be able to bear armsand live on the land for five years.

Third, he was reguired to clear fiveacres and build a house.

Clalms could be filed, during theAet's one year life, at either the St.Augustine Land Office or the one atNewnansville, north of Gainesville. Theoffice at St. Augustine issued only 370land patents to settlers, while the oneat tiny Newnansville issued 942.

Permit papers of these settlers arenow in the holdings of the Title Section,Bureau of State Land llanagement, FloridaDepartment of Natural Resources, 3900Commonwealth Boulevard, TaIIahassee, FL32303.

Many of these land grants were made toearly Marion County residents. One ofthose who received }and was ;Iames M.

Kingsley, who states in his applicationthat he is a single man of age eighteenor over, able to bear arms and a residentof Florida in February 1843. Thedescription of his intended settlementwas NW Quarter of Section J-2, Township11, Range 23. The document wag signed onthe 10th day of May 1843 by James M.Kings1ey.

Rarely do we find him using hiE middleinitial M., although we know that JamesKinglsey who married Louanzy Higgenbothamwas the same. From the 1850 census, we

learn that he was living just across thecounty line in Putnam County. He gavehis age as 26, born in Georgia andLouanzy age 18, born in 8lorida.

His known children are CharlieKingsley b. circa !849, who married LydiaMatchett, !,1. A. Kingsley (a female) b.1854, susan Kingsley b. 1857 and 'rames S.Kiagsley b. cirea 1862 who maried UaryE. Matchett.

A James Kingsley is shown in the 1820censusr of Pulaski County, GA. He ispossibly the father of James Kingsley,the subject of this sketch. The youngerJames Kingsley is believed to have hadother wives, possibly Martha Stricklandand Elizabeth llatchett.

The Kingsley land encompasEes a largearea from north of Orange Springs to BayLake. Many of his descendants are stillthere today.

It is easy to assume that he wasrelated to the illustrious ZephaniaKingsley and indeed he might have been,but not a direct descendant as isevidenced by his descendants.

The name of David Bruton apPearE manytimes in the early history of thls area.I first found him in the L840 census ofAlachua County, Florida. In 1843, onFebruary 9th, he received land under theArmed Occupation Act, and states that heis a single man, over eighteen years ofage and able to bear arms. He alsostates that he has been a resident ofFlorida since L822. The land that hereceived under this act is as follows: "Atract of unsurveyed land situated threemiles East of South from Wetumpka, knownas Miccopotopkae Town, North twenty fivedegrees East, three hundred and fiftyyards from a Spring in the South eastcorner of the Hammock, and on the Northwest corner of the town running fromthence south one half mi1e, then West onehalf miler then North one half mile, thenEaat to the place of the begining. "given under my hand, this 9th day of

February 1843 -- Signed, David Bruton.In L844, on Dec 2, he registered his

llark and Brand: To wit: Mark:Swallowfork and under bit in one ear andhalf crop in the other. Brand: 48recorded by Alexander McCleod, Cty clerk.

David Bruton voted in the flrstFlorida election in May of 1845 in MarionCounty at Fort King, with E. D. Howse,Lewis Ballard, and Thomas Barnes asElection Inspectors.

In July of 1845, when Marion Countywas created, David Bruton received thecommission of the first County surveyor.In January of 1845, Bruton was instructedto make a survey for the proposed town,which would come to be named Ocala. Iliswork waEr completed in 3OL days, and hewaE paid one dolIar per day. The p1at,shown on the next page, shows the PublicSguare, and for my satisfaction, theSpring and where it branched off to. See

it really did existtDavid Bruton evidently didn't marry

early in life, or his was widowed, as hemarried Nancy Connell on 18 June 1845.

The 1850 censuE of Marion County showsthe Brutons in househoLd #L94. He is nowage 46 with his wife Nancy, age 25. Theyare the parents of Susannah E. age 4,Nancy S. age 2, and Sarah A. l'{. age 11months.

The death date of David Bruton is notknown, but it is believed to have beensometime between 1850 and 1854, as NancyBruton registered her Mark and Brand onJune 10, 1854. In L859, his childrenregister theirs, using the brand of theirfather.

There could possibly have been anotherchild born between 1850 and 1854. TheBruton children married into the familiesof Frink, HuIl, Beck, Evans and SanderE,among others.

I believe Nancy S. Bruton (sometimesshown Brutin and sometimes Burton) whomarried Thos. Wallace 11 uay 1855 to bethe widow of David Bruton, nee Connell.If sro she is buried in EvergreenCemetery: Nancy S. Wallace 31 Dec 7825 -11 JuI 1912.

For the relief of Gabriel Priest

WHEREAS the marrlage contract, legallyexisting between Gabriel Priest and AnnPrieet, his wife, was by an act ofassociation perporting to be of the nameand style of the President and Council ofa part of East Florida on the twentyeight of october eighteen hundred andtwelve desolved forever.

Be it enacted therefore by thecovernor and Legislative Council of theTerritory of Florida, That the Eame ishereby recognized and confirmed.Provided, that no part of this act shaLlbe so construed as to acknowledge thevalidity or binding force of any of theacts of any of the revolutionaryassociations, within this Territory.

s. L. Satterwaite, E. Martin, and T.Ward, passed Tuesday in Gainesville.sumner now has 12O acres of fine land onwhich the U.S. has no claim.

E. Martin is doing considerablecarpenter work building up Kerr City. Heis an enterprising young man, and hiscapabilities as a workman are reeommendedin his work.

Joseph Allmonn had considerabledifficulty in receiving his goods fromthe North over the different freight1ines. He r^rent to Palatka last week todetermine the possible cause of thedelay.

There is quite a rivalry existingbetween the local fisherman at the LakeKerr House, aE to who can catch thelargest fish. The schedule of theirsuccess as they stand at present, is asfollows: Mr. Swan stands at 7 1b., Potts5 at 12 lbs., and Douglas 8 at 12 Ibs.,and Edson 5.

.Toseph stanley and wife of Damaseus,ohio, have just arrived and will makeKerr City their permanent home. He hasbought land on the South gide. Hisson-in-Iaw and family of Mass. willfollow in a short time.

James Lane of Hol1oway, Michigan, whohas some property in Kerr City arrived atthe Lake Kerr House on saturday.

!lrs. wm. stone of Sanford, is visitingfriends in Ker City.

Kerr City need 5 or 8 neat littlecottages to rent. Who crmong ourenterprising citizens will put them up?

At the reorganization of our Sabbath

School, R. B. llenley was choeen as Supt.Mrs. EIla Hammond Sec./Treas. llr. andl{rs. J. B. Swan, and Urs. Terry,teachers. The school is well attendedeach Sabbath and is very interesting.Everybody young and old is invited toattend and assist the good cause.

A number of families of Friends arepermanently located here now. And othersare expected to eome soon. We understandthey expect to organize a permanentmeeting here in the near future. Forseveral months past they have beenholding a Union meetlng in SabbathSchool.

Williamson Cemeterv, Lake Kerr

No citizen of Kerr City is intered atthe Williamson Cemetery that I know of,but the old cemetery is located onproperty owned by descendants of theoerners of the original Kerr City. It isfenqed and on private property. I feLtthat it is of importance to pubJ.ish thenames on the markers there for theconvenience of folks tracing their famityhistory. The McRae markers, forinstanee, tie into the old Chalkerfamily; the Williamson family into theHolly family and Hastings, etc.

Ancestrv Jest

The ehildren of a prominent familychose to give the family patriarch a bookof their family's history. Thegenealogist they hired was warned of oneproblem. Uncle Wi11ie, the "BlackSheep", had gone to the Florida StatePrison electric chair for murder. Thewriter promised to carefully handle thesituation, and did so in the following$ray:

"Uncle Willie occupied a ehair ofapplied electronicg at one of Florida'sleading institutions. He was attashed tohis position by the strongest of ties.His death came aE a true shock."
