I. Definitions and general remarks

A - Archival material

1. Archival material is any document originated or received by a person or a bodyin the course of activity in an official function at CERN, which is preserved inthe Archives because of its long-term interest, regardless of its physical form ortechnical support.

2. Files or documents setting out the policy, planning and operational structuresset up to carry out and support scientific research are of great importance bothto the Organization and for scholarly research and must therefore be archivedin a manner which facilitates access, thus avoiding costly retrieval procedures.

3. Files or documents which fall into the following categories have to be(i) preserved :

- CERN Council and its subordinate bodies.Administration, management and policy-making.Accelerators : planning, construction, operation.Research facilities, experiment collaborations.Theoretical physics.Technologies: computing, electronics, vacuum, cryogenics, etc.Spin-offs : technical, economic and cultural.Training, conferences, utility studies, etc.Cultural and social life at CERN.

4. Unpublished CERN divisional reports, technical notes and specifications arearchival material.

5. In keeping with the provisions of CERN Administrative Circular N° 29 on(', CERN publications, documents intended for publication are, as a rule, not" archival material.

B- Special archival collections

6. Special archival collections at CERN include:- Administrative files to which special obligations apply (Personnel, Finance,

Medical Service, Pension Fund, etc.), as defined in Administrative CircularN° 10.Audio and video recordings.Photographs and films.Press articles.Interviews.Technical drawings and plans.

This tyPe of archival material is, at present, the responsibility of the unitsconcerned and is subject to special agreements between the originators or thepersons responsible for these units and the CERN Archivist.

c- CERN property and inviolability

7. Archival material, regardless of its physical form or technical support, createdor received in the course of activity in an official function at CERN is theproperty of the Organization.

8. By virtue of the agreements between CERN and its two Host States, definingthe legal status of the Organization in Switzerland and in France, signed in1955 and 1972 respectively, the Archives of the Organization and, in general,all documents belonging to it or in its possession shall be inviolable anywherein the Host States. The waiving of this inviolability is addressed by the above­mentioned agreements.

II. Bodies and members of the personnel responsible for archiving

A- Director-General

9. CERN archiving policy is entrusted to the Director-General, who usuallydelegates the authority for decisions on archival matters to the chairperson ofthe Archive Committee.

B- Archive Committee

10. The members of the Archive Committee are members of the personnel andare appointed by the Director-General for an initial period of three years,normally renewable only once. Proposals for membership are made by thechairperson, who must be a staff member of CERN and who reports once ayear to the Director-General. Ex officio members of the Archive Committeeare the secretary of the Research Board, a member of the Advisory Committeeof CERN Users (ACCU), the group leader responsible for the Archives and theCERN Archivist.

c- CERN Archivist

11. The CERN Archivist (hereinafter referred to as the Archivist) is responsible forhandling all archival matters. The Archivist and all staff working in theCERN Archives are bound by professional secrecy.

12. The Archivist :

• Is empowered to oversee the application of archiving policy within CERN.

• Is an ex officio member of the Archive Committee, to which regularreports must be given.

• Is responsible for briefing the Divisional Records Officers (DROs) onarchival matters and giving advice and assistance on archival issues to thedivisions and any other originator of files and documents.

• Convenes an annual forum of DROs.

D-Divisional Records Officer (DRO)

13. Each division leader nominates in an official function a ORO, to whom theauthority for implementing a records management and archiving plan withinthe division is delegated. The ORO is empowered to advise his division onthe creation of intermediate divisional archives in order to facilitate a degreeof autonomy with respect to records management and archiving within thedivision. The ORO identifies archival material and informs the CERNArchives prior to restructuring, cessation of activities in the division ordeparture of staff who possess files of potential interest to the Organization andthe CERN Archives. The ORO is periodically invited to report to the ArchiveCommittee.

E- Management, senior staff with special responsibilities and spokespersons

14. CERN Management (Oirector-General, directors, division leaders), CERNsenior staff with special responsibilities and spokespersons of experimentcollaborations must keep their files and other material of long-term interest inan organized manner. In collaboration with the Archivist, they must transferthe relevant material (as indicated in § 3) to the CERN Archives followingpre-established retention schedules and review dates.

15. It is the responsibility of each division leader to make these present rulesknown to the relevant members of the personnel (divisional secretariat, groupleaders, project leaders, senior staff, etc.).

III. Rules for access to the CERN Archives

A- Introduction

16. Rules for access to material kept in the CERN Archives follow general archivalpractices applied in other international organizations and in public archives inEurope.

17. The CERN Archives are not public archives; they primarily serve as aninformation source for the Organization. However, access is given to personsoutside CERN upon request when there is justified interest.

18. There are two categories of users, internal and external, to whom differentrules of access apply:

• Internal users are members of the personnel of CERN. They have freeaccess to documents and files of a purely scientific nature which have notbeen subject to restricted distribution and which do not contain anyconfidential information.

• External users are persons who are not or are no longer members of thepersonnel of CERN. In principle, they have to send a written request to theArchivist. H access is requested to archival material which does not havefree-access status, then the request is forwarded to the Oirector-General toobtain authorization for consultation.

19. There exist three levels of access according to the type of archived material.The level of access to a document or file is generally decided by the creator ofthe document or file and is indicated in the catalogue of the CERN Archives.

• Free access applies to the majority of the scientific and technical materialarchived.

• Restricted access applies to documents with restricted distribution, to filescontaining administrative documents, in particular correspondence, andto some declassified confidential material. Restricted access can be imposedby the originator or by CERN Management.

• Protected access applies to confidential material for a period of thirty years,which may be extended in exceptional cases to fifty years.

20. For consultation and information retrieval, free access to the catalogues of theCERN Archives' holdings on databases is given to users inside and outsideCERN via the WWW. The catalogued records describe the documents andfiles held in the CERN Archives, indicating their access status. C)

21. All users must contact the Archivist to gain access to the CERN Archives.

22. All users must comply with the present rules; in case of non-compliance, theDirector-General may decide to prohibit future access.

B- Levels of access

1) For internal users

23. Documents and files with free-access status

Internal users have free access to these documents and files.

24. Documents and files with restricted-access status

Requests for access to documents or files with restricted-access status must be of C"",justified interest and the intended use of the information extracted must bedisclosed.

CERN Management have access to all documents and files of the Organization.Division leaders and spokespersons of collaborations (or delegated persons)have unrestricted access to the documents and files of their own division orcollaboration. For documents and files of another provenance, priorauthorization from the originator or the Director-General is needed forconsultation and/or copying.

All other users who are members of the personnel of CERN need priorauthorization from the originator, via the CERN Archivist.

Non-staff members will be asked to fill in and sign a "Declaration" on theintended use of the information and, if applicable, concerning copies made orreceived from the CERN Archives.

25. Protected access

In cases where information is needed out of files whose content is partlyconfidential, the information may be extracted out of the file by the Archives'staff without giving access to the whole file. If the information itself isconfidential or restricted, prior authorization is needed as outlined in § 24.

2) For external users

26. Documents and files with free-access status

External users need to contact the CERN Archivist, preferably in writing, toconsult documents and files with free-access status.

27. Documents and files with restricted-access status

Requests for access to documents or files with restricted access must be ofjustified interest and the intended use of the information extracted must be

Authorized external users, having made a written request to the Director­General of CERN, may also need authorization from the originator, via theCERN Archivist, to have copies made from documents and files withrestricted-access status. They must fill in and sign a "Declaration" on theintended use of the information and, if applicable, concerning copies made orreceived from the CERN Archives.

28. Protected access

In cases where information is needed out of files whose content is partlyconfidential, the information may be extracted out of the file by the Archives'staff without giving access to the whole file. If the information itself isconfidential or restricted, prior authorization is needed as outlined in § 27.

(.c- Categories of archival material

1) Documents and files with free-access status

29. These comprise:- All non-confidential documents of Council more than five years old.

All non-confidential documents (unrestricted distribution) of CERNexperiment committees and of technical and scientific committees andboards.All CERN divisional reports, technical notes, specifications, etc. with freedistribution.CERN yellow reports.Press releases, CERN annual reports, CERN Bulletin, Experiments at CERNand similar series.In general, collections of a scientific nature from CERN staff (exceptdocuments or files marked confidential).

2) Documents and files with restricted-access status

30. In general, files with a closing date of less than 30 years containingcorrespondence have restricted access. This applies particularly to files withprovenance from the Director-General, directors and division leaders and todocuments from the subordinate bodies of Council (Committee of Council,Finance Committee, Scientific Policy Committee).

31. Parts of declassified confidential material may also have restricted-access status.

3) Confidential documents and files

32. As a rule, all confidential archival material is protected from access for a pre­determined time period. Sensitive information, in particular pertaining toindividuals, is confidential and is protected for thirty years dating from theyear of creation of the document or the closing date of the file, extended inexceptional cases to fifty years.

33. Files compiled by Personnel Division, Finance Division, the Medical Serviceand the Pension Fund, as long as they remain the responsibility of thesedivisions or services, are not accessible via the CERN Archives.Administrative Circular N° 10 describes the conditions for access of thesespecial collections. Archiving of these collections is subject to agreements withthe CERN Archivist and future transfer of part of the collections will be subjectto discussions between the relevant parties.

34. Various types of interviews with members of the personnel of CERNconstitute the oral history collection. Recorded interviews are treated asconfidential material, except interviews with purely scientific and technicalaspects which have restricted-access status.

D- Regulations for access

1) General

35. Some of the archived documents and files have special restrictions concerningtheir availability for consultation, citation and/or publication imposed by theiroriginators or by CERN Management.

36. Members of the personnel and authorized external users have access to theCERN Archives.

2) Obtaining authorization for access

37. Applications for access to the material kept in the CERN Archives should bemade in writing to the CERN Archivist, indicating the reason for consultation.The form and the degree of authorization depends on the kind of collection tobe consulted and on the status of the applicant.

E- Use of archival material

38. No document may be removed from the Archives. Copies may only be madewith the authorization of the Archivist and, when necessary, the originators ofthe document concerned.

39. The information extracted from all material belonging to the CERN Archivesmust be properly referenced by the user in order to identify the source.

40. Any authorization given by CERN is personal and not transferable. CERN'sauthorization for access to and use of its Archives in no way discharges theuser from responsibilities and obligations concerning property and copyrightsof CERN and of third parties.

DECLARATION

In consideration of the permission granted to me by the Director-General of CERN toexamine for scholarly purposes papers in the CERN Archives, I hereby declare:

1. I shall not quote from any of the material to which I am given access without the priorand written permission of the CERN Archive Committee, via the CERN Archivist.

2. I shall not paraphrase this material in greater detail than is essential to an accurateexpression of its historical and scientific substance.

3. I agree to give credit to the CERN Archives, Geneva (Switzerland) wheneverdocumentary source material from the Archives is quoted, or summarized, or otherwiseused.

4. I shall send two copies of any publication resulting from my consultation of the CERNArchives to the CERN Archivist, Scientific Information Service, CH-1211 Geneva 23.

5. H I receive copies or am allowed to copy or have copies made of any of the material byany means, including hand copying, I shall use these copies solely for my scholarly purposes.

6. I shall not allow any copies or notes made in connection with the consultation of theCERN Archives to pass into the hands of other persons without the prior and writtenconsent of the CERN Archive Committee.

7. I shall not hold CERN responsible for any liability arising from the permission given tome and my activity connected therewith.

Divisional Records Officer (ORO)

Mandate, responsibilities and functions

The Divisional Records Officer, hereinafter referred to as the DRO, is a staffmember nominated by the division leader in an officially recognized function forthree years, renewable. The DRO shall receive the support of the group leaders andthe divisional secretariat.

This position requires knowledge and experience of both current and formeractivities of the division.

TheDRO:

• Has the authority to implement a records management and archiving planwithin the division.

• Is empowered to advise on the creation of intermediate divisional archives.In collaboration with the group leaders and the divisional secretariat (DAO),and, if applicable, project leaders and spokespersons, the DRO identifies andlists archival material, and passes information on to the CERN Archivist.

• Must contact the spokespersons of experiments or special projects assignedto their division to coordinate archiving activities.

• Works in close collaboration with the CERN Archivist and the ArchiveCommittee.

C', • Informs the CERN Archivist prior to restructuring or cessation of activities inthe division or departure of staff who possess files of potential interest to theCERN Archives.

• Is invited to attend meetings of the Archive Committee when relevantdivisional or general archiving issues are discussed.

• May also attend any other meeting of the Archive Committee by priorarrangement with the CERN Archivist.

• Participates in DRO forums convened by the Archivist (once or twice a year).
