    APPOINTMENT OF OFFICIAL VISITOR

    I, TERENCE ALLAN GRIFFITHS, Minister for Justice, in pursuance of the provisionsof Section 8A (1) of the Prisons Act 1952, do, by this notification, appoint PH1 asOfficial Visitor to PH2, for a period of two years, effective from PH3.Dated this day of 1992.

    OFFICIAL VISITOR SCHEME

    BACKGROUND

    The Official Visitor Scheme commenced in May 1985 on a trial basis and in 1988 thePrisons Act 1952 was amended to provide for the statutory appointment of OfficialVisitors. Sections 8A and 8B, and Schedule 4A, to the Prisons Act 1952 are concernedwith the appointment and responsibilities of Official Visitors. Official Visitors areappointed for a period of two years, but they may be re-appointed at the discretion of theMinister for Justice. They are usually of a professional background, eg retireddepartmental head, school teacher, psychologist, medical practitioner.

    The objective of the Scheme is to provide an outlet for inquiries or complaints from bothstaff and inmates. As a general principle, Official Visitors do not intervene wheresomeone else in the Department is available or employed to handle the matter. Bydeveloping productive relationships within their respective correctional centres, OfficialVisitors facilitate the resolution of problems quickly and effectively, so that only thoseissues which they are unable to deal with locally are referred elsewhere. I t follows,therefore, that much of an Official Visitor's work is that of problem-solving, mainly byappropriate referral, with any necessary follow-up action to confirm resolution.

    Official Visitors have direct access to the Minister and the Commissioner. Except in themost unusual circumstances, all complaints are initially discussed with the Superintendent.

    LEGISLATION

    SECTIONS SA AND SB OF PRISONS ACT 1952

    Official VisitorsSA. (1) TherMinister may appoint, in respect of each prison, one or more Official

    Visitors.(2) Any such appointment shall be notified in the Gazette.(3) The following persons are not eligible to be Official Visitors:

    (a) a person employed as an officer or temporary employee in theDepartment of Corrective Services; or

    (b) a person who is to any extent responsible for the management of, orwho is employed at or in connection with, a prison; or

    (c) a person having any interest in a contract under Part 6A; or(d) a person who has not made a declaration under clause 3A of

    Schedule 4A.(4) An Official Visitor:

    (a) shall visit the prison in respect of which the Official Visitor isappointed at least once* each month for the purpose of givinginterviews to prison officers and prisoners; and

    (b) may visit the prison at any other time unless, in the opinion of thegovernor of the prison, a visit would be undesirable for reasons ofsecurity; and

    (c) shall, in accordance with the regulations, receive and deal withcomplaints; and

    (d) shall, in accordance with the regulations, report at least once every6 months to the Minister; and

    (e) shall have such other functions as may be prescribed.(5) Schedule 4A has effect with respect to Official Visitors.

    (*Please note that as of 26.S.91 the Minister requires Official Visitors to visit correctionalcentres twice per month)

    Disclosure of informationSB. An Official Visitor shall not disclose any information obtained in

    connection with the administration or execution of this Act unless thatdisclosure is made:(a) with the consent of the person from whom the information was

    obtained; or(b) in connection with the administration or execution of this Act; or(c) for the purpose of any legal proceedings arising out of this Act; or(d) in accordance with a requirement of the Ombudsman Act 1974; or(e) with other lawful excuse.

    SCHEDULE 4

    SCHEDULE 4A - PROVISIONS RELATING TO OFFICIAL VISITORS(Sec. SA (5))

    Term of office1. Subject to this Schedule, an Official Visitor shall hold office for such period not

    exceeding 2 years as may be specified in the Official Visitor's instrument ofappointment, but is eligible (if otherwise qualified) for reappointment.

    Acting Official Visitors2. (1) The Minister may, from time to time, appoint a person to act in the office

    of an Official Visitor during the illness or absence of the Official Visitor,and the person, while so acting, has all the functions of (and shall be takento be) an Official Visitor.

    (2) The Minister may, at any time, remove a person from any office to whichthe person was appointed under this clause.

    (3) A person while acting in the office of an Official Visitor is entitled to bepaid such remuneration (including travelling and subsistence allowances) asthe Minister may from time to time determine in respect of the person.

    (4) For the purpose of this clause, a vacancy in the office of an Official Visitorshall be taken to be an absence from office of the Official Visitor.

    Remuneration3. An Official Visitor is entitled to be paid such remuneration (including travelling

    and subsistence allowances) as the Minister may from time to time determine.

    Declaration of interest3A. (1) Before being appointed as an Official Visitor or as an acting Official

    Visitor to a prison that is being managed under an agreement in accordancewith Part 6A, a person is required to make a declaration of his or herinterest (if any) in the agreement or in the management company.

    (2) For the purposes of a declaration under this clause, a reference in subclause(1) to an interest in the management company includes a reference to:(a) shareholding in the management company or in any related

    corporation within the.meaning of the Companies (New SouthWales) Code; and

    (b) any interest in business dealings that are taking place or that havetaken place with the management company or any director or officerof the management company.

    (3) A person is not to be appointed as an Official Visitor or acting OfficialVisitor if, in the opinion of the Minister, the person has such an interest inthe management agreement or the management company that the personshould not be so appointed.

    Vacancy in office of Official Visitor4. (1) The office of an Official Visitor becomes vacant if the Official Visitor:

    (a) dies; or(b) completes a term of office and is not re-appointed; or(c) resigns the office by instrument in writing addressed to the Minister;

    or(d) is removed from office by the Minister under this clause; or(e) becomes bankrupt, applies to take the benefit of any law for the

    relief of bankrupt or insolvent debtors, compounds with his or hercreditors or makes an assignment of his or her remuneration fortheir benefit; or

    (f) becomes a temporary patient or a continued treatment patient withinthe meaning of the Mental Health Act 1958, a forensic patientwithin the meaning of the Mental Health Act 1983 or a protectedperson within the meaning of the Protected Estates Act 1983; or

    (g) is convicted in New South Wales of an offence that is punishable bypenal servitude or imprisonment for 12 months or more or isconvicted elsewhere than in New South Wales of an offence that, ifcommitted in New South Wales, would be an offence so punishable.

    (2) The Minister may remove an Official Visitor from office at any time forsuch cause as to the Minister seems sufficient.

    (3) Without affecting the generality of subclause (2), the Minister may removefrom office an Official Visitor who contravenes section 8B or who, in thecase of a prison that is managed under an agreement in accordance withPart 6A, is found:(a) to have such an interest in the agreement or the management

    company that the person ought not, in the opinion of the Minister,to continue to be an Official Visitor to the prison; or

    (b) to have made a declaration under clause 3A that was false ormisleading in a material particular.

    Filling of vacancy in office of Official Visitor5. If the office of an Official Visitor becomes vacant, a person may, subject to this

    Act, be appointed to fill the vacancy.

    Notice etc of availability of Official Visitors132. (1) The governor of a prison is to notify all prison staff and prisoners at the

    prison of the date and time when the Official Visitor to the prison will bein attendance at the prison and available for interviews.

    (2) The governor of a prison is required, if aware that a prisoner considers acomplaint or inquiry made by the prisoner has not been dealt withsatisfactorily by the prison staff, to advise the prisoner that the prisonermay request an Official Visitor to deal with the complaint or inquiry.

    Complaints and inquiries: how dealt with133. (1) I f an Official Visitor receives a complaint or inquiry, the Official Visitor is

    required to:(a) immediately record the complaint or inquiry in the Official Visitor's

    official diary; and(b) if the Official Visitor considers it necessary, clarify with the prison

    officer or prisoner concerned the details of the complaint or inquiry;and

    (c) ascertain from the prison officer or prisoner what action (if any) hasbeen taken or information provided in response to the complaint orinquiry; and

    (d) complete and forward to the Commissioner an Official Visitors'record form for statistical purposes that contains particulars ofaction taken under this subclause.

    (2) An Official Visitor must:(a) if the Official Visitor considers that the complaint or inquiry can be

    resolved quickly by bringing it to the attention of the governor ofthe prison, inform the governor of the prison of the complaint orinquiry and attempt to have it resolved at that level; or

    (b) advise the prison officer or prisoner concerned of any other actionthat the Official Visitor thinks may be taken by the prison officer orprisoner with respect to the complaint or inquiry; or

    (c) with the consent of the prison officer or prisoner concerned, referthe complaint or inquiry on behalf of the prison officer or prisonerto such person as the Official Visitor considers appropriate.

    (3) In dealing with a complaint or inquiry at any level, an Official Visitor mustnot:(a) interfere with the management or discipline of the prison; or

    (b) give any instructions (other than advice referred to in subclause(2)(b) to prison staff or prisoners.

    (4) If more than one Official Visitor is appointed to a prison, each OfficialVisitor:(a) must inform each other of the persons they have interviewed at the

    prison and the nature and substance of any complaints or inquiriesreceived by them; and

    (b) may attend the prison on separate occasions.

    Reports by Official Visitors134. (1) The periodic report of an Official Visitor to the Minister under section

    8A(4)(d) of the Act must be in writing.(2) An Official Visitor may report to the Minister at any time if, in the opinion

    of the Official Visitor, a complaint or inquiry received by the OfficialVisitor requires the immediate attention of the Minister.

    AIMS OF THE OFFICIAL VISITOR SCHEME

    1. To address inadequacies and injustices affecting staff and inmates.

    2. To deal with complaints by staff and inmates at a local level wherever possible,referring only those which cannot be resolved by the utilisation of resources withinthe correctional centre.

    3. To provide an additional avenue of communication with the Minister and theCommissioner through regular reporting of the nature of complaints/inquiries andthe success or otherwise of action taken.

    4. To identify those areas where, prima facie, complaints may be more appropriatelydealt with by Official Visitors than by the Ombudsman.

    ROLE OF THE OFFICIAL VISITOR

    1. An Official Visitor may visit his/her correctional centre at any time, except whenin the opinion of the Superintendent a visit would be inappropriate for reasons ofthe security or good management of the correctional centre.

    2. An Official Visitor must be available at the correctional centre twice a month forinterview by staff and inmates.

    3. An Official Visitor is to notify the Superintendent of the date and time of theintended visit, as far as possible giving at least three days' notice.

    4. In every case the name of a complainant is to be recorded in the Official Visitor'sdiary.

    If it is impossible to satisfactorily investigate or conclude a complaint withoutdisclosing a complainant's name, then the Official Visitor should consult thecomplainant before carrying on with the complaint.

    5. When a complaint/inquiry is received, the Official Visitor is to:(a) immediately record it in his/her official diary;(b) clarify the facts;(c) ascertain what action the complainant/inquirer has already taken out and

    advise of other possible action;(d) take up the matter on behalf of the complainant/inquirer.

    6. The Official Visitor should discuss the complaint with the Superintendent todetermine what action has been taken.

    7. As a general rule, no problem capable of being dealt with at the local level shouldbe taken further.

    8. In co-operation with the Superintendent, the Official Visitor will monitor inmatesheld in segregation to ensure that they are not unreasonably deprived of rights andprivileges in relation to medical treatment and access to services.

    9. The confidentiality of personal records of staff is respected. In specialcircumstances, subject to the approval of the officer concerned, the Minister orCommissioner may give approval for an Official Visitor to have access to theofficer's personal file.

    10. The Official Visitor must deal with inquiries and complaints without interferingwith the management or discipline of a correctional centre.

    11. Where more than one Official Visitor is appointed to a correctional centre, eachmust inform the other of persons interviewed and their inquiries/complaints, sothat duplication does not occur. They may attend the correctional centreseparately.

    12. An Official Visitor is to submit a six monthly report to the Minister within21 days of 31 December and 30 June and complete the Official Visitors RecordForm for every quarter.

    13. If deemed necessary, the Official Visitor should bring important matters to theattention of the Commissioner or Minister, instead of waiting to submit the bi-annual report.

    14. An Official Visitor should advise the complainant to refer to the Office of theOmbudsman any matter which should be dealt with by that Office.

    15. An Official Visitor should deal with any matter referred to him/her by theOmbudsman.

    16. Official Visitor's Remuneration:Remuneration will be approved only for actual visits to the correctional centre towhich the Official Visitor is appointed and for attendance at meetings whenrequested by the Minister or the Commissioner. Claims for incidental expensesincurred in visiting correctional centres or attending meetings will be paid ifsupported by receipts.

    ROLE OF THE SUPERINTENDENT

    1. The Superintendent shall notify all staff and inmates in advance of the date andtime the Official Visitor(s) will be in attendance.

    2. The Superintendent will advise inmates that if problems have arisen and they havenot been able to have these problems dealt with satisfactorily by staff, they shouldgenerally refer them to the Official Visitor rather than to the Ombudsman. Forexample:*****

    Social welfare problemsDelays in responding to applications and requestsProblems regarding private property and earningsTransfers and classificationsDissatisfaction with decisions and desire for review

    This does not preclude inmates from bringing a matter to the attention of theOmbudsman.

    3. As a matter of courtesy the Superintendent will inform the Official Visitor on hisor her next visit of action taken to resolve the problems brought to his or herattention on the Official Visitor's previous visit.

    4. The Superintendent will afford the Official Visitor access to the necessarydocuments and information.

    5. If considered necessary, the Superintendent will invite the Official Visitor to makean additional or urgent visit to the Centre to deal with pressing matters.

    6. The Superintendent will inform the Minister if the Official Visitor does not visitthe correctional centre as required.

    7. The Superintendent will ensure that legitimate claims for fees and expenses ofOfficial Visitors are dealt with promptly.

    ROLE OF THE CHffiF SUPERINTENDENT

    1. The Chief Superintendent will supply such information and advice as is required toenable the Minister to reply to matters raised in Official Visitor reports.

    2. The Chief Superintendent will convene an annual meeting of Official Visitorswithin his/her Region.

    3. The Chief Superintendent will, when convenient, meet individual Official Visitorsto discuss matters to do with their work.

    ROLE OF THE COMMISSIONER

    Through the Ministerial Liaison Unit, the Commissioner will:

    1. Prepare an up-to-date manual for issue to Official Visitors at the time of theirappointment.

    2. Organise and convene an annual two-day Seminar of Official Visitors .

    3. Liaise with Superintendents, Official Visitors and the Ombudsman regardingproblems, reports and Official Visitor meetings and seminars.

    4. Provide advice to the Minister on matters raised in Official Visitor reports.

    5. Provide knowledge and understanding of the role of the Department of CorrectiveServices, its organisational structure and cultural environment, its corporate planand future directions.

    6. Provide information concerning the role of the Department of Corrective Servicesin the NSW Criminal Justice system.

    7. Provide information concerning human rights issues affecting persons incorrectional centres.

    8. Provide information on issues concerning minority groups, in particular, thosegroups subject to discrimination as covered by the NSW Anti-Discrimination Act1977, and its later amendments.

    REMUNERATION - QFFICIAL VISITORSMeal allowances are payable for one day trips in the following circumstances and subject tocertification.

    Breakfast money = $8.60No payment will be made unless the claimant commenced duty at or before 6.00 am and has beenput to the expense of obtaining a meal while travelling.

    Lunch money = $11.15No payment will be made unless the form is endorsed that the claim is the amount actually paid forthe meal Oess normal expenditure for the midday meal). The certification is made at the bottomright hand comer of the Diary side of the form.

    Tea money = $20.25Travel must have been after 6.30 pm and expense incurred in obtaining a meal while travelling. Theactual time of ending the trip must be included on the claim.Subsistence allowance is paid when required to stay overnight. When this allowance is claimed,meal allowances are not paid. The current rate is $153.75 per day (plus $6.41 per hour for eachhour thereafter) for capital cities; $109.50 per day (plus $4.56 per hour for each hour thereafter)elsewhere.A motor vehicle mileage allowance of 29.8 cents per kilometre is payable.In order to be eligible for a motor vehicle mileage allowance it is necessary, according to thePremier's directive of 22 September 1988, that you hold a comprehensive motor vehicle insurancepolicy. The policy should then include an indemnification of the Crown against liability for any lossarising from use of the vehicle while on official business.Your original comprehensive motor vehicle insurance policy should be sighted by the GaolSuperintendent. A certified copy of the policy should be attached to the Request for Use of PrivateVehicle on Official Business form and sent to the Officer-In-Charge, Transport Services, Departmentof Corrective Services, Roden Cutler House, 24 Campbell Street, Sydney, 2000.Claims for meal and mileage allowances should be made on Form C39 and forwarded to theappropriate institution.Fees to Official Visitors will be paid:

    (a) $71.00 for each official visit not exceeding a half day;(b) $120.00 for each visit exceeding a half day (over 4 hours).

    Claims should be made on Form C37 and forwarded to the appropriate institution.The above rates are effective as of 1 December 1991.
