Copy of MOD letter No. 17(4)/2008(1)/D (Pen/Policy) Vol - VI dated18.01.2011 on the above subject is forwarded herewith as Annexure for furthernecessary action at your end.

2. In this context kindly refer to the Ministry of Defence letter. No 17(4)/ -2008(1) /D(Pen / Policy) dated 11.11.2008 as amended vide Ministry's letter ofeven number dated 11.12.2008, dated 20.1.2009,dated 20.5.2009,dated21.5.2009 and dated 20.01.2010 on the above subject matter which have beencirculated vide this office circulars quoted under reference. The rates ofminimum guaranteed pension/family pension in terms of Para 5 of MOD letterdated 11.11.2008 for commissioned. Officers and PBOR have been provided inAnnexure-II, IIA and Annexure-III of said letter dated 11.11.2008 as amended,respectively. The rates of minimum guaranteed pension/ordinary family Pensionin respect of Pre -1996 EC/SSC pensioners/family pensioners, have also beenissued under this Ministry's letter No 1(1)/2007/ D (Pen/Policy) dated 3rdSeptember 2009. A number of references are being received by the Governmentregarding applicability of above said rates of minimum guaranteed pension inrespect of Pre-2006 officers and PBOR pensioners of Territorial Army and Post -1996 but Pre -2006 retiree Emergency Commissioned /Short ServiceCommissioned officers.

3. Since rates of minimum guaranteed pension/ordinary family pensionprovided under Annexure-II and Annexure-III of Ministry's above said letterdated 11.11.2008 as amended are inclusive of rank weightage applicable toregular commissioned officers and PBOR, the same shall not be applicable to theofficers and PBOR pensioners of Territorial Army and Post -1996 but Pre -2006retiree Emergency Commissioned/Short Service Commissioned officers. Tablesshowing rates of minimum guaranteed pension and ordinary family pension inrespect of Territorial Army Officers who retires/died prior to 1.1.2006 andEmergency Commissioned / Short Service Commissioned officers whoretires/died between 1.1.1996 and 31.12.2005 are enclosed to MOD letter dated18.01.2011 under transmission which may be treated as Annexure –lI B andAnnexure –II C respectively to Ministry's above quoted letter dated 11.11.2008.

4. In case of PBOR pensioners of Territorial Army, Pension DisbursingAgencies (PDAs) shall revise pension/family pension of such Pensioners/familypensioners only in terms of Para 4.1, read with Annexure-I, of MOD letter dated11.11.2008. Thereafter, PDAs shall refer these cases to this office in theenclosed' Annexure to the MOD letter dated 18.01.2011, for determining andauthorizing the entitlement of minimum guaranteed pension/family pension, iffound beneficial in terms of Para 5 of MOD letter dated 11.11.2008.This officeshall inform to the PDAs in cases where the entitlement of minimum guaranteedpension/family pension is not beneficial. A copy of such authorization /information will invariably be endorsed to the pensioner by this office.

5 The cases may be submitted to this office by name to Shri Jagdish Prasad,Officer Incharge RP Cell office of the PCDA(P),Draupadi Ghat, Allahabad -211014in the enclosed Annexure to the MOD letter dated 18.01.2011.

6. As evident from the above it is reiterated that Tables enclosed with theMOD letter dated 18.01.2011 showing rates of minimum guaranteed pensionand ordinary family pension in respect of Territorial Army Officers is applicable inrespect of those who retires/died prior to 1.1.2006 and EmergencyCommissioned / Short Service Commissioned officers who retires/died between1.1.1996 and 31.12.2005.

7. All other subsidiary payment instructions will be the same as alreadycirculated vide this office circulars quoted under reference. The cases for revisionas per these orders may please be reviewed at your end. The affected cases maybe revised accordingly.

The undersigned is directed to refer to this Ministry's . letter No 17(4)/2008(1)ID(PenIPolicy) dated 11.11.2008 as amended vide this Ministry'S letter of evennumber dated 11.12.2008, dated 20.1.2009, dated 20.5.2009 and dated 21.5.2009 on theabove subject matter. The rates of minimum guaranteed pension/family pension interms of Para 5 of this Ministry's above said letter dated 11.11.2008 for commissioned.officers and PBOR have been provided in Annexure-II, IIA and Annexure-III of saidletter dated 11.11.2008 as amended, respectively. The rates of minimum guaranteedpension/ordinary family pension in respect of Pre - 1996 EC/SSC pensioners/familypensioners, have also been issued under this Ministry's letter No 1(1)/2007-.D(PenIPolicy) dated 3rd September 2009. A number of references are being received inthis Ministry regarding applicability of above said rates of minimum guaranteedpension in respect of pre-2006 officers and PBOR pensioners of Territorial Army andPost - 1996 but Pre - 2006 retiree Emergency Commissioned/Short ServiceCommissioned officers.2. .. The matter has been carefully considered in this Ministry and it is conveyed thatsince rates of minimum guaranteed pension/ordinary family pension provided underAnnexure-II and Annexure-III of this Ministry's above said letter dated 11.11.2008 asamended are inclusive of rank weightage applicable to regular commissioned officersand PBOR, the same shall not be applicable to the officers and PBOR pensioners ofTerritorial Army and Post --" 1996 but Pre - 2006 retiree EmergencyCommissioned/Short Service Commissioned officers. Tables showing rates ofminimum guaranteed pension and ordinary family pension in respect of TerritorialArmy Officers who retires/died prior to 1.1.2006 and Emergency Commissioned/ShortService Commissioned officers who retires/died between 1.1.1996 and 31.12.2005 areenclosed to this letter which may be treated as Annexure - lIB and Annexure - IICrespectively to this Ministry's above quoted letter dated 11.11.2008. However, in caseof PBOR pensioners of Territorial Army, Pension Disbursing Agencies (PDAs) shall

revise pension/family pens-ion of such pensioners/family pensioners only in terms ofPara 4.1, read with Annexure-I, of this Ministry's above said letter dated 11.11.2008.Thereafter, PDAs shall refer these cases to the respective Pension SanctioningAuthorities (PSAs), in the enclosed' Annexure, for determining and authorizing theentitlement of minimum guaranteed pension/family pension, if found beneficial in termsof Para 5 of this Ministry's above said letter dated 11.11.2008. PSAs shall also informto thePDAs in cases where the entitlement of minimum guaranteed pension/ familypension is found not beneficial. A copy of such authorization/ communication mayinvariably be endorsed to the pensioners concerned for their information.3. Note 1- The pension of post-1996 and pre-31.12.2005 ECO/SSCOs pensioners is required to be revised by PensionDisbursing Agencies in terms of Annx-1 read with Para 4 of Gal, MOD letter No17(4)/2008(1 )/D(Pen/Policy) dated 11.11.2008. However, in case the pension so consolidated happens tobe less than the amount indicated in the Table above, the pension protection as as indicated in this Tablewill be given.

Note 2- While the qualifying service indicated in Table-1 above is the actual qualifying service, the amount ofpension indicated is inclusive of weightage as admissible in terms of Para 5(b)(ii) of this Ministry'sletter No. 1(6)/981D(Pen/Ser) dated 3.2.98 amended vide Gal, MOD letter No. PCD/39028/AG/PS-4(A&C)/863/B/D(Pen/Sers) dated 28.11.2000.
