DAILY SWEEPING, CLEANING, OPERATION & MAINTENANCE OF PUMP, SURVEILLANCE AND ARRANGEMENT OF SECURITY GUARD OF KUMAR CHANDRA JANA AUDITORIUM AND BEAUTIFICATION, OPERATION, MAINTENANCE AND SECURITY SERVICES OF AMUSEMENT PARK (ADJACENT TO KUMAR CHANDRA JANA AUDITIROUM) AT BASUDEVPUR, HALDIA.

For and on behalf of Haldia Development Authority, the Chief Executive Officer invites Online (e-Tender) single rate tenders in TWO BID SYSTEM from reliable, resourceful, bonafide and experienced firms / companies / individual agencies having requisite financial capability and sufficient technical credential on execution of similar nature of work. The details are given below:

1. Name of work : DAILY SWEEPING, CLEANING, OPERATION & MAINTENANCE OF PUMP, SURVEILLANCE AND ARRANGEMENT OF SECURITY GUARD OF KUMAR CHANDRA JANA AUDITORIUM AND BEAUTIFICATION, OPERATION, MAINTENANCE AND SECURITY SERVICES OF AMUSEMENT PARK (ADJACENT TO KUMAR CHANDRA JANA AUDITIROUM) AT BASUDEVPUR, HALDIA.

2. Location of Work : Basudevpur, P.O. - Khanjanchak, P.S. - Durgachak, Haldia, Purba Medinipur.

3. Scope of Work : Daily sweeping and cleaning of Auditorium Hall and adjacent premises and Amusement Park .

Daily cleaning of toilets and disinfecting and acid cleaning of sanitary fittings floor dado and keeping toilets in serviceable condition.

Daily cleaning of all drains in and around courtyards, spreading disinfecting materials and disposing spoils outside the compound.

Daily sweeping and cleaning of all the rooms, staircases, attached lobby, including stair and disposing spoils outside the compound.

Cleaning of all dusts of chairs (Ground floor and first floor) and ceiling, stair waist slab, corridor walls and ceiling once in a week.

Cleaning and sweeping of Roof and removal of all spoils and vegetation as directed in every month.

Cleaning, sweeping, sanitation provides toiletries, and minor plumbing works.

Operation of pump as and when required and its proper maintenance.

i) Sanitary items: Phenyl, naphthalene balls, eucalyptus oil, odonil etc. are to be supplied by the contractor.

ii) Materials for cleaning of floor, surface drain and other sanitary structure are also to be supplied by the contractor.

The naphthalene balls in urinal should be sufficient throughout the day.

Work at adjacent area of the Auditorium (in the open area) daily cleaning of roads, lawns, other structures, cleaning of drains on regular basis.

Cleaning of Toilet inside the Park.

Guarding/ security arrangement round the clock to safeguard Auditorium Complex and Amusement Park providing security guard including Gunman, Security Dogs with Handlers and manning of Metal Detector.

Pest Control within the premises of the Auditorium once in a week.

Regular cleaning of Water Body in the Park.

Other unseen work to be carried out as per instruction of the Authority.

Landscaping and gardening of Amusement Park (adjacent to K.C. Jana Auditorium) at Basudevpur providing seasonal flowering & ornamental plants, planting, watering, weeding, cleaning & maintenance, providing pot plants and beautifying the campus, etc. of Garden & landscape, Cleaning of the Sculptures and amusement rides, situated inside the park to be done on regular basis.

Maintenance of existing plants/trees, flower plants and replacement thereof as and when necessary including regular manuring, watering, spraying of pesticides.

Supply and planting of seasonal flowers.

Preparing flower bed in the winter season as directed by the Authority.

Supplying earthen flower-pots in summer and rainy season as (100 pieces per season) and when necessary or as directed by the Authority.

Maintenance of the lawns of the park in its proper shape by supplying and planting grass seeds and hedge or border plants of approved quality including preparation of soil, supplying and mixing required quantity of manure with soil, dressing, leaving earth, watering of the lawns everyday (except during monsoon months) is to be done.

Trimming of grass in the lawn hedges and border plants should be done on regular basis (at least once in 45 days, compulsory).

Minor repairing of sanitary & plumbing system of Auditorium and Amusement Park.

To provide personnel for opening and closing of the park for general public particularly the children every day as instructed by HDA.

Other unseen work to be carried out as per instruction the Authority.

Engagement of Staff: Adequate nos. of sweeper /gardener/ security guard (including gunman and security dog with handler) should be deployed to carry out the above work with good quality and care.

Material to be used –

Phenyl = 50 ml per bucket i.e. 50ml per 15 litre of water. Odonil = 1 packet per toilet per week. Eucalyptus Oil = As required. Naphthalene = 4 pieces per urinal per day. Sweeping materials: As required. Bleaching powder (Bengal Chemicals / Hammer Master) for

outside drain on regular basis.

Contract Period : The contract period is 03 (Three) Years only. However, the contract period may be extended subject to performance of the agency and approval of the authority.

Other works as instructed by the authority time to time.

4. Tender Value : Rate to be quoted (including all taxes & GST)

5. Period of Assignment : 03 (three) Years.

8. Eligibility Criteria for “Pre Qualification”

:

1. The Agency should have successfully executed similar nature of work having single tender value of at least i.e. 10.0 Lakh Or Executing similar nature of work and received payment of 10.0 Lakh in a year against that work

2. The agency should have Valid Private Security Service License issued by Home (Political) Deptt., Govt. of W.B.

3. Having experience of operation & maintenance of Fire Fighting System. 4. Having Pest Control License/ necessary documents issued by Competent

Authority and having experience of Pest Control. 5. Credential Certificate for providing security dog with handler under any

Government / Semi Government / Undertakings / Autonomous / Statutory bodies / Local bodies.

6. Having experience for manning metal detectors through Civil Guards in Central Government / State Government Departments / Public Companies / Undertakings / Autonomous Bodies / Local bodies.

7. Average Annual Turn Over from Contracting business for the past 3 (Three) Financial Years should be equal to or more than 30.0 Lakh Only from Contracting Business. Audited Balance Sheet (authenticated by a Chartered Accountant) shall have to be produced in support of the claim.

8. Statutory Documents: a. Latest Income Tax return. b. PF and ESI registration. c. GST registration certificate. d. Latest Professional Tax Return e. Audited Balance Sheet of last 3 Financial years f. PAN Card (Xerox Copy). g. Valid Private Security License issued by Home (Political) Deptt., Govt.

9. Earnest Money Deposit :

Rs. 20,000/- ( Rupees Twenty Thousand) only.

THE EARNEST MONEY SHALL BE DEPOSITED BY THE BIDDER ELECTRONICALLY: The Earnest Money shall be deposited by the bidder online-through his net banking enabled bank account, maintained at any bank or through any bank by generating NEFT /RTGS challan from the e-tender portal. Intending Bidder will get the Beneficiary details from e-tender portal with the help of Digital Signature Certificate and may transfer the EMD from their respective Bank to the Beneficiary Bank Account No. The name of Beneficiary bank (at present ICICI Bank), Account No. & IFSC Code are given in the e-tender portal. The details of deposition of EMD can be obtained from the following link, “wbtenders.gov.in Home Page Bidders Manual Kit Help for on-line receipt and refund of EMD” Intending bidder who wants to transfer EMD through NEFT/RTGS must read the instruction of the Challan generated from E-Procurement site. Bidders are also advised to submit EMD of their bid, at least 3 working days before the bid submission closing date as it requires time for processing of Payment of EMD and Bid can be submitted only after receipt of EMD. NOTE: Earnest money through offline instruments like Bank Draft, Pay Order etc. will not be accepted for e-tender procurement of this office. The E.M.D, will be transferred as security deposit.

Interested bidders shall register with NIC in advance. Necessary assistance can also be obtained from the Office of the CEO, HDA.

17. Technical Bid Evaluation

: The Technical Bid will be evaluated by the Tender Evaluation Committee of HDA. Bidders shall produce hard copies of the requisite documents during evaluation for the technical bid. Originals shall be shown, if required.

18. Date and time of opening of Financial Bid submitted on line of only the technically qualified bidders

: To be intimated through On-line after evaluation of Technical Bid.

19. Financial Bid : Lump Sum Amount per Month to be quoted in the prescribed format of Financial Bid given with this NIT inclusive of all taxes & duties except Service Tax. Service Tax will be reimbursed on production of documents in support of Service Tax payment.

The bidders interested to submit the bid Online shall get registered and get a digital signature as per the procedure described below:

Agencies/Bidders who are interested in participating HDA’s e-tenders are requested to contact the representatives of NIC for registration, computer setting and clarification on e-tendering.

Training on e-tender can also be availed from Office of the CEO, HDA if desired by the bidder during office hours.

Online Tenders can be submitted by logging in www.wbtenders.gov.in. ONLINE BID SUBMISSION:

The Bidders are required to submit the Technical and Financial Bid documents

ONLINE i.e uploading of the documents complete in all respect by following the Online Bid submission procedure.

22. Training on E-tender : Training on e-tendering will be given to the bidders on request.

23. Important Instructions : Names of the technically qualified bidders as per the bid criteria after verification with original & evaluation will be displayed in the e-portal, this office notice board and official website.

The Financial Bid documents of the technically qualified bidders will only be opened.

List of financial comparison chart of bidders will be published on the next day after opening. CEO HDA reserves the right to reject or cancel any or all pre-qualification documents and bid document without assigning any reasons whatsoever

All duties, taxes, royalties, cess, including 1% Cess under W.B. Building and other Construction Workers (Regulation of Employments & Condition of Service) Act, 1996], toll, taxes and other levies payable by the Contractor under the Contract to the State / Central Government for any other cause, shall be included in the rates, prices and total Bid price submitted by the bidder. 1% Cess under W.B. Building and other Construction Workers (Regulation of Employments & Condition of Service) Welfare Cess Act, 1996 will be deducted from the running bills.

The successful Tenderer shall have to start the work at site within 7 days after receipt of the work order or as instructed by HDA, failing which work order shall be cancelled with forfeiture of earnest money deposited with HDA without assigning any reason.

Sub-letting of the job is not permissible and the Tenderer must submit one undertaking that he will not sub-let the job under any circumstances. If the authority comes to know that the agency has sub-let the work then action shall be taken to terminate the contract and the SD money will be forfeited.

All materials & workmanship shall be as per the approved quality and methodology.

No advance will be paid to the contractor. The contractor will pay minimum wages to his workmen in the presence of HDA officials and only after certification by HDA officials that the minimum wages have been paid the bill will be processed.

Progressive payment will be paid in running account bill subject to good performance. Payment may be withheld / not made on average or poor quality of job. If the agency gets average or poor grading of work quality, he may be debarred for one year from the tender of HDA.

No escalation of cost is permissible at any time after the issuance of work order. Agency shall be barred from approaching the authority to claim escalation cost for reasons whatsoever.

verification of all supporting documents on request of HDA.

Penalty up to 10% of the contract value may be imposed if the performance is not satisfactory.

The agency should possess the requisite and relevant equipments and machineries for the work.

Work shall be carried out without hampering the harvesting of the crops for which water is collected from this canal, however authority shall be consulted every time.

The Contract will be for a period of 3 (Three) years. The same may be extended subject to the performance of the contractor at the discretion of the Authority.

Contractor will deploy and pay the personnel engaged by him. Minimum

wages and all other necessary and statutory aspects of existing Labour

Rules, Workman Compensation and insurance cover of workmen and

other statutory fringe benefits payable to the workers as per relevant Acts

shall be adhere to at least . If minimum wages are revised time to time,

the additional burden if any shall be borne by the contractor.

Keep on record that the contractor is the employer and the personnel to be

engaged for the work will be treated as the workers / labours of him.

Agency is the principal employer in this regard.

The personnel/ workers engaged for the work shall be the employees of

the Agency/ Contractor and will take their remuneration/wages/statuary

benefits from the agency/contractor. They will have no claim and

liabilities of whatsoever nature including monetary claims or any other

claim or benefits from the Authority. Any liability arising under

Municipal, State or Central Govt. laws and regulations will also be the

sole responsibility of the concerned agency/ Contractor and the Authority

shall not be responsible for such liabilities.

The personnel having required skill shall be deployed.

Any damage/loss/theft of the Authority’s property, due to negligence of

the Contractor, will be made good and all accidents of theft/damage/loss

are to be reported to the CEO, HDA promptly.

The Contractor will obtain Labour License as required under the Contract

Labour (Regulation and Abolition) Act and rules framed therein.

The CEO/HDA and other authorized Government Officials will reserve the right to investigate any labour dispute that may arise between

contractor and his staff employed in the Administrative Office building.

The CEO/HDA or his authorized representative will have the right to inspect records regarding workers employed by the Contractor and payment of wages made to them. He shall have access to all records and registers at any point of time without prior intimation.

Any illegal activity reported that vitiates the social environment and public tranquility will be dealt with severely and may result in termination of contract.

HDA will have every right to cancel the contract if any of the terms and conditions, as laid down, is violated without any further reference to the Contractor.

The intending bidders are requested to inspect the work site before quoting their rates.

To keep the Auditorium and Amusement Park in good condition during the contract period if any additional / excess work is required over the stipulated scope of work, the Contractor has to do the maintenance work at his own cost.

INFORMATION TO THE BIDDERS (ITB)

1. Request for Tender Request for tender paper is to be placed online only through the Website www.wbtenders.gov.in

2. Submission of Tender The tender will be submitted in Two Bid System i.e. Technical bid & Financial bid.

3. Online Bid submission procedure

i) Registration of Contractor: Agencies/Bidders who are interested in participating HDA’s e-tenders will have to be enrolled & registered with the Government e-Procurement system, through logging on to https://etender.wb.nic.in. They are requested to contact to the toll free Help-line No. 1800 3070 2232 of National Informatics Centre for registration, computer setting and other clarification on e-tendering.

ii) Digital Signature certificate (DSC): Each contractor is required to obtain a class-II or Class-III Digital Signature Certificate (DSC) having Signing and Encryption certificate for submission of tenders, from the approved service provider of the National Information’s Centre (NIC) on payment of requisite amount.

iii) The contractor can search & download NIT & Tender Documents electronically from computer once he logs on to the website www.wbtenders.gov.in using the Digital Signature Certificate. This is the only mode of collection of Tender Documents.

iv) Submission of Tenders: General process of submission, Tenders are to be submitted through online to the stipulated website in two folders at a time for each work, one in Technical Bid & the other is Financial Bid before the prescribed date & time using the Digital Signature Certificate (DSC). The documents are to be uploaded duly Digitally Signed. The documents will get encrypted (transformed into non readable formats).

B. Financial Bid:

The financial proposal should contain the following documents in one cover (folder) i.e. Bill of quantities (BOQ):

The contractor is to quote the rate as Lump Sum cost per Month online through Computer only in the space marked for quoting rate in the Financial Bid. Only downloaded copies of the above documents are to be uploaded in (Excel file) Digitally Signed by the contractor.

4. TECHNICAL BID

4.1.1 Receiving of documents

Relevant documents must be uploaded online for participating in this tender. If the mandatory documents are not submitted online within the stipulated date & time, then bid of the applicant shall summarily be rejected and the bid offer shall not be opened. The Details of Mandatory Documents are given below:

Mandatory Documents:

i) Copies of original documents defining the constitution or legal status, Name and address, registration detail of Firm / Company / Agency, place of registration, and principal place of business, name of proprietor and written power of attorney of the signatory of the Bid to commit the Bidder.

ii) Completion certificate and filled in Form – I along with details of similar type of project/job under any Government / Semi Government / Undertakings / Autonomous / Statutory bodies/ Local bodies, with requisite single tender value.

iii) Audited Balance Sheet of last three Financial Years (authenticated by a Chartered Accountant) and filled in Form – II for establishing average Annual Turnover in contractual business.

iv) Duly Filled in FORM – III (Details of the agency).

v) Duly Filled and notarized Affidavit as given under Annexure – I

Note: The tender will be summarily rejected if any of these documents are not submitted online. Bidders shall produce hard copies of the requisite documents during evaluation for the technical bid. Originals shall be shown if required by the authority.

4.1.2 Receiving of Earnest Money Deposit (EMD)

Rs. 20,000/- ( Rupees Twenty Thousand) only.

THE EARNEST MONEY SHALL BE DEPOSITED BY THE BIDDER ELECTRONICALLY: The Earnest Money shall be deposited by the bidder online-through his net banking enabled bank account, maintained at any bank or through any bank by generating NEFT /RTGS challan from the e-tender portal. Intending Bidder will get the Beneficiary details from e-tender portal with the help of Digital Signature Certificate and may transfer the EMD from their respective Bank to the Beneficiary Bank Account No. The name of Beneficiary bank (at present ICICI Bank), Account No. & IFSC Code are given in the e-tender portal. The details of deposition of EMD can be obtained from the following link, “wbtenders.gov.in Home Page Bidders Manual Kit Help for on-line receipt and refund of EMD” Intending bidder who wants to transfer EMD through NEFT/RTGS must read the instruction of the Challan generated from E-Procurement site. Bidders are also advised to submit EMD of their bid, at least 3 working days before the bid submission closing date as it requires time for processing of Payment of EMD and Bid can be submitted only after receipt of EMD. NOTE: Earnest money through offline instruments like Bank Draft, Pay Order etc. will not be accepted for e-tender procurement of this office. The E.M.D, will be transferred as security deposit.

4.1.3 Average Annual Turnover

Average Annual Turnover during last 3 (three) years should be more than Rs. 30.0 Lakh

4.1.4 CREDENTIAL

4.1.4.1 Technical :

The Agency should have successfully executed similar nature of work having single tender value of at least i.e. 10.0 Lakh per year. Or Executing similar nature of work and received payment of 10.0 Lakh against that work in a year NOTE: Similar nature of work: Maintenance of Office/ Guest House/ Residential complex/ Sports Complex/ Market Complex / Business Centre/ Hospital etc. Maintenance of Garden/Park/ any landscaping work.

Executing of Beatification/Gardening/Park/Landscaping Work.

For running work, Copy of the Work Order having details of similar nature of job and Work Schedule/ BOQ of the similar nature of work shall have to be submitted along-with the Payment Certificate, in the technical bid for verification of the credential.

The agencies who have completion certificate against any of the above-mentioned works shall be eligible for this tender.

4.1.4.2 The Completion Certificate should be pertaining to the work specified in the NIT. The completion certificate should not be misleading the authority. If the completion certificate has mention on multiple nature of works executed by the agency in a single tender including the work specified in this NIT, then the value of the work as specified in this NIT will only be taken into account for evaluating the eligibility of the bidder. The decision of the authority in this respect is final and binding.

4.1.4.3 FINANCIAL : The average Annual Turn Over from contracting business for the past three financial years of the firm should be more than 30.0 Lakh of the aggregate cost of works in which the contractor intends to participate. Annual Turnover statement shall be submitted in the Form-II in addition to the Audited Balance Sheet of the last three financial years authenticated by Chartered Accountant.

4.1.5 If the applicant is an authorized signatory he should submit document of authorization (Power of Attorney) in his favour along with the application. In case of Partnership firm, copies of the partnership deed are to be submitted along with the tender document.

4.1.6 Penalty for suppression / distortion of facts : If any tenderer fails to produce the original hard copies of the documents (especially Completion Certificates, audited balance sheets or any document which is vital for his eligibility), or any other documents within the specified time frame stated above or if any deviation is detected in the hard copies from the uploaded soft copies or if there is any suppression of fact during any time of the tendering process or even after the issuance of work order, the tenderer will be suspended from participating in the tenders on e-Tender platform for a 2 (two) years.

4.2 FINANCIAL BID: a) Single rate (per month basis) shall be quoted in the prescribed Financial Bid form online. b) The rate is to be quoted both in words and figures clearly in the specified space of the Tender

form/ Financial bid Form.

c) The rate quoted by tenderer shall be inclusive of all elements of taxes and duties, demands, etc. The

tenderer shall include all statutory taxes and GST, as applicable, octroi if any, toll, ferry charges,

local charges, royalties, turn over tax and all other charges as applicable while quoting the rate.

d) All other charges like insurance charges, freight etc as would be required for completion of the

work shall also be included in the rate quoted. No claim what so ever in this account shall be

entertained.

4.3 Taxes & duties to be borne by the Contractor :

It may again be reiterated that Income Tax, GST, Royalty, Construction Workers’ Welfare Cess and similar other statutory levy / cess etc. will have to be borne by the contractor while executing the work. Rate to be quoted inclusive of all Taxes including GST.

4.4 Site inspection before submission of tender :

Before submitting any tender, the intending tenderer should make themselves acquainted thoroughly with the local conditions prevailing at site by actual inspection and taking into consideration all factors and difficulties likely to be involved in the execution of work in all respect and no claim whatsoever will be entertained on these account afterwards.

4.4.1 Conditional and incomplete tender :

Conditional and incomplete tenders shall be summarily rejected.

5. Acceptance of Tender :

Lowest valid rate will be accepted, however, the undersigned does not bind himself to do so and reserves the right to reject any or all the tenders, without assigning any reason and also reserve the right to split the work amongst more than one Tenderer.

6. Return of Earnest Money of the unsuccessful tenderer(s)

The earnest money of unsuccessful Bidder shall be returned not later than 60 days from the bid validity period without interest.

7. Payment

Payment will be made against the Monthly bill to be submitted by the agency after verification of the performance and quality of maintenance work. Payment of RA as well as final bill for any work will be made according to the availability of fund and no financial claim in case of any delay in payment will be entertained.

8. Security Deposit

10 % of the contract value shall be the security deposit. 10% from each RA payment will be deducted

security money. EMD may be converted to security deposit for the successful tenderer. E.M.D. & the

total 10% (Ten Percent) Security Deposit will be released after 06 (six) months after the successful

completion of the contract period. An application along with a prescribed format of this office to be

submitted for release of S.D. for which the contractor should apply to the authority with an undertaking

that the work is maintained properly as per the terms of contract.

9. Withdrawal of tender:

A tender once submitted shall not be withdrawn within a period of 120 days from the last day of the opening of the financial bid of the tender. If a tenderer withdraws his tender within this period without any valid reason, the EMD shall be forfeited and the tenderer will not be allowed to participate in any tender of this Authority.

10. OTHER TERMS & CONDITIONS: 10.1 Tenderers requested to be present in person during the opening of technical and financial bids.

10.2 The tender accepting authority may ask any tenderer to submit analysis to justify the rate quoted by

the tenderer.

10.3 The personnel provided shall be the employees of the Contractor and all statutory liabilities will be

paid by the contractor such as ESI, PF, Workmen’s Compensation, etc. The list of staff going to be

deployed shall be made available to the Authority and if any change is required on part of the

Authority fresh list of staff shall be made available by the agency after each and every change.

10.4 The Agencies/contractor shall abide by and comply with all the relevant laws and statutory

requirements covered under various laws such as Minimum Wages Act, Contract Labour (Regulation

and Abolition) Act 1970, EPF Act, ESI Act and various other Acts as applicable from time to time

with regard to the personnel engaged by the contractor for the Authority. Payment of contractual

workmen to be engaged shall be in conformity prevailing rates.

10.5 The Agencies/contractor shall abide by all the labour welfare laws and their modifications from time

to time, if any, within the contract period. Minimum labour wages act, labour facilities, E.S.I, P.F,

Bonus facilities etc. should be provided as per latest Govt. order/Circulars. In no case, HDA shall be

held responsible for any eventualities in this regard including payment of wages to personnel

deployed by the contractor.

10.6 The personnel/ workers engaged for the work shall be the employees of the Agency/ Contractor and

will take their remuneration/ wages/ statutory benefits from the agency/ Contractor. They will have

no claim and liabilities of whatsoever nature including monetary claims or any other claim or benefits

from the Authority. Any liability arising under Municipal, State or Central Govt. laws and regulations

will also be the sole responsibility of the concerned Agency/ Contractor and the Authority shall not

be responsible for such liabilities.

10.7 Keep on record that the agency is the employer and the personnel to be engaged for the work will be

treated as the workers/labours of him. Agency is the principal employer in this regard.

10.8 The successful Tenderer is to obtain license from the Registering Officer and Assistant Labour

Commissioner, Haldia, Purba Medinipur under the Contract Labour (Regulation & Abolition), 1970

and to submit the same to the office on receipt of the work order. He is also required to fulfill all the

terms and conditions as embodied in the above Act, as well as any other laws and statutes as

applicable.

10.9 Initial Employment is to be made from the Local Employment Exchange as will be available in forms of Para – 6(b) of 1700/EMP dated 03.08.1989.

10.10 HDA takes no responsibility for any delay/loss/non-receipt of tender document or any other letter sent by post either way.

10.11 If any accident happens to personnel during duty hours, the Agency shall be solely responsible for providing necessary treatment and compensation to the affected personnel of his /her affected dependent family members.

10.12 Tenderer can approach only the Assistant Planner-I, HDA for any clarification with respect to this tender.

10.13 The decision of authority with respect to this tender is final and binding.

10.14 All corrections in the tender should be signed with date by the Tenderer. Each of the Tender

document and drawings must be signed by the Tenderer.

10.15 Tenderers who will sign on Tender on behalf of a company or Firm must produce the “Registered

documents” in respect of their competency to do so, failing which their tender will not be considered.

10.16 It has been observed that the successful bidders deploy unqualified supervisor during execution of

work. Therefore, the successful bidder shall ensure that qualified superiors are deployed to carry out

quality works. If substandard works during the execution of work is detected, then the authority shall

have right to direct the agency to re-do the work once again, check the qualification of supervisors,

penalize the agency etc.

10.17 The successful Tenderer shall have to start the work at site within 07 (seven) days after receipt of the

work order/ or as instructed by HDA failing which work order shall be cancelled with forfeiture of

earnest money deposited with HDA without assigning any reason.

10.18 Sub-letting of the job is not permissible and the Tenderer must submit one undertaking that he will

not sub-let the job under any circumstances. If the authority comes to know that the agency has sub-

let the work then action shall be taken to terminate the contract and the SD money will be forfeited.

10.19 All materials & workmanship shall be as per the approved quality and methodology.

10.20 An amount equal to 1% of the contract amount will be deducted from the RA bill / final bill on

account of “The Building and other Construction Work (Regulation of Employment and Condition of

Service) Act, 1996” and “The building and other construction work welfare cess Act, 1996” apart

from other statutory deductions from bills/ payment due.

10.21 No materials and labour charges would be borne by this authority. Workmen are to be engaged as per

standard norms of the Labour Contract Act.

10.22 Progressive payment will be paid in running account bill subject to good performance. Payment may

be withheld / not made on average or poor maintenance work. If the agency gets average or poor

grading of work quality, he may be debarred for one year from the tender of HDA.

10.23 No escalation of cost is permissible at any time after the issuance of work order. Agency shall be

barred from approaching the authority to claim escalation cost for reasons whatsoever.

10.24 Original copy of all certificates shall be produced for checking and verification of all supporting

documents on request of HDA.

10.25 Penalty: For poor maintenance and loss of any asset, penalty as decided by the authority will be

imposed upon the agency.

10.26 The agency should possess the requisite and relevant equipments and machineries for the work. If

equipments and machineries are not deployed as per the undertaking given by the contractor, the

Official in-charge is authorized to stop the work and direct the contract to deploy them immediately.

If the contractor fails to carry out the direction, then the authority may take appropriate action

including forfeiture of EMD and cancellation of the work order.

10.27 Registration of all workers engaged in building and other construction workers to be done under the

Building and other Construction Workers’ (RE & CS) Act, 1996 and the State Rules, 2004 framed

there under to provide for their safety, health and welfare measures.

10.28 HDA reserves the right not to allow the agency in the Technical bid under the following

circumstances.

(i) Delay in completion of any assignment/ work in HDA.

(ii) Poor performance in terms of either quality of materials or workmanship.

10.29 Termination of Contract/ Work Order: The authority may terminate the contract/work order due

to the following reasons.

i) Poor maintenance of the infrastructures and garden.

ii) Poor Quality of work.

iii) Adoption of any unfair means during execution of work.

iv) Violation/Non-compliance of any instructions of the authority.

For termination of the contract/work, the authority will issue a 7 days notice to the

agency/contract to make up the discrepancy/shortfall of the work as instructed by the authority,

failing which the contract/work order will be terminated with forfeiture of E.M.D., S.D.

10.30 Keep on record that the agency is the employer and the workers / labourers, if any, to be engaged for

the work will be treated as the workers/ labourers of him. Agency is the principal employer in this

regard.

10.31 Discretion of the authority inviting tender - The tender inviting authority reserves the right to accept

or to reject any or all applications/tenders without assigning any reason whatsoever. On matters of

dispute authority decision shall be final and binding. The quantity of work indicated above is

provisional and should not be taken as firm. The extent to which the work would be actually executed

will depend on the final decision of the Chief Executive Officer, HDA. He however reserves the right

to reduce the quantity even substantially without assigning any reason thereof and take up the same

otherwise for which no compensation is payable under any circumstances.
