THE KEY POLICIESAct is quite short and divided into 5 sections. -Section 1: Covers the test to determine if something is obscene. -Section 2: Covers the actual prohibition of publishing obscene material. -Section 2.1: Replaces the common law misdemeanor of ‘obscene libel’ which was previously the crime. -Section 2.4 states that where an article is obscene no other common law charges should be brought and it should instead be dealt with through the 1959 act to limit prosecutions to those crimes found in this Act. -Section 2.5 creates an defense of innocent dissemination. -Section 3 covers powers of search and seizure. -Section 4 creates the defense of public good. -Section 5 allows for a valid defense if the defendant can show that the publication of the materials was justifiable as for the ‘public good’.

WHAT INDUSTRY EFFECT Film > Age ratings

Radio > Language used > also on songs.

T.V > Watershed

This Act puts tighter control on the media industry by liming what you can show/publish, TV can get around this via the watershed. Other industries including TV can get around this Act by warning people before showing it,

so they have the option whether they want to watch it or not. But there are still certain things that you can’t show, even on an 18 rated film.

WHEN WAS IT FORMED?

The film act was formed in 1985 as it replaced the film acts 1960-1980; the film act ruined the British

film fund agency therefore ending the Eady levy system established in 1951

THE KEY POLICIESAn Act to repeal the Films Acts 1960 to

1980; to make further provision with respect to the financing of films; and for connected

purpose. (23rd of May 1985)

Film Acts 1960 to 1980 repealed.

The cinematograph Films Council shall accordingly cease to exist.

The film acts 1960 to 1980 replaced and the Cinematograph Films Council abolished.

As the film industries grew the films, TV programs got more graphic and more obscene images where bro-casted

so they had a tighter control eased slightly.
