NZLS HAWKE’S BAY BRANCH NEWSLETTER FROM THE PRESIDENT: Issue 45, September 2014 NZLS-HB Newsleer – September 2014 Page 1 of 11 Members, I have nine months remaining on my term as your President and I thought that I would reflect on the benefits and challenges of this role with an eye toward encouraging some of you to become actively involved in serving on Council and, ultimately as President of our Branch. I have found that one of the most valuable aspects to this role is the interaction on a national level with my counterparts and with the NZLS National Office staff in Wellington. Twice a year – in April and October – I travel to Wellington to attend the bi-annual meeting of the NZLS National Council, which is made up of NZLS Officers and the Presidents of the various branches around the country. Before my first National Council meeting, I have to admit that I was not looking forward to this aspect of my job. I have a meetings-allergy and find that many/most meetings are a drain on time and energy and do little to advance things. I was entirely wrong about this body and these meetings. My opinion changed immediately at the very first National Council meeting that I attended in April 2013. Our National NZLS President Chris Moore conducts a very tight meeting and ensures that people stay on track and focused. As a result, the format is organized and contributions valuable and interesting. One of the best parts of the meeting is the chance for branch Presidents to update the Council on activities/ challenges in their areas. Information, ideas sharing and problem solving in this manner renders the National Council a very cohesive and supportive group. One of the problems that I have shared on the national level concerned the use of AVL – Audio Visual Links – in the High Court at Napier. I learned that other centres were having the same problem. I also got the solid support and backing of the National Office staff who met with Ministry of Justice staff in Wellington and brokered a solution for us – flying an Associate Judge to Napier for Commercial List days. This greatly enhanced the List functioning for practitioners and parties alike. I also relied upon National Office for support and assistance in dealing with the threatened merger of Hastings and Napier District Courts’ jurisdictional functions. While this issue is far from gone, we are assured that it is not currently a priority for the Ministry. We are also assured by the Ministry in Wellington that proper consultation with our Branch will occur well before steps are taken should this merger idea be refloated. Another benefit to the role of President is the direct access that many of you utilize in bringing matters to my attention. I very much appreciate this and my successful functioning as your President depends greatly upon it. I try to be responsive to all queries and I urge you all to continue in your direct contact with me and/or Branch Council members and staff when needs arise. The role does require the investment of time and I am grateful to Carlile Dowling Lawyers for their indulgence in granting me this time to serve you. I must say, however, that the Branch staff is efficient and responsive and their competence makes my role significantly easier. My Council members are also excellent ambassadors of you all and I thank them for their service. As a Council, we continue to host functions for members, such as the bar dinner in July for Principal Family Judge Laurence Ryan and the welcome reception in September for local Judge Tony Lendrum. We are also finalizing seminar and workshop ideas to assist you all in staying abreast of changing developments in the profession and maintaining your obligations under the new CPD (Continuing Professional Development) rules. We always welcome new seminar suggestions, so please do feel free to contact us should you identify a topic that needs addressing locally, or if you would like to present a session. Finally, please mark your calendars for Friday 5 December 2014 for our end of year function. In response to very strong feedback from the past two years’ functions, this year we will be returning to the Hawke’s Bay Club for a meal and collegiality with colleagues and partners. An added twist this year will be a non-compulsory fancy dress theme: “Pacific Island Holiday”. Those of you (like me) who are inclined toward costumes can let your imagination run wild for a chance at a costume prize! Those of you who do not like costumes can enjoy the evening in whatever comfortable attire suits you best – no pressure! Formal invitations will be forwarded to you as we finalise costing. We want to ensure that the price is very reasonable so that most of our members can enjoy a great evening with their colleagues and spouses/partners. I look forward to greeting you there. Members,

TENNIS: Scribes v Counters

The annual Scribes v Counters tennis match proceeded on 18 May 2014, after we had been rained off on the earlier, April date.

For late Autumn, the Bay turned on a stunning day for all eager participants!

In Round 1, Antony Steiner (Langley Twigg) and Mandy White (formerly Gifford Devine) put up a good fight against accountants

Phil Beamish-White and Paul McAuley. Unfortunately our Lawn tennis regulars, however, were unable to take this one out!

Andy Palliser (Langley Twigg) and Oscar Ward (Willis Toomey Robinson Scannell Hardy) made a formidable duo, and after a hotly

contested, long-lasting game, managed to hold their own and tie with bean counters Rob MacDonald and Richard Hollis.

Who would have guessed that accountants Andrew O’Carroll and Nigel Hoare had little chance in line for the wrath of Tony

Redmond’s serve (Bisson Moss), who with companion Hamish White (standing in for Nigel Loughnan of Baker Loughnan) made

mince meat out of their opposition!

It was a closely fought contest between William Story (Gifford Devine) and partner, out of town sub-in Tom Naylor (who happens

to be one of “them”!) against Scott McPhail and Helen Jones, but luckily the lawyers again managed to cross the line first!

For round 2, the final round, things were mixed up a little to add to the variety of the day.

Andy and Tom paired up against Chris Denby and Paul McAuley in the hot seats. Those in the gallery would have been forgiven

for thinking they had landed at Wimbeldon!

Antony and Tony took on Phil Beamish-White and Richard Hollis and gave the counters a good old fashioned thrashing!

Unfortunately the same could not be said for William and Mandy, and Nigel and Oscar, who both ended up the wrong side up

against Andrew O’Carroll and Nigel Hoare and Scott McPhail and Helen Jones respectively.

All in all, the day was thoroughly enjoyed by all. Proceedings were capped off by the inaugural presentation of the “Scribes v

Counters Challenge Cup” to us scribes! Collectively we managed to pip the counters, the final scoreboard reading 75-58 points.

A mouth-watering, gourmet barbeque kindly provided by Chris and Jane Denby topped off what was a most successful and

enjoyable inter-professional event.

The standard for next year has been well and truly set!

well as our own resources, we have access to other New Zealand library collections and

the moment these are not able to be borrowed but can be used in the libraries on the

library computers. These include a number of very relevant texts such as Taylor’s Judicial

Review book, Burrow’s Statute law in New Zealand and the Public Law Toolbox. You can

LAW LIBRARY UPDATE

Library Kiosks

The original library kiosks were installed in 2010/11. A replacement programme has commenced

starting with the configuring and testing of a new ‘build’. The new kiosks will allow a user to

temporarily store files (e.g. pdf documents) so they can be emailed. Secondly, files will be able to

be saved to a USB flash drive. The new kiosks will refresh their setup completely when a person

logs off or a session times out, thus eliminating the chances of the setup becoming cluttered with

saved files or malware. The first stage of the refresh will involve 15 new kiosks at 11 sites including

Napier and Hastings.

CCH Online access changes

For members using the branch kiosks, life has just become much easier, as you no longer need to

log in to access the CCH databases. Only users in the Auckland and Wellington Libraries need to

do this now. Explore the large number of CCH electronic databases the library subscribes to,

including NZ Competition Law, NZ Company Law, NZ E-Commerce Law, NZ Employment Law,

Trusts & Estates Planning Guide and NZ Trusts Reports.

Halsbury’s online

Halsbury’s titles are the best place to start your research when you want an overview of the

authorities for a common law jurisdiction. Legal encyclopaedias for New Zealand, United

Kingdom, Canada and Australia are available as part of the Library’s online collection. Alongside

Laws of New Zealand you have access to Halsbury’s Laws of Australia, Halsbury’s Laws of England

and Halsbury’s Laws of Canada. Laws of New Zealand has hyperlinks to the UK and Australian

encyclopaedias.

At the end of October, Thomson Reuters (Brookers) will no longer be supporting their platform

“Brookers online”, on which all their databases run at present. They are switching the platform

they use, to WestlawNZ which looks quite different and involves some changes in searching and

the way documents are retrieved. “Brookers online” will no longer be available. At the moment

on the computers you have the option to use either platform.

Thomson Reuters is running a training session on WestlawNZ in Napier at the Hawke’s Bay Club on

Wed 8 October.

This is a free training and you can also gain CPD points at the same time.
