BACKGROUND/HISTORY

This is the action item for considering approval of a final plat of Sunfield Main Street Retail subdivision. The subdivision is planned as the site of a fuel station/convenience store development.

Water and sewer service is provided through the Sunfield Municipal Utility District. Hays County is responsible for road maintenance, though the City reviews and approves infrastructure plans.

2. FINDINGS/CURRENT ACTIVITY

This plat encompasses 1 lot, which is in the Buda ETJ. Hays County has reviewed the plat and all the applicant has completed all edits the county has recommended. Although the lot is shown as fronting on “Future Campo del Sol Parkway,” the Campo del Sol North final plat is currently awaiting Hays County signatures prior to recordation and should be platted before this plat is recorded.

Water service will be provided by the Sunfield MUD through Goforth SUD. Waste water service will be provided by the Sunfield MUD. The site will drain through the subdivision’s storm sewer system, releasing to Soil Conservation Service Site 10 Reservoir, which is a tributary of Plum Creek.

3. FINANCIAL IMPACT

4. ACTION OPTIONS/RECOMMENDATION Staff recommends approval of this final plat as it is consistent with the Sunfield master plan, the requirements of the Unified Development Code, and the Development Agreement.

SUBJECT: DELIBERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLAT OF CARPENTER HILL SUBDIVISION, BEING +/- 64.69 ACRES OUT OF THE PHILLIP J. ALLEN SURVEY, ABSTRACT NO. 31 GENERALLY LOCATED NORTH OF FM 967, NORTHEAST OF DODGEN TRAIL (PP 17-35). 1. BACKGROUND/HISTORY

This is the action item for considering approval of the preliminary plat of Carpenter Hill Subdivision. Water and sewer service would be provided through the City of Buda. The City would be responsible for road maintenance. The City Council approved the Carpenter Hill Development Agreement on February 6, 2018.

2. FINDINGS/CURRENT ACTIVITY Carpenter Hill Subdivision covers 64.69 acres. The plat contains 207 residential lots on 41.91 acres. The subdivision also includes a commercial area of 6.61 acres. This commercial area is currently shown as two lots, but may be subdivided into additional lots based upon the needs of prospective businesses. The remaining 16.17 acres is divided between right-of-way and open space/drainage. The subdivision is divided into seven sections, which may be platted separately. Regulatory Environment The plat site is not currently within the city limits, but the site would be annexed prior to connection to city services. It is, however, subject to a development agreement approved in February by the City Council following a January recommendation from the Planning & Zoning Commission which regulates it as though it was inside the city limits. The intended zoning of the site is R-3 for the residential sections of the plat and B-2 for the commercial area. The R-3 district has a minimum lot size of 6,000 square feet, with a minimum width of 55 feet for interior lots, and 60 feet for corner lots. Minimum lot depth in the R-3 district is 100 feet. R-3 requires 20’ front & rear setbacks, 7.5’ interior side setbacks and 10’ corner side setbacks. These side setbacks are 50% wider than required in the prior UDC, and 50% wider than what is found in Garlic Creek, Elm Grove & Whispering Hollow. The subdivision is subject to the residential architectural standards adopted in the 2017 Buda UDC. The approved development agreement allows for 14 lots to be 50’ in width, and also allows three blocks to exceed 12 lots on their respective block faces. These narrower lots

must still meet the setbacks. These longer blocks are allowed to extend to up to 1,100 feet, exceeding the city’s usual maximum of 800 feet but still substantially less than what was allowed in the prior UDC. This was a significant part of the Development Agreement negotiation in order to maximize implementation of other new UDC elements. Streets & Connectivity The plat is bound by FM 967 (80’ ROW) on the southern end of the property. “Street A,” to be named at final platting, is proposed as a 60’ ROW collector street. The other streets within the subdivision would be local streets with 50’ rights-of-way. The plat shows two street connections and five stub streets, including the construction of the street connection to the Buda Sportsplex. The stub streets in particular will help promote the orderly subdivision of surrounding land in the future with appropriate connectivity. The connectivity ratio for the proposed subdivision is 1.6875, which exceeds the City’s 1.6 connectivity ratio requirement for new subdivisions.

The traffic impact analysis (TIA)/TxDOT driveway analysis contained recommendations to add deceleration lanes and a center turn lane. The TIA was performed by the same traffic engineer that performed the TIA for the nearby school district project, allowing for improved coordination. Due to the improvements related to both projects, the school district as well as this developer are funding improvements. Generally, TxDOT requires projects involving alteration within the current roadway (such as a center turn lane) to contribute funds so TxDOT can perform the project rather than allowing a private developer to do so. This has to do with TxDOT’s expertise and the liability involved in a private player making improvements in an active corridor. This amount is being finalized, but TxDOT will withhold the driveway permit until the matter is settled. Stormwater & Water Quality Management This project is located near the headwaters of Garlic Creek, with all stormwater ultimately discharging to the Garlic Creek watershed. As a general rule, stormwater facilities ‘high’ in a watershed tend to be larger than those of an equal project found lower in a watershed. This is because detention high in a watershed is more beneficial (holds back stormwater peaks), whereas lower in a watershed there is a need to “beat the peak” (to push stormwater out before upstream flows arrive). This is analyzed through dynamic hydraulic & hydrologic analysis models. This reveals total flows, the timing of those flows, the peak of those flows (and how long the peak lasts & when the peak occurs), among other factors on the basis of certain key storm thresholds (5, 10, 25 & 100 year storm events). These are then used to inform the design of the stormwater conveyance system within a project as well as the sizing & placement of detention & retention facilities. This data is also used to evaluate upstream & downstream conveyance & capacity to determine any need for off-site alterations and to verify no negative impact upstream or downstream. This data is sealed by a registered professional engineer, and is analyzed by the City (its 3rd party engineer) for assurance of proper process, assumptions & calculations. The analysis is summarized on the drainage sheets of the Preliminary Plan. Carpenter Hill is unique in that it is a complete hilltop, with flows going in every direction (but ultimately to Garlic Creek). This results in four separate water quality & detention pond facilities. All stormwater within the development is conveyed to these ponds via underground stormwater pipe. The ponds then discharge, based on the analysis described above, into existing natural & improved conveyances. This discharge is designed to match conditions prior to development. Municipal UDC requirements as well as TCEQ requirements (due to location in contributing and/or recharge zone) pertaining to the water quality treatment of storm water apply to this project. The facilities proposed comply with these requirements. Such facilities must comply with the Engineering Criteria Manual or LCRA’s Non-Point Source Pollution Control Technical Manual. Water quality control must isolate and treat the water draining to the control from the contributing area and result in 80% reduction in total suspended solids and total phosphorous resulting from the development activity. The required reduction is applied only to the incremental increase in pollutant load caused by the development. Generally, these facilities capture & treat the volume of the first ½ inch of runoff or the 2-year storm event, whichever is greater. This is commonly called treating the “first flush” of a storm. The facilities must also avoid any recharge features, environmental features or buffer zones around such features. The ponds & conveyance facilities are dedicated to the City for maintenance, with the UDC requiring developer payment of a certain amount to address maintenance needs.

Parks

At its February 21, 2018 meeting the City of Buda Parks and Recreation Commission recommended approval of the proposed parkland dedication and fee-in-lieu agreement. This agreement would conserve 1.10 acres of land to create a HOA-maintained park, the restoration of a historic log cabin, acquisition of land and construction to create a roadway connection to the Buda Sportsplex, and a $35,000 fee-in-lieu payment. The Planning & Zoning Commission may recall this open space being discussed with the Development Agreement, and subsequently being included in the Development Agreement. The right-of-way acquisition from HCISD alone (a 30’ strip alongside the existing 30’ strip already owned by the City), not including the cost for the developer to construct the road & pedestrian improvements, is $142,300.

3. FINANCIAL IMPACT

Each house constructed will incur fees totaling $9,347, which includes the $3,595 water impact fee and the $3,515 wastewater impact fee, as well as associated building permit & tap fees. As a result, the 207 homes will produce at least $1,934,829 ($1,471,770 of which is w/ww impact fees) in fees over the life of the project. Commercial development will also incur fees, but those vary based on the particular needs & size of each project. Fees will also be collected for each site development permit and final plat. The developer, over the course of the project, will pay $35,000 ($169.08 per unit) in fee-in-lieu for parkland, and will meet the remaining obligation through preservation of private open space, provision of critical connections to existing facilities and the value of preserving historic facilities. This approach does not result in an increase in operations & maintenance while also maintaining the City’s goal for all homes to be within a 5-minute walk of parks/open space.
