Qld tour operator jailedA CAIRNS tour operator caught

underpaying backpackers has been sentenced to a year in prison for contempt of court as part of action brought by the Fair Work Ombudsman.

Leigh Alan Jorgensen, the owner-operator of Trek North Tours, has also been fined $84,956, but was released from jail on Fri pending an appeal.

Jorgensen had underpaid five backpackers on 417 working holiday visas in 2013 and 2014, resulting in fines totalling $67,000 and a 2015 Federal Court order to back-pay the workers in full.

However, the Fair Work Ombudsman took further action to secure freezing orders against Jorgensen after he failed to pay and indicated he was prepared to bankrupt his company to avoid the penalties and back-pay.

Jorgensen had also previously told Fair Work inspectors investigating the underpayments that the backpackers “would not get a cent”.

The Fair Work Ombudsman launched contempt of court action against Jorgensen last

year when he contravened the freezing order by transferring $41,035 from two frozen accounts into a family trust.

It is the first time the Ombudsman has taken contempt of court action, and the first time a prison sentence has been imposed as a result of the agency’s actions.

Fair Work Ombudsman Natalie James said that the commencement of the proceedings demonstrated that her agency was prepared to “use every tool at its disposal” to ensure justice was served.

“We will use every lever open to us to ensure the integrity of the administration of justice and compliance with court orders imposed under the Fair Work Act 2009,” she said.

The Federal Court has released Jorgensen on conditions including that he surrender his passport, remain in Queensland and report to police twice a week.

A date has not been fixed for appeal proceedings.

APT adds Qantas pointsAPT is the latest operator to

announce an alliance with the Qantas Frequent Flyer program, with travellers now able to earn points on every APT booking they make (TD breaking news Sat).

The agreement covers all APT trips, with two points per dollar spent available for APT river cruises, and one point per dollar for all other APT product including classic journeys, 4WD adventures, small group discoveries and small ship cruising itineraries.

The move was unveiled on Sat during a presentation by APT chief commercial officer Debra Fox at the Helloworld Owners and Managers Conference in Adelaide.

However, astute agents would have also spotted the new bonus on APT’s advertising in mainstream newspapers the same day, which for the first time featured the Qantas Frequent Flyer logo and details of the offer.

Points could be earned on APT bookings made in Australian dollars effective 01 May 2018, with APT ceo Steve Reynolds saying “for agents booking APT trips the additional sell point will help secure bookings”.

Points aren’t awarded on airfares bundled with an APT holiday, on cancelled trips or on travel industry discounted rates.

Qantas Points will be credited to the QF frequent flyer member’s account within seven days of the trip departure.

Arab Emirates have struck a deal to preserve their Open Skies arrangements, potentially ending years of conflict between the two countries over aviation policy.

Carriers from both nations will retain current and future rights under the deal - including Fifth Freedom rights - in an agreement that allows them to add or reduce flights broadly in line with the Air Transport Agreement signed by the US and UAE in 2002.

Carriers will also be subject to audited financial reports consistent with internationally recognised accounting standards, a measure designed to address long-standing accusations from US carriers that Middle East counterparts including Emirates and Etihad receive unfair government assistance.

The US Travel Association has welcomed the deal, saying it is hoped that three years of division has been ended.

TOURISM NT has challenged young Australian travellers to “go full bush” in its latest marketing campaign, which enlists the help of three comedians to showcase the Northern Territory’s “big red rocks” & “epic tropical sunsets”.

The destination has partnered with Pedestrian.TV to create a three-part video series titled “All the Gear and No Idea”, produced in mockumentary style to highlight the “incredibly Instagrammable” adventures that await travellers in the NT.

Presenters include Pedestrian.TV’s Lucinda Price, comedian Tanya Hennessy and radio host Michael Beveridge (who puts his background to good use as he interviews a camel).

ATAC unveils a new lookTHE Australian

Travel Agents Co-operative (ATAC) has unveiled a refreshed corporate branding, positioning the group under a new tagline - Partners In Your Prosperity.

The new slogan is part of a wider update of the group’s identity, designed to “better reflect the culture and vision of the co-operative”.

The group has dispensed with its previous tagline - The Independent Alternative - though ATAC general manager Michelle Emerton said independence would remain a core attribute.

“Everyone touts independence now - it has lost its meaning,” Emerton said.

“Everyone says it, even if it’s not necessarily the truth. It has become over-used.”

Emerton said the new identity was more relevant, innovative

and forward-thinking, reflecting ATAC’s role as a partner and conduit for the success of member agencies.

The group last year announced a record total transaction value (TTV) of more than $200 million during 2016/17 (TD 13 Nov), a year in which membership broke the 100 barrier for the first time.

Emerton said the group had since increased its membership further to 106 shareholders, with high retention rates.

She attributed this to benefits including transparency, buying power, independence and ATAC’s system of profit-sharing.

ATAC has also opened registrations for its Future Focus 2018 Conference, to be held in Singapore 02-05 Nov.

Scenic class action appeal in court

THE NSW Supreme Court has today commenced an appeal hearing in the long-running Scenic Tours class action (Cruise Weekly 07 Apr 2015).

The case relates to 13 European river cruise departures in Apr and May 2013 which were impacted by heavy rain and flooding.

Last year a ruling found the lead plaintiff, David Moore, was entitled to a full refund of his cruise fare plus $2,000 in damages (TD 31 Aug 2017).

Following the judgement Scenic confirmed it would appeal the ruling, with the case set down for four days this week.

The case is also scheduled for a directions hearing on 29 Jun.

Following the decision last year Scenic noted that its practice had always been to “deliver itineraries that were as close to schedule as possible without compromising on safety or comfort”.

Product drives loyaltyIMPROVING product is a more

important driver in traveller loyalty in the Asia Pacific than membership or discount programs, according to a new report from the Expedia Affiliate Network (EAN).

The Travel Loyalty Report: A Wake-up Call for Sleepwalking Loyalty Programs questions the sustainability and tactics behind recent loyalty gains, with only 24% of APAC respondents saying they use points to drive loyalty, while 26% claim to not offer a loyalty program at all.

Despite the sector’s perception that product has more of an effect on loyalty than discounts, only half of those surveyed are actively working to improve their product range, and only a third are working to expand the range of their products and services.

The Asia Pacific differed significantly with global markets, with a stronger economy and increased market spend as the primary drivers of loyalty.

AA opens 5 gatesAMERICAN Airlines has

celebrated the opening of five new gates at its hub at Chicago O’Hare International Airport.

The gates are the first new departure points to be added to the airport in 25 years and are part of a US$78 million construction project designed to increase American’s capacity.

announced a 50% increase in operating income and a US$93.9 million net profit in its 2018 first quarter results.

Operating income totalled US$228.5 in the three months to 31 Mar, driven by higher traffic and yields across all markets.

ON 10 May AccorHotels’ MGallery by Sofitel brand celebrated the roll out of Inspired by Her, its new hotel program designed specifically for women.

Australian international model, photographer and Inspired by Her ambassador, Candice Lake, was flown out from London for the event ahead of Sydney Fashion Week, where she spoke about why the Inspired by Her program is so important to cater to the needs of travelling women.

Held in the Big Barn at the new William Inglis Hotel, the intimate lunch was attended by travel, fashion and lifestyle media and guests experienced the best of the hotel’s Inspired by Her menu and hospitality.

Indonesia’s Mount Merapi in Central Java took place on Fri, causing the temporary closure of Yogyakarta International Airport.

Emirates Formula 1EMIRATES has extended its

sponsorship agreement with Formula 1 for another four years.

The expanded partnership will see Emirates carry out branding and consumer activations at over 15 races across Europe, Asia, Australia, and the Americas, with Title Sponsorship rights at the Spanish Grand Prix in Barcelona and the German Grand Prix in Hockenheim also included.

TK grows Apr paxTURKISH Airlines (TK) has

posted a solid jump in passengers carried for Apr, announcing 15% growth for the month to 6.4 million customers.

The Turkish carrier also recorded a sizable 30% increase in international pax (excluding transit pax) and improved its total load factor by 4.1% to 87.1% for the month.

The Tourism Australia initiative, supported by Nippon Travel Agency, JTB Travel, and H.I.S Travel Agency, aired on the J-WAVE radio station that broadcasts to an area where 43 million Japanese residents live.

Among the images shared to her 36 million fans on social media were shots of the superstar climbing the Sydney Harbour Bridge, exploring the Blue Mountains, and touring the Melbourne Cricket Ground.

VN new terminalVIETNAM Airlines (VN) has

announced plans to relocate its operations at China’s Baiyun Int’l Airport (CAN) to the new T2 terminal from 19 May.

VN’s decision to move was motivated by the availability of modern tech such as facial recognition and more space.

The carrier will run nine check-in counters at CAN’s T2.

Tourism pay gapA NEW study conducted by

Southern Cross University has found women working in the Australian tourism industry earn almost 10% less than men.

The findings were published in Tourism Analysis and showed female tourism employees were 8.5% behind men in remuneration with “less human capital” and being “interrupted by major life events” put forward as possible causes for the disparity.

However the study’s lead researcher Professor Michael Kortt believes that additional elements are also at play.

“Even after controlling for these factors, our results indicate that female employees still incur a wage penalty,” he said.

“It appears that women may face discrimination in the tourism and hospitality labour market.”
