24 l. On or about May 9,2013, Complainant John Wallauch, in his official capacity as the

25 Chief of the Bureau of Automotive Repair, Department of Consumer Affairs, filed Accusation

26 No. 79/13-78 against Joe's Test Only Smog, Joseph Robert Vance, Sr., Owner; and Joseph Robert

27 Vance, Sr. (Respondent) before the Director of Consumer Affairs. (Accusation attached as

28 Exhibit A.)

DEFAULT DECISION AND ORDER

1 2. On or about March 4,2011, the Bureau of Automotive Repair issued Automotive

2 Repair Dealer Registration NumberARD 264291 to Joe's Test Only Smog, Joseph Robert Vance,

3 Sr., Owner (Respondent). The Automotive Repair Dealer Registration will expire on March 31,

4 2014, unless renewed.

5 3. On or about April 8,2011, the Bureau of Automotive Repair issued Smog Check,

6 Test Onl)" Station License Number TC 264291 to Respondent. The Smog Check, Test Only,

7 Station License will expire on March 31, 2014, unless renewed.

8 4. In or about 2002, the Bureau of Automotive Repair issued A~vanbed Emission

9 Specialist Technician License Number EA 142545 to Respondent. Pursuant to California Code

10 of regulations, title 16, section 3340.28, subdivsion (e), said license was renewed pursuant to

11 Respondent's election as Smog Check Inspector (EO) License No. 142545 and Smog Check

12 Repair Technician (EI) License No. 142545, effective May 7, 2013. The SD;log Check Inspector

13 (EO) License and Smog Check Repair Technician (EI) License. will expire. on April 30, 2015,

14 unless renewed. I

15 5. On or about May 14,2013, Respondent was served by Certified and First Class Mail

16 copies of the Accusation No. 79/13-78, Statement to Respondent, Notice of Defense, Request for

.17 Discovery, and Discovery Statutes (Government Code sections 11507.~, 11507.6, and 11507.7) at

18 Respondent's address of record which, pursuant to Business and Professions Code section 136, is

19 required to be reported and maintained with the Bureau. Respondent's addresses of record were

20 and (as to the first of the following two addresses) are: 15515 Bear Valley Road, Hesperia, CA . .

21 92345; and 21444 Nisqually Road, AppleValley, CA 92308 (this particular address of record has

22 since been changed to 14806 Erie Rd., Apple Valley, CA 92307).

8. Go.verrunent Cede section 11506 states, in :pertinent part:
