1.0. REPORT SUMMARY

Table 1.1 below lists the BCA DtS provisions compliance matters that must be considered and where further detail is required to be submitted at the construction certificate phase. Table 1.1: Summary

Note: The class 5 ancillary office building is a separate standalone building for the purposes of this assessment.

Performance solutions Deemed to satisfy departures from the BCA to be addressed with a performance solution that satisfy the NCC governing requirements in Part A2. 1. D2.20

Swinging doors

A swinging door in a required exit or forming part of a required exit, must swing in the direction of egress unless it serves a building or part with a floor area not more than 200sqm, it is the only required exit from the building or part and it is fitted with a device for holding the door open. The southern exit door, and the new western exit door serving the new staircase, both swing against the direction of egress. Obtain a performance solution to permit the door swing against the direction of egress.

2. F1.0 Deemed to satisfy provisions (weather proofing of external walls)

Performance Requirement FP1.4, for the prevention of the penetration of water through external walls, must be complied with. There are no Deemed-to-Satisfy Provisions for this Performance Requirement in respect of external walls. As part of the construction certificate application, a performance solution to satisfy FP1.4 must be developed and submitted for assessment and acceptance by the Certifying Authority. The performance solution must be determined in accordance with A2.2(3) and A2.2(4) as applicable. It is noted that for a building of this size and nature, a façade engineer need not provide the performance solution and this can come from the project architect, or other suitably qualified registered certifier, or BCA consultant.

Compliance readily achievable The DA plans submitted to the Consent Authority do not contain full BCA compliance details as full BCA compliance is not a head of consideration for the Consent Authority during the DA assessment phase. It is expected however that at the construction certificate phase, the level of detail provided to the certifying authority will be at a level that confirms strict compliance with the BCA. These items are summarised below. 3. D1.10

Discharge from exits

If a required exit leads to an open space, the path of travel to the road must have an unobstructed width throughout of not less than—

(i) the minimum width of the required exit; or

(ii) 1m,

Whichever is the greater

It is noted that when discharging from the new stairway serving level one, the path of travel to the road is along the below blue line heading south. Pedestrian line marking and potentially bollards to prevent cars from blocking the exit path should be considered.

4. D1.13 Number

of persons accommodated

The combined level one office areas is 142sqm. Table D1.13 permits up to 14 occupants, unless determined by some other relevant factor such as seating numbers. Ventilation, egress widths, and amenities must be considered. Refer to F2.3 in this table for maximum numbers of people the amenities allows for.

5. C3.2 Protection of openings

The ancillary office building is considered a separate building from the existing class 9b childcare centre and will comply with Type C construction. Openings in the two buildings that are within 6m of each other will be protected as required under C3.2. Full details to be provided at the CC stage however protection for these openings must be noted on the DA plans to ensure that approval for heat attenuation screens, fire shutters, or the like is granted by Council.

6. C3.4 Acceptable methods of protection

The eastern elevation of the office building and the western elevation of the existing childcare centre building must have openings that are within 6m of the other building protected in accordance with C3.4. Doorways, windows and other openings must be protected as follows:

i. Doorways

internal or external wall-wetting sprinklers as appropriate used with doors that are self-closing or automatic closing; or

–/60/30 fire doors that are self-closing or automatic closing.

ii. Windows

internal or external wall-wetting sprinklers as appropriate used with windows that are automatic closing or permanently fixed in the closed position; or

–/60/– fire windows that are automatic closing or permanently fixed in the closed position; or

–/60/– automatic closing fire shutters.

iii. Other openings—

excluding voids — internal or external wall-wetting sprinklers, as appropriate; or

construction having an FRL not less than –/60/–.

Fire doors, fire windows and fire shutters must comply with Specification C3.4.

Protection in accordance with C3.4 must not incorporate more than 1/3 of the entire elevation where protection is required. In the event compliance is required, product technical data sheets, installation guidelines, and test sheets from an authorised testing laboratory, or alternatively another form of evidence of suitability in accordance with NCC Part A5: Documentation of design and construction, must be submitted to the Certifying Authority for assessment as part of the construction certificate application.

7. D2.3 Non-fire isolated stairways and ramps

In a building having a rise in storeys of more than 2, required stairs and ramps (including landings and any supporting building elements) which are not required to be within a fire-resisting shaft, must be constructed according to D2.2, or only of—

a. reinforced or prestressed concrete; or b. steel in no part less than 6 mm thick; or c. timber that—

i. has a finished thickness of not less than 44 mm; and ii. has an average density of not less than 800 kg/m

3 at a moisture

content of 12%; and iii. has not been joined by means of glue unless it has been laminated

and glued with resorcinol formaldehyde or resorcinol phenol formaldehyde glue.

Prior to the issue of the construction certificate, the architectural drawings and specification must be submitted to the certifying authority confirming the proposed materials for the building’s required non-fire isolated stairways that serve basement 1 and 2.

8. D2.7 Installations in exits and paths of travel

Services or equipment comprising— i. electricity meters, distribution boards or ducts; or ii. central telecommunications distribution boards or equipment; or iii. electrical motors or other motors serving equipment in the building

may be installed in— iv. a required exit, except for fire-isolated exits specified in (a); or v. in any corridor, hallway, lobby or the like leading to a required exit,

if the services or equipment are enclosed by non-combustible construction or a fire-protective covering with doorways or openings suitably sealed against smoke spreading from the enclosure. Details and specifications are to be provided to the Certifying Authority with the construction certificate application to confirm the electrical cupboards in common areas throughout the building are protected accordingly.

9. D2.10 Pedestrian ramps

A ramp serving as a required exit must— i. where the ramp is also serving as an accessible ramp under Part D3, be

in accordance with AS 1428.1; or ii. in any other case, have a gradient not steeper than 1:8.

The floor surface of a ramp must have a slip-resistance classification not less than that listed in Table D2.14 when tested in accordance with AS 4586. Prior to the issue of a construction certificate full details illustrating compliance for both the southern ramp leading from the rear of the building to the south, and the ramp leading to Simone Crescent from the front of the building to the north, is to be provided to the Certifying Authority.

10. D2.13 Goings and risers

For all stairs – Risers are required to be between 115-190mm and goings between 250-355mm. Relationship – ALL Goings and Risers are to satisfy the equation of 2R+G=700(max) and 550(min). Construction tolerances – Goings and risers are to be consistent throughout in one flight other than where the allowable construction tolerances are not exceeded – i.e. the variation is as follows: Adjacent risers, or between adjacent goings, is no greater than 5 mm; and the largest and smallest riser within a flight, or the largest and smallest going within a flight, does not exceed 10 mm. Note that the 5mm variance is not permitted to take a riser below the minimum or above the maximum dimension of Table D2.13. Gaps – Any gap between risers must not permit a 125mm sphere to pass through it. Slip Resistance – All tread surfaces and nosing strips are to achieve a slip resistance classification not less than that listed in Table D2.14 when tested in accordance with AS4586.

11. D2.15 Landings

Landings must comply with the requirements of Clause D2.14 of the BCA. Landings must be not less than 750mm long and have a non-slip finish throughout or an adequate non-skid strip near the edge of the landing where it leads to a flight below.

12. D2.15 Thresholds

A threshold of a doorway must not incorporate a step or ramp at any point closer to the doorway than the width of the door leaf unless: - the doorway opens to a road or open space, external stair landing or external

balcony; and - the door sill is not more than 190 mm above the finished surface of the ground,

balcony, or the like, to which the doorway opens. Prior to the issue of a construction certificate full details illustrating any door thresholds that may require ramps is to be provided to the certifying authority for assessment. Threshold ramps at doorways on a continuous path of travel shall have—

(a) a maximum rise of 35 mm; (b) a maximum length of 280 mm; (c) a maximum gradient of 1:8; and

be located within 20 mm of the door leaf which it serves, 13. D2.16 Barriers

to prevent falls Compliance with Table D2.16a is required for all barriers that are designed to prevent falls of greater than 1 metre from a surface below. For barriers that prevent falls greater than 4 metres from the surface below, the barrier is to be designed to ensure there are no climbable elements between 150mm-760mm from the finished floor level. In a fire isolated stairway, the barrier of need only comply with Part 2 of Table D2.16a in terms of the allowable barrier openings. Where a barrier incorporates glazed panels, compliance with AS1288 and AS1170 is required. Prior to the issue of a construction certificate full barrier details illustrating compliance are to be provided to the Certifying Authority.

14. D2.17 Handrails

For ALL staircases handrails are to be provided to at least one side of stair flights and located not less than 865mm above the nosings of stair treads and the floor surfaces of landings.

For stairs that are used only for emergency purposes i.e. the fire stairs leading from the basement, and the internal fire isolated stairway serving the upper residential levels, a single handrail is permitted and that handrail need not be provided with a 300mm horizontal projection. Where stairs are also used for general access (i.e. for a purpose other than an emergency) the stairway is to have double handrails in accordance with AS1428.1-2009, including the required 300mm extensions at the top and bottom of handrails. Handrails are not allowed to encroach into the required 1 metre stairway width; and must be a consistent height throughout the flight. To achieve the consistent height, stairways may need to be off-set by one tread. Prior to the issue of the construction certificate full details and specifications are to be provided to the certifying authority that include all handrail details including extensions and heights.

15. D2.19 Doorways and doors

If a doorway servings as, or forming part of a required exit is fitted with a door that is power operated, it must be able to be opened manually under a force of not more than 110N if there is a malfunction or failure of the power source, and if it leads directly to open a road or space it must open automatically if there is a power failure to the door or on activation of a fire or smoke alarm anywhere in the fire compartment served by the door.

16. D2.21 Operation of latch

A door in a required exit, forming part of a required exit or in the path of travel to a required exit must be readily openable without a key from the side that faces a person seeking egress, by—

(i) a single hand downward action on a single device which is located between 900 mm and 1.1 m from the floor and if serving an area required to be accessible by Part D3—

A) be such that the hand of a person who cannot grip will not slip from the handle during the operation of the latch; and

B) have a clearance between the handle and the back plate or door face at the centre grip section of the handle of not less than 35 mm and not more than 45 mm; or

(ii) a single hand pushing action on a single device which is located between 900 mm and 1.2 m from the floor, and

(iii) where the latch operation device referred to in (ii) is not located on the door leaf itself—

(A) manual controls to power-operated doors must be at least 25 mm wide, proud of the surrounding surface and located—

a. not less than 500 mm from an internal corner; and b. for a hinged door, between 1 m and 2 m from the door leaf

in any position; and c. for a sliding door, within 2 m of the doorway and clear of a

surface mounted door in the open position. (B) braille and tactile signage complying with Clause 3 and 6 of

Specification D3.6 must identify the latch operation device. Prior to the issue of the construction certificate a door schedule is to be provided to the certifying authority confirming all door hardware and security requirements.

17. D2.24 Protection of openable windows

Design detail of the barriers and manufacturer’s specification of the locking mechanisms to restrict windows is to be submitted to the certifying authority for assessment prior to the issue of a construction certificate. (a) A window opening must be provided with protection, if the floor below the window is 2 m or more above the surface beneath in a Class 9b early childhood centre. (b) Where the lowest level of the window opening is less than 1.7 m above the floor, a window opening covered by (a) must comply with the following:

(i) The openable portion of the window must be protected with— (A) a device capable of restricting the window opening; or (B) a screen with secure fittings.

(ii) A device or screen required by (i) must—

(A) not permit a 125 mm sphere to pass through the window opening or screen; and (B) resist an outward horizontal action of 250 N against the— (aa) window restrained by a device; or (bb) screen protecting the opening; and (C) have a child resistant release mechanism if the screen or device is able to be removed, unlocked or overridden.

(c) A barrier with a height not less than 865 mm above the floor is required to an openable window—

(i) in addition to window protection, when a child resistant release mechanism is required by (b)(ii)(C); and (ii) where the floor below the window is 4 m or more above the surface beneath if the window is not covered by (a).

(d) A barrier covered by (c) except for (e) must not— (i) permit a 125 mm sphere to pass through it; and (ii) have any horizontal or near horizontal elements between 150 mm and 760 mm above the floor that facilitate climbing.

(e) A barrier required by (c) to an openable window in— (i) fire-isolated stairways, fire-isolated ramps and other areas used primarily for emergency purposes, excluding external stairways and external ramps; and (ii) Class 7 (other than carparks) and Class 8 buildings and parts of buildings containing those classes;

must not permit a 300mm sphere to pass through it. 18. D2.25 Timber

stairways: concession

(a) Notwithstanding D2.2(a), timber treads, risers, landings and associated supporting framework which—

(i) has a finished thickness of not less than 44 mm; and (ii) has an average density of not less than 800 kg/m

3 at a moisture content

of 12%, may be used within a required fire-isolated stairway or fire-isolated passageway constructed from fire-protected timber in accordance with C1.13 subject to— (iii) the building being protected throughout by a sprinkler system complying with Specification E1.5 which extends to within the fire-isolated enclosure; and

(iv) fire protection being provided to the underside of stair flights and landings located immediately above a landing level which—

(A) is at or near the level of egress; or (B) provides direct access to a carpark.

(b) Fire protection required by (a) must be not less than one layer of 13 mm fire-protective grade plasterboard fixed in accordance with the system requirements for a fire-protective covering.

19. E1.6 Portable fire extinguishers

Portable fire extinguishers are required to be provided in accordance with Table E1.6 of the BCA and located and distributed in accordance with Sections 1, 2, 3 and 4 of AS2444.

20. E1.9 Fire precautions during construction

In a building under construction not less than one fire extinguisher to suit Class A, B and C fires and electrical fires must always be provided on each storey adjacent to each required exit or temporary stairway or exit.

21. E4.2 Emergency lighting requirements

Emergency lighting is to be provided throughout the building in accordance with Clause E4.2 of the NCC:

• In the class5 building: - In every required non fire isolated stairway.

Electrical design drawings including the emergency lighting layout must be submitted to the certifying Authority with the construction certificate application.

22. E4.4 Design and operation of emergency lighting

Every required emergency lighting system must comply with AS 2293.1-2018 (test switch to be installed at each storey).

23. E4.5 Exit signs An exit sign must be clearly visible to persons approaching the exit, and must be installed on, above or adjacent to each:

a) door providing direct egress from a storey to— i. an enclosed stairway, passageway or ramp serving as a

required exit; and ii. an external stairway, passageway or ramp serving as a required

exit; and iii. an external access balcony leading to a required exit; and

b) door from an enclosed stairway, passageway or ramp at every level of discharge to a road or open space; and

c) horizontal exit; and d) door serving as, or forming part of, a required exit in a storey required to

be provided with emergency lighting in accordance with E4.2. Class 5 office – Level one requires exit signage at the double leaf doorway leading form the open office plan area into the top landing of the non-fire isolated stairway. In addition, the doors that discharge at ground floor (non-fire isolated stair and southern main door) require exit signage.

24. E4.6 Direction signs

Where an exit is not readily apparent then exit signs with directional arrows must be installed in appropriate positions in corridors, hallways, lobbies and the like indicating the direction to a required exit in accordance with Clause E4.6 of the BCA. Class 5 office – Where directional exit signage is required, the CC application must denote the location in the electrical drawings and reflected ceiling plan.

25. E4.8 Design and operation of exit signs

Exit signs are required to operate in accordance with AS 2293.1, or for a photoluminescent exit sign specification E4.8, and always be clearly visible while the building is legally occupied.

26. F1.1 Stormwater drainage

Stormwater drainage design shall be in accordance with AS/NZS 3500.3. Details and a design certificate will be required by a suitably qualified hydraulic engineer prior to the issue of a Construction Certificate.

27. $1.4 External above ground membranes

Compliance with AS4654.1 and 2 must be satisfied.

28. F1.5 Roof coverings

Roof coverings are to comply with the relevant Australian Standards as per Clause F1.5. A roof must be covered with:

a. concrete roofing tiles complying with AS 2049 and fixed, except in cyclonic areas, in accordance with AS 2050, as appropriate; or

b. terracotta roofing tiles complying with AS 2049 and fixed, except in cyclonic areas, in accordance with AS 2050; or

c. cellulose cement corrugated sheeting complying with AS/NZS 2908.1 and installed in accordance with AS/NZS 1562.2; or

d. metal sheet roofing complying with AS 1562.1; or e. plastic sheet roofing designed and installed in accordance

with AS/NZS 4256.1, AS/NZS 4256.2, AS/NZS 4256.3, AS/NZS 4256.5 and AS/NZS 1562.3; or

f. Terracotta, fibre-cement and timber slates and shingles designed and installed in accordance with AS 4597, except in cyclonic areas.

Details and design certification to be provided prior to the issue of a Construction Certificate.

29. F1.6 Sarking Waterproofing membranes for external above ground use must comply with AS 4654.1 and AS 4654.2. Product technical data sheets, installation guidelines, and test sheets from an authorised testing laboratory, or alternatively another form of evidence of suitability in accordance with NCC Part A5: Documentation of design and construction, including a section detail of all above ground membrane systems must be submitted to the Certifying Authority for assessment as part of the construction certificate application.

30. F1.7 Waterproofing of wet Areas in buildings

Roof coverings are to comply with the relevant Australian Standards as per Clause F1.5. A roof must be covered with:

a) concrete roofing tiles complying with AS 2049 and fixed, except in cyclonic areas, in accordance with AS 2050, as appropriate; or

b) terracotta roofing tiles complying with AS 2049 and fixed, except in cyclonic areas, in accordance with AS 2050; or

c) cellulose cement corrugated sheeting complying with AS/NZS 2908.1 and installed in accordance with AS/NZS 1562.2; or

d) metal sheet roofing complying with AS 1562.1; or e) plastic sheet roofing designed and installed in accordance with AS/NZS

4256.1, AS/NZS 4256.2, AS/NZS 4256.3, AS/NZS 4256.5 and AS/NZS 1562.3; or

f) Terracotta, fibre-cement and timber slates and shingles designed and installed in accordance with AS 4597, except in cyclonic areas.

Details and design certification to be provided prior to the issue of a Construction Certificate.

31. F1.9 Damp-proofing

Sarking type materials used for weatherproofing of roofs and walls must comply with AS/NZS 4200 Parts 1 and 2. Details and design certification to be provided prior to the issue of a Construction Certificate.

32. F1.10 Damp-proofing of floors on the ground

Shower enclosure surfaces, floor surfaces in bathrooms, shower rooms, slop hoppers, sink compartments, laundry and sanitary compartments are required to be waterproofed and/or water Resistant in accordance with table F1.7 and comply with AS 3740. Details and design certification to be provided prior to the issue of a Construction Certificate.

33. F1.11 Provisions of floor wastes

A bathroom or laundry located on any level above a SOU or public space must have a floor waste provided to all bathrooms, toilets and laundries, and the floors graded to the floor waste to permit the drainage of water.

34. Sub-floor ventilation

a) Except for a building covered by (c), moisture from the ground must be prevented from reaching—

i. the lowest floor timbers and the walls above the lowest floor joists; and

ii. the walls above the damp-proof course; and iii. the underside of a suspended floor constructed of a material

other than timber, and the supporting beams or girders. b) Where a damp-proof course is provided, it must consist of—

i. a material that complies with AS/NZS 2904; or ii. impervious sheet material in accordance with AS 3660.1.

c) The following buildings need not comply with (a): i. A Class 7 or 8 building where in the particular case there is no

necessity for compliance. ii. A garage, tool shed, sanitary compartment, or the like, forming

part of a building used for other purposes. iii. An open spectator stand or open-deck carpark.

35. F1.13 Glazed assemblies

If a floor of a room is laid on the ground or on fill, moisture from the ground must be prevented from reaching the upper surface of the floor and adjacent walls by the insertion of a vapour barrier in accordance with AS 2870, except damp-proofing need not be provided if—

a) weatherproofing is not required; or b) the floor is the base of a stair, lift or similar shaft which is adequately

drained by gravitation or mechanical means. Details and design certification to be provided prior to the issue of a Construction Certificate.

36. F2.3 Facilities in class 3 – 9 buildings

Males – up to 25 Females – up to 45

37. F2.5 Construction of sanitary compartments

The door to a fully enclosed sanitary compartment must: i. open outwards; or ii. slide; or iii. be readily removable from the outside of the sanitary compartment,

Unless there is a clear space of at least 1.2m, measured in accordance with Figure F2.5, between the closet pan within the sanitary compartment and the doorway. Plans submitted with the Construction Certificate Application must ensure that compliance with the above has been achieved for all sanitary facilities.

38. F4.4 Artificial lighting

Artificial lighting must be provided in required stairways, passageways, and ramps. If natural light of a standard equivalent to that required by F4.2 is not available, and the periods of occupation or use of the room or space will create undue hazard to occupants seeking egress in an emergency,

i. In the class 5 building: provide artificial lighting to al rooms that are frequently occupied, all spaces required to be accessible, all corridors, lobbies, internal stairways, other circulation spaces and egress paths.

The artificial lighting system must comply with AS1680.0. Details and design certification to be provided by electrical consultant prior to the issue of a Construction Certificate.

39. F4.5 Ventilation of rooms

Where ventilation shall be provided throughout the building by means of natural ventilation complying with Clause F4.6, the construction certificate plans must incorporate calculations that identify the area of relevant openings. Prior to the issue of a construction certificate, if ventilation will be provided by mechanical means then design details are to be provided to the certifying authority for assessment confirming compliance with AS1668.2 or AS3666.1 as required by Clause F4.5. The proposal is located at the legal address of 19 Florence Street, Strathfield NSW 2135 however vehicular entry is only from Albyn Road. The existing improvements on the lot include an existing early education and care facility comprised of an existing single storey building to the north of the lot and existing 2 storey building to the southwest, and existing ancillary office building to the southwest. Report Purpose The purpose of this report is to satisfy Strathfield Municipal Council’s Development Application lodgement requirements and assist Council to understand whether the proposal is indicatively capable of complying with the NCC (Parts C, D1, D2, E, F and G) without significant modification at the construction certificate phase. This review does not include a detailed assessment against the following NCC provisions: Part B Structural Provisions, Part D3 access for people with a disability, or Part J energy efficiency. Part H Special Use Buildings is not applicable.

3.6. Legislative Framework

Section 4.15 of the Environmental Planning and Assessment Act provides the matters of consideration that the consent authority must take into account in the determination of a development application. Once development consent is granted, and pursuant to Clause 145 of the Environmental Planning and Assessment Regulations 2000, a certifying authority must not issue a construction certificate for building work unless: (a1) the plans and specifications for the building include such matters as each

relevant BASIX certificate requires, and (a) the design and construction of the building (as depicted in the plans and

specifications and as described in any other information furnished to the certifying authority under clause 140) are not inconsistent with the development consent, and

4.7. Fire protection and structural capacity (Clause 143) Being new construction and therefore no change of use to an existing building, the provisions of clause 143 of the Environmental Planning and Assessment Regulation do not apply.

4.8. Referral of certain plans and specifications to New South Wales Fire Brigades

Clause 144 of the Environmental Planning and Assessment Regulation 2000 describes the circumstances in which referral to FRNSW is required. Those circumstances are for a class 9b and class 5 building that is proposed to have:

i. a fire compartment with a total floor area of more than 2,000 square metres, or

ii. that is proposed to have a total floor area of more than 6,000 square metres, and where the plans and specifications for the work provide for a performance solution to meet the performance requirements contained in any one or more of the Category 2 fire safety provisions, Category 2 fire safety provision means the following provisions of the Building Code of Australia, namely, CP9, EP1.3, EP1.4, EP1.6, EP2.2 and EP3.2 in Volume One of that Code. The proposal does not incorporate a fire compartment greater than 2,000m² and the building is less than 6,000m², therefore the provisions of clause 144 of the Environmental Planning and Assessment Regulation and referral to Fire and Rescue NSW will not be required.

6.0. CONCLUSION NCC Compliance Demonstrating full compliance with the National Construction Code (NCC) at DA assessment stage is not prescribed under Section 4.15 of the Environmental Planning & Assessment Act 1979. The Consent Authority however has an obligation to consider whether the proposed development application is indicatively capable of complying with the NCC and without significant modification when an application for a construction certificate is made. In this regard, the concept design submitted to council for approval contains no departures from the deemed to satisfy provisions of the NCC. Existing windows however that are on ground floor of the ancillary class 5 office building that are within 3m of a fire source feature will be addressed with a performance solution from a fire engineer and will likely require heat attenuation screens of some kind (these are shown in the DA drawings). In addition, the ground floor egress doors to the south (the main entry doorway), and to the west (the side exit) swing against the direction of egress and will require a performance solution to permit the direction of swing. Weather Proofing of External Walls It is recognised that under Part F1.0 of the NCC, there are no Deemed-to-Satisfy provisions for performance requirement FP1.4 in respect of external walls. As part of the construction certificate application, a performance solution to satisfy FP1.4 must be developed and submitted for assessment and acceptance by the Certifying Authority. The performance solution must be determined in accordance with A2.2(3) and A2.2(4) as applicable. Disability (Access to Premises – buildings) Standard 2010 The Certifying Authority is to consider the Disability (Access to Premises – buildings) Standard 2010 and determine whether the affected part upgrade should be applied to the proposal and to what extent. The proposal relates to the rection of a second storey to an existing building and therefore the standard is triggered. Despite this, the additional storey is subject to a concession under Part D3 that mitigates the need for wheelchair access to level one and as such the proposal does not include lift access to level one. That being said and to avoid doubt, wheelchair entry into the ground floor has been proposed along with a modification to the ground floor amenities to incorporate a unisex accessible sanitary compartment. The design therefore addresses the affected part upgrade within the Premises Standard. Clause 145 (EP&A Regulation 2000) DA Consistency Construction certificate plans when lodged with the certifying authority are expected to contain appropriate detail illustrating full compliance with the NCC. It is our opinion those plans will not demand the need for any significant design changes that in turn would necessitate the submission of an application under Section 4.55 of the Environmental Planning and Assessment Act 1979. D2.17 Handrails CRA For ALL staircases handrails are to be provided to at least one side of stair flights and located not less than 865mm above the nosings of stair treads and the floor surfaces of landings. For stairs that are used only for emergency purposes i.e. the fire stairs leading from the basement, and the internal fire isolated stairway serving the upper residential levels, a single handrail is permitted and that handrail need not be provided with a 300mm horizontal projection. Where stairs are also used for general access (i.e. for a purpose other than an emergency) the stairway is to have double handrails in accordance with AS1428.1-2009, including the required 300mm extensions at the top and bottom of handrails. Handrails are not allowed to encroach into the required 1 metre stairway width; and must be a consistent height throughout the flight. To achieve the consistent height, stairways may need to be off-set by one tread. Prior to the issue of the construction certificate full details and specifications are to be provided to the certifying authority that include all handrail details including extensions and heights.
