Jonas qualified as a Chartered (UK) Patent Attorney and as a European Patent Attorney in 2010, and as a SingaporeRegistered Patent Attorney in 2016. He specialises in electronics patent matters and has particular expertise in draftingand prosecuting patent applications in the electronics and software fields. Jonas practices in designs as well as patentsand has experience of registering designs in Europe for graphical user interfaces and animated characters.

Jonas regularly visits Japan and has given a number of presentations on patent and design law in Japanese. Jonasgraduated from Imperial College London with an MSci degree in Physics. His final year project involved computationalmodelling of atoms. Following graduation he spent two years teaching English in Japan.

Jonas joined our London office in 2008 and moved to our Singapore office in June 2015. Before joining Marks & Clerk,Jonas completed a Masters degree in Management of Intellectual Property at Queen Mary University of London andworked for a German Patent Attorney firm.

• IP gives the owner a limited monopoly.• E.g. A patent protects an invention and gives the owner the right to stop

others from using the invention.• Main IP rights – Patents, Confidential Information, Trade Marks, Copyright,

and Registered Designs.• Rights are generally territorial and limited in duration.

• IP provides a limited monopoly and the owner profit from that monopoly.• IP can also be licensed – licensee pays a royalty to the owner to use the IP.• Many different types of licence are possible – can be limited to particular

products or countries, cross licences.• IP attracts investors – IP can be one of the most important assets of a startup.

Economic Value of IP



• Patents protect inventions – an invention can be defined as a product, a process or both.

• To patentable, an invention must be new, inventive and include patentable subject matter.

• New (or novel) means not disclosed to the public before the patent application was filed.

• Prior disclosure by the applicant themselves can invalidate a patent application (some but not all countries have grace periods).

• Inventive means that the subject matter must not be obvious.

Patents



• IoT inventions – often software based. • The law on patentability of computer software is complex and varies between

countries.• Most South-East Asian countries follow a similar approach to the European

Patent Office. • This involves considering whether a “technical problem” is solved by the

software.• Generally IoT related inventions satisfy this – problems such as faster data

transfer, improved security, increased accuracy of sensors, reduced power consumption are regarded as technical.

Patentable Subject Matter



• Protect an idea by keeping it secret.• Example – processes implemented on a server that end users cannot see.• Only works if idea cannot be reverse engineered.• Can be applicable to non-patentable ideas.• Patent applications – will be published after 18 months – therefore necessary

to decide how to protect innovations early on.

Confidential Information



• Brand names, slogans and logos can be protected as Trade Marks• Also possible to protect non-traditional marks – 3d shapes, colours and even

smells in some countries• Trade Marks are registered for specific classifications of goods/services.• Example – app or computer program – may be able to the name as a word

mark and the icon as a logo. • Important to check availability of mark before launching/entering new

markets.

Trade Marks



• Gives owner right to prevent others from copying work.• Copyright generally exists once work has been recorded.• IoT – often software/computer program code protected by copyright.• Limitation of copyright – protects the implementation of an idea – not the

idea itself.

Copyright



• Generally relate to physical products.• Protect the appearance of the product (not how it works)• Some South East Asian countries (e.g. Singapore, Thailand, the Philippines

and Malaysia) also allow registered design protection for graphical user interfaces.

• Relatively low cost compared to patents.• Protect the appearance not underlying functionality.

Registered Designs



• The protection given by a patent is defined by the claims.• Claims can define a device, a system, a method, a computer

readable medium etc.• When an invention relates to a distributed system (e.g. a server

and multiple devices in communication with the server) it is important to how best to define this in the claims.

• The best way to have claims that cover each different part of the system. This gives the best coverage and protection.

Patents - Enforceability – Distributed Systems



• Some countries (e.g. the Philippines) have provisions for “contributory infringement”.

• Section 76.6 of the IP Code:• “Anyone who actively induces the infringement of a patent or provides the infringer

with a component of a patented product or of a product produced because of a patented process knowing it to be especially adopted for infringing the patented invention and not suitable for substantial non-infringing use shall be liable as a contributory infringer and shall be jointly and severally liable with the infringer.”

• However, most other South East Asian countries (including Singapore, Vietnam, Malaysia, Thailand and Indonesia) do not have such a provision.

Enforceability – Distributed Systems



• IoT developments related to interoperability –e.g. data transfer protocols may be relevant to future standards (or future versions of existing standards).

• Incorporation of a patent in a standard –essentially a form of licensing – patent owner may receive a royalty for each product sold

• Potentially a large source of revenue if future standard widely adopted.

Patents - Standards



Filing a PCT application and then national phase applications after 30 months allows extra time to make a decision on which countries to file national phase applications. It is important to note that some countries such as Thailand require a translation to be submitted on filing of the national phase entry so a decision must be made around one month before the deadline.

• Examination acceleration programme among SEA patent offices for “Industry 4.0” related patent applications.

• Launched August 2019.• Participating offices - Brunei Darussalam, Cambodia,

Indonesia, Lao PDR, Malaysia, the Philippines, Singapore, Thailand and Vietnam.

• If patent granted by one participating patent office can request accelerated processing of applications in other patent offices.

• Turnaround time of 6 months to receive first office action.

ASPEC Acceleration for Industry 4.0 Infrastructure and Manufacturing (ASPEC AIM)



Singapore previously had two technology specific fast track programmes for AI and Fintech related patent application. In May 2020 a new programme was launched for all fields of technology.

Patent applications in all technology fields which are first filed in Singapore can utilisethe SG Patent Fast Track programme to have the patent granted in as fast as 6 months. This programme will run from 4 May 2020 to 29 April 2022. Fee for acceleration will not be imposed till further notice.

Requirements

- The applicant must provide reasons for requesting acceleration and the technology field to which the invention relates. Possible reasons for acceleration include the patent application being filed is for an emerging technology with a short product lifecycle (eg: FinTech, Industry 4.0 and Artificial Intelligence) or a technology with an environment or public health cause (eg: food security, mitigating climate change, waste water and smart energy management, and therapeutic agents to combat COVID-19).

- The request is within the cap on the number of requests per month (at least 5), and the request is within the cap of 10 requests per year per entity (individual or corporate).

- Application has to be first filed in Singapore;- Application shall contain 20 or fewer claims;- Applicant needs to respond within two weeks from the date of receipt of formalities

examination adverse report; - Applicant needs to respond within two months from the date of receipt of written opinion
