1.0 Occupational Health and Safety Policy

1.1 Policy Statement

1.1.1 Millers Metals is committed to ensuring, as far as reasonably practicable, a safe place of work

for all employees, contractors and visitors across all sites.

1.2 Policy Objective

1.2.1 Millers Metals Occupation Health and Safety (OHS) Objectives are to:

- Ensure the ongoing compliance of the Work Health and Safety Act 2011, and Work Health

and Safety Regulation 2011, Mine Health and Safety Act 2004 and Mine Health and Safety

Regulations 2007.

- Maintain the Mine Safety Management Plan (MSMP) based on AS/NZS 4801, AS/NZS4804

and AS 4360

- Develop and report against measurable objectives and targets with the aim to continually

improve the company’s OHS performance and reduce the number of workplace injury &

illness.

- Promote effective consultation and communication with employees, subcontractors,

suppliers and regulatory authorities regarding workplace health and safety.

- Ensure that all employees of the company, subcontractors, suppliers and clients are aware

that health and safety is considered a priority in all aspects of the company’s business.

1.2.2 To fulfil these objectives, Millers Metals will:

- Appoint a management representative who shall be responsible for ensuring the MSMP is

implemented and maintained including progress reports against set targets and objectives .

- Review the effectiveness of the MSMP and progress with achieving the company’s objectives

through various consultation processes such as safety meetings, project reviews and

following the results of internal and external audits.

- Provide ongoing training and education for all employees of the company.

- Review of the OHS policy in consultation with employees every two years.

1.3 Responsibilities

General Manager The General Manager is responsible for the enforcement of Millers Metal

OHS Policy.

Production Managers The Production Managers are responsible for the active enforcement of the

this OHS policy including leading by example

OHS Manager The OHS Manager is responsible for ensuring the implementation of the

MSMP and providing support in OHS matters to both staff and management.

Employees/Contractors/Visitors All employees, contractors and sub contractors whilst at work are responsible

for their safety and that of others and to follow site safety rules and

instructions given to them by management in relation to their safety.

2.0 Management Responsibilities and Accountabilities

2.1 Scope

2.1.1 The purpose of this document is to ensure that all persons on site are aware of their legal responsibilities to ensure health and safety in the workplace

in accordance with the Work Health and Safety Act 2011 (WHS) and the Mine Health and Safety Act 2004 (MHS).

2.2 Definitions

2.2.1 Definitions below are listed are excerpts directly from the various acts. Please note, that you may fall under more than 1 definition.

Position Definition According to

Officer

‘’officer” means:

(a) an officer within the meaning of section 9 of the Corporations Act 2001 other

than a partner in a partnership; or

(b) an officer of the Commonwealth within the meaning of section 247; or

(c) an officer of a public authority within the meaning of section 252;

other than an elected member of a local authority acting in that capacity.

"officer" of a corporation means:

(a) a director or secretary of the corporation; or

(b) a person:

(i) who makes, or participates in making, decisions that affect the

whole, or a substantial part, of the business of the corporation; or

(ii) who has the capacity to affect significantly the corporation's

financial standing; or

(iii) in accordance with whose instructions or wishes the directors

of the corporation are accustomed to act (excluding advice given by the person in

the proper performance of functions attaching to the person's professional

capacity or their business relationship with the directors or the corporation); or

(c) a receiver, or receiver and manager, of the property of the corporation; or

(d) an administrator of the corporation; or

(e) an administrator of a deed of company arrangement executed by the

corporation; or

(f) a liquidator of the corporation; or

(g) a trustee or other person administering a compromise or arrangement made

between the corporation and someone else.

Note: Section 201B contains rules about who is a director of a corporation.

Worker

Meaning of “worker”

(1) A person is a worker if the person carries out work in any capacity for a person

conducting a business or undertaking, including work as:

(a) an employee; or

(b) a contractor or subcontractor; or

(c) an employee of a contractor or subcontractor; or

(d) an employee of a labour hire company who has been assigned to work in the

person’s business or undertaking; or

(e) an outworker; or

(f) an apprentice or trainee; or

(g) a student gaining work experience; or

(h) a volunteer; or

(i) a person of a prescribed class.

Contractor

"Contractor"

In relation to a mine, means a person who is not an employee at a mine, who

undertakes work at the mine, but does not include the operator of the mine.

Employee

"employee"

Means an individual who works under a contract of employment or

apprenticeship or, subject to the regulations, under some other arrangement

whereby the individual expects to receive something of value for the individual’s

work, being a share of, or payment out of proceeds from the sale of, a mineral

recovered or a payment dependent on the recovery of a mineral.

Employer “employer"

Means a person who employs another person under a contract of employment or

apprenticeship or, subject to the regulations, enters some other arrangement

whereby the person agrees to give another person who is an individual something

of value for the other person’s work, being a share of, or payment out of proceeds

from the sale of, a mineral recovered or a payment dependent on the recovery of

a mineral.

Operator

"operator" of a mine means:

(a) the mine holder, if the mine holder nominated himself, herself or itself as the

operator of the mine under section 22 and that nomination is not rejected, or

(b) the person nominated by the mine holder as the operator of the mine, and not

rejected by the Chief Inspector, under section 22, or

(c) the person declared by the Chief Inspector to be the operator under section 23,

or

(d) the person prescribed by, or determined in accordance with, the regulations to

be the operator of the mine.

Mine Holder

"mine holder" means:

(a) in relation to land subject to a mining title granted under the Mining Act 1992 -

the person who holds the title, or

(b) in relation to land subject to a mining licence granted under the Offshore

Minerals Act 1999 -the person who holds the licence, or

(c) in relation to any other land-the person with the right to extract minerals or

quarry product from the land.

2.3 Production Manager

2.3.1 A Production Manager is appointed by the Mine Holder/Operator if the mine employs 20 plus workers. The Operator has a duty to inform the Chief

Inspector of the appoint of a Production Manager in writing including evidence of competence as soon as possible after the appointment is made.

2.3.2 A Production Manager may also be appointed at the discretion of the Chief Inspector.

2.3.3 A Production Manager must hold a production managers permit in order for the appointment to be approved by the Chief Inspector. An application

must be made in writing to the Chief Inspector .

2.3.4 Eligibility for production manager permit;

A person is eligible for a production manager permit if the Chief Inspector is satisfied:

a) that the person has had sufficient experience to supervise the production operations at the mine concerned, and

(b) in the case of an application for a permit relating to a mine at which more than 20 persons are employed:

(i) that the person has sufficient knowledge or skill to supervise the production operations at the mine, or

(ii) that minimal knowledge or skill is required to supervise the production operations at the mine, having regard to the location of the

mine, or the nature of the material mined, or

(iii) that the person will shortly sit for the requisite examination for the grant of a certificate of competence as production manager.

2.3.5 Absence of Production Manager – Temporary

An operator must take all reasonable steps to maintain the management structure for a mine operation. This includes having others acting in, and the

timely filling of, vacant positions in the structure (see section 35 of the Mine Health and Safety Act 2004).

Temporary Absence:

If the appointed production manager is temporarily absent from site the following must occur:

- Absence more than 7 days (5 working days) - an alternative, qualified person, mustbe appointed (CIM notified in writing) or a competent person

must be nominated using the attached specified form (GNM-006 http://www.resources.nsw.gov.au/safety)

- Absence less than 7 days (5 working days) - the operator of the mine must consider the ability of the incumbent production manager to

supervise extraction at the mine while away from site.

2.4 Duty of Care

2.4.1 Every person who enters the mine has a duty of care. These duties are outlined in the WHS Act and MHS Act.

2.4.2 This duty of care cannot be transferred to anyone.

2.4.3 A person may have more than 1 duty and the same duty may be held by more than 1 person. (i.e. All persons on site have a duty to ensure their own

health safety and that their actions do not risk the health and safety of others).

2.4.4 Any one person may fall into multiple categories. The below table was developed combining both WHS Act 2011 and MHS Act 2004.

(1) If a person conducting a business or undertaking has a duty or obligation under this Act, an

officer of the person conducting the business or undertaking must exercise due diligence to ensure

that the person conducting the business or undertaking complies with that duty or obligation.

(2) Subject to subsection (3), the maximum penalty applicable under Division 5 of this Part for an

offence relating to the duty of an officer under this section is the maximum penalty fixed for an

officer of a person conducting a business or undertaking for that offence.

(3) Despite anything to the contrary in section 33, if the duty or obligation of a person conducting a

business or undertaking was imposed under a provision other than a provision of Division 2 or 3 of

this Part or this Division, the maximum penalty under section 33 for an offence by an officer under

section 33 in relation to the duty or obligation is the maximum penalty fixed under the provision

creating the duty or obligation for an individual who fails to comply with the duty or obligation.

(4) An officer of a person conducting a business or undertaking may be convicted or found guilty of

an offence under this Act relating to a duty under this section whether or not the person

conducting the business or undertaking has been convicted or found guilty of an offence under this

Act relating to the duty or obligation.

(5) In this section, due diligence includes taking reasonable steps:

(a) to acquire and keep up-to-date knowledge of work health and safety matters; and

(b) to gain an understanding of the nature of the operations of the business or undertaking of the

person conducting the business or undertaking and generally of the hazards and risks associated

with those operations; and

(c) to ensure that the person conducting the business or undertaking has available for use, and

uses, appropriate resources and processes to eliminate or minimise risks to health and safety from

Work Health and

Safety Act 2011,

work carried out as part of the conduct of the business or undertaking; and

(d) to ensure that the person conducting the business or undertaking has appropriate processes for

receiving and considering information regarding incidents, hazards and risks and responding in a

timely way to that information; and

(e) to ensure that the person conducting the business or undertaking has, and implements,

processes for complying with any duty or obligation of the person conducting the business or

undertaking under this Act; and

(f) to verify the provision and use of the resources and processes referred to in paragraphs (c) to

(e).

Management

54 Persons in management positions must comply with mine safety management plan

(1) A person who holds a management position at a mine must comply with the mine safety

management plan for the mine.

(2) A person who holds a management position at a mine and is an employee of a contractor must

comply with any safety management plan of the contractor that has been accepted by the operator

of the mine in accordance with section 63.

55 Persons in management positions must inform operator of non-compliance

(1) A person who holds a management position at a mine must inform the operator of the mine if

(2) A failure by a person to inform the operator under this section does not affect any liability of the

56 Further obligations

A person who holds a management position at a mine:

(a) must ensure that the workplace and work methods for which the person is responsible are safe,

and

(b) must ensure that hazards at the workplace for which the person is responsible are identified

and that associated risks are controlled, and

(c) must ensure that safety information concerning the workplace for which the person is

responsible is communicated to relevant persons, particularly other supervisors at the change of a

shift, and

(d) must have regard to appropriate risk management standards at the workplace for which the

person is responsible, and

(e) must implement risk management practices in areas that the person controls.

Supervisor

58 Supervisor must comply with mine safety management plan

(1) A supervisor at a mine must comply with the mine safety management plan for the mine.

(2) A supervisor at a mine who is an employee of a contractor must comply with any safety

management plan of the contractor that has been accepted by the operator of the mine in

accordance with section 63.

59 Supervisor must inform operator of non-compliance

(1) A supervisor at a mine must inform the operator of the mine if the supervisor is aware that the

conduct of the mine does not conform with this Act or the regulations or the Work Health and

Safety Act 2011 or the regulations under that Act.

(2) A failure by a supervisor to inform the operator under this section does not affect any liability of

the operator under this Act or the regulations or under the Work Health and Safety Act 2011 or the

regulations under that Act.

60 Further obligations

A supervisor at a mine:

(a) must ensure that safety information concerning that part or aspect of the workplace for which

the supervisor is responsible is communicated to relevant persons, particularly other supervisors at

the change of a shift, and

(b) must have regard to appropriate risk management standards, and

(c) must implement risk management practices in that part or aspect of the workplace for which

the supervisor is responsible.

Contractors

62 Contractor must comply with operator’s mine safety management plan

Except as provided by section 63, a contractor who works at a mine must comply with the mine

safety management plan of the operator for the mine to the extent that it applies to work done by

the contractor.

28 Duties of workers

While at work, a worker must:

(a) take reasonable care for his or her own health and safety; and

(b) take reasonable care that his or her acts or omissions do not adversely affect the health and

safety of other persons; and

(c) comply, so far as the worker is reasonably able, with any reasonable instruction that is given by

the person conducting the business or undertaking to allow the person to comply with this Act; and

(d) co‑operate with any reasonable policy or procedure of the person conducting the business or

undertaking relating to health or safety at the workplace that has been notified to workers.

Employees

50 Duties of employees

(1) An employee who works at any mine:

(a) must comply with the mine safety management plan for the mine, and

(b) must follow the operator’s procedures for emergencies as set out in the emergency plan for the

mine, and

(c) must, before commencing work and at frequent intervals during the employee’s work day,

carefully examine the working place and any machinery or system intended to be used so as to be

satisfied that it is safe, and

(d) must take any actions within the employee’s responsibility to control a danger at the mine, and

(e) if the employee is employed by a contractor, must comply with any safety management plan of

the contractor that has been accepted by the operator of the mine in accordance with section 63.

(2) An employee who works at a mine must immediately report to the employee’s immediate

supervisor (if any) any situation that the employee believes could present a risk to health and safety

and that is not within the employee’s competence to control. If the employee’s supervisor is not

immediately available, the employee must instead immediately report the situation to another

senior person (if any) at the mine.

29 Duties of other persons at the workplace

A person at a workplace (whether or not the person has another duty under this Part) must:

(a) take reasonable care for his or her own health and safety; and

(b) take reasonable care that his or her acts or omissions do not adversely affect the health and

safety of other persons; and

(c) comply, so far as the person is reasonably able, with any reasonable instruction that is given by

the person conducting the business or undertaking to allow the person conducting the business or

undertaking to comply with this Act.

2.5 Offences and Penalties

2.5.1 Under the Work Health and Safety Act 2011, offences and penalties committed can result in an individual being fined. The table below details the

category in which offences fall under, the offence and maximum penalty that can be handed down.

2.5.2 Penalty units are used to define the amount payable for offences committed against various acts. The rate for penalty units is indexed annually and

goes up in line with inflation.

Reckless Conduct

(1) A person commits a Category 1 offence if:

(a) the person has a health and safety duty; and

(b) the person, without reasonable excuse, engages in conduct

that exposes an individual to whom that duty is owed to a risk of death or

serious injury or illness; and

(c) the person is reckless as to the risk to an individual of death

or serious injury or illness.

(2) The prosecution bears the burden of proving that the conduct was

engaged in without reasonable excuse

Penalty:

(a) In the case of an offence committed by an individual

(other than as a person conducting a business or

undertaking or as an officer of a person conducting a

business or undertaking)—$300 000 or 5 years

imprisonment or both.

(b) In the case of an offence committed by an individual

as a person conducting a business or undertaking or as

an officer of a person conducting a business or

undertaking—$600 000 or 5 years imprisonment or

both.

(c) In the case of an offence committed by a body

corporate—$3 000 000.

Category 2 Failure to comply with health and safety duty

Penalty:

(a) In the case of an offence committed by an individual

(a) the person has a health and safety duty; and

(b) the person fails to comply with that duty; and

(c) the failure exposes an individual to a risk of death or serious

injury or illness.

(b) In the case of an offence committed by an individual

as a person conducting a business or undertaking or as

(a) the person has a health and safety duty; and

business or undertaking)—$50 000.

(b) In the case of an offence committed by an individual

as a person conducting a business or undertaking or as

an officer of a person conducting a business or

undertaking—$100 000.

(c) In the case of an offence committed by a body

corporate—$500 000.

3.1 Policy Statement

3.1.1 To ensure that all Mine Safety Management Plan (MSMP) documents are maintained and

controlled in a consistent manner.

3.2 Policy Objective

3.2.1 The objective of this policy is to ensure that all documents in relation to the MSMP are current

and approved for use.

3.2.2 All programs, procedures, plans, registers, inspections and forms associated with the MSMP

accordingly by the Occupational Health and Safety Manager (OHS) and entered onto the master list.

3.2.3 Original documents are to be kept in the Wyalong quarry office with copies to be kept in the

Forbes office as well as remote mobile equipment as required. Electronic copies of the MSMP shall

be kept at the OHS Managers office and available upon request.

3.3 Responsibilities

3.3.1 The Document Control Master List – Form 3A will be the responsibility of the OHS Manager.

This shall include the maintaining documents listed on the master list and ensuring they are

reviewed according to schedule. The OHS Manager will also be responsible for the storage and

distribution of documents.

3.3.2 It will be the responsibility of the General Manager and Managers to assist and support the

OHS Manager in the implementation of this policy.

3.4 Version Control

3.4.1 All documents under the MSMP shall be subject to version control. This is to ensure that

documents remain current. All documents will be numbered accordingly.

3.4.2 Documents shall be classified by the system/management plan they belong too.

ie. Mine Safety Management Plan = MSMP

Quality Management System = QMS

3.4.3 Documents shall be numbered according to the section/program they belong to within the

system/management plan.

3.4.4 Document numbers shall be followed by a decimal point and number indicating the document

is a policy/procedure or similar or shall be followed by a letter indicating the document is a

form/register/plan or similar.

3.4.5 A document version number will follow to indicate which published version the document is.

The larger the number will indicate the documents currency. This can be followed up with cross

checking with the date that the document was last reviewed.

3.4.6 If there is a decimal point following the published version number, this will indicate the

document is in draft and is subject to further change. When the draft process is over, the published

version number will go up by 1.

3.4.7 Document number will separated by dashes as demonstrated below.
