BACKGROUND Correspondence has been received from WALGA requesting registration of Council’s voting delegates for the WALGA Annual General Meeting to be held on Wednesday 5 August 2015. COMMENT In previous years the voting delegates for the Shire of Corrigin have been the President and Deputy President. COMMENT The arrears on Assessment 721 have been subject to debt recovery for a substantial amount of time. Council engaged Austral Mercantile to assist with the recovery of the debt and issue the appropriate claims. The cost of legal fees to date is $1420.44. Legal fees are on-charged to the debtor and are included in the amount outstanding. Despite legal action being taken over a number of years, no payments have been received. It was decided that the cost of legal action was not being beneficial and to cease current action until the property has arrears in excess of 3 years, where recovery action in accordance with section 6.64(1)(b) of the Local Government Act 1995 could be applied. To recover the rates arrears Council has the following options; Option 1 – Exercise the provisions of Section 6.64 of the Local Government Act 1995
• Given the high level of debt, and the amount of time that has been afforded to enable the ratepayer to either clear or reduce the debt, it is appropriate to apply the relevant section of the Local Government Act 1995 empowering the sale of land provision in relation to unpaid rates and charges.
Option 2 – Exercise the provisions of Section 6.74 of the Local Government Act 1995
• Apply to the Minister to have the land re-vested in the Crown in right of the state. Option 3 – Exercise the provisions of Section 6.75 of the Local Government Act 1995
• Make application for the land to be vested in the local government, It is suggested that Council apply the provisions of Section 6.64 of the Local Government Act 1995 and commence proceedings to take possession of the land and sell the land in respect of the unpaid rates and charges, which are in arrears for a period of excess of 3 years. It is noted that the property in question has had a notice pursuant to section 135 of the Health Act 1911 (as amended) - House unfit for habitation issued. STATUTORY ENVIRONMENT Local Government Act 1995 section 6.64
(1) If any rates or services charges which are due to a local government in respect of any rateable land have been unpaid for at least 3 years the local government may, in accordance with the appropriate provisions of this subdivision take possession of the land and hold the land as against a person having an estate or interest in the land and –
a. From time to time lease the land; b. Sell the land; c. Cause the land to be transferred to the Crown; or d. Cause the land to be transferred to itself.
(2) On taking possession of any land under this section, the local government is to give to the
owner of the land such notification as is prescribed and then to affix on a conspicuous part of the land a notice, in the form or substantially in the form prescribed.
(3) Where payment of rates or services charges imposed in respect of any land is in arrears the local government has an interest in the land in respect of which it may lodge a caveat to preclude dealings in respect of the land, and may withdraw caveats so lodged by it.

BACKGROUND At its June 2014 meeting, Council noted the submissions received on the Shire of Corrigin Health Local Law and due to the significant number of changes requested by both Departments, it was decided that the laws would be redrafted with these changes included. The laws would then be re-advertised for a period of six (6) weeks. The EHO and MGC were directed to prepare a revised Shire of Corrigin Health Local Law for approval at the July 2014 Council meeting with the intention of commencing the advertising period then. With an increase in the EHO workload and variation in hours this was not able to be achieved and it was decided to proceed once the new EHO was appointed and the EHO was able to set aside time to properly revise the local laws. This has now been completed and the draft local law is now ready to be reviewed and the process of adoption recommenced. The draft Shire of Corrigin Health Local Law includes the changes suggested by both the Department of Local Government and Communities and the Department of Health as well as the submission received from the public. COMMENT As there has been a significant delay in the process of developing this local law the process of adopting it shall recommence from the start. The process for adopting local laws is set out in Section 3.12 of the Local Government Act 1995 however an additional step is required to obtain Executive Director of Public Health approval. This includes:-
1. At the council meeting the person presiding is to give notice to the council meeting of the purpose and effect of the proposed local law;
2. State-wide and local public notice is to be given stating that the Shire intends to make a local law. Advertising is to remain open for at least 6 weeks;
3. As soon as the notice is given, a copy of the proposed local law, together with the public notice and National Competition Policy form are to be provided to the Minister for Local Government and Minister for Health(C/- Director, Environmental Health Directorate);
4. A copy of the proposed local law is to be provided to any person requesting it; 5. After the last day of submissions, the local government is to consider any submissions and
may by absolute majority proceed with the local laws as proposed or make alterations which are not significantly different from what was first proposed;

BACKGROUND The purpose of this report is to update Council on the work that Council’s Environmental Health Services is doing in the Shire of Corrigin COMMENT Review of Council’s Asbestos Register Both EHO’s Lauren Pitman and Julian Goldacre have been participating in Council building inspections in order to review the Shire’s asbestos register. The asbestos register, once fully reviewed will be presented to Council. Review of Council Food Act Enforcement Policy Shire’s EHO, Lauren Pitman, is currently reviewing the Shire’s Food Act Enforcement Policy, which will be available at June Council meeting for Council endorsement. Food Hygiene and Safety Workshop Shire’s EHO, Lauren Pitman, held a small food hygiene and safety workshop during April. A maximum of 6 places were available, and 4 people attended. Each attendant left with an I’m Alert certificate and specific questions about food legislation topics answered. Food Unit Audit of Abattoir The Shire’s EHOs both accompanied the Department of Health’s Food Unit representative during the audit of the abattoir during April. The Shire will be informed by the Department whether any enforcement action is recommended as a result of the audit. The Shire is the enforcement agency under the Food Act 2008, and will be required to act on any advice received from the Department of Health. Appointment of Meat Inspectors for Abattoir There have been two new meat inspectors appointed in the last month for the Corrigin Meatworks. The business is legally required to employe a qualified meat inspector to oversee all kills at the abattoir. Each meat inspector must be appointment by the Shire of Corrigin if they meet the required qualifications. Routine activities:

BACKGROUND Permits are required for all operators of Class 2 and 3 Restricted Access Vehicles (RAVs) to access the heavy vehicle network. Examples of Class 2 and 3 RAVs include B-doubles, road trains and truck and trailers. Further information about RAV routes is available from the Main Roads WA website www.mainroads.wa.gov.au. The routes available under the Gazette Notice permit system are based upon the existing heavy vehicle routes. That is, they are already approved routes. Additional routes can be added following approval of Local Government and route inspection. The CBH Group has requested that Council consider adding the following roads to the RAV networks:

BACKGROUND Council has made allowance in the 2014/15 Budget for the replacement of various plant including:
• (CR13) 2008 Caterpillar 226B Skid Steer Loader • (CR28) 1972 Moore Road Roller • (CR950) 2006 Mack Prime Mover • (CR23) 2005 Hino Tipping Truck
The Budget includes allowances for income from the disposal of existing plant. Plant purchases will be in accordance with the WA Local Government Association (WALGA) preferred supplier agreements. Requests for quotations for new equipment including trade-ins have been sent to WALGA preferred suppliers. When disposing of property, a local government is required to comply with the provisions of section 3,58 of the Local Government Act 1995. The Act provides for Local Government property to be sold by public auction or tender. The Local Government (Functions and General) Regulations (Reg. 30) allows for the sale of property other than by tender or public auction within six months of Council putting the sale of property out for public tender. The tender (01/2015) for the disposal of plant has been advertised with tenders closing on 22 May 2015. COMMENT In order to ensure that plant purchases are made within in a timely manner it is recommended that Council authorises the CEO to purchase plant as provided for in Budget and delegates authority to the CEO to accept tenders submitted for Tender 01/2015 for the disposal of plant. BACKGROUND The Wheatbelt South (WBS) Road Safety Advisor, Rodney Thornton has researched the option of crash car trailers being built to assist the region in promoting road safety messages at community events and other strategic locations. The WBS Regional Road Group has been approached in regard to the project, with both Kulin and Pingelly accepting the role of host Councils for the trailers for ease of availability and access by other local governments in the region. In the first instance grant funding will be applied for to assist with the capital cost of the trailers, however in the event this funding is not forthcoming it is envisaged that each of the local governments will contribute to the capital cost of the trailers and the host local governments will license, insure and maintain the trailers. A Memorandum of Understanding (MOU) between the local governments will be required to ensure a suitable trailer booking policy is adhered to and any other possible issues regarding the trailers are highlighted to ensure fairness to all local governments involved. For the purpose of the grant funding applications all participating local governments will be required to present a Letter of Support for the project prior to the end of May 2015. Currently there are a number of crash car trailers which are registered to the Commissioner of Police and located in strategic locations. Unfortunately the Wheatbelt South region does not have access to such trailers for promotion of road safety messages. COMMENT In the first instance grant funding is to be applied for by the host Council (Shire of Kulin) through the Office of Road Safety Funding Program (Closing Date: 5 June 2015) and the RAC (Closing Date: 29 June 2015) with assistance from WBS Road Safety Advisor, Rodney Thornton. If this funding is not successful or there is a funding shortfall each of the local governments in the WBS will contribute to the capital cost of the trailers (2) which is envisaged to be approximately $1,100 per local government or the lesser amount if part funded by grants (subject to changes due to quotes running past their due date). The initial license and registration of the trailers are included in this cost. Ongoing cost to the host local governments is approximately $235 p.a. per trailer for the licensing (subject to the weight of the trailer and any increases in licensing costs. Insurance costs are subject the individual local governments insurance policy. Maintenance of the trailers is to be carried out by the host local government.

It is recommended that Council supports the purchase of two Wheatbelt South crash car trailers and makes provision in the 2015/16 Annual Budget for expenditure of up to $1,100 for the purchase of the trailers.
