FDA’S RULES FOR TOBACCO PRODUCTS It has been 90 days since the FDA announced its final deeming rules for cigars, pipe and hookah tobacco and electronic cigarettes. August 1, 2016 marks the date when the regulations officially go into effect. A press release from the FDA’s Center for Tobacco Products (CTP) outlines which provisions affecting retailers will go into effect the 1st on and after , retailers: 1. Must not sell e-cigarettes, hookah or pipe tobacco, or cigars to people under 18 years of age; also must check photo

ID of everyone under age 27 who is attempting to purchase such products. 2. Must not sell tobacco products covered under the rule in a vending machine (except in a facility where people under

age 18 are not allowed on the premises). 3. Must not give away free samples of any newly regulated tobacco products (this provision also applies to manufactur-

ers, importers, and distributors). Although some provisions will go into effect on August 8, others will go into effect at a later date. Additionally, the FDA has created a webpage that provides information packets on the rules for each category of product. It is important that retailers selling these products read the rules and comply with them. It is also important for consumers of these products to be aware of the new rules, therefore we suggest having these materials available at your retail stores.

MN Revenue Extra Security

The Minnesota Department of Revenue is adding an extra layer of security to our e-Services system. To log in to e-Services you currently enter a username and password. Beginning September 7, you must enter a username, password, and verification code we send you to access your account. This is called two-step veri-fication. Why is Revenue adding two-step verification? We take the responsibility of protecting your information seriously. Two-step verification adds a second layer of security to prevent unauthorized access to your account. With two-step verification, you select if we send you a code through a text message or an email. Two-step verification is becoming an industry standard for protecting data security. How do you use two-step verification? After the initial set up is complete, you must enter a verification code along with your username and pass-word to log in to your account.

1. Log in using your username and password. 2. Send your code. We will send your code using the information you entered when setting up two-step

verification. 3. Enter your code into the Verification Code field. 4. Select Login.

SHORT-TERM ENERGY OUTLOOK

EIA estimates that the amount of electricity generated using natural gas reached a record high during July, surpassing the previous record set in July 2015. The record natural gas-fired generation was driven by competitive economics compared with coal (despite recent natural gas price increases) and by warmer-than-normal temperatures that boosted overall electricity generation. For 2016, EIA expects natural gas to fuel 34% of electricity genera-tion compared with 30% for coal. In 2015, natural gas was used to generate slightly less than 33% of electricity, and coal was used to generate slightly more than 33% of electrici-ty.

Benchmark North Sea Brent crude oil spot prices averaged $45/barrel (b) in July, a $3/b decrease from June. This was the first monthly decrease since the Brent price fell to a 12-year low of $31/b in January 2016.

Brent crude oil prices are forecast to average $42/b in 2016 and $52/b in 2017. West Texas Intermediate (WTI) crude oil prices are forecast to be slightly less than Brent in 2016 and the same as Brent in 2017. The current values of futures and options contracts suggest high uncertainty in the price outlook. For example, EIA’s forecast for the average WTI price in November 2016 of $44/b should be considered in the context of Nymex contract values for November 2016 delivery. Contracts traded during the five-day period ending August 4 (Market Prices and Uncertainty Report) suggest the market expects WTI prices could range from $29/b to $61/b (at the 95% confidence interval) in November 2016.

U.S. regular gasoline retail prices this summer (April through September) are forecast to average $2.19/gallon (gal), 6 cents/gal lower than forecast in last month’s STEO and 44 cents/gal lower than last summer. U.S. regular gasoline retail prices are forecast to average $2.06/gal in 2016 and $2.26/gal in 2017.

U.S. crude oil production averaged 9.4 million barrels per day (b/d) in 2015. Production is forecast to average 8.7 million b/d in 2016 and 8.3 million b/d in 2017. EIA estimates that crude oil production for July 2016 averaged 8.6 million b/d, almost 0.2 million b/d below the June 2016 level, and 1.1 million b/d below the 9.7 million b/d reached in April 2015.

Natural gas working inventories were 3,288 billion cubic feet (Bcf) on July 29. This level is 13% higher than last year during the same week, and 16% higher than the previous five-year (2011–15) average for that week. EIA projects that natural gas inventories will be 4,042 Bcf at the end of October 2016, which would be the highest end-of-October level on record.

SPOTLIGHT PROGRAM : Drive Off Program

Minnesota Petroleum Marketers Association’s Drive-Off Program. The legislature approved trade associations, acting on behalf of their members, to send notic-es of nonpayment and to collect for the motor fuel and the service charge. With this new program, you simply have to fill out the Authorization form (keeping a copy for your records) and start using the Drive-Off Report form. 1. We will keep a database for your store or stores and enter the information from the drive-off forms sent in; 2. Get the appropriate license plate information from the MN Department of Public Safety; 3. Send the notice and demand for payment to the correct address; 4. Send you (the member) all payments and surcharges received monthly; 5. Notify the drive-off a second time if payment is not received. You will receive a report of the drive-off activity by individual store each month. If payment is not received 10 days after the second notification, all the information will be sent to you so, if you choose, you can report to the police or go to small claims court. Anytime the same li-cense plate number shows up twice in our database the information will be immediately sent to you, to report to the police. Employees should know that drive-offs are reported to a third party and collection activities will happen on every drive-off form received. You will also be able to track times and pump numbers where drive-offs are occurring. The cost to you is $7.50 per drive off report received. This covers the $5 dollar charge from the MN Department of Public Safety for license plate information and all mailing costs. Your cumulative costs will be billed monthly.
