4.40 Persons who have already registered under various MDA schemes but have not received any allotment letter may also apply under this scheme by depositing the registration amount. However they would be considered at par with other applicants in this scheme. Such applicants must clearly mention their old registration number and scheme details.

4.50 If in case, any person (the individual himself) or any of his dependent family members receives allotment in more than one scheme, then except for one property, the earnest money deposited for the remaining allotted properties will be reimbursed without any deductions.

5.10 Application Forms only in the prescribed format given in the Scheme booklet accompanied by an affidavit on Rs 10 stamp paper will be considered. General Category Applicants are required to enclosed 10% of the estimated value of the form of a bank draft while reserved category applicants (Scheduled caste, scheduled tribe, other backward classes, freedom fighters, ex-servicemen, their dependents and handicapped persons) will be required to deposit 5% of estimated value by bank draft/bankers cheque or pay order addressed to the Vice Chairman, Meerut Development Authority. Application forms not enclosing the receipt for the 10% payment (General Category) or 5% (in case of reserved categories) will be considered incomplete. Likewise application forms received after the due date will not be considered.

5.20 Applicants are required to submit their application form complete in all respects accompanied by the applicable registration amount in any branch of the advertised banks also issuing application forms.

5.30 Application cannot be made in more than one or joint names, except in case of husband-wife who can apply in joint names. Application form can be deposited in any of the following bank branches during hours.

7.10 Out of reserved quota Handicapped Applicants will be given 3% horizontal reservation in each category while Senior Citizens shall be given 10% reservation - horizontal reservation in each category. To be eligible for this, applicants have to enclose Handicap Certificate / Senior Citizen age Certificate along with the application form. General category applicants should leave the Quota Code 15.

7.20 Applicants eligible for reservation in more than one category should themselves decide the category under which they wish to claim reservation. In case adequate number of applications are not received under any reserved category other than General Category, Applicants may be considered for allotment of the surplus plots.

7.30 Applicants wishing to avail of any of the Reserved categories, must submit the proof that they are eligible for that category there of, duly attested by the complete Authority/Officer.

7.40 25% of the vacant plots in all categories will be allotted to those applicants for cash down option. Balance 75% plots will be allotted as per lottery draw system to Applicants paying in installments.

The applicants paying cash down have to deposit the balance amount after adjusting the Registration amount within 45 days from the date of Allotment letter.

Availability of Category-wise plots, approx. cost, application amount is mentioned in the enclosed table. Applicants with an installment payment options has to deposit 10% amount as allotment amount within one month, either in the form or cash of bank draft in favour of VC, Meerut Development, Authority at Allahabad Bank, MDA compound.

, Applicants with installment payment option have to deposit 10% amount as allotment amount and HIG category has to pay in 2 yrs. with 8 equal installments with 18% interest. MIG applicants have to pay in 2 yrs. with 8 equal installment with 16% interest, and LIG applicants have to pay in 2 yrs. with 8 equal installment with 14% interest, in the form of cash or bank draft in favour of Vice Chairman, MDA at Allahabad Bank, MDA compound. (Payment of balance amount should be deposited in authority account through cheque / draft within the specified period.) If two or more than two installments not deposited within time period then allotment will be cancelled.

If any payment due to Meerut Development Authority is not made within the stipulated time then additional compounding penal interest at the rate of 18% in case of HIG, 20% for MIG and 22% for LIG will be payable for the delayed period. If the payment is delayed beyond three months, then allotment will be cancelled, without any indication to the allottee.

10.10 Allottee will be given possession of the plot after execution of the Registration Agreement. Even after intimation by the authority to take possession, if any allottee fails to take possession of the plot then the Development Authority shall be entitled to charge the prescribed fee every month towards security of the premises, as per rules. In case of delay in possession beyond the stipulated time, the allottee shall have to pay the following charges to M.D.A. every month for security of the property.

10.20 It will be the responsibility of the allottee to pay all the Municipal and any other taxes levied by the Government and other local bodies from time to time as per the laws and by-laws from the date of possession.

10.30 Allottee may apply for electricity and water connections from the concerned departments at his own expense.

Registration deed-sale transfer processes shall be executed after payment towards cost of the property, location charge, 12% freehold charge on cost of property including location charge, water and sewer tax, road cutting charge, all documentation charges and the Stamp Duty prescribed as per rules has been paid in full.

There are provision in the rules for refund process, in case an applicant wants to withdraw the money deposited by him/her.

12.10 Amount deposited before allotment can be refunded on production of the original booking receipt without any deduction and without any interest within one year of the date of registration. A simple interest of 4% shall be payable on refund of an amount deposited in the accounts of the Authority for more than one year.

12.20 In case of refund claimed after the allotment letter has been before the next installment of 10% amount become due, the balance amount after deducting 20% from the deposited booking/registration amount shall be refunded on production of the original booking receipt, without any interest.

12.30 For refund claimed after payment of the allotment amount but before possession, 15% of the total amount will be deducted and the balance amount shall be refunded, without any interest.

12.40 For refunded claimed after allotment and possession of the premises, the balance amount, if any, after deducting 15% of the total amount as well as interest on any defaulting installment till the date of Refund Application or Cancellation Order, whichever is earlier, shall be refunded to the applicant, without interest.

If the applicant wishes to restore allotment of the property, within one month of the cancellation, it can be done after revaluation of the property as per the land rate applicable at the time of restoration of the allotment.

14.00 APPLICATION MISREPRESENTING OR SUPPRESSING FACTS :

15.00 OTHER IMPORTANT TERMS :

In case an applicant is found to be providing incorrect/fals information of suppressing any material facts, the registration and allotment will be cancelled without assigning any reason. The said applicant would also be barred from participating in any future allotment process and the amount deposited would be forfeited.

15.10 10 All applicants should agree to the Terms and Conditions mentioned in the application form and

must be willing to abide by them in future as well.15.20 At any stage if any applicant is found to have provided incorrect/false information or suppressed

any material facts to obtain allotment/Amount will be forfeited and the balance amount, if any, after deducting 15% from the total installments paid will be refunded - without any interest.

15.30 The allottee should be ready to pay an additional cost, if any, in case of any future hike in land acquisition rates for the proposed land to be acquired under this Scheme by the authority - by an appropriate court of law under the provisions of section 18 and other relevant sections of the Land Acquisition Act 1894 (since amended). Also in case of any rise in land prices due to increase in levies and taxes by the competent court of law and / or direction to the Collector under the provision of section 28-A of the Land Acquisition Act 1894 (since amended) to pay a higher rate to the farmers for their land acquired-this hike in price shall have to be borne by the allottee. In case the allottee fails to pay this amount, then the entire amount paid by the allottee would be diverted towards paying the dues of the land revenue department. Hence, this liability would be the first charge on the property.

15.40 In case of change of address of the applicant, an application should be sent to the Secretary, Meerut Development Authority mentioning the application form number and detailed description. In case of incorrect or incomplete address on the original application form or failure to communicate any change in address, the authority will not be responsible for any loss to the applicant/allottee on account of not getting any correspondence on time.

15.50 For the properties mentioned in the enclosed table, only those applicants whose registration forms are found to be complete in all respects are eligible to participate in the lottery draw provided they are found to be carrying the original receipt for the registration amount. Anyone who does not have the receipt for the amount deposited at the time of the lottery draw will not be allowed to participate.

15.60 All disputes, if any, related to the allotted property will be settled in Meerut Jurisdiction courts only.15. 70 The Vice Chairman, Meerut Development Authority shall have the final say in all matters related to

the application, allotment process, refund or redressal of grievance. He shall have the liberty to implement, amend or nullify any terms and conditions mentioned in this booklet, as he may deem fit - and this would be binding on all the application.

2. The applicant(s) should use only international form of Indian numerals in the filling of the application form for writing the codes. Only the Code number thus filled in will be taken into account.

3. These application forms are processed by a computerized system. Hence, these forms should be filled in English BLOCK LETTERS only. The signature(s) may, however, be in any language.

4. Incomplete/invalid/illegible applications are likely to be rejected. No correspondence in this regard shall be entertained.

5. In all future correspondence, the application no., scheme code and property code should be quoted. However, the form's serial number may be quoted till allottee's code is not received.

6. Any change in mailing address should be immediately informed to Meerut Development Authority, Meerut.

7.00 Item wise details for filling the application form are given below :

7.01 Item 2 : SCHEME NAME : Please write scheme name and code.

7.02 SCHEME CODE : Please write property category and code.

7.03 PROPERTY DESCRIPTION : Please write property description and code.

7.04 PAYMENT PLAN : Please write payment plan and code.

7.05 SALUTATION : Please write salutation and code.

7.06 NAME, ADDRESS & PIN CODE : These are self explanatory.

7.07 AGE : Fill are in the column (in years only) i.e. 32 No fraction of a year should be mentioned.

7.08 SEX : Write the code. See code table.

7.09 MARITAL STATUS : Fill the code with carefully from code table as applicable in your case against this column.

7.10 QUOTA CODE : Some categories of applications will be given reservation facility as per details given in Clause 7.00. Please fill in the code number of the quota category belonging to your reserved class. If you belong to more than one reserved category, fill only that quota code in which you want to put yourself. Attach sufficient proof, as mentioned below for getting reservation against quota, otherwise your application will be treated as in the general category. General category should fill 15 code against quota code.

(b) Applicant of reservation categories should attach certificate issued by the competent authority.

7.11 OCCUPATION CODE : These are given in Codes Table

7.12 PAY CODE : Please fill up code in pay plan.

7.13 INCOME CODE : No income limit for applications in this scheme.

8.00 ALLOTTEE'S SIGNATURE : This term is self explanatory. Unsigned application form is liable to be rejected.

9.00 No request in change of contents of application form shall be entertained after the closing date of scheme except change in address.
