In Italy, the regulatory regime for nuclear and radioactive transportation is based on:
! Law No.1860 of 31 December 1962
! Legislative Decree No. 230 of 17 March 1995

The first, Framework Law No. 1860 of 31 December 1962:
“Peaceful Uses of Nuclear Energy” introduced a general regime based on a series
of procedural requirements such as notifications and licences (also for the transport)

The second, basic text is Legislative Decree No. 230 of 17 March 1995. This Decree mainly deals with matters related to the safety of nuclear installations and the protection of workers, population and environment against the hazards of ionising radiation. This Decree provided, inter alia, for the implementation of the applicable Euratom Directives/Regulations.
General regulatory regime for radioactive transportation
With regard to the “transportation”, we mainly refer to art.21 of Legislative Decree No. 230 of 17 March 1995:
Art. 21: �Per il trasporto delle materie di cui all'articolo 5 della legge 31 dicembre 1962, n. 1860, e successive modifiche e integrazioni, effettuato in nome proprio e per conto altrui, oppure in nome e per conto proprio, ancorché avvalendosi i mezzi altrui dei quali si abbia la piena responsabilità e disponibilità, restano ferme le disposizioni ivi contenute. Nelle autorizzazioni previste da dette disposizioni, rilasciate sentiti l'ANPA e il Ministero dell'interno, possono essere stabilite particolari prescrizioni definite dall'ANPA. Con decreti del Ministro dei trasporti e della navigazione, sentita l'ANPA, sono emanate le norme regolamentari per i diversi modi di trasporto, anche in attuazione delle direttive e raccomandazioni dell'Unione europea e degli accordi internazionali in materia di trasporto di merci pericolose. I soggetti che effettuano il trasporto di cui al comma 1 sono tenuti ad inviare all'ANPA un riepilogo dei trasporti effettuati con l'indicazione delle materie trasportate. Con Decreto del Ministro dell'industria, del commercio e dell'artigianato, sentita l'ANPA, sono stabiliti i criteri applicativi di tale disposizione, le modalità, i termini di compilazione e di invio del riepilogo suddetto, nonché gli eventuali esoneri.�
Key points on application of Art. 21: The transport Company must be licensed (art.5 of
1860/62 as modified) with a Decree issued by the Ministry of Industry in conjunction with the Ministries concerned >> Authorized carrier.
The Authorized carrier can use “subcontractors” under its complete availability and responsibility.
The licence is for all mode of transport >> road, rail, air, sea, inland waterway.
The authorized carrier must send a quarterly notification of the performed transports.
The licence is not compulsory only in very few cases with particular contingencies >> from the practical point of view: it’s always applicable (even for excepted packages).
