    Public Hearing Notice

    This is to inform the public of the opportunity to attend a public hearing on the proposed Rural OperatingAssistance Program (ROAP) application to be submitted to the North Carolina Department ofTransportation no later than June 20, 2012 by the county ofMacon. The public hearing will be heldon July 10, 2012 at 6:00 p.m. at the Macon Countycommissioners meeting in the Macon CountyCommissioners Board Room of the Macon County Courthouse located at 5 W. Main St., Franklin,NC 28734. Macon County will provide auxiliary aids and services under the ADA for disabled personswho wish to participate in the hearing. Anyone requiring special services should contact Kim Angel(Transit Director) as soon as possible so that arrangements can be made.

    The programs included in the Rural Operating Assistance Program application are:

    1. Elderly & Disabled Transportation Assistance (EDTAP) Program provides operating assistance forthe public transportation of elderly and disabled citizens.

    2. Employment Transportation Assistance Program provides operating assistance for the publictransportation of persons with employment related transportation needs.

    3. Rural General Public (RGP) Program provides operating assistance for the public transportation ofpersons living in non-urban areas of the county.

    The period of performance for Rural Operating Assistance Program funds is July 1, 2012 through June30, 2013. The FY2013 individual program totals are:

    CERTIFIED STATEMENTFY 2013

    RURAL OPERATING ASSISTANCE PROGRAM

    County of MACON

    WHEREAS, the state-funded, formula-based Rural Operating Assistance Program (ROAP) administeredby the North Carolina Department of Transportation, Public Transportation Division provides funding for

    the operating cost of passenger trips and for other transportation services for counties within the state;

    WHEREAS, the county uses the most recent transportation plans (i.e. CTSP, CTIP, LCP) available andother public involvement strategies to learn about the transportation needs of agencies and individuals inthe county before determining the sub-allocation of these ROAP funds;

    WHEREAS, the county government or regional public transportation authorities created pursuant toArticle 25 or Article 26 of Chapter 160A of the General Statutes (upon written agreement with themunicipalities or counties served) are the only eligible recipient of Rural Operating Assistance Programfunds which are allocated to the counties based on a formula as described in the Program Guidelinesincluded in the ROAP application. NCDOT will disburse the ROAP funds only to counties and eligibletransportation authorities and not to any sub-recipients selected by the county;

    WHEREAS, the county finance officer will be considered the county official accountable for theadministration of the Rural Operating Assistance Program in the county, unless otherwise designated bythe Board of County Commissioners;

    WHEREAS, the passenger trips and transportation services provided with ROAP funds must beaccessible to individuals with disabilities and be provided without discrimination on the basis of nationalorigin, creed, age, race or gender (FTA C 4702.1A, FTA C 4704.1, Americans with Disabilities Act1990); and

    WHEREAS, the period of performance for these funds will be July 1, 2012 to June 30, 2013 regardlessof the date on which ROAP funds are disbursed to the county.

    NOW, THEREFORE, by signing below, the duly authorized representatives of the Countyof MACON North Carolina certify that the following statements are true and accurate:

    The county employed a documented methodology for sub-allocating ROAP funds that involved theparticipation of eligible agencies and citizens. Outreach efforts to include the participation of theelderly and individuals with disabilities, persons with limited English proficiency, minorities and lowincome persons in the countys sub-allocation decision have been documented.

    The county will advise any sub-recipients about the source of the ROAP funds, specific programrequirements and restrictions, eligible program expenses and reporting requirements. The county willbe responsible for invoicing any sub-recipients for unexpended ROAP funds as needed.

    The county will monitor ROAP funded services routinely to verify that ROAP funds are being spenton allowable activities and that the eligibility of service recipients is being properly documented. Thecounty will maintain records of trips and services for five years that prove that an eligible citizen wasprovided an eligible service or trip on the billed date, by whatever conveyance at the specified cost.

    The county will be responsible for monitoring the safety, quality and cost of ROAP funded servicesand assures that any procurements by subrecipients for contracted services will follow stateguidelines.

    The county will conduct regular evaluations of ROAP funded passenger trips and transportationservices provided throughout the period of performance.

    The county will only use the ROAP funds to provide trips when other funding sources are notavailable for the same purpose or the other funding sources for the same purpose have beencompletely exhausted.

    The county assures that the required matching funds for the FY2013 ROAP can be generated fromfares and/or provided from local funds.

    The county will notify the Mobility Development Specialist assigned to the county if any ROAPfunded services are discontinued before the end of the period of performance due to the lack offunding. No additional ROAP funds will be available.

    The county will provide an accounting of trips, services and expenditures in semi-annual reports toNCDOT Public Transportation Division or its designee.

    Any interest earned on the ROAP funds will be expended for eligible program uses as specified in theROAP application. The County will include ROAP funds received and expended in its annualindependent audit on the schedule of federal and state financial assistance. Funds passed through toother agencies will be identified as such.

    SUBJECT MATTER: Change Order #12 on the Little TennesseeRiver/Cartoogechaye Creek Trunk Sewer Project

    DEPARTMENT HEAD COMMENTS/RECOMMENDATION:

    Please see the attached change order on this project, which results in a netincrease of $25,519.23 and one additional day of contract time. Alsoattached is a letter from McGill Associates that summarizes the changes andincludes a recommendation for approval. The County Manager can providefurther details at the meeting.

    COUNTY MANAGERS COMMENTS/RECOMMENDATION:

    The project is complete with the exception of the reuse system. Thestate has allowed a modification to the original requirement that will beless expensive and more useful. With the approval of this change orderand budget amendment, we still have a balance in the project fund ofover $129,000. I feel this is more than enough to complete the entireproject with no additional local funds being required. I recommendapproval.

    This would be the first step in authorizing Prudential to offer our employees

    what is known as a 457 or deferred compensation plan. Prudential

    currently administers our 401(k) plan. We have an existing 457 plan

    provider but would simply like to offer employees another option. In

    addition to the resolution, there are two other documents attached for your

    information that provide highlights of the plan. If approved, the board

    would also need to authorize the County Manager to sign a third-partyadministrator agreement, pending review and approval by the County

    Attorney.

    ResolutionMacon County Board of Commissioners

    Whereas, the Macon County Board of Commissioners wishes to provide aqualified defined contribution plan to the employees of Macon County;and

    Whereas, the State of North Carolina has established the North CarolinaPublic Employee Deferred Compensation Plan, a qualified governmental

    Deferred Compensation Plan under Internal Revenue Code 457(b) forpublic employees of North Carolina.

    Therefore, be it resolved that the Macon County Board ofCommissioners has adopted the North Carolina Public EmployeeDeferred Compensation Plan, as known as NC Deferred Comp, underthe terms of the Plan Document and the Third-Party AdministratorAgreement. All employees shall become eligible to defer compensationimmediately.

    This includes full-time, part-time, and temporary employees. The Plan also includes elected and appointed officials along with

    Make up for lost time with catch-up contributions

    People are always concerned about saving enough for retirement. By enrolling in the NC Deferred Compensation Plan,you have two ways to catch up and contribute more:

    1. Standard catch-up allows you to, in the three calendar years prior to normal retirement age, contribute more

    up to double the annual contribution limitinto the Plan. The additional amount that you may be able to contribute under

    the Standard catch-up option will depend upon the amounts that you were able to contribute in previous years but did not.

    2. Age 50+ catch-up. If you will be age 50 on or before December 31, 2009, you may contribute an additional

    amount of $5,500 to the Plan.

    You cannot use the Age 50+ catch-up and the Standard catch-up in the same year.

    Rollovers into the NC Deferred Compensation PlanApproved balances from an eligible governmental 457(b), 401(k), 403(b), or 401(a)

    plan or an Individual Retirement Account (IRA) may be rolled over into the Plan.Take loans from your accountIf you are enrolled in the NC Deferred Compensation Plan, you can borrow from $1,000 to $50,000 or 50% of your total account

    balance (whichever is less). You have up to five years to repay a loan, or up to 15 years if the money is used to purchase your

    primary residence. You may only have one loan outstanding at any time, and there is also a $60 loan initiation fee.

    If you have a loan with the NC Deferred Compensation Plan and leave your job or are terminated, the remaining balance must

    be paid in full or it is deemed a distribution and is subject to ordinary income tax.

    Distribution optionsBefore retirementWithdrawals from your NC Deferred Compensation Plan account are never subject to a 10% federal income tax penalty. You are,

    however, subject to paying taxes at your current income tax rate, and are limited to the reasons for withdrawal. Your money can

    be withdrawn before retirement if you:

    Reach age 70; Have an unforeseeable emergency, as defined by the Internal Revenue Code;

    Become permanently disabled; Experience a severance of employment, as defined by the Internal Revenue Code; or

    Request an in-service transfer to purchase service credits with the Retirement System (this type of distribution is NOT subject to

    ordinary income tax).

    At retirement

    When the time comes for you to begin enjoying the next phase of your life, you have many options to choose from, including:Leave your funds in the Plan (subject to federal rules on minimum required distributions): You can

    leave your money in the NC Deferred Compensation Plan, even if you leave public employment.

    Take a full or partial systematic withdrawal (periodic payments to fit your need): You can opt to receive

    a lump sum, periodic payments, a partial lump sum with the remainder paid in periodic payments, or an annuity.

    Roll over your balance to an eligible governmental 457(b), 401(k), 403(b) or 401(a) plan, or to an

    Individual Retirement Account (IRA): If youre retiring or changing jobs, you may want to consider this option. Please

    keep in mind that if you roll over your Deferred Compensation Plan balance to a 401(k), 403(b), 401(a) plan, or an IRA,

    distributions taken before age 59 may also be subject to the 10% early withdrawal federal tax penalty. Please consult a

    tax professional for more information.

    In 2009, members can contribute

    a total of $16,500 to their

    NC Deferred Compensation Plan.

    MINUTES

    Chairman Corbin convened the meeting at 6:03 p.m. All Board

    Members, the County Manager, Deputy Clerk, Finance Director, CountyAttorney, members of the news media and interested citizens werepresent.

    ANNOUNCEMENTS: Commissioner Beale invited those in attendance toa Flag Day celebration at the Junaluska Masonic Lodge. CommissionerKuppers noted the passing of Dale Hough and spoke of Mr. Houghscontributions to the community and the Franklin High School footballprogram. The Finance Director explained that there were a number ofbudget amendments to add to the agenda, as well as an ordinanceamending the Fiscal Year 2011-12 budget.

    MOMENT OF SILENCE: Chairman Corbin asked those in attendance toobserve a moment of silence and to remember Mr. Hough and his family.

    PLEDGE TO THE FLAG: Led by Commissioner Tate, the pledge to theflag was recited.

    PUBLIC COMMENT: Catherine Robb spoke to the board regarding theproposed fire substation being considered for Mason Branch Road in theCowee district, and addressed the additional tax burden that it wouldplace on the community. She suggested that county officials consider

    placing a fire station near the Macon County Airport. Chairman Corbinrecognized David Nicholson with the North Carolina Association ofCounty Commissioners (NCACC), who provided the board with an updateon legislative matters affecting counties. Mr. Nicholson is an outreachassociate with the NCACC and covers the 49 westernmost counties, andnoted that Macon was kind enough to lend us Ronnie Beale, who willrise to the office of 1st Vice-President of the NCACC at the annualconference later this year.

    ADJUSTMENTS TO AND APPROVAL OF THE AGENDA: Upon a motionby Commissioner Kuppers, seconded by Commissioner Beale, the board

    voted unanimously to approve the agenda as adjusted, as follows:

    To add an appointment to the Macon County Child FatalityPrevention Team under Appointments as Item 12E, per ChairmanCorbin.

    TENNESSEE VALLEY AUTHORITY SETTLEMENT: The CountyManager informed the board that the Swain County Board ofCommissioners would be considering a resolution later this monthrequesting the states General Assembly to allocate funds received fromthe Tennessee Valley Authority (TVA) settlement to be distributed based

    on the settlement agreement. The resolution states that the AttorneyGeneral of North Carolina has settled a lawsuit with TVA in regards topollution emission in the Great Smoky Mountains and othermountainous areas of Western North Carolina, and the County Managernoted that Swain County officials are concerned where the funds fromthe settlement might end up going. The County Manager read theproposed Swain resolution for the record, which requests statelawmakers to adopt specific guidelines for the grant processes of thissettlement fund to specifically address the needs of the area affected bythe pollution generated by TVA and to give priority to those projects andproposals being submitted from the TVA Region. Upon a motion by

    Commissioner Beale, seconded by Commissioner Haven, the board votedunanimously to authorize the County Manager, County Attorney and theChairman to compose a letter in support of the Swain resolution.

    CONSIDERATION OF THE FISCAL YEAR 2012-13 BUDGETORDINANCE: The County Manager reviewed a list of minor changes tothe proposed budget, which the board members had agreed to byconsensus during the budget work sessions. Commissioner Tateexplained his recommendation that, out of five departments that hadsubmitted proposed tax increases, only the Mountain Valley VolunteerFire Department be granted the requested increase in its fire district tax

    rate for the upcoming year, with that rate increase being one-tenth of onecent. The County Manager briefed the board on the ongoingcompensation and classification plan study. While a full presentation isscheduled for the July 10th regular meeting, he explained that thepreliminary indications are that some county salaries are belowminimum levels while others are underpaid versus the average for thatposition. Funding for adjustments stemming from the study is notincluded in this years budget, he added, and requested that the boardconsider a one-year, one-time benefit of 24 additional hours of annualleave for each full-time employee as a means of showing appreciation.He explained that to do so would not require an additional appropriation

    in the new budget. The board agreed to consider this as a separate itemfrom the budget ordinance. The commissioners reiterated their supportfor all of the countys volunteer fire departments, and would be preparedto offer assistance mid-year if needed. Upon a motion by CommissionerBeale, seconded by Commissioner Kuppers, the board votedunanimously to approve the budget ordinance for Fiscal Year 2012/2013

    as presented, balanced with appropriations and revenues of$44,391,193. A copy of the ordinance (Attachment 1) is attached and ishereby made a part of these minutes. With regard to the extra annualleave, Commissioner Tate questioned the cost of covering shifts in thelaw and emergency services departments, and the County Manager said

    he and Finance Director discussed this and found a way to shift funds sothat no impact was foreseen. After further comments from boardmembers, Commissioner Kuppers made a motion, seconded byCommissioner Beale, to approve the 24 hours of additional annual leave,to be provided to employees in the upcoming fiscal year. CommissionerHaven said he sees this as a big expense that would cost the county inthe long run, adding he does not see it as a benefit and that employeeswould prefer more money to time off. The motion passed 4-1 withCommissioner Haven opposing.

    LEASE AGREEMENT WITH THE GEM & MINERAL SOCIETY OF

    FRANKLIN The County Attorney explained that the county wasconsidering a renewal of the lease for the old county jail on Phillips Streetwith the Gem & Mineral Society of Franklin for a period of five years at arate of $10 per year. He also explained that the required notice had beenpublished and that he had prepared a resolution and an updated leaseagreement with the society for the boards consideration. CommissionerBeale noted that the society had spent several thousand dollars duringrecent years to make improvements to the building. Upon a motion byCommissioner Beale, seconded by Commissioner Haven, the board votedunanimously to approve the resolution and lease agreement aspresented. A copy of the Resolution Leasing Property For a Term of up

    to Ten Years (Attachment 2) and the lease agreement with the Gem &Mineral Society (Attachment 3) are attached and hereby made a part ofthese minutes.

    LEASE AGREEMENT WITH THE FRANKLIN ARCHERS: The CountyAttorney explained that the county was considering leasing a portion ofproperty adjacent to South Macon Elementary School to The FranklinArchers, Inc. for use as an archery range, subject to the range beingopen to the public and reasonable regulations and rules. He hadprepared a resolution and a lease agreement for the boardsconsideration, noting in the resolution that the commissioners were

    declaring the property surplus as part of this action. The term of thelease is for one year at a rate of $10, with the county being named as anadditional insured under the archers liability insurance. CommissionerBeale also pointed out that the agreement calls for the archers use of theproperty to not hinder hay production there. Upon a motion byCommissioner Beale, seconded by Commissioner Tate, the board voted

    unanimously to approve the Resolution of the Macon County Board ofCounty Commissioners Declaring Property to be Surplus and Approvinga One Year Lease of the Same by Macon County to The Franklin Archers,Inc., as well as the accompanying lease agreement, as presented. Theresolution (Attachment 4) and the lease agreement (Attachment 5) are

    attached and are hereby made a part of these minutes.

    VIDEO SWEEPSTAKES UPDATE: The County Attorney updated theboard on legislative developments regarding the video sweepstakes issue.He explained that the General Assembly appeared to be moving in adifferent direction with regard to the machines, seeking to regulate andtax them as opposed to outlawing them. Owners of such establishmentswould be required to pay the state $2,000 for a privilege license, plus$1,000 per machine, with a certain percentage of the gross receipts goingto the county to be used for local law enforcement and for publiceducation. The proposed law would allow counties to impose a

    requirement for local licenses, with fees of up to $1,000 perestablishment and $500 per machine. He noted that he had prepared aresolution supporting the legislation for the boards consideration, if theboard was inclined to do so. Following discussion, the board membersagreed by consensus to remain neutral at this time, and took no action.

    RENEWAL OF CONTRACT WITH NEW SOUTH STRATEGIES, LLC:Upon a motion by Commissioner Tate, seconded by CommissionerKuppers, the board voted unanimously to renew the contract with NewSouth Strategies, LLC to provide economic development services to thecounty for the upcoming fiscal year, based on the terms and conditions

    of the current agreement.

    AWARDING OF BID FOR MOBILE GENERATOR LIGHT TOWERS:Emergency Services Director David Key explained that the county hadopened bids for mobile generator light towers on June 4th, and hadreceived three bids. He said the county was a member of a regionalgroup stretching from Cherokee County to Buncombe County that hadreceived a Homeland Security grant in 2009, with the county to bereimbursed 100 percent. The project has been bid out twice, because thefirst time the county received five bids, but the one bid that was 100percent compliant was above the value of the grant. Certain options

    were removed and the project was rebid. Of the three bids received, twowere 100 percent compliant, and Mr. Key recommended that the countyaward the low bid of $130,075 to Southeast Industrial Equipment. Thebid is for nine units, with Macon County to receive one of them. Upon amotion by Commissioner Tate, seconded by Commissioner Beale, theboard voted unanimously to award the bid as recommended.

    Budget amendments Approved the following budget amendments:#204 for the Sheriffs Department to appropriate drug forfeiture money inthe amount of $7,187 and controlled substance tax money in theamount of $1,502; #205 for E911 for the following items: to correctBudget Amendment #66, to reverse Budget Amendment #14, to transferpublic safety funds back to Fund 26 where they need to be tracked andreported and to allocate funds for general fund services; #206 for anumber of year-end amendments that cover numerous line items acrossvarious departments; (Revisions with corresponding numbers attached.)Tax releases There were no tax releases for the boards considerationat this time.     APPOINTMENTS: Airport Authority Upon a motion by CommissionerHaven, seconded by Commissioner Kuppers, the board votedunanimously to reappoint Gary Schmitt to the Macon County Airport

    Authority. Term of appointment is for six years, and will expire on June12, 2018. Board of Adjustment The board was notified that GaryDrake cannot accept the appointment to the Board of Adjustment madeby the commissioners at their meeting on May 15th, and that the vacancywill need to be readvertised. Health Board Upon a motion byCommissioner Beale, seconded by Commissioner Kuppers, the boardvoted unanimously to appoint Molly Phillips to a full-three term on theBoard of Health, with the term to run from July 1, 2012 to June 30,2015. Planning Board Upon a motion by Commission Haven,seconded by Commissioner Kuppers, the board voted unanimously toaccept the recommendation of the Town of Highlands Board of

    Commissioners and appoint John Underwood to the Macon CountyPlanning Board, replacing Alan Marsh. Term of appointment is for threeyears and will run from January 2012 through January 2015. ChildFatality Prevention Team Upon a motion by Commissioner Beale,seconded by Commissioner Haven, the board voted unanimously toappoint David Key, as an emergency services provider, to serve on the
