Terminology Probable Cause – Evidence such that a reasonable

person would believe a crime has been committed Arrest – the formal process of taking a person into

custody as a result of a warrant or based on probable cause to believe the person has committed a crime.

Referral – an official request by a law enforcement agency for a prosecuting authority to review an investigation for possible criminal charges

a person with a misdemeanor or gross misdemeanor. Complaint/Information – a document by which a prosecuting

authority formally charges a person with a crime. Sentence – consequences imposed on a defendant who pleads

guilty or is found guilty at trial Appeal – the review by an appellate court of legal issues in the

case Community custody/Probation – the supervision of a person to

ensure compliance with the conditions of the court’s sentence

Types of Hearings

Preliminary Appearance – the first hearing following an arrest during which a judge determines conditions of release

Personal Recognizance – the release of a defendant with conditions and their promise to reappear

Bail – the requirement that the person post a sum of money, or a bond, to ensure their appearance in court at future hearings

Types of Hearings Arraignment – the first appearance following the filing of

a formal charge where a plea is first entered Omnibus/Pre-trial – a hearing to determine case status,

identify issues, and set future hearings Motion hearing – a hearing where arguments are

presented to a judge on a legal issue Suppression Hearing – a motion hearing regarding the

admissibility of evidence, usually as a result of a contested search or an issue regarding a confession

Types of Hearings Change of plea – a hearing

where a defendant formally changes his/her plea from not guilty to guilty or NGRI

Levels of Crimes A Felony is a crime for which the

maximum punishment is over one year incarceration.

A Gross Misdemeanor is a crime for which the maximum punishment is one year in the county jail.

A Misdemeanor is a crime for which the maximum punishment is ninety (90) days in the county jail.
