LANGUAGE SERVICES IN THE MARYLAND COURTS

Programs

The Maryland Courts serve persons with Limited English Proficiency (LEP) in a variety of ways and contexts. LEP individuals may contact the courts or court-based services by telephone or in person. Courts serve the needs of LEP persons at the counter in clerk’s offices, in self-help centers, at initial appearances, and protective order proceedings, in Commissioner’s offices, in mediation, evaluations, educational programs, as well as in full-length trials. Interpreters are provided for all court proceedings, as well as many court-related services and events. Other resources are available for interactions at the counter, on the phone or in less formal settings.

There are four primary resources available to court personnel in serving the needs of LEP individuals.

THE MARYLAND COURT INTERPRETER PROGRAM The Maryland Court Interpreter Program provides trained and certified foreign language and ASL interpreters for in-person interpretation of court proceedings and court-related events.

STAFF INTERPRETERS Some Maryland courts have access to full-time Spanish-speaking staff interpreters. These interpreters are available for all courtroom proceedings as well as in settings outside the courtroom.

TELEPHONIC INTERPRETATION SERVICES Clerk’s offices, commissioners, self-help centers and other court personnel have access to Language Line accounts. Language Line provides telephonic interpretation upon demand for a wide range of settings. Telephonic interpretation is not generally used for courtroom proceedings, however, when in-person interpretation is preferred and recommended.

TRANSLATION SERVICES Finally, the Access to Justice Department of the Administrative Office of the Courts, provides translation services for all Maryland courts. The service is available primarily for public documents including forms, brochures and web content.

Recent Innovations

A number of important innovations were launched in Fiscal Year 2015 and in the first few months of Fiscal Year 2016 that will have important benefits for LEPs in Maryland.

IMPROVED INTERTERPRETER RULES AND PROCEDURES The Maryland Court of Appeals adopted revised Rules 1-332 (Accommodation Under the Americans with Disabilities Act) and Rule 1-333 (Court Interpreters), which took effect July 1, 2015.

One Request Only for Parties. The revised rule provides that parties need only request an interpreter one time. The court will provide an interpreter for each subsequent proceeding without requiring a separate request for each event. Since victims and witnesses are not required at every court event, they must continue to submit a request each time they need one. For parties, however, the procedure is streamlined and simpler.

Interpreters for Court-Related Events. The rule now specifies that, in addition to trials, hearings and matters held in open court, the court will provide interpreters in certain court-ordered services or events that are delineated in an administrative order of the Chief Judge.

CONTINUING EDUCATION REQUIREMENTS FOR INTERPRETERS The Maryland Judicial Council approved a proposal submitted by the Court Access and Community Relations Committee to require Maryland court interpreters to earn 16-hours of continuing education units every 2 years. The new requirement takes effect January 1, 2016.

ENHANCED TRANSLATION SERVICES The Access to Justice Department created a new web page to promote and encourage courts to take advantage of its translation services. See http://mdcourts.gov/interpreter/translationservices.html. Courts can use a newly developed form to request translation projects and the department has seen an increase in the demand for this service. Recently department staff met with staff from District Court Headquarters, the Department of Family Administration, and the Office of Communications & Public Affairs to coordinate the management of translated documents.

MULTILINGUAL SIGNAGE During Fiscal Year 2015, the Access to Justice Department made grants to 13 District Court jurisdictions and 3 Circuit Courts to fund the creation and installation of multi-lingual signage. The department’s Court Interpreter Program staff worked with local administrative clerks and court administrators to coordinate the translation of sign content which was funded directly by the department. Photos of some of the signs produced are included in the Appendix.

Court Interpreter Program

The Access to Justice Department of the Maryland Administrative Office of the Courts manages the Court Interpreter Program. Program staff recruit, train, test and certify interpreters to meet the needs of LEPs using the Maryland courts.

REGISTRY Program staff maintain the Maryland Court Interpreter Registry. The registry provides court personnel with an easy reference to identify and engage interpreters for court events. The registry currently includes 565 interpreters, speaking 72 languages.

WORKSHOPS Prospective interpreters have two opportunities a year to participate in programs and workshops designed to help them gain certification. Twice a year program staff offer the following:

• Introductory Workshop • Language Proficiency Interviews • Written Examinations • Two-Day Orientation Workshop • Oral Examination Prep Workshop • Certification Examinations

In addition, specialty courses are offered throughout the year. In Fiscal Year 2015, programs were offered on the following topics:

October 18, 2014 Illegal Drugs Information & Terminology

June 6, 2015 Ethical Challenges

June 27, 2015 English/Spanish Criminal Procedure Law Terminology- Latin American Reforms

Finally, program staff support and train local court interpreter coordinators in each District and Circuit Court. During Fiscal Year 2015 the following program was offered:

CERTIFICATION Interpreters who have passed the written exam and a language proficiency interview are considered eligible, and may serve in court settings when certified interpreters are not available. Certified interpreters, those who have passed the written exam, the language proficiency interview and an oral certification exam, earn a higher hourly rate. Finally, there are some rare or unusual languages for which the program does not offer an exam, or where there are no certified interpreters available. These non-certified interpreters may be engaged by the courts and are entitled to an established rate. ASL interpreters are certified by an outside entity and all Maryland ASL interpreters are certified by either the Registry of Interpreters for the Deaf or the National Association of the Deaf.

Program staff offer certification in 13 languages. Staff offer several workshops to help prospective interpreters prepare for the certification examination. Program staff proctor the certification exam. Exams are offered in the following languages:

• Arabic • Bosnian/Serbian/Croatian • Cantonese • French • Haitian-Creole • Korean • Mandarin • Polish • Portuguese • Russian • Spanish • Turkish • Vietnamese

PROGRAM STATISTICS The Appendix to this report includes data reflecting Court Interpreter Program usage in the Circuit and District Courts. This data does not include the impact of staff interpreters. Courts with lower interpreter usage rates may be benefiting from the presence of staff Spanish interpreters.

District Courts used in-person interpreters for three times as many events (17,323) as Circuit Courts (5,744). Not surprisingly, however, Circuit Court interpreter costs exceeded those of District Courts, presumably because those court events are longer and more complex.

Spanish represents approximately half of all Court Interpreter Program usage in the Circuit Courts.

Although Spanish is generally the language in highest demand for all types of interpreter services (in-person and telephonic), there are regional differences. As aforementioned, some jurisdictions may report lower usage of Spanish-speaking in-person interpreters because they have on-site staff Spanish interpreters. Still other regional differences are due to the presence of unique local populations.

For example, Frederick County Circuit Court expenditures for in-person court interpreters show a high demand for ASL and Burmese. Frederick County is the home of the Maryland School for the Deaf and has a large deaf population. Recent articles have also noted that Frederick County, along with Howard County, have high numbers of Burmese and Chin (from Western Burma) residents.

Over three quarters of the Court Interpreter Program expenses in Prince George’s County Circuit Court are for services in Spanish, while other jurisdictions, like Baltimore County report more diversity in language needs.

As in Circuit Courts, the demand for in-person interpreter services in District Courts is highest in Spanish, which represents over 50% of all funds expended on the program.

Like Circuit Courts, there are significant regional differences among District Court jurisdictions.

Montgomery County District Court meets the needs of an extraordinarily diverse population, for example, and provided in-person interpreters in 49 different languages during Fiscal Year 2015.

Staff Interpreters

Maryland courts employ 21 Spanish-speaking staff interpreters. These full-time employees are available to interpret on demand for court proceedings, court-related services and between court staff and Spanish-speaking court users. Eleven (11) staff interpreters are located in District Court locations; ten (10) are located in Circuit Court locations.

Telephonic Interpretation Services

The Maryland Judiciary contracts with Language Line, a telephonic interpretation vendor, to provide phone-based interpreter services in all languages. Program staff provide Language Line posters and desk reference cards, and provide ongoing support and training in how to use telephonic interpretation services. Telephonic interpretation is not generally available for in-court proceedings when in-person interpretation services are recommended and preferred.

District Court Commissioners are by far the highest users of telephonic interpretation.

Circuit Courts

Telephonic interpretation appears to be used more heavily by some courts than by others. Although some jurisdictions may benefit from in-house staff interpreters, the data suggests that court personnel need additional training to ensure they are using telephonic interpretation when necessary to meet the unscheduled and less formal needs of LEPs that appear in Maryland courthouses.

Telephonic interpretation is used in Circuit Courts for Spanish speakers, much more so than any other language. Spanish represents over 80% of all telephonic interpretation in the Circuit Courts.

District Courts

District Courts similarly are using telephonic interpretation primarily in Spanish, but with more diversity in clerk’s offices than Circuit Courts. Commissioner’s use is very heavily focused on Spanish.

LANGUAGE SERVICES IN THE MARYLAND COURTS

Translation Services

The Access to Justice Department recently developed a new web page featuring the department’s

translation services and has taken a number of steps to enhance the handling of translation project

requests. The Court Interpreter Program of the Access to Justice Department provides limited ongoing

translation services to the courts. Currently, these services are limited to the translation of official court

forms, signs, brochures, court instructions, and court web pages. To ensure quality and consistency in the

translation process, the Court Interpreter Program utilizes Morgan Language Services to handle all

translations.

While interpreting involves oral rendition, translating involves taking a written text in a source language

and providing a written translation in the target language.

The Maryland Judiciary has numerous District and Circuit court forms and brochures translated into

Spanish. A smaller number of forms and brochures is in the process of being translated into French,

Chinese, Korean, and Russian. Limited English proficient individuals can find these forms on the Court

Forms page.

A new notice was posted on the main courts webpage, www.mdcourts.gov, to help LEP individuals find the

multilingual content available on the website. By clicking on “Need an Interpreter” in English or any of five

languages (Spanish, Chinese, French, Korean or Russian), the user is directed to special information in that

language about how to request an interpreter. Eventually, those links will take users to a “landing page” in

that language with key information about the courts, including how to request an interpreter. The landing

page is currently available in Spanish. A Russian version has also been prepared and is awaiting posting.

The other languages are in the process of being translated for posting.

The Access to Justice Department has also begun translating the scripts for all self-help videos. Videos are

currently captioned in English and Spanish, and English and Spanish scripts are posted along with the

videos to aid those with sensory impairments. Our goal is to provide translated scripts in all priority

languages, and eventually to produce versions of each video narrated in Spanish and other key languages.

The department recently hosted a meeting with District Court Headquarters, Family Administration, and

the Office of Communications & Public Affairs, to plan for the effective management of translated content.

Maryland Court Interpreter Program

• Certifi cation exams in 13 languages: Arabic, BSC (Bosnian-Serbian-Croatian),Cantonese, French, Haitian-Creole, Korean, Mandarin, Polish, Portuguese, Russian,Spanish, Turkish, and Vietnamese. Certifi ed court interpreters in 11 languages.

• 72 languages listed on the Court Interpreter Registry for a total of 565interpreters. There are 320 eligible interpreters and 245 certifi ed interpreters(including 75 ASL interpreters.) List containing interpreter names is available forhospitals, schools, other public agencies, and law fi rms.

• Largest language need in the courts is for Spanish. Maryland has 19 Spanish courtinterpreters on staff in the Circuit and Districts Courts. Lesser language requestsare for Korean, Russian, Mandarin, Cantonese and Vietnamese.

• Translations of 51 District Court and Circuit Court forms have been completedin Spanish. In addition, brochures and posters have been translated for displayin court facilities. On-going forms translation continues in Russian and French.Other languages to follow.

• Twice yearly Introductory Workshops, Language Profi ciency Interviews, WrittenExaminations, a Two-Day Orientation Workshop and Certifi cation Examinations.In addition specialty classes are scheduled including DNA and Forensics, CrimeScene Investigation, Domestic Violence and Sexual Abuse, Weapons, Drugs andIllegal Substances, and Gangs.

• To assist prospective interpreters, there are intermediate skills buildingworkshops, language skills classes for certifi ed Spanish interpreters andexamination preparation classes. An Arabic skills building workshop was held forthe fi rst time. Note-taking classes were delivered. To assist court employees, aninterpreter coordinator workshop was delivered by staff this Fall.

• Interpreters pay a modest fee for workshops and certifi cation exams. Fees aredeposited in the general fund. For FY 2015 to date: $16, 250 has been collected;FY 2014: $18,050 and in FY2013: $17, 060. Since FY 2008: $172,060.

Multiliingual Signage In Fiscal Year 2015 thirteen Maryland District Courts and three Circuit Courts were awarded grants to produce multi-lingual signage to enhance the accessibility of courts for persons with Limited English Proficiency.
