The right of appeal by environmental protection organisations


Le droit d'appel des organisations de la protection de l'environnement

Loi fédérale Suisse sur la protection de la nature et du paysage (LPN)

du 1er juillet 1966 (Etat le 1er juillet 2007)

Art. 12

1 Ont qualité pour recourir contre les décisions des autorités cantonales ou fédérales:

a.les communes;

b.les organisations qui se vouent à la protection de la nature, à la protection du paysage, à la conservation des monuments historiques ou à des tâches semblables, aux conditions suivantes:

1.l’organisation est active au niveau national,

2. l’organisation poursuit un but non lucratif; les éventuelles activités économiques servent le but non lucratif.

Art. 12

1 The following bodies have the right to appeal against decisions of cantonal or federal authorities:

a the municipalities

b the organisations that act for the protection of nature, for the protection of landscape, for the conservation of historical monuments or for similar duties, if the fulfill the following conditions:

1.the organisation is active on national level,

2.the organisation's aim is not to male any profit; economic activities help exclusively the non-profit-goal.
