An event to note this month is Veteran’s Day at the Solway Aviation Museum, Carlisle Airport on Sunday 4th July. A great day out for the family where you can: meet serving and retired service veterans, see the Battle of Britain Memorial Spitfire flypast and Jet Provost (weather permitting), see live Jet Engine runs & WW2 re-enactments, access the Vulcan Bomber and have free access to the Museum & Aircraft (see page 18).

Thanks as always to our columnists; Frank Lee has compiled a listing of all the new properties on the market in Carlisle since the last issue (see page 8/9), Kerry Steel on Mortgage Rescue, David Ellwood of Cumbria Trading Standards on the changes to HIPs and Austen Skinner on adapting your home as you grow older.

Energy Performance Certificates (EPC) and Home Information Packs (HIP)Selling or renting your house. Responsibilities of seller or landlord.

Changes announced on 20th May affect the obligation to have a HIP for a residential property. For residential properties being sold, a HIP no longer has to be available when a property is first marketed. An EPC is still required wherever a residential property is marketed for sale or rent.

• The seller/landlord is responsible for providing the EPC and is responsible if an EPC is not available. • Estate agents have liability to ensure EPC has been commissioned for residential property being sold before marketing.• Estate Agent and Seller responsible to take reasonable efforts to obtain EPC within 28 days of residential property being marketed.• The EPC has a life of 10 years and can be reused within that time. • A copy of the EPC should be provided at the earliest opportunity. • An EPC should be commissioned immediately a property is put on the market.• An EPC should be available when a property is being viewed.• An EPC should be available when fuller written details are provided in property brochures and advertising.• A copy of the EPC should be provided to the purchaser or tenant on completion.

LEGACY ISSUES

PAYMENT FOR HIPS (already provided or in process of being created)

As a result of the changes there will be a number of sellers who have obtained a HIP but not yet paid for it and a number who have ordered a HIP that has not been completed. The Following examples may be of assistance in understanding any liability. Please note however that only a Court can finally determine liability. This is guidance only, and should not be taken as any final determination of the legal position.

• Liability for anyone whose house is: being marketed; having received a HIP but not paid; and house not yet sold. (This would cover situations where the Estate Agent provides a pay later facility for the HIP or any situation where the payment has not been made)

The seller still has liability to pay the full fee in accordance with the contract. The contract was made at a time when the HIP was necessary to market and the fact that it is no longer necessary does not remove the right to be paid. The position is the same whether the property has been marketed only since 20 May 2010 or for a far longer period.

• HIP has been ordered but the property not yet been marketed.

The contract has been frustrated and the liability of the parties is then subject to common law and provisions of Law Reform (Frustrated Contracts) Act 1943.

In simple terms this means that both parties are relieved of their obligations under the contract. With provisos noted below both parties can walk away from performing the contract. There is no obligation to produce the HIP and no obligation to pay. Any money paid in advance can be recovered.

HOWEVER

If it is just in the circumstances, Consumer is liable for expenses incurred before contract was frustrated. This is limited to the actual expenses incurred and would not include any uplift charged by Estate Agent or other intermediary involved. It would cover admin expenses and overheads.
