What you should know aboutalternative dispute resolution

options in divorceQ: My wife and I are thinking about ending

our marriage, but we’d like to avoid a “knockdown drag out” divorce. Is that possible?

A: Yes. There are several options available, including collaborative divorce, early neutralevaluation and mediation.

Q: What is collaborative divorce?A: Collaborative divorce, also called collabo-

rative dissolution, is a “team” process in whichthe parties engage attorneys and other profes-sionals to assist in the negotiation and settle-ment of their dispute. Collaborative law usesan “interdisciplinary model,” meaning thatthird-party “neutrals” (such as CPAs, valuationexperts, child psychologists and mental healthprofessionals) are engaged to assist the team. The goal is not to just get signatures on the dot-ted line, but also to address underlying issuesin reaching a lasting agreement.

Q: What are some advantages and disad-vantages of a collaborative divorce?

A: One advantage of a collaborative divorceis that it focuses negotiations on helping partiesto communicate effectively over the long term. This generally minimizes the negative impactupon children. It is also less expensive, bothfinancially and emotionally, than litigation. Allinformation is shared and all negotiations takeplace in face-to-face “four-way” meetings.Generally, these meetings foster trust becausethe other spouse’s attorney does not function asan adversary. Each of the lawyers is retainedfor the limited purpose of helping the clientsreach an acceptable settlement without litiga-tion or threats of litigation. This allows thelawyers to focus on creative solutions ratherthan on preparation for trial.

One disadvantage is that, if the collaborativeprocess fails, neither lawyer who was engagedin the process can continue to represent theclient. Therefore, each client must retain newcounsel for litigation. At any time during col-laborative negotiations, each side has the uni-lateral right to terminate the process and forcethe other party into litigation.

Q: What is early neutral evaluation?A: In early neutral evaluation, the parties

meet with a neutral third party who has experi-ence in family law. Both parties present infor-mation and the neutral offers each party a con-fidential opinion regarding the likely outcomeof the case and an analysis of strengths andweaknesses of each side’s arguments. The pur-pose of this evaluation is to give both parties arealistic view of the case and to encourage set-tlement.

Q: What are the advantages and disadvan-tages of early neutral evaluation?

A: One advantage is that the neutral partyacts as an educator, consultant and evaluator, which can encourage the parties to explore abroad range of creative options and solutions. An early neutral evaluation can give both par-ties an objective assessment of the issues athand and the relative strengths and weakness-es of each party’s position, which can help theparties reach a fair and reasonable settlement. The neutral does not provide any individual, personal legal advice to either party. Also, theneutral does not draft any pleadings or otherdocuments for either party. At the end of thisprocess, the parties are referred to otherlawyers for personal advice and drafting ofdocuments.

In cases where parties are in high conflictor where there are personality disorders ordrug or alcohol addiction issues, this optionmay not be appropriate or effective. Since theparties’ lawyers generally do not participatedirectly in the negotiations, any agreementthat was reached may be scuttled once eachparty receives her or his lawyer ’s critique.

Q: What is mediation?A: Mediation is a process in which a medi-

ator facilitates communication and negotia-tion between parties to help them reach a vol-untary agreement about their dispute. Themediator is not authorized to make a decisionfor the parties.

Q: What are the advantages and disadvan-tages of mediation?

A: A neutral mediator facilitates resolutionby direct, face-to-face negotiations betweenthe parties. Also, the parties retain controlover decision- making and consider eachparty’s needs and interests, along with awider variety of options. Because mediationdoes not focus on evidence and the law as inan adversarial process, the potential for long-term conflict between the parties may bereduced. Costs for the participants also maybe lower.

A disadvantage is that the mediator cannotindividually counsel either party. The media-tor is, for example, limited in getting neces-sary information if one party is reluctant toprovide it. As with the early neutral evalua-tion process, any agreement may be scuttledwhen each party receives her or his lawyer ’scritique, since the parties’ lawyers generallydo not participate directly in negotiations.

Winter is fast approaching:Time to weatherize your homeWinter is fast approaching, and cold

weather normally brings high electricbills. Whether the temperature outside isextremely hot or extremely cold, yourhome’s heating and cooling system needsto work extra hard. During seasons of nor-mally high electric bills, a little workbeforehand could potentially save yousome headaches and some money. Thereare a number of things that can be doneregularly that cost no money at all and bydoing so you can reduce the amount ofunnecessary energy use.

1. Windows provide a great deal ofbeauty and entertainment for a home. They offer incredible views depending onwhere your home is located. They alsoallow large amounts of cold air into yourhome if not properly insulated. Duringthose winter sunny days, keep the blindsopen to allow the sun’s rays to heat yourhome. At night, shut the blinds to helpinsulate against the cold air. You can alsoplace plastic on the inside or outside ofyour windows. Be sure to tape the plasticsecurely to prevent any air leaks.

2. Many homes in our area have tradi-tional fireplaces, and these can potentiallybe huge energy losers. When not usingfireplaces be sure to close the damper asan open damper pulls heat out of thehouse and up the chimney. Before closingthe damper, be sure that you don’t haveany smoldering embers. If you have a fire-

place and don’t use it, block the chimneyoff with a piece of rigid insulation. Be surethe insulation fits snugly into the chimneyto prevent any air leaks.

3. Don’t linger in the shower. Reducingthe amount of time you spend in theshower can save hundreds of gallons of

water per month for a family of four.Normally, showers account for roughly2/3 of a home’s water heating costs. Bycutting your shower time in half, you canpotentially reduce your water heatingcosts by 33 percent.

If you live in a mobile home there areseveral steps you can take to lower yourelectric bills in the winter. Many oldermobile homes do not have the best insula-tion, and it is recommended that you haveyour insulation checked by a professional.

Make sure that your return air duct istightly sealed as outside air can be pulledin from the smallest crack. Since mostductwork in mobile homes is found underthe home it is suggested that skirting beplaced to at least ground level. If possible, place the skirting a couple inches belowground level to get the most out of yourheating and cooling systems. This methodalso helps to prevent small animals fromdamaging the duct system insulation orthe ductwork itself.

By taking a few extra precautions youcan start saving money on your electricbill today. For additional tips on how youcan save electricity and money, visitwww.buckeyerec.com

By taking the “Energy Savings HomeTour” on the website, you can easily calcu-late the amount of energy that you canpotentially save simply by making a fewminor adjustments in your home.

February 2011 Gives up yoga due to arthritis

June 2011 Undergoes double knee replacement

August 2011 Completes rehabilitation therapy

September 2011 Experiencing new twist on life

Living proofthat replacing a knee is better than replacing the activities you love.Cheryl Gaus wasn’t going to let a family history of arthritis stop her from doing the things she loves. So when her orthopaedic surgeon recommended total knee replacement as an option, she jumped (rather gingerly) at the chance. In fact, Cheryl was so eager to get back on her yoga mat and back to her other activities, that she had both knees

replaced at the same time. And with the encouragement of her physical therapists and her husband, Mike, Cheryl is now twisting and turning to her heart’s – and knees – content. Living proof that new knees can bring back the good old you. To learn more about Adena’s comprehensive orthopaedic services, visit us online at www.adena.org/ortho.

Austin Baldwin paced theVikings with eight points, while Herrell and ZaneWheeler had seven and sixpoints respectively.

Coach Persin was pleasedwith the effort of Hammondand Gaines, as well as KyleLove (nine points) off the bench.

McCown was touted by theAMRA in 2011, but indicated“I honored my first year com-mitment to stick with an open-tire rule.”

“As the season progressed, Isaw the value of the AMRA inour particular area and think itwill be a great deal for ourspeedway, the AMRA, and ourdrivers competing for theAMRA championship. Most ofall, I think it will stabilize ourcar counts for the quality ofshows we want to put on forour fans,” said McCown.

“It is a great honor to haveJackson County Speedway jointhe AMRA family,” said AMRApresident Larry Keefer. “Bradwent out on a limb to start arace track in tough economictimes. Having brought thetrack back to life is a monumen-tal accomplishment, and havingJackson County in the AMRA isa major anchoring point for boththe speedway and the AMRA.”

The close proximity toAtomicSpeedway now gives AMRAdrivers atAtomic Speedway (for-merly K-C Raceway) a place torace on Fridays, thus givingAMRA drivers there a betterchance to compete for the nation-al point money.

Additionally, under thesame rules package, JacksonCounty drivers have aSaturday-night venue.

McCown added, “Obviously,I see a lot of value in having theAMRA at our speedway. Mostof all, we can concentrate on onerules package and stay in linewith the AMRA motto of ‘main-taining a level playing field’ forall of our drivers. I can’t wait forthe 2012 racing season.”

Santa Claus visits WellstonYou better watch out, you better not cry, better not pout, I’m telling you why, Santa Claus is

coming to town. Over the weekend Santa Claus made his rounds in Jackson County. One of hismany stops was in Wellston. He was in the annual Wellston Lion’s Club Christmas parade. Afterthe parade Santa made a stop at the city building so the children could visit with him and tell himwhat they wanted for Christmas. Hayden Steele pictured above is checking out his bag of candyfrom Santa. Wellston Lion’s Club member Charlie Patton stated, “The Lions Club has done theChristmas parade for 29 or 30 year now.”
