Canisteo Wind Energy LLC (CWE) submits the enclosed Second Supplement of its Application for a Certificate of Environmental Compatibility and Public Need (Second Application Supplement) authorizing the CWE wind energy facility interconnection transmission line. The Second Application Supplement is comprised of those Application exhibits that have been revised to reflect adjustments CWE has made to the route of the proposed transmission line and pole locations resulting from consultations with the parties and landowner preferences. The route alignment adjustments reduce impacts to regulated wetlands, avoid impacts to protected bird habitat and address landowner concerns. Portions of the Second Application Supplement were posted on DMM 40 on October 27, 2021 and emailed to the active parties.

Copies of the Second Application Supplement are being provided to the recipients required by Public Service Law § 122(a)(2) and 16 NYCRR 85.2(9) and have been sent by email to the parties in this case who have consented to electronic service and by regular mail to those who have not.

Pursuant to Article VII of the Public Service Law On Monday, November 8, 2021, Canisteo Wind Energy LLC will submit to the New York State Public Service Commission the Second Supplement to its Application for a Certificate of Environmental Compatibility and Public Need authorizing CWE to construct, own, operate and maintain a new, overhead, 115 kV electric transmission line and associated equipment (Transmission Facility). The Transmission Facility will interconnect the planned Canisteo Wind Farm to New York State Electric and Gas Corporation’s (NYSEG) existing 115 kV Bennett Substation in Hornellsville. The Transmission Facility will start at the Canisteo Wind Farm collection substation to be located in the Town of Jasper, Steuben County, and be routed through the Towns of Jasper, Canisteo, and Hornellsville, the Village of Canisteo, and the City of Hornell and deliver electricity to the Bennett Substation. The Second Supplement reflects changes to the Transmission Facility route proposed in the original Application that reduce environmental impacts and accommodate the preferences of landowners from whom CWE is leasing property rights. CWE’s separate application for authority to construct theCanisteo Wind Farm was granted by the NewYork State Board on ElectricGeneration Siting and the Environment pursuant to Article 10 of the PublicService Law in Case 16-F-0205 on March 13, 2020. The Article VIIApplication is being reviewed by the NYSPSC, separately from the Article10 Application, in PSC Case 19-T-0041.

The purpose of this Notice is to apprise the public that CWE is consideringseveral minor changes to the originally proposed transmission line route.The changes are intended to address locations along the original route inwhich CWE was unable to secure required easements from property ownersand locations which were located in or adjacent to regulated wetlands. Theroute now being proposed will locate a 2,000 foot section within the southend of the City of Hornell on property owned by the Hornell IndustrialDevelopment Authority. The proposed Transmission Facility will be locatedwithin a new 80-100 foot right-of-way, primarily on easements on privately-owned land traversing 14.6 miles generally in a southeast to northwestdirection from the proposed Canisteo Wind Farm collection substation tothe Bennett Substation, passing through the Towns of Jasper, Canisteo, andHornellsville, the Village of Canisteo, and the City of Hornell.

The Finger Lakes Wine Festival, orig-inally scheduled for July 9-11, has beencanceled due to New York’s COVID-19guidelines, track officials said Friday.

The popular wine tasting event isnow scheduled to be held next July 8-10,2022 at Watkins Glen International.

Several school bus drivers in theGreece Central School District have fileda federal lawsuit regarding unemploy-ment benefits that ultimately could im-pact countless other school employeesacross New York.

The bus drivers received unemploy-ment benefits last summer, when sum-mer school was canceled and the courseof COVID-19 was far from clear. Earlythis year, though, the state Departmentof Labor informed them that they didnot in fact qualify for those benefits andwould have to pay them back, in sumsranging from $4,200 to $8,200.

The lawsuit, filed against the statelast week in federal court, calls that amisreading of labor law and asks a judgeto recognize a wide class of possibly af-fected employees: namely, all non-edu-cator school employees such as busdrivers, security guards and cafeteriaworkers who may have sought unem-ployment benefits last summer andbeen denied.

“They followed the rules, they did ev-erything right,” said Peter Dellinger, anattorney with the Empire Justice Centerin Rochester who is representing theplaintiffs. “And then they get these no-tices saying, you owe us $8,000; youowe us $4,000.”

Generally speaking, non-educatorschool workers are not entitled to un-employment benefits during the sum-mer as long as their employer provides“reasonable assurance” that they will beable to resume their job in the fall. “Rea-sonable assurance” is a specific legalterm with certain criteria to be met.

The lawsuit alleges procedural viola-tions were made by both the school dis-trict and the Department of Labor. Morebroadly, though, it argues that it was im-possible in June 2020 for a school dis-trict to assure a school bus driver that heor she would be able to begin work inSeptember, given the pandemic.

“Every school in New York wasclosed; nobody knew when they weregoing to reopen,” Dellinger said. “How isthat reasonable assurance of a job?”

Most of the plaintiffs in the lawsuitare senior citizens who work as busdrivers to supplement their otherwisefixed income. They have filed adminis-trative appeals of the state’s attempt to

recoup their money, which they al-ready spent last summer to pay theirbills.

“These are not wealthy people whocan write you a check for $5,200 to-morrow,” Dellinger said.

There are six plaintiffs from Greece,but countless non-educators fromacross New York are likely in a similarsituation and could possibly have theirrepayment requirements dismissed.

Dan DiClemente, president of thenon-educators union BENTE in theRochester City School District, esti-mated that a few dozen members havegotten claw-back letters regarding un-employment money they received lastsummer.

The Department of Labor declinedto comment but said federal law re-quires it to attempt to recoup overpay-ments. It notified people last weekthat they can seek a waiver for repay-ment as long as they did not commitfraud.

In March, the state reported about$115 million in unemployment over-payments in 2020, about two tenths ofone percent of the $69 billion it paidout. Some state legislators have urgedthe administration not to recoup thatmoney except in cases of fraud.

The Greece Central School Districtis not named in the lawsuit. The law-suit alleges that the state’s recent inel-igibility determinations were “basedon (Greece’s) protest of unemploy-ment benefit payments.”

A spokeswoman said in a state-ment: “We communicated regularlywith staff during the pandemic andprovided them with written informa-tion about who was eligible for unem-ployment, even providing filing assis-tance to those who qualified. We alsomade clear to 10-month employeesthat even if they traditionally workedin our summer programs, summer em-ployment is determined on a yearlybasis and is not guaranteed.”

The lawsuit is being led by the Em-pire Justice Center and the Universityof Buffalo School of Law’s COVID Lawand Community Engagement Clinic. Itseeks class action status but no newmonetary reward.

“Our clients aren’t looking for anymoney; they already got the money,”Dellinger said. “They just want to keepthe money they got.”

The Transmission Facility will enable CWE to deliver renewably generated electricity to the electric power grid. The application was docketed by the NYSPSC in Case 19-T-0041. Copies of the Application were provided to area public libraries and municipal offices for access to the public and have been available for review on the NYS PSC and CWE websites. Following the filing of the Application, CWE has consulted with staff of involved state agencies and is now considering several adjustments to the Transmission Facility route. On or about May 7, 2021, CWE will file a Supplement to its 2019 Application addressing the changes associated with the adjusted route. CWE has concluded that the adjusted route, located on easements negotiated with owners of private property, will avoid land use conflicts, minimize environmental impacts, protect the public, and assist in the achievement of the state’s renewable energy goals. The enclosed map depicts the route now under consideration as well as the originally filed route with property parcel boundaries shown. Those of you who have entered into easement agreements with CWE, of course, are well aware that the Transmission Facility, if permitted, will be located on your property. For others, the enclosed map will enable you to determine how the Transmission Facility, though not located on your property, may affect your property. You are entitled to participate as a party in the formal proceeding and to participate in settlement negotiations in which CWE’s Application and the upcoming Supplement, and a settlement agreement (the Joint Proposal) will be reviewed before coming before the NYS PSC for a decision. You can become a party to this proceeding by completing and submitting a “Party Status Request Form,” within 30 days of receipt of this notice. A Protective Order was adopted by Ruling Adopting Protective Order on December 31, 2019 in this case to protect information claimed to be confidential from public dissemination. Only limited confidential information, primarily concerning the location of archeological resources and threatened and endangered species, has been filed in the record of the proceeding. The Protective Order is binding upon all parties, their attorneys, consultants, and agents.
