Whereas the first meeting of the newly elected members of the Village Panchayat, Salem, in Bicholim Talukiol. (herein­after called as the "said Panchayat") was fixed on 22-12-81, by the Director -of Election to elect the Chair.man and the Vice-Chairman of the said Panchayat under sUb-section (1) of Section 19 of the Goa, Daman and Diu Village Panchayats' Regulation 1962 (9 of 1962) (hereinafter called the "said Regulation"); .

And Whereas no valid nominations were received by' the presiding officer and consequently the meeting had to be adjourned;

And Whereas again in the subsequent adjourned meetings held on 29-12-81, 19-1-82 and 28-1-82, no valid nominations were received by the presiding officer;

And Whereas in pursuance of sub-section (1) of section 19 of the said Regulation, it is incumbent on the members of the Panchayats to elect from among themselves, the Chair­man and the Vice-Chairman at its first meeting after election;

And Whereas the failure of the members to elect the Chairman and the Vice-Chairman, tantamounts to wilful and persistent default in the performance of the duties imposed on them by or under the said Regulation.

And Whereas all the members of the said Panchayat were served with notices of even number dated 29-4-1982, to show cause as to-why the said Panchayat should not be dissolved; .

And Whereas ho members of the said Panchayat given any explanation to the said notices, ~thin the prescribed time limit;

Now, therefore, in exercise of- the powers conferred by sUb-section (1) of section 52 of the said Regulation, the Lieutenant Governor of Goa, Dam~ and Diu hereby dissolves

Wherea.!'; 'as against a total number of eleven seats/va­cancies on the Bo"ard of Directors of the said Federation to be filled, -in by election only one nomination had been. reported to have been received; ~

Wherea.:, there is a failure to fill in substantial number of seats/vacancies on the Boa:r:d of Directors on account of the- numbo~r of nominations received being less' than the number of vacancies/seats to be filled in;

Wherea.:, a new Committee has failed to enter upon office on the date on which the term of office of the existing Committee expired;

Whereas, it is necessary to appoint an Administrator in terms of Clauses (b) and (d) of Sub-Section (1) of Section 77A and Glause (e) (ii) of the said Section of the Maha­rashtra Coop. Societies Act, 1960, as applied to this Union Territory to manage the affairs of the said society.

Wherea~; the working/affairs of the said Federation has virtuaJly I~ome to a standstill on account of the Manage­ment being non-functional for sometime and in view of these circlUnstances, the undersigned is satisfied that imme­diate action is required to be taken for the appointment of an Administrator in the interest of the Institution and hence it i~: felt that notice as required under the first proVISO to Sub-Se~tion (1) of Section 77A is not necessary.

Now in terms of the provisions of Clause (e) (ii) of Sub-Secticn (1) of Section 77A of the aforesaid Act, I, A. Venkataratnam, Registrar o-f Coop. By this . office Notice dated 11-5-82 cited at Sr. No. (1), above, objections and suggestions had rem invited from the members of the Goa, Daman and Diu Coop. Housing Finance Society Ltd., to the proposed action of thi~; office for appoint­ment of an Administrator to manage the affairs of the said society for reasons mentioned. in, the said', Notice.

2. Twenty-three primary housing cooperative societies and four individuals as mentioned above,. all members of the aforesaid Finance Society as also the Chairman of the said Finance Society have filed their objections and suggestions to the proposed action for the appointment of an Adminis­trator.

3. On exa.nurung the replies received fi'om' the aforesaid member-societies, it is seen that the main objection urged is that the .proposed action is unnecessary and is undemo­cratic 'and in this manner it is liable fo cause injury to tl1e lawful interests of the society. However, the aforesaid con­tention is unfounded and baseless since the members of' the aforesaid Finance Society had earlier in January, 1982 been provided an opportunity of having a democratically cons­tituted Management by the due process of· election but the members did not evince any interest in the affairs/manage­ment of their society in as much as against nine seats/ /vacancies which were to be filled in by election, only four noYillllatioDs 'had been reported to have' been received. Hence no injustice' is being caused to the interests of the members of the. society as has beep. contended.

4. As far as the other objection that the Registrar did not make use of the other two options, viz., of appointing any member or members of the society to fill in the va­cancies or of appointing a Committee of members to manage the affairs of the society is concerned, it. is the discretion of the Registrar to resort to any of the .alternatives as provided for under'section 77A.. No member of' the so­ciety has' a' vested right to be apPointed as an Adminis·. trator for failure of election. Similarly, nominating 5 members when. 4 members .are elected uncontest~d. just to have 9 member Board of Directors is also ridiculous and helps only the 4 members to reta~n their power and not in th~ smooth functiOning of .the society.

Whereas it appears to the Appropriate Government (here­inafter referred to as Uthe Government") that the land speci­fied in the schedule hereto (hereinafter refelTed to as the "said land") is likely to be needed for pu1;>lic· purpose viz. Cons­truction of Rural Road from Dori Kadaiya. via Bhandarwad to· Kadaiya Tank at Kadaiya in Marwad Group Gram Pan­chayat.

Therefore the Government is pleased to notify under sub­-section (1) of $ection 4 of the Land Acquisition Ac,t, 1894 (hereinafter referred to' as thet ·'said Act") that the said ,,~and is likely.to be needed for the purpose specified above.

2. All persons interested in the said land are hereby warned not. to obstruct or interfere with any surveyor or other per­sons employed upon the said land for the purpose of the said acquisition. Any contracts for the disposal of the said land by sale, mortgage, assignment, exchange or otherwise, or any outlay commenced or improvements made thereon with­out the sanction ?f: the Collector appointed in paragraph '4

Whereas by Government Notification No. 22/16/81-RD dated 24-2.1981 published on page 757 of Series II, No. 51 of the Official Gazette, dated 20~3-81 it was notified under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as lithe said Act") that the land,_ specified in the schedule appended to the -said Notification (hereinafter referred, to as the "said land") was likely to be needed for the pu~IJ.c purpose viz. Whereas. it appears to the a:pprol?rla~ Government (here~ter referred to as .cthe Government") that the land specified' 'in the schedule hereto (hereinafter' referred to as the "said land'~) is likely to be needed for pub,lic purpose viz. For Rehabilitation of affected families for cnnstruction of approach ':0000. to Zua:ri Bridge at COi'talim.

Therefore the Goverriment is pleased to notify under sub-section (1) of Section 4 of the Land A('.quisition Act, 1894, (hereinafter referred to as the "said Act".) that the said land is likely to be needed for the purpose specified above.

2. ,All persons interested in the said land are hereby waI'l}ed, not to obstruct or interfere with any surveyor or other 'persons employed upon the said land for the purpose of the said acquisition. Any contracts for' the, disposal of the said le.!ld by sale, mortgage, assignment, exchange or otherwise, or any outlay commenced or improV'ements made' thereon without the sanction of the Collector appointed in paragraph ,4 _ below, after the date of the publ:lcation 0:: this Notific<il-tion, will under clause (seventh) of Section 24 of the said Act, be disregarded by him while assessing com­pensation for such parts of the said land as may be finally acquired.

3. If the Government is satisfied that the said lalld is needed fo:r the aforesaid purpose, a dec>.laration to that effect under Se!}tion 6' of the said Act will' be published in the 0fficial' Gazette;" in due course. If_ the acquisition, is aban­doned wholly or in part, the fact will be notified.

4. The Government is further pleased to appoint under clause (c J.. of _ Section 3 'of the said Act the Land Acquisition Officer, P,W.D. (CELL), Altinho, Panaji, to perform the func­tions of .1. Collector under the said Act in respect of the said land~
