The NEP
The New Economic Policy (NEP) of 1971 wasthe policy that accelerated the development ofracism in Malaysia.
The stated objectives of the NEP are:
1) Restructure of society to eliminate
identification of race with occupation
2) The eradication of poverty
-

The NEP did not do either.
Rather it has created new identificationsof race with occupation
The civil service
The judiciary
The armed forces The police
The Academia in Public universities

With this a completely Malay bureaucracy wasestablished.
All decision making positions - Secretaries-General of Ministries and Directors-General ofprofessional departments are Malays or
Muslims. The same is true of their deputies.

It is overt Government policy not to awardGovernment projects to the non-Malay non-Muslims individuals or companies.
The Ministers and the Ministries control theeligibility for and the award of these projectsvery tightly, as if to keep it within the family.
The Finance Ministry absolutely controls thequalification of contractors for these projects.

Employment in the
Government Sector
The Malayness of the Government Administration is instrumental inoperationalising the policies of the racist state, in fact in creating it, just like in
Apartheid South Africa where the entire State apparatus was manned byWhites.
Goes up to 85% if the Chinese and Indian Teachers are excluded.

Treatment by the Media
The Mainstream media slants different news in
different ways according to the race it addresses.
The mainstream media promotes political
wayang kulit and indulges in wholesaledeception .
It enhances the sense of insecurity by playing upthe insecurities of each race selectively.

Comparison with South African
Apartheid Majority Race in Power (50% of
the population)
Uses subtle methods so as notto lose the valuable humanresource of the minority.
Malaysia has the InternalSecurity Act,the Publishing andPrinting Presses Act, the
Official Secrets Act, the TheSeditions Act, the The Freedomof Assembly Act
Section of the minority hassignificant leverage in theeconomy
The administration is largelyMalay .
There is a clear definition ofwho is Malay.
Not so readily recognised as
immoral
Minority Race in Power (25% ofthe population)
Needed overt and harshmeasures to maintain controlover the majority to use theland and its resources.
They had the PopulationRegistration Act , Group Areas
Act , Prohibition of MixedMarriages Act, Suppression ofCommunism Act, Terrorism Act ,The Public Safety Act, TheRiotous Assembly Act
The majority had little leverage
in the economy . The administration was all white They ha d a definition of who is
White, who is colored Very readily recognised as

The Usurpation of the Malaysian Agenda
The Malayan Aristocracy initiallyusurped the Malayan Agenda at
independence.
Now a broadened Malay elite class
usurps the entire Malaysian agenda.

The source of institutionalized racism
Article 153 of the Malaysian Federal Constitution.
(1) It shall be the responsibility of the Yang di-Pertuan Agong
to safeguard the special position of the Malays and natives of any
of the States of Sabah and Sarawak
and
the legitimate interests of other communities in accordance withthe provisions of this Article.
This has caused the evolution of adefacto two tier citizenship in the countryand has provided the Malay elite with theopportunity for the institutionalization of
racism in Malaysia

The source of institutionalized racism
Special Position has been translated in-
toto to special privileges/rights.
The NEP became the purveyor of that
special privileges beginning 41 years ago
In 2007 Deputy Prime Minister Najib Tun
Razak said that there would be no timelimit for the expiration of this MalayAgenda.

Brief History
In 1957 95% of the Indians were livingin slave like conditions, without land of their
own, at the mercy of the British capitalists.
With the departure of the British, the estatesbegan to fragment and there began the biggestforced displacement of rural Malaysians to theurban centres.
The new colonialist Tuans who replaced theBritish took no notice.

Dispossession gets institutionalized
The displaced Indian were not classified asrural, landless and poor in policy terms by the
racist Malay bureaucracy.
This resulted in total denial of opportunities for
participation in the development programs forthe rural, landless and poor.
There have been twelve 5 year plans to date. But nothing for these rural, landless and poorIndians.

Destruction of the rural Indian social
system
The result of the massive displacement
was the destruction of the social system ofthe rural Indians in Malaya / Malaysia onlyto be replaced by a broken down urban
slum communities.
And all the incumbent socio-economic ills
just piled up.

Statelessness There are an estimated 450,000 stateless
Indians because the State has denied them

Institutional racism creates underclass
More than 60% of the inmates in Malaysian prisons are of
Indian origin.
The number of individuals detained just under preventivelaws in 2003 was 702 of which 316 are Indians compared
to 111 Chinese and 111 Malays. This is about half of totalinmates.
For a population which makes up less than 8% of the totalpopulation the percentage of Indian inmates isdisproportionately high.

Institutional racism encroaches on
religious freedoms and rights
Alongside the racially lopsided developments on theeconomic front, the Islamists have been steadily
gaining influence over the judicial system in the1990s.
This is visible in the steady deterioration of the status of
the civil Legal System that is enshrined in the FederalConstitution leading to the ascendancy of the ShariaLegal system
The Civil courts do not want to rule on matters involvingnon-Muslims who are entangled between the twosystems passing such adjudication to the Syaria courtswhich have no constitutional authority over the non-Muslims.

Institutional racism reinforced by
encroaching Islamists
Ms Banggarma, 27 a Hindu lady, was abandoned by herparents to a welfare home as a baby . There she was
converted to Islam by the welfare home when she wassix years old. Now however she lives and practices as aHindu.
But because of the conversion, she is unable to revert toher religion of origin. The civil courts will not hear hercase and the decision from the Syaria court is aforegone conclusion.
As a result she is unable to register her wedding a aHindu wedding and her children are denied registrationas citizens of the country unless they are registered asMuslims.

Institutional Racism maims and stunts
At the Primary school level, half the Indian
children go to schools most of which are in
dilapidated condition, resulting in a near collapse
of the Primary Education system of about
100,000 Indian children.
This contributes to the ultimate poor life
performance of the Indian poor .

The Myth
Malaysia is a bubbling, bustling melting pot of races andreligions where Malays, Indians, Chinese and many otherethnic groups live together in peace and harmony and is a rolemodel for many other nations.
The Truth
Malaysia is a country based on a subtle, pervasive andaggressive racist politico-economic system - one that hasinstitutionalized racism at its core, in the political, legal and
administrative structures in a craftily interwoven jigsaw ofreinforcing practices .
