    Brief History

    In 1957 95% of the Indians were livingin slave like conditions, without land of their

    own, at the mercy of the British capitalists.

    With the departure of the British, the estatesbegan to fragment and there began the biggestforced displacement of rural Malaysians to theurban centres.

    The new colonialist Tuans who replaced theBritish took no notice.

    Dispossession gets institutionalized

    The displaced Indian were not classified asrural, landless and poor in policy terms by the

    racist Malay bureaucracy.

    This resulted in total denial of opportunities for

    participation in the development programs forthe rural, landless and poor.

    There have been twelve 5 year plans to date.But nothing for these rural, landless and poorIndians.

    Institutional racism creates underclass

    More than 60% of the inmates in Malaysian prisons are of

    Indian origin.

    The number of individuals detained just under preventivelaws in 2003 was 702 of which 316 are Indians compared

    to 111 Chinese and 111 Malays. This is about half of totalinmates.

    For a population which makes up less than 8% of the totalpopulation the percentage of Indian inmates isdisproportionately high.

    religious freedoms and rights

    Alongside the racially lopsided developments on theeconomic front, the Islamists have been steadily

    gaining influence over the judicial system in the1990s.

    This is visible in the steady deterioration of the status of

    the civil Legal System that is enshrined in the FederalConstitution leading to the ascendancy of the ShariaLegal system

    The Civil courts do not want to rule on matters involvingnon-Muslims who are entangled between the twosystems passing such adjudication to the Syaria courtswhich have no constitutional authority over the non-Muslims.

    Ms Banggarma, 27 a Hindu lady, was abandoned by herparents to a welfare home as a baby . There she was

    converted to Islam by the welfare home when she wassix years old. Now however she lives and practices as aHindu.

    But because of the conversion, she is unable to revert toher religion of origin. The civil courts will not hear hercase and the decision from the Syaria court is aforegone conclusion.

    As a result she is unable to register her wedding a aHindu wedding and her children are denied registrationas citizens of the country unless they are registered asMuslims.
