Status Report by way of affidavit of P.K. Agrawal, IPS, Additional
Director General of Police, Crime, Haryana, Panchkula as head of Special
Investigation Team.
RESPECTFULLY SHOWETH:
I, the above named deponent do hereby solemnly affirm and
declare as under:-
1. That it is submitted that this status report by way of affidavit is
being filed by the deponent as head of Special Investigation Team,
hereinafter, referred as SIT, in compliance of directions issued by
this Hon’ble Court vide order dated 08.11.2017. Relevant
directions pertaining to SIT have been mentioned in para 12 of
the order, which are reproduced for kind perusal as under:-
“The incidents of violence, arson and rioting took place on 25.08.2017. By now more than two months have passed. We direct the SIT constituted by State of Haryana to file status report explaining (i) the efforts made by State Police to arrest

the suspects who are statedly hiding and evading their arrest; (ii) the conspiracy pre or post-25th August, 2017, if any, hatched by the core group of Dera activists, and if so, the nature of such conspiracy; (iii) the present status of the investigation by SIT in respect of other related issues; and (iv) whether or not ‘Kurbani’ gang has been actually formed, and if so, is there any substance in extending threats by such gangs to those who were found exposing the Dera or its followers as was directed by this Court on 13.10.2017. The status report shall be filed by the head of SIT.”
2. That it is submitted that the pronouncement of verdict on 25th
August, 2017 by the Ld. CBI Court at Panchkula against the Chief
of Dera Sacha Sauda, hereinafter, referred as DSS, was followed by
violent incidents of rioting, arson and damage to public/private
property by the followers of DSS at Panchkula, Sirsa and some
other districts of Haryana and Punjab. 240 criminal cases were
registered in different districts of Haryana for investigation of the
aforesaid incidents. On 29th August 2017, the Hon’ble High Court
in CWP No. 19086 of 2017 was pleased to direct as under:-
“It is agreed that the States of Haryana and Punjab shall constitute Special Investigation Teams comprising of three IPS officers. The three IPS officers shall be headed by an officer not below the rank of ADGP to investigate, supervise and monitor all the FIRs relating to the incidents of violence, rioting, arson etc in the wake of pronouncement of the judgment against the accused Gurmit Ram Rahim Singh in the Court at Panchkula.”
In pursuance of the aforesaid directions a Special
Investigating Team headed by the deponent was constituted to
investigate, supervise and monitor all the FIRs registered in the
State of Haryana relating to all the incidents of violence, rioting,
arson etc in the wake of pronouncement of the judgment by Ld.
CBI Court. The SIT included as its members the ADGP/IG/CP of

Range concerned , SP/DCP of the district concerned and other
Gazetted Officers/ Inspectors etc as per requirements of
investigation. Detailed instructions were issued by the deponent
vide memo no. 2398-2419/R/ADGP dated 6.9.2017 and vide
Memo 2694-2714/R/ADGP dated 18.9.2017 for ensuring a
systematic and thorough investigation of the cases entrusted to
the SIT. Vernacular copies of the instructions dated 06.09.2017
and 18.09.2017 are annexed as Annexure R-1 and
Annexure R-2 and true English translated copies are annexed as
Annexure R-1/T and Annexure R-2/T respectively. Periodic
meetings were convened by the deponent at Police Headquarters,
during field visits and also through Video Conferencing with the
other SIT members to review the progress of investigation and for
issuing directions for guiding the investigation. Besides, specific
directions were regularly issued to members of SIT for guidance
and highlighting various issues relating to investigation. Periodic
reports were called for from the districts concerned through
respective Range ADGP/IG/CP for monitoring the progress of
investigation.
3. That it is submitted that directions dated 08-11-2017 issued by
this Hon’ble Court were duly communicated to members of the
SIT vide DO Letter no. 3981-4001/R/ADGP dated 16.11.2017 for
ensuring compliance on each of the aspects highlighted in the
Court order. The deponent further called for a point-wise report

by way of affidavit from the SsP/DCsP –cum- Member SIT
concerned through their respective ADGP/IG/CP vide letter no.
4451-71/R/ADGP dated 7.12.2017. The reports submitted by the
members of the SIT gave the factual position/ findings of
investigation with regard to each of the specific queries made by
the Hon’ble Court. The reports were examined and discussed with
the members of the SIT. Point-wise reply to the queries of the
Hon’ble Court is as follows:-
(i) The efforts made by State police to arrest the suspects who
are statedly hiding and evading their arrest:-
It is submitted that the persons indulging in violence, arson
and rioting were identified with the help of photographs, video-
recordings of the scene of occurrence and information collected
from secret as well as technical sources including mobile tower
dump analysis and lawful interceptions of telephonic
conversations of DSS functionaries and followers. The identified
accused and suspects were then arrested through persistent
efforts of the investigating officers. The interrogation/
examination of arrested accused further revealed identities of
other conspirators and perpetrators of violence who are being
made to join investigation. The photographs of accused who are
yet to be identified and/or are evading arrest have been widely
circulated and uploaded on Haryana Police Website for enlisting
support of general public for providing information to facilitate

apprehension of the wanted accused and relevant information has
also been conveyed to neighboring State Police Forces seeking
their cooperation to nab the accused. Warrants of arrest have also
been obtained from Ld. Courts. Rewards have been announced in
suitable cases for those providing information leading to the
arrest of the wanted accused. 1413 accused/suspect persons
have been arrested in the cases under investigation by the SIT and
277 other accused/suspects have been identified as on
13.12.2017 who will be made to join investigation/ arrested on
the basis of evidence. All out efforts are being made to trace out
the aforesaid accused/suspects and carry out arrests on the basis
of available evidence. Raids on likely whereabouts of remaining
accused are being conducted both within and outside the State of
Haryana. The number of accused can vary as the investigation
progresses. A district-wise report, in this regard, is annexed for
kind perusal of the Hon’ble Court as Annexure ‘R-3’.
(ii) the conspiracy pre or post-25th August, 2017, if any, hatched
by the core group of Dera activists, and if so, the nature of
such conspiracy:-
It is submitted that investigation regarding conspiracy pre
or post 25th August, 2017 has revealed that the violent incidents
that followed the pronouncement of verdict by the Ld. CBI Court
at Panchkula were engineered by the DSS leadership/senior
functionaries as a part of a pre-planned conspiracy.
The accused arrested during the course of investigation
were interrogated on the angle of conspiracy. The interrogation
reports and evidences collected during the course of investigation

have revealed that DSS has a hierarchical structure headed by the
DSS Chief. Below the DSS Chief, key functionaries including
Honeypreet @ Priyanka Taneja, Vipasana, Dr. Prithvi Raj Nain, Dr.
Aditya, Gurdat, Rakesh, Parveen@ Gobi Ram, Pawan Insan etc.
formed the second rung of DSS leadership. They assisted and
advised the DSS Chief on all key matters including the running of
DSS institutions (Hospitals, educational institutions, film theatres,
recreational resorts etc.), the management of DSS finances and
investments; as well as organizing religious congregations/
Namcharcha/Satsangs at different locations. The third tier of dera
management was formed by the State Level Management
Committee which generally comprised about 45 members. The
committee members were tasked with coordinating dera
activities with the districts/field units assigned to them. Separate
committees were constituted at the district/block level. At the
bottom of the hierarchy was the ‘Bhangidass’ a local level incharge
of DSS followers at village/colony/locality level. The necessary
communications emanating from the dera chief and the top
management were conveyed down the multiple layers right up till
the level of the ‘Bhangidass’ as required. Widespread use of
internet based communication especially ‘whatsapp’ was made for
quick transmission of messages.
The above-said multi-layered model of communication
presented the dual advantage of quick transmission of commands
as well as the existence of multiple cut- outs in the flow of
communication. Thus the interrogation of any arrested accused
followers of DSS could typically reveal the names of persons only
in the next higher level of the hierarchy. The investigating officers
are thus faced with the challenge of exposing the suspected
linkages of actual perpetrators of violence with senior
functionaries who have directed their actions.

The investigation has revealed that the DSS functionaries
and followers were extremely cautious in conducting telephonic
conversations and also made use of coded phrases. The analysis
reveals that instructions were issued to DSS followers to
congregate in large numbers at Panchkula with weapons, stones,
sticks, umbrellas and petrol as well as DSS headquarters at Sirsa
by 25th August. Suspicious terms such as ‘Paudha Ropan’,
‘Tamatar Fodna’ and ‘Jharu Kis Taraf Nikalni Hai’ etc. have been
detected in some of the communications between Dera
functionaries and the followers which suggest coded indications
to resort to violence and arson. Interrogation reports and other
evidences indicate that large scale mobilization of followers at
Panchkula and Sirsa was done at the behest of the senior
leadership and some tasking was done for initiation of violence
upon signal of senior DSS functionaries. It is further pertinent to
mention that DSS is a socio-religious sect and most followers are
completely devoted to their Chief and are not forthcoming with
information about the role played by senior functionaries in
conspiring to cause violence. Continuous efforts are however
being made to collect evidence for exposing the full dimensions of
the suspected conspiracy and the specific role played by the core
group of Dera activists/key functionaries.
The lead case regarding conspiracy has been registered at
Police Station Sector-5, Panchkula bearing FIR No. 345 dated
27.08.2017 u/s 145/146/150/151/152/153/216/121/121-
A/120B IPC on the complaint of Mr. Sanjeev Mahajan, ‘City
Dainik Bhaskar’ newspaper, Panchkula. During the investigation
of the afore-said case 22 accused have been arrested by the SIT
including senior DSS functionaries. The interrogation of arrested
accused persons revealed that a meeting was held at Teravas
DSS HQ on 17.8.2017. The said meeting was presided over by
Honeypreet and Aditya Insan. The said meeting was called to

exert pressure on the Government and the judiciary for acquittal
of Dera Chief. During the meeting, office bearers were deputed
to collect the followers in Panchkula. Directions were given to
followers to gather in Panchkula with weapons, stones, sticks,
umbrellas and petrol. It was decided that if the Court verdict
comes out against the Dera Chief, then violence, rioting, arson is
to be resorted to by inciting/abetting the followers of the Dera.
It was also planned that Dera Chief will be rescued from the
custody of the police from the Court Complex Panchkula and in
the process, if need arises, they should not hesitate in waging
war against the State. In the meeting, it was also decided to
carry arms in the carcade of Dera Head Gurmeet Ram Rahim
Singh. Due to proximity of Chamkaur Singh to Panchkula, he was
assigned the duty to locate the place where followers of the Dera
are to gather and commit arson and violence. Kharati Lal was
deputed to arrange meals for the gathering. Rakesh PA, driver
Phool Singh, private PSO Pritam Singh and Punjab Police PSO
Karamjeet were deputed for rescuing Dera Head, if he is
convicted by the Court. Rs. 1.25 Crore was distributed to
Chamkaur Singh and others through Rakesh PA by the accused
Honeypreet. Rs. 25 Lac each were distributed to Dr. Aditya Insan
, Dr. Pawan Insan and Naveen @ Gobi Ram. Rs 18 Lac was given
to Ram Singh Chairman for the above said purpose. On 25-08-
2017, Aditya Insan, Surender Dhiman, Gobind, Mohinder and
Pawan Insan also called a meeting at HAFED Chowk and in view
of the meeting dated 17-08-2017, they incited/abetted the
followers to resort to violence, arson and wage war against the
State. During investigation ,about Rs. 25 Lakh have been
recovered from Chamkaur Singh. Authority letter of Rs. 51 Lakh
from Rakesh, Rs. 87,000/- from Pawan Insan have been
recovered alongwith other items and documents. Gurmeet Ram
Rahim Singh has been joined in investigation at Sunaria Jail on

06-12-2017 in this case and further investigation is still under
way. Challan u/s 173 Cr.P.C. has been filed in the Court of
Learned Ilaqa Magistrate against 15 accused till 13-12-2017.
Non-bailable arrest warrants have been obtained from the Court
for 18 of the accused wanted in the above cases. Addresses of 8
other accused/suspects are being established.
It is further submitted that 4 AK-47 Rifles along with 159
Rounds, 5 Pistols (9mm) alongwith 102 Rounds, 1 Revolver
alongwith 10 Rounds, 1 Rifle (30 Bore), 1 Rifle (315 Bore
alongwith 28 Rounds and 2 Mausers alongwith 67 Rounds have
been recovered in other cases registered at Panchkula.
All out efforts are being made to arrest remaining
accused/suspects involved in this conspiracy. There is a
possibility of other names involved in the conspiracy being
revealed during the course of ongoing investigation.
Apart from the lead case, a number of cases have also been
registered in various districts U/s 120-B IPC. However, these
cases involve criminal conspiracy predominantly at local level
and concrete/direct connection with the lead case has not been
established during the course of investigation, so far. District
wise report of all the cases registered in this regard is annexed as
Annexure ‘R-4’.
(iii) the present status of the investigation by SIT in respect of
other related issues:-
It is submitted that 240 FIRs have been registered so far in
the State of Haryana regarding incidents of violence, arson and
rioting in the aftermath of the judgment pronounced by the
Learned CBI Court at Panchkula against Gurmit Ram Rahim
Singh on 25.08.2017. During investigation of these cases, 1413
accused/suspect persons have been arrested till 13-12-2017.
However, since some of these persons have been arrested in
more than one case, hence, total number of arrests are 2464. It

is further submitted that 200 cases have already been put in
Court. Out of the above 200 cases, further investigation in 10
cases is still being carried out by SIT as part challan has been
submitted in these cases. 20 cases are still under investigation in
various districts. It is further submitted that 20 FIRs of district
Panchkula have been clubbed with other FIRs as the places of
occurrence are found same. District wise detailed report, in this
regard, is annexed as Annexure ‘R-5’.
This Hon’ble Court vide order dated 27.09.2017 has
directed the SIT to supervise and monitor the FIRs pertaining to
missing persons from Dera headquarters. It is submitted that 6
( 1 expired) out of 22 reported missing persons from DSS have
been traced by the SIT constituted for the purpose. However, one
more FIR No. 201 dated 27-10-2017 U/s 346 IPC, PS Sadar Sirsa
has been registered regarding missing person Sh. Gyanender
Kuldeep on the complaint of Sh. Rajkumar Kuldeep S/o Sh.
Gyanender Kuldeep resident of Hanutpura, Tehsil Shahpura,
District Jaipur, Rajsthan. All out efforts are being made to trace
out remaining 17 missing persons. Information regarding
missing persons have been telecast on Doordarshan Hisar and
broadcast on All India Radio Hisar. Information/Notices have
been published in local editions of leading News Papers and
pamphlets have been sent to all the Police Stations concerned for
pasting at public places. Suitable rewards have also been
announced for providing information regarding missing persons
in this regard.
(iv) whether or not ‘Kurbani’ gang has been actually formed, and
if so, is there any substance in extending threats by such
gangs to those who were found exposing the Dera or its
followers as was directed by this Court on 13.10.2017:-
It is further submitted that a case bearing FIR No. 1046,
dated 05.07.2017, under section 506 IPC was registered at Police

Station City Karnal against unknown persons on the complaint of
Sh. Vishwas Gupta the former husband of Honeypreet a senior
functionary of DSS. An application was also moved by Vishwas
Gupta and his father Mohinder Pal Gupta before the Hon’ble High
Court seeking their impleadment in the pending PIL and for
issuance of certain directions including for their protection as
they apprehend danger to their life and liberty at the hands of
‘Kurbani’ Gang alleged to have been formed by or at the beheast
of DSS. During the investigation of the aforesaid case, around 65
persons have been made to join the investigation to ascertain the
source of the anonymous threatening letter and anything related
thereto. However, no arrest has been made in the above said
case and investigation is under way.
It is further submitted that the interrogation of accused
arrested in case FIR No. 225 dated 26.8.2017 under section 188,
124A, 120B IPC PS Parao and FIR case no. 134 dated 28.8.2017
under section 122, 120 B IPC and section 4 & 5 Explosive
Substance Act 1908 PS Barara has revealed that a ‘Kurbani’ Gang
was formed in District Ambala. Names of 12 persons who were
included in the aforesaid gang were revealed during the
investigation. The Kurbani Gang was formed at the instance of
accused Joginder Singh of Dhurala PS Jhansa Kurukshetra and
Sandeep alias Anu resident of Pipli Kurukshetra. They had
collected money from the Dera followers and had stocked
explosive material and weapons in Naam Charcha Ghar for this
purpose. An amount of Rs. 52 lacs and other objectionable
material which was to be used for spreading riots arson violence
etc. was recovered. No evidence, however, came to light of any
actual threat being extended by the said gang to anybody.
It is submitted that investigation has revealed that the
names of followers who were willing to make sacrifices for the
sake of the DSS chief were called for by some functionaries

अन्य संतदग्ध वाहि, जो कब्जा पुतिस में तिए गए है उिकी

13. आपिातधक घटिाओ ंकी पृष्टिूतम में िहकि सम्पति को
िष्ट कििे वािे, िीड को उकसािे वािे व िीड का िेिृत् कििे
वािे व्यखक्तयो ं की पहचाि सुतितिि किके उिके खििाफ
तियमािुसाि कडी कायभवाही की जाए ।
14. धािा 144 द.प्र.स. से सम्बखिि साक्ष्य सफा तमशि पि
िाए जाएं िातक उलं्लघिा कििे वािो ं के खििाफ धािा 188
िा.द.स. का अपिाध सुतितिि तकया जा सके ।
15. घटिा में मािे गए व्यखक्तयो ंकी तवसृ्ति जािकािी प्राप्त की
जाए व मृतु्य के कािण जैसे तकस जगह/िाग पि गोिी िगी,
तकस हतथयाि से गोिी चिी, गोिी चिािे की दूिी इत्यातद सफा
तमशि पि िाई जाए । इसी प्रकाि िीड को तििि-तबिि कििे
के तिए अशु्रगैस, िाठी चाजभ या बि प्रयोग के अन्य साधिो ं से

Following important points be given special attention
during investigation of cases of violence, rioting and arson etc.
registered in your District/Commissionerate after pronouncement of
judgment against Gurmit Ram Rahim Singh by Ld. CBI Court, Panchkula.
Regarding all the cases.
1. Capable investigating officers be appointed for investigation
as per the Acts and Sections imposed as well as seriousness of
cases.

2. District Police shall issue helpline numbers and Whats App
numbers so that any information or video clip can be received.
Name of informer be kept secret.
3. Places nearby the scene of crime/incidents be inspected
closely. Footage of CCTV cameras installed be obtained and
legal action be taken against the miscreants after their
identification.
4. Photographs of wanted criminals, who could not be identified,
be uploaded on the website of Haryana Police, and provision
of suitable reward be made for those who will provide
information about criminals mentioned this list, so that the
wanted criminals could be identified.
5. Criminals involved be identified by obtaining photographs
from newspapers and videos from social media and after
identification of criminals involved, action be taken against
them as per law and appeal be made through local channels
and newspapers to eyewitnesses for help, their statements be
recorded.
6. CDR of suspected mobile phones after obtaining the Mobile
dump from the scene of crime and tower location of the
mobile numbers of the arrested persons, which connect their
presence with the scene of crime be prepared.
7. The medical report of the person, who has been arrested after
getting discharge be collated to clarify that the injury has
accrued during the incident .
8. Officers/officials of other departments deputed on duty be
joined in the investigation and their statements be got
recorded as well as the people living in the residential area
nearby the scene of crime be joined in the investigation and
their statement be got recorded.

9. All those officers / officials deployed on duty who sustained
injuries, after collecting their MLR / Medical Examination
should be joined in investigation.
10. Heads and other officials of the local branches of Dera Sacha
Sauda be interrogated regarding their involvement as well as
involvement of local criminals in the incident.
11. Evidences like explosive substances / remains (ashes) etc be
collected in cases of arson with the help of Forensic Science
Laboratory, Madhuban and Scene of Crime Team and expert
opinion be obtained.
12. Ownership of the vehicles burnt at the Scene of crime or
suspected vehicles taken in possession by the police be
confirmed from the registration authorities and action be
initiated as per law.
13. Ensure identity of the persons with criminal background, who
destroyed property, provoked the crowd and led the mob and
take strict action against them according to law.
14. The evidences related to violation of Section 144 Cr.P.C be
brought on case file, so that action for offence under section
188 IPC be ensured against violators.
15. Detailed information about the persons killed in the incidents
be obtained and the reasons for death such as the place/part
of body where the bullet hit, from which weapon the bullet
was fired and the firing distance etc. be brought on the case
file. Similarly, evidence related to use of tear gas, lathi charge
or other means of force used to disperse the crowd also be
brought on the case file.
16. If prosecution sanction is required before filing chargesheet
against arrested persons in the Court, the prosecution
sanction be obtained without delay by initiating
correspondence as per rules with department concerned.

17. Footage of the video cameras installed on toll plazas and other
places enroute convoy of vehicles of Gurmeet Ram Rahim
Singh and other suspected vehicles be obtained and the same
be examined minutely
18. Chain of evidence regarding incidents be prepared to establish
involvement of accused.
19. During the investigation of the cases and the before filing
chargesheet in the Court, supervisory officers, the
Superintendents of Police / Deputy Commissioners of Police
concerned must verify the case and issue clear written
directions and guidance to the investigating officers.
20. Superintendents of Police / Deputy Commissioners of Police
should get the verification of the cases of heinous crimes
registered in their jurisdiction from the Range Inspector
General of Police / Commissioner of Police as per requirement
and if necessary, such cases may also be got verified from the
undersigned.
21. Action should be taken against wanted/remaining accused as
per law and challan be submitted in the court without delay.
Regarding cases registered under the Arms Act-
1. Maximum physical evidences like empty cartridges etc be
collected from the scene of crime.
2. During the investigation, if any weapon has been recovered,
ownership of the weapon be ascertained from the licensing
authority concerned and investigation as per law be done also
against the person from whom the weapon has been recovered.
3. During the investigation, if any ammunition has been recovered, it
should be verified, whether it is as per Arms license of the person
concerned and take action as per law.
4. All the arms taken into possession be got examined from Forensic
Science Laboratory to find out, whether these are fit for use or not
and whether they have been used during the incident or not.

5. Prosecution sanction be obtained before filing chargesheet in the
Courts.
Regarding cases registered under PDPP Act-
1. In cases of destruction / damage to government property,
statement of officer concerned alongwith clear assessment of loss
be recorded.
2. Photos or videos of the incident be obtained.
3. Efforts be made to identify the culprits by getting duty roster from
supervisory officers/officials of public property destroyed at the
time of incidents and recording their statements .
Ensure compliance of above guidelines and keep the
undersigned informed about the progress of cases time to time.

Investigation Team has been constituted.
Vide this office letter No. 2398-2417/Reader/ADGP,
Crime dated 06.09.2017, detailed directions regarding investigation of
various cases have been issued. Apart from it, the progress of cases has
also been reviewed in meetings, through video conferences and
verbally/telephonically from time to time and necessary directions have

been issued. Though the progress in many cases is satisfactory yet there
are cases in which greater efforts are required and immediate special
attention needs to be paid in this direction.
As such, compliance of following
suggestions/directions may be ensured:-
1. It is important that there is concrete and complete evidence
against those accused who are arrested apart from the persons
arrested from the scene of crime, such as whether his name
figures in the disclosure statement of any arrested accused, in the
statements of eye witnesses, presence near the scene of crime on
the basis of information regarding the mobile phone used by the
accused etc.
2. Special attention be given towards technical aspects during the
investigation of all cases and help of the experts, who have special
knowledge in this regard, be obtained.
3. The police officials and officers deputed for investigation will
discharge their duties with complete dedication, honesty and
transparency and the Superintendent of Police/Deputy
Commissioner of Police/Inspector General/Commissioner of
Police concerned should pay special attention towards this.
4. Injuries of the injured people and accused be got compared with
the weapons/ammunition of police force deployed at the scene of
crime. In case the injuries do not match with the available arms

with police force; then it must be ascertained as to how these
injuries were received.
5. In all, incidents where force has been used by the police; the
orders issued regarding use of police force be attached with the
concerned police files of such cases.
6. The Inspectors and DSPs appointed for investigation must write
regular case diaries regarding all important aspects of
investigation and related guidelines so that investigation is
carried out in the right direction and progress at regular pace
towards conclusion.
7. The evidences collected during the course of investigation be
properly packed in parcels and sent to Forensic Science
Laboratory, Madhuban for examination at the earliest.
8. Maximum proof /evidence which is concrete and based on truth
must be collected to establish guilt of accused arrested in various
criminal cases in the Courts and the directions issued by the
Hon’ble Courts in the D.K. Basu case regarding arrest be complied
with.
9. The security and confidentiality of evidences, all documents and
police files related to cases be ensured.
